Preface

The team that prepared this initiative are national experts, who are
standing at the same distance from all disputed parties. With this effort,
they are seeking to provide a platform for reconciliation between the
brothersofthestruggletounitetheireffortsinordertoachievesecurity,
stabilityandprosperityforLibya.
Ithasbeentakenintoconsiderationthatforthepartiesinthisdialogueto
accept this initiative, it will inevitably require some compromises and
sacrifices.However,weareallinagreementthatLibyaisworthmuchmore
thanallofthat.

Themostimportantcharacteristicoftheinitiativeisthesetofproposedalternativestosolvetheproblemof
the peaceful transition of powers and to maintain the continuity of the Libyan constitutional entity, as it
determinesthestartingpathstowardsthemanagementofthiscrisisasapreludetoengageinstabilityand
developmentstage.Thesealternativesare:
FirstAlternative:TherecognitionoftheGeneralNationalCongressandtheHouseofRepresentativesastwo
legislativebodiesandmergethemintoasingleentitycalledtheLegislativeCouncilwithasinglepresidential
council. The Legislative Council will form an advisory commission from revolutionary leaders chosen by the
localcouncils,toparticipateinthechoiceofthesecurityleaders.
SecondAlternative:TheformationofasmallLegislativeCouncilfromwithinthemembershipoftheGeneral
National Congress and the House of Representatives, such that the thirteen electoral precincts will be
representedproportionally.
Third Alternative: The formation of a legislative council from within the membership of the Constitutional
Council that was mandated with drafting the constitution by selection of one member from each of the 13
precincts.
FourthAlternative:ThereinstatementoftheGeneralNationalCongressasalegislativebodybymeansof
the consent of the parties involved in the national dialogue. This will include the formation of an advisory
bodycommissionedbyanumberofleadersoftherevolutionaries,whowillbenominatedbythemunicipal
and local councils, as well as receive clearance from the Military Integrity Commission to participate in the
selectionofthesupremesecurityleaders.
FifthAlternative:ThereinstatementoftheHouseofRepresentativesasalegislativebodybymeansofthe
consentofthepartiesinvolvedinthenationaldialogue.Thiswillincludetheformationofanadvisorybody
commissioned by a number of leaders of the revolutionaries, who will be nominated by the municipal and
local councils, as well as receive clearance from the Military Integrity Commission to participate in the
selectionofthesupremesecurityleaders.
Sixth Alternative: The international community, under the auspices of the United Nations, will convene a
meeting comprised of the influential political and military parties for the purpose of forming a legislative
council..
Senventh Alternative: The General Assembly of the Supreme Court or the Judiciary Supreme Council will
assumethefunctionsoftheLegislativeCouncil.
Inthiscontext,thesealternativeswillbediscussedwiththepartiestoapproachthedialogueandtradeoffs,
including the agreement on the objective and the most appropriate solutions to get out of this crisis,
accordingtothefollowingstages:
FirstPhase:Holdseparatemeetingswithallpartiestothedialoguetopresentanddiscusstheinitiativeand
documenttheirobservations,opinionsandquestionsandthentoformulateanynecessarysolutionsrequired
toreconcilethemtothisinitiative.
SecondPhase:Holdajointmeetingwiththerepresentativesofthepartiestothedialogueforthepurposeof
draftingtheinitiativeinitsfinalform.
Third Phase: Communicate with all relevant and supportive parties of this initiative and hold joint and
extendedmeetingstosupportthisinitiative.
Fourth&FinalPhase:HoldingandorganizingtheNationalForumfortheRescueofLibyainthepresenceofall
partiestothedialogue,relatedpartiesandsupportingparties;andinvitetheSecretaryGeneraloftheUnited
Nations, the Secretary General of the Arab League, the Islamic Conference, the Arab Maghreb Union, the
AfricanUnionandtheEuropeanUniontoattendthemeetingandratificationceremonyfortheinitiativeto
becomethegeneralframeworkofthenationalprogramforsalvation,securityandstability.

NationalPrinciples

TopreservetheunityandsovereigntyofLibya.
IslamistheLibyanstatereligionandIslamicShariaisthemainsourceoflegislation.
Freedom and human rights as enshrined in Islamic law and international
conventions are national binding values, and seeking the rights are only in
accordancewiththelaw.
Commitmenttothedemocraticsystem,thepeacefultransferofpower,respectfor
theprincipleofseparationofpowersandtheadoptionoftheprincipleofdialogue
andreconciliationK
TheRevolutionofthe17thofFebruaryisarevolutionforallLibyans.Thisrevolution
cannotabandonorneglectitsprinciples,whatevertheconsequenceswillbe.
Theformer,collapsedregimewasunjust,ruthlessandcorrupt.Itrepresentedthe
darkest era of Libyan history. The former regime is irretrievably broken and has
therefore become a part of the past. Henceforth, it should be considered a
criminalacttoadheretoitsprinciplesortotrytoreproducetheformerregimein

The participation of the February 17th revolutionaries is considered nationally
deservingandimperativeinthistransitionalphaseK
The possession and use of weapons will be exclusive to the official security
institutionsandtheircollectionisanurgentnationalnecessityK
Terrorismisrejectedinallofitsforms,andonlythestatesinstitutionspossessthe
powerstoconfrontitK
The preservation of national identity in all its diversity is vital and are to be
consideredauthenticcommunityvalues.

ConstitutionalAspect
The Constitutional Declaration represents the only frame of
reference
AftertherulingoftheConstitutionalChamberoftheSupremeCourt,theelectedmembersofthe
differing legislative authorities became the basis of the constitutional problem.
In light of the differences and disputes within the Libyan scene, the solution can only be a
consensualoneand,inthisregard,oneofthefollowingsixalternativesmustbechosen:
First Alternative: The recognition of the General National Congress and the House of
Representatives as two legislative bodies and merge them into a single entity called the
LegislativeCouncilwithasinglepresidentialcouncil.TheLegislativeCouncilwillformanadvisory
commissionfromrevolutionaryleaderschosenbythelocalcouncils,toparticipateinthechoice
ofthesecurityleaders.
SecondAlternative:TheformationofasmallLegislativeCouncilfromwithinthemembershipof
theGeneralNationalCongressandtheHouseofRepresentatives,suchthatthethirteenelectoral
precinctswillberepresentedproportionally.
Third Alternative: The formation of a legislative council from within the membership of the
Constitutional Council that was mandated with drafting the constitution by selection of one
memberfromeachofthe13precincts.
FourthAlternative:ThereinstatementoftheGeneralNationalCongressasalegislativebodyby
means of the consent of the parties involved in the national dialogue. This will include the

means of the consent of the parties involved in the national dialogue. This will include the
formationofanadvisorybodycommissionedbyanumberofleadersoftherevolutionaries,who
will be nominated by the municipal and local councils, as well as receive clearance from the
MilitaryIntegrityCommissiontoparticipateintheselectionofthesupremesecurityleadersK
Sixth Alternative: The international community, under the auspices of the United Nations, will
conveneameetingcomprisedoftheinfluentialpoliticalandmilitarypartiesforthepurposeof
formingalegislativecouncilK

Note: These alternatives will be discussed with the parties to the dialogue objectively to

The adoption of one of these alternatives, under the auspices of the United Nations, will
bindingtoallparties.Thisalternativewillbeendowedwithspecificlegislativeauthoritiesand
itstermwillexpirewiththecompletionofthegeneralelection.

ThePrioritiesoftheLegislativeCouncil

TheLegislativeCouncilisanentitywithlimitedtransitional
authorities.

1. AmendingtheConstitutionalDeclarationasnecessaryforthisphase.
2. AssignedtoHeadaGovernmentofNationalUnityandensureitsadoption.
3. Closingoutthe2014fiscalbudgetandtheadoptionofthe2015fiscalbudget.
4. Theissuanceofageneralelectionlaw.
5. TheratificationoftheConstitutionafterthepositivereferendum.
6. Legislatingthenecessarylawstoperformthesefunctions.

The term of the Legislative Council expires at the announcement of

thefinalresultsofthegeneralelectionsandholdingtheceremonyof
transferofpowerwithinamaximumperiodoftwoweeks.Inthecase
ofnoncompletionoftheprocessforthetransferofpowerwithinthe
specified period, the elected legislative council will automatically
assumetheirdutiesandwillhaveofficiallyassumedoffice.

PoliticalAspect

AlthoughtherootoftheLibyancrisiscanbetracedbacktotheconstitutionaldisputeandthe
inability to achieve a peaceful transfer of power, the underlying cause of the crisis is in
actuality linked to a political aspect. The source of the political aspect is the differences,
tensions and ideological affiliations of the influential players within Libya; therefore, the
necessary approach of dialogue and reconciliation should be directed towards the political
tracks.

Inthisregard,andafterdealingwiththenecessaryconstitutionalaspect,
thefocusshouldbedirectedtoachieve:

The formation of a consensual national unity government, by the agreed upon

legislative body in consultation with all involved parties, invested with a limited
numberofportfoliosandlimitedexecutivetasks.

Politicalpartiesandentitiesceasetoexercisepoliticalactivitiesatthisstage.

Communicate effectively with the international community to ensure respect for

internationalconventions,treatiesandsendmessagesreassuringthedenouncement
ofallformsofterrorism.

Take appropriate actions against countries that interfere in Libyan affairs, both
politicallyormilitarily.

TheJudiciaryisanindependentauthority.
Theconsolidationoftheruleoflawandinstitutionsrequiresthefollowingactions:

Commitmenttoreviewthelegislationsandthedecisionsthathavebeentakenbythe
legislature(Congress,theParliament),withanemphasisonthedirectivesthatcaused
thewideningriftandconfusionoftheLibyanpoliticalscene.

Referral of all prisoners, detainees and suspects to the official authorities and to
expeditetheprocessofreviewingtheircases.

Prohibit the adoption of any strategic regional or international agreements, or new

bilateraltreaties,thatexceedthisphase.

Liftingthesocialprotectionofanypersonwhocommitsacrimethatisdetrimentalto
the security and stability of thehomeland,and extradite thecriminalsto the official
authorities.

Issuance of a law to regulate the media and the adoption of a required code of
conduct by the media to observe professionalism, impartiality, ethics and a
commitmenttonationalprinciples.

TheSecurityAspect

The provision of security, stability, protection of the citizens and the state property is
considered the ultimate goal of the Libyan society and the necessary foundation for the
construction of the State. It is the primary responsibility of the state authorities. This
objectivecanbeachievedthroughthefollowingsteps:

TheimmediatecessationofallfightingintheLibyanregions

The launch a national plan to create and rebuild the army and police based on a
loyaltytoGodandthehomeland,todisbandallarmedformations,andtocollectthe
weaponsaccordingtospecifictimeplan.

Thecondemnationofallwhoobstructthenationalreconciliationandnationbuilding
program.

Callinguponallcountriesconcernedfortheextraditiontojusticeofallpersonswho
are wanted by Libya, the freezing of their funds, prohibit their interference in the
internalaffairsofLibya,andtakeappropriateactionagainstthem.

Prosecuteallpersonswhohavecommittedcriminaloffenses,aswellasanypersons
whoseactionsandactivitiescountertheFebruary17threvolution.

Timeline

InconsiderationofthedeterioratinganddangerousLibyanlandscape,andinresponsetothe
urgent need necessitated by the current situation, it requires the implementation of the
steps outlined in this initiative, God willing and by His help, within a maximum period of
thirty days from the date of the adoption of this initiative that was drafted by national
experts.Thisperiodincludesfourphases:
First Phase: Hold separate meetings with all parties to the dialogue to present and discuss
theinitiativeanddocumenttheirobservations,opinionsandquestionsandthentoformulate
anynecessarysolutionsrequiredtoreconcilethemtothisinitiative.
SecondPhase:Holdajointmeetingwiththerepresentativesofthepartiestothedialogue
forthepurposeofdraftingtheinitiativeinitsfinalform.
ThirdPhase:Communicatewithallrelevantandsupportivepartiesofthisinitiativeandhold
jointandextendedmeetingstosupportthisinitiative.
Fourth&FinalPhase:HoldingandorganizingtheNationalForumfortheRescueofLibyain
thepresenceofallpartiestothedialogue,relatedpartiesandsupportingparties;andinvite
theSecretaryGeneraloftheUnitedNations,theSecretaryGeneraloftheArabLeague,the
IslamicConference,theArabMaghrebUnion,theAfricanUnionandtheEuropeanUnionto
attend the meeting and ratification ceremony for the initiative to become the general
frameworkofthenationalprogramforsalvation,securityandstability.

UrgentActionsAddendum

Theurgencycausedbytheseriousconditionsimposedbytherapidsuccessiveeventsin
Libya requires taking preemptive steps with regard to the implementation plan and
schedule of the National Initiative for the Salvation of Libya through the signing of an
addendumwhichincludesthefollowingimmediateactions:
1. All concerned parties declaring their commitment to dialogue as the sole national
approachtowardreconciliationandLibyaRescue.
2. All concerned parties declaring immediate ceasefire and freezing of combat
operationsonallaxesandfrontsandinallcitiesandregionsofLibya,andacceptingan
agreementforcalmandtrucebetweenarmedgroupsthroughouttheperiodneededfor
theimplementationofthisinitiative.
3. Openingofsafecorridorsforthesafepassageofrescueandemergencyteamstothe
affectedanddevastatedareasandprovidingthenecessarylogisticalsupport.
4. The immediate opening of the Libyan airspace and all Libyan airports to enable
domesticandinternationalairtraffic.
5. Acceptingthisinitiativeasageneralframeworkforthedialogueandcomplyingwith
allitsnationalprinciplesandconsideringitasthebasisforthisdialogue.
6. Eachpartytothedialoguenaminganofficialrepresentative,anindividualorgroupof
individuals, and the requiring in writing that they sign on any actions or agreements
reachedduringthedialogue.
7. Adopting this Addendum by issuing a formal statement to be sent to local and
internationalmedia.
