Please be informed that the SBMA Board of Directors of the Subic Bay Metropolitan
Authority (SBMA) approved on March 20, 2014 through Board Resolution No. 14-03-5031
the New List of Imposable Traffic Violations within the Subic Bay Freeport Zone and the
Corresponding Fines / Penalties.

Note that the same shall take effect immediately after fifteen (15) days from this
publication.

In the event of an emergency or breakdown, a motorist can pull into the hard shoulder to
get out of the flow of traffic and obtain an element of safety.

Shoulders, especially paved or hard shoulders, increase safety. They allow some extra
space should a motorist need to take evasive action or speed to recover control of their
vehicle before a run-off collision occurs.
c.
Emergency vehicles such as ambulance and police cars may also use the shoulder to bypass traffic congestion.
d.
Shoulders provide bicyclists to ride out of vehicle traffic.
e.
On curbed roadways, shoulders move the gutter away from travel lanes. This reduces the
risk of hydroplaning, and reduces splash and spray of storm water onto pedestrians using
an adjacent sidewalk.
f.
Shoulders provide structural support of the roadway.
g.
Shoulders move water away from the roadblock before it can infiltrate into the roads subbase, increasing the life expectancy of the road surface.
h.
h. In some urban areas, shoulders are used as travel lane during peak commuting hours.

when such consists of transferring such right-hand drive motor vehicle from port or wharf or destination
to a SBF enterprises warehouse / yard, or vice versa, that is engaged in the business of trading,

(a) The act of driving a vehicle: (i) in a built-up area at a speed exceeding 60 kilometers per hour, except
in speed zone in which a higher speed is permitted under paragraph ii; (ii) in a speed zone, whether in a
built-up area or not, at speed exceeding the speed in kilometers per hour indicated by numerals or the
speed limit sign at the beginning of the speed zone; or (iii) elsewhere, other than a limited access
freeway, at speed exceeding 100 kilometers per hour.

Failure on the part of a driver of a vehicle, while on a highway, to yield the right of way to an authorized
emergency vehicle that is operating in the course of: (i) its official business; (ii) the drivers profession;
(iii) an emergency response; or (iv) the pursuit of an actual or suspected violator of the law
Failure of the driver of a vehicle to yield the right-of-way to a pedestrian crossing the roadway within any
unmarked or unmanned crosswalk at an intersection, except at crosswalks when the movement of traffic
is being regulated by police officers or traffic control signals, or where otherwise regulated by municipal,
city, or country regulation, and except where a pedestrian tunnel or overhead pedestrian crossing has
been provided.
Failure of the driver of a vehicle approaching an intersection to yield the right-of-way to any vehicle that
has entered the intersection from a different highway. This is intended to prohibit deliberate crowding or
interfering with other vehicles already in the intersection.
Any of the following acts:
1) When a driver follows an authorized emergency vehicle that is travelling in response to an
emergency closer than 300 feet; and/or
2) When a driver of any vehicle drives nearer to or parks within 200 feet of any fire department
vehicle that has stopped in response to a fire alarm.
The act of following too closely behind another motorist, or tailgating where the recommended
minimum safe following distance of three (3) seconds between a traveling vehicle behind another
vehicle which applies in all roads is not followed. This applies to passenger cars and light trucks
travelling in ideal conditions. When conditions are less ideal, the driver of a vehicle must increase the
distance between his vehicle and the vehicle ahead of him.
Way to determine the following distance of three (3) seconds: When the back-end of the vehicle ahead
passes a stationary object such as a sign along the road, count how long it takes you to pass the same
object. This is intended to prevent collisions

*Section 3. Mandatory Use of Motorcycle Helmets. - All motorcycle riders, including drivers and back
riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short
drives, in any type of road and highway.
Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that
comply with the specifications issued by the Department of Trade and Industry (DTI).

The DTI shall issue guidelines, which should include the specifications regarding standard protective
motorcycle helmets.
Violation of the provisions of R.A. 8750 particularly Section 4* thereof and the pertinent provisions of the
Implementing Rules and Regulations of the said Act.
*Section 4. Mandatory Use of Seat Belts. For their own safety, the driver and front seat passengers
of a public or private motor vehicle are required to wear or use their seat belt devices while inside a
vehicle of running engine on any road or thoroughfare: Provided, That for private vehicles, except for
jeeps, jeepneys, vans, buses and such other private vehicles as may be determined in the Implementing
Rules and Regulations (IRR), front and back seat passengers are likewise required to use their seat belt
devices at all times.
In the case of public motor vehicles, the driver shall be required to immediately inform and require the
front seat passengers upon boarding a vehicle of running engine to wear the prescribed seat belts. Any
passenger who refuses to wear seat belts shall not be allowed to continue his trip.
For special public service vehicles such as school services and other similar vehicles as may be
determined by the IRR, seat belt devices should be provided and used by both drivers and front seat
passengers as defined herein and the first row passengers immediately behind the driver at all times
while inside a vehicle of running engine.

Reckless Driving

Operational motor vehicles, both public and private, which are not equipped with the required seat belt
devices, are given one (1) year from the issuance of the IRR by the Land Transportation Office (LTO) to
retrofit appropriate seat belt devices in their vehicles.
The act of operating a motor vehicle on any road recklessly or without reasonable caution considering
the width, traffic, grades, crossing, curvatures, visibility and other conditions of the road and the
conditions of the atmosphere and weather, endangering the property or the safety or rights of any
person or to cause excessive or unreasonable damage to the road. This includes the following:

- Hazardous Behavior, which consists of sudden stop, sudden depress in speed, passing stopped
vehicles, and the failure of the driver of the vehicle: (1) to recognize potentially hazardous situations
sufficiently in advance to allow time to safely maneuver past them; or (2) to assume that others may
make mistakes and is on guard in the event an error is made; or (3) to search ahead of what is
immediately in front, to have advance warning of approaching hazards by sudden stop, sudden
depress/decrease in speed, passing stopped vehicles
- Just Missed Accident, which refers to the driver's failure to pay proper attention to the road while
driving. It includes, among others, talking, eating, putting on makeup and attending to children, use of
cellphones or electronic units, or similar acts which can cause distraction.
- Unsafe Behavior or permitting passenger to ride dangerously, opening / closing doors of vehicle,
failure to depress headlight to low beam, extending body or any part of the body outside of the vehicle,
sitting on pick-up cargo sidings / tailgating
- Inattentive Driving or when a driver almost figures in an accident while using a motor vehicle due to
an unsafe or negligent act, as well as a driver's or operators failure to pay proper attention to the road
while driving. It includes, among others, talking, eating, putting on makeup and attending to children,
use of cellphones or electronic units, or similar acts that can cause distraction
- Inattentive / Unsafe Driving or driving while on the lap, driving with headphone, driving while using
cellular phone or similar devices,
Violation of the provisions of R.A. 8750, particularly Sections 4, 7 and 9 thereof and the pertinent

operator is approaching a hill crest; (4) the vehicle operator is traveling on a narrow or winding roadway;
and (5) a special hazard exists with regard to traffic, including pedestrians, or weather or highway
conditions

Excessive Noise - Operating on a street a motor vehicle that is not equipped with a muffler or mufflers in
constant operation and of sufficient capacity for the motor, and equipped with an exhaust system to
prevent the escape of excessive fumes or smoke and unusual noise.

The act of not operating a vehicle reasonably, so as to block the normal flow of traffic such as when the
driver of a motor vehicle blocks an intersection; or is driving too slow and causing a log jam; or driving a
motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of
traffic except when reduced speed is necessary for safe operation or in compliance with law or except
when the vehicle is temporarily unable to maintain a greater speed due to a combination of the weight of
the vehicle and the grade of the highway

76. Obstruction obstructing the free passage of other vehicles on the highway while discharging or
taking passengers or loading and unloading freight, or driving a motor vehicle in such a manner as to
obstruct or impeded the passage of any vehicle.
Section 109
Obstructing Roads
(a) A person shall not, without the written permission of the traffic management authority, drive or leave
standing any vehicle on a road for the purpose of: (i) Soliciting employment or business from the
vehicle;(ii) Displaying an advertisement on the vehicle; or (iii) Offering goods for sale from the vehicle.
(b) A person shall not stand or place himself on a thoroughfare for the purpose of: (i) soliciting
contributions; (ii) display any advertisement; or (iii) offering goods for sale
(c) A person in vehicle shall not buy or offer to buy an article from any person standing or placed on a
thoroughfare.
(d) A person shall not bar, impede or divert the flow or direction of traffic from any road, street or
highway, unless authorized in writing or except when the closure of a road or any part thereof to traffic
or the diversion or traffic is dictated by reasons of emergency to protect the public from any calamity, fire
or other public danger.
(e) The prohibition contained herein shall also apply to the use of sidewalks by vendors, repair shops or
any establishments.
(f) Stalled vehicles on thoroughfares shall be construed as obstructing traffic if not removed or towed
within five (5) minutes.

a. Failure of the driver to wear prescribed helmet (including: (i) no or defective helmet (outer shall be
intact) and (ii) improper or unfastened helmet while riding;
b. Carrying more passengers other than the back rider, or cargo other than built-in saddle, bags, and
luggage carriers; and other related violations such as: (i) Child passenger except when his/her feet are
resting on the foot rests, (ii) Unstrapped or untied load to the vehicle, (iii) Carrying passenger not
equipped with proper foot rests, and (iv) Riding in side-saddle position;
c. Defective accessories such as lights (Headlights, Tail Light, Brake Light, Turn Signal Light), standard
side mirrors and horn;
d. Modifying any part of the original design of a motorcycle or scooter such as when: (i) Muffler
produces excessive noise, (ii) Handle bar with no side mirror or ineffective for its purpose, (iii) Horn with
amplified noise, or which produces audible siren/alarm, etc., (iv) Motorcycle decorated with blinkers,
running/strobe lights, etc., and (v) using Halogen or non-standard color lights for headlight, tail light,
brake light, and turn signal light;
e. Rider / Passenger wearing sandals or slippers, or barefooted while driving; and
f. Headlights turned off while driving (daytime or night time) within the Subic Bay Freeport .
