COMPLAINT
I, Linda Manansala-Cruz, of legal age, Filipino, with assistance of
counsel, and resident of No. 1 Del Pilar St., Sampaloc, Manila, do
hereby state under oath that:
1.

That respondent is my husband, Cesar Cruz, of legal age,


Filipino, with last known address at 78-B Elena St., San Lazaro,
Manila

2.

That we contracted marriage in the City of Manila, on January


5, 2007 via civil ceremony, as evidenced by a certificate of
marriage hereto attached as Annex A

3.

That I am charging respondent for violation of Sections 5 (a)


and 5 (i), otherwise known as the Anti-Violence Against
Women and their Children Act which provides:
Section 5: Acts of Violence Against Women and Their
Children The crime of violence against women and their
children is committed through any of the following acts:
a. Causing physical harm to the woman or her child

Causing mental or emotional anguish, public ridicule or
humiliation to the woman or her child, including but not
limited to, repeated verbal and emotional abuse, and denial
of financial support or custody of minor children of access to
the womans child/children

The acts and/or omissions giving rise to my causes of action


are committed as follows:

That earlier said, my husband and I contracted marriage in


January 5, 2007;

That after our marriage we lived in the house of my husbands


mother since my husband had been laid off work.

That 6 months into the marriage, my husband was still


unemployed

That during the first two years of our marriage our life was
typical for me.

That however, on May 2007, following a trip to Nueva Ecija


after I finished cooking and cleaning, my husband woke me up
to buy him a beer and when I refused, he raised his voice and
slapped me.

That after the said incident, on July 2007, around 4 in the


morning, he went home drunk and ordered me to cook him a
meal. After I told him that I needed to rest since I got home at
2 am following a shift that ended at 12mn. He forcefully

dragged me from bed to the door. I was constrained to finally


oblige and cooked him instant noodles, which irked him and
poured the hot noodles on me. To appeased him, I cooked him
rice and egg.

The following day, his mother and I had a conversation after


she saw my misery. She in turn talked to him. She asked him
to treat me kindly, to get a job and move out of the house.
She told my husband that she would pay for the room while
he was still looking for a job.
That on April 2009, I asked him to attend the wake of my
grandmother with me. He declined, alleging that he was not
feeling well. However, moments later he went out of the
house and visited our neighbor, a certain Arnold de Leon.
When he returned he was already drunk. He told me he hates
me and that we can live off of her mothers allowance. He
slapped me afterwards.
That after sometime my husband finally acceded to her
mothers proposal to move out. We settled in a room near my
work place, which his mother paid for.
That after we moved in, life became better for the both of us,
although my husband is still unemployed.
That on March 2010 my husband finally found a job. For the
next two months my husband regularly went to work. Until
one time when I went to visit my mother in law, saw my him
there. When I asked for an explanation, he said it was his day
off.
That after that incident, I have observed that my husbands
work schedule became erratic but when I questioned him, he
said his schedule changed;
That finally on June 2010, I confronted him about the status of
his job. To which he answered that he is still unemployed and
he just pretended to have a work to get away from my
constant nagging.
That after said confrontation we fought and during the course
of our fight he physically abused me. He left later, despite my
plea for him to stay.
That we have been separated ever since that incident.
That during the course of our marriage I endured physical
violence in the hands of my husband.
That because of the irresponsible conduct of my husband, I
also suffered emotional dislocation and psychological distress.
I am executing this affidavit to attest to the foregoing facts
and circumstances and for purposes of filing a criminal
complaint for violation of Sections 5 (a) and 5 (i), otherwise
known as the Anti-Violence Against Women and their Children
Act.
