The new calendar will put a smile on the face of many readers as it brings an
‘Unhappy New Year’ for unlicensed contractors. The ‘mystery’ of an unexpected letter
from the CSLB sets a ‘suspense’ story in motion. Another general contractor wants to
‘root out’ some serious problems with his plan of action…

Q: I have an individual contractor’s license that the CSLB advised was suspended
last week because a previous (corporate) license that I am associated with was
suspended due to unpaid judgments. These were recorded a year ago. The previous license was dissolved
(after the judgment) and unfortunately I did not cancel the license with the CSLB. We did not file bankruptcy
and I’ve been told it’s too late to do so. How can I get my sole owner license reinstated?

A: Based on the information provided, it would appear that the only way for you to get the CSLB to lift their
suspension would be to take care of the unpaid judgment. If Bankruptcy is not an alternative you may be able to
work out a payment plan with whom ever is owed the money. I am sorry but I do not know of any other way to
get your license reinstated.

Q: I have a Class “A” license, but I have never really used it. I'm now starting a plumbing service business
and would like to know your opinion about using my license in this business.

I am planning to take the “C-36” (plumbing) test; however, I'm thinking the Class “A” may be appropriate for
this business. Most repairs inside buildings are small in size and value, but outdoor sewer line and water line
repairs will most likely be the most intensive and higher priced repairs. Wouldn't a Class “A” be more
appropriate for this work?

Also, I formed a Limited Liability Company (LLC) before I noticed the board does not license LLC's. I
updated my license with the new company name and may have even told them it was a Limited Liability
Company. Does this mean my LLC offers no protection? I am listed as a sole proprietor on the license and I'm
assuming I can't change it. What do you think?

A: First, you cannot do business as a LLC so it would appear this offers you little or no “protection”. Second, if
you notified the Board of a name change using the LLC designation, they would reject it. Third, if you’re
registered with the CSLB as a sole owner but actually doing business as a LLC, this could cause you a significant
problem.

Finally to handle a plumbing service business you should have a “C-36” classification. The "A" would be proper
if only handling outdoor sewer and water line repairs; however, this would not cover indoor residential or
commercial plumbing service problems.

Unlicensed contractors caught in the act now face much greater peril in California with passage of new laws to
punish them. The Legislature put ‘sharper teeth’ in the law to take a larger ‘bite out of unlicensed contractor’s
crimes’ and protect consumers. FIRST offenders now face jail time and/or up to $5000 in fines. Previously, a first
offense was considered a misdemeanor with no set penalty or fines. REPEAT offenders also face much greater
peril in working unlicensed as jail time and fines go way up. For consumers, anyone hiring an illegal contactor
can receive restitution for unfinished work whether they knew the “contractor” was unlicensed or not.

State Recalls Respirators -- Bad Fit Tests

The California Department of Public Health (CDPH) is ordering a recall of a specific type of N95 respirator and
Cal/OSHA is advising employers not to use the respirators if employees cannot pass fit-tests on them.

In October, the state released millions of respirators from its stockpile to local public health departments so that
health-care facilities could protect workers from exposure to the H1N1 influenza virus. Fit-tested N95 filtering
facepiece respirators are recommended for workers in direct contact with patients with suspected or confirmed
cases of H1N1. The recall affects 3M 8000 respirators, which comprise "the majority of the state stockpile,
unfortunately," says Deborah Gold, senior safety engineer for the Division of Occupational Safety and Health
(DOSH). CDPH has asked local health departments to stop providing the respirators to health-care facilities
and is developing procedures for the return of remaining supplies.

The 8000 series "has a low success rate in fit-testing," Cal/OSHA says, which is a crucial safety factor because
respirators protect people from inhaling infectious particles by sealing to their faces. DOSH says it is not
prohibiting use of the 8000s, but it "strongly recommends against using this model for prevention of aerosol-
transmitted disease" and urges employers to assure successful fit-tests if they decide to use them. Fit tests
must be conducted according to General Industry Safety Orders ﾧ5144, Appendix A.

DOSH and CDPH urge employers to use other respirators to protect employees; CDPH will provide other
brands and models to local health departments upon request. Even with the recall, California has alternative
respirators in its stockpile. Nonetheless, the respirator supply remains under stress, DOSH says, reminding
employers to use respirator-conserving procedures. Employers should take whatever steps they can to limit
aerosol transmissible disease exposure to employees by appropriate patient identification and placement,
source control measures, and using engineering and work practice controls to minimize respirators use.

Focus on Eye Protection

A construction worker ruined a good pair of safety glasses the
other day and that might have been the best part of his day.
His safety glasses – not his eye - absorbed the impact of a
wood chip shot from a saw. Of all body parts prone to work
injuries, the eye is perhaps the most vulnerable. No one can
predict when and where the next eye incident will occur but
wearing proper protective equipment is the first defense
against an eye injury or blindness.
Eye injuries are one of the most easily avoidable injuries.
Unfortunately, many eye injuries occur because workers are
not wearing the eye protection equipment they’ve been given
or aren’t using it properly. The type of eye protection depends
on the job at hand. It's an employers' responsibility to identify
the eye hazards at the workplace then provide workers with
the best protection against those hazards. In some cases, there
may be more than one type of eye protection that provides
adequate protection.
Management support is key to a successful eye protection
program. After eliminating eye hazards through engineering
and administrative controls, they should ensure that workers
use machine guards, substitute less caustic or hazardous
chemicals when possible, and eliminate or contain processes
that create dust, particles or fragments.
In any work situation, workers should be trained to know
when eye protection is needed, how to wear it, how to care
for it, and when to replace it. Warning signs should be placed
near machines, equipment or process areas that require
operators to wear specific eye protection. Common eye
injuries are caused by:
• large particles and fragments from caulking, chiseling,
grinding, hammering, metalworking, and riveting
• dust, fumes, mist, and small particles from
woodworking, grinding, sanding, metal working spot welding
scaling or painting
• splashing metal or liquids from activities such as
welding, hot metal casting or handling acids and other
caustics
• light burns from exposure to welding, laser or other
radiant light
• impact and cuts from a blow or bump
A minute is all it takes to destroy the vision in an eye. That's
the same time it takes to make sure that eye protection is in
place and secure. Workers in hazardous areas should not
only wear proper protective eyewear, but they should also
know what to do in case of an eye injury. First aid and
eyewash stations should be readily available and workers
should be trained in how to use them. When employers and
workers focus on eye protection, they’ll like the results
they’ll see.
