JOINT STATUS REPORT REGARDING DECEMBER 3 STATUS CONFERENCE

In accordance with this Courts Order of August 13, 2014 (Doc. 85), the parties hereby
notify the Court that they do not believe it is necessary to hold the status conference currently
scheduled for December 3.
In addition, in the event that the Court decides to hold argument on the Governments
pending motion to stay proceedings, Plaintiffs respectfully request that such argument be held no
earlier than Friday, December 19. Because of scheduling conflicts affecting counsel for Plaintiffs, including arguments scheduled for December 9 before the Second Circuit and December 16
in the U.S. District Court for the Southern District of Iowa in Continental Western Insurance Co.
v. FHFA, No. 14-42, Plaintiffs are not available before December 19. For the same reasons,
Plaintiffs are not available on December 17, the date of the next regularly scheduled status conference.
The Government prefers that the resolution of the pending motion to stay not be delayed. Therefore, we oppose the delay requested by plaintiffs. Should the court desire oral argument on the motion, we respectfully request that argument be scheduled on a date as soon as possible after Washington Federal files its amicus curiae brief on December 5, 2014.
