It is noticed that in rnany cases,the disciplinaryproceedingsget vitiated on account


of failure to follow the prescribed procedure. Some of the common mrstakeswhich are
cornrnitted by the DisciplinaryiAppellateiRevisionarv/Revrewing
Authorities and inquiry
Officers have been brought out in this brochure for guidance/informationof all concerned.
This is an attemptto compilethc gist of variousrules.instructions,etc.,issuedin this regard
from time to time. While refbrring to this Circular, the onginal letter referred to therein
should be read for a proper appreciationand in caseof doubt, the original letter should be
relied uponas authoritv.
Since only the important instructionson the subject have been included in this
Master Circular, some instructionsmight not have found place herein. Instructionscontained
in circulars not included in the Master Circular. should not be deemed to have been
superseded

DisciplinaryAuthority:
a) The chargesheet
shouldbe issuedby the apprcpriateDisciplinaryAuthority prescribedin

the time of initiation of disciplinaryactionand not with refbrenceto the postheldby him
at the time the allegedmisconductoccurred.

d) While (a), (b) and (c) abovereftr to the level of the DisciplinaryAuthority,the Authority
who actuallyfunctionsas Disciplinary Authority can be noneother than the one under
whoseadministrativecontrolthe delinquentemployeeworks. Also therecanbe only one
Disciplinary Authority for an employee,e.g. for an operatingstafi who is under the
administrativecontrol of Divisiond OperatingManager(DOM), only the DOM can act
as Disciplinary Authority,.evenif the misconductpertainsto violation of commercial
rules or safety rules and not Divisional CommercialManager or Divisional Safety
Officer.

e) If the DisciplinaryAuthority of a r:hargedoffrcial is alsoinvolvedin the samecasethen he
shouldnot act asthe DisciplinaryAuthority in the saidcas. The authoritywho is next

f) The authority looking after the current duties of a post cannot exercise the disciplinary
functions assignedto the said post.

g) Authority who has acted as a member or Chairman of a Fact Finding Inquiry or Accident
Inquiry should not act as Disciplinary Authority becausethe Charged employee would
apprehend that the officer having expressed earlier an opinion would not, as a
Disciplinary Authority, depart from his own earlier finding. He may not thus get justice.
However, if the report does not indicate a final opinion but only a view, prima facie, he
can act as a Disciplinary Authority. A member or chairman of the Fact Finding Inquiry
or Accident Inquiry cannot, however act as an Inquiry Officer in that case since the
Inquiry Of|rcer should be an authority who should not have prejudged the guilt, even
provisionallyat an early stage.

Charge Memorandum:
a) The chargesin a charge memorandum should be drawn up in clear and distinct articles of
charges,separatefor each alleged act of ommisiorlcornmission. The charges should be
specific and not vague. Where the chargesare not entirely separateand distinct, it would
be more appropriate to combine the various elementsof the chargesinto a single article
of chargebut in which the different elementsare brought out clearly.
b) The articles of chargesand the statementof imputation in support of the articles of charges
should not be identically worded. While the article of charge should be concise, the
statementof imputation should contain details, referencesetc. relating to the chargesand
should generally give a clearer idea about the facts and circum.stancesrelating to the
alleged act of commission or omission. Specific ruieVinstructions which may have been
violated by the chargedofficial should also be mentioned in the statementof imputation.
c) Where intention is to bring out the gravity of the chargein a particular casedue to the fact
that punishmentsin the past have not resultedin better sonduct on the part ofthe charged
o{Iicial, then the previous record should be brought out in the chargesheetitself to enable
the charged offrcial to defend himself with reference to these factors also. Otherwise,
Disciplinary Authority cannot take into account the previous misconductswhile taking a
decision in regard to the presentcase.

d) The list of documents by which and the list of witnesses by whom the charges are
proposed to be sustainedshould be comprehensiveand drawn up with due care taking
into account the relevance of each documenVwitness in establishing the articles of
charges,their availability and easeof being produced during the inquiry etc. If it is found
after the issueof chargesheetthat additional documents/witnesseshave to be addedto the
lists, a suitable corrigendumto the chargedmemorandumshould be issued.

If, on consideration
of the reply of the chargedoffrcial to the majorpenaltychargesheet,
the DisciplinaryAuthority is of the view that a minor penaltyis warrantedin the case,the same

10. Appointmentof lnquiry Officer is the prerogativeof the DisciplinaryAuthority. In nonCVC vigilance cases,the Vigilance Organisationwill leavethe choice of the Inquiry Offrcer
completelywith the DisciplinaryAuthority in most of the cases.In somecasesVigilancemay
forward panelof Inquiry Offrcer indicatingthe numberof inquiriespendingwith eachone of
them. The DisciplinaryAuthority in that casemay chooseoneout of the paneland appointhim
asInquiry Offrcer.

charged official makes a specific request for summoning the hand-writing expert for
cross-examination,then it would be obligatory on the part of Inquiry Offrcer to summon
the hand-writing expert for appearingin the inquiry.

After the case on behalf of the Disciplina.ry Authority is closed, the charged official
should be given the opportunity to present his detbnce. The Charged Official, if he so
desires, should be allowed to examine iiimselfl in his own behalf. The defence
documents,if any,would then be taken on re';ord and defencewitnesses,if any, would be
examined/cross-examined.
It is not obligatory for the Inquiry Offrcer to send summonsto all the defencewitnesses
cited by the charge offrcial. If the inquir-v-Officer is of the view that the evidence
purported to be given by a witness w;ll be irrelevant to the charge against the charged
official and failure to secure rhe attendanceof the witness would not prejudice the
defence, the Inquiry Officer may reject the request for summoning that witness duly
recording the reasonstherefor. In the case of outside witnesses cited by the charged
official, the responsibility is on him to ensurehis presenceduring the inquiry. However,
all those defencewitnesseswho have been allowed by the Inquiry Offrcer and who have
come to give the evidence,have to be examined.

At the end, the Inquiry Ofiicer may generally question the charged offrcial on the
circumstancesappearingagainst him in the evidence produced,to enablehim to put forth
his explanation. Such questioning cf the chargedoffrcial by the Inquiry Offrcer would be
mandatory if the chargedofficial has not examinedhimself as a witness and failure on the
part of Inquiry Oflicer to do this would am{runtto denial of reasonableopportunity.

After the production of evidence is completed, the Inquiry Offrcer 4g3g allow the
PresentingOffrcer and the charged official to file written briefs as a final presentationof
their respective cases. This again is not mandatory in all casesbut if it is allowed, the
PresentingOffrcer's brief should be obtained first and a copy given to the chargedofficial
