Situation
Grand Jury decision re. the 09 Aug 14 OIS is eminent.
It is anticipated demonstrations and marches will
occur at Frank Ogawa Plaza (FOP) & other vital
structures/locations in the downtown area.
Many individuals of the general public will
demonstrate.
Subversive groups and individuals may use the event
to commit acts of violence and/or vandalism.

Situation Specific
FTP has advertised a demonstration to occur the
day of the verdict regardless if officer is indicted. The
demonstrators are expected to start arriving at FOP
@ 1500 & march at 1900 hours.
Historical events (Mehserle Verdict, Treyvon Martin)
required OPD to plan for the following:
Surge of protesters after announcement;
March/rally to various vital structures to include: PAB,
Federal and State Buildings, NCJ, Superior Court; and
Violent component(s) within group.

Intelligence
FTP announced demonstration at 14th St.
& Broadway @ 1900 hours, day of
announcement. Expected gathering to
begin at 1500 hours.
No other planned events have been
identified.
The crowd composition could be a blend
of different groups.

Intelligence
There is no specific intelligence indicating that Black
Bloc anarchists or other radical elements will
participate; it is anticipated that individuals may
attempt to disrupt the event or commit criminal acts.
Some individuals may display hostility to law
enforcement.
Hostile/violent demonstrators have been known to
possess makeshift projectile weapons, shields,
sticks, hammers, ice picks, etc.

Intelligence
Radical tactics of violence and vandalism include use
of barricades/shields, setting fires, throwing objects
at the police (crowd and elevated positions),
lynching, splinter groups committing criminal acts.
Some protesters have attempted to monitor OPD
communications via scanners.
Some protesters have disseminated misinformation
via Twitter for law enforcement to intercept.

Mission
OPD, with the assistance of other City Depts. and
outside LE Agencies (if needed), will conduct crowd
management and apply the appropriate level of
direction and control to:
1. Protect life;
2. Maintain officer safety;
3. Protect vital facilities;
4. Protect property;
5. Maintain public peace and order; and
6. Uphold constitutional rights of free speech and
assembly while relying on the minimum use of
physical force and authority required to address
crowd management and crowd control issues.

Commanders Intent
Purpose and Tasks
Gather information on the intent and plans of event organizers/leaders.
Attempt dialogue with event organizers/leaders/liaisons if possible.
Communicate with crowd early and often.
Monitor and control crowds to allow for peaceful demonstrations.
Facilitate marches.
Enforce applicable laws (tactical advantage) including:
Prevent/Respond to acts of vandalism
Prevent/Respond to acts of violence
Identify and arrest specific individuals engaged in unlawful behavior.
If necessary, issue dispersal order and disperse crowds in an orderly manner
to predetermined escape routes.
Cite or Arrest individuals who are in violation of a lawful order to disperse.

Execution
Concept of Operation

OPD will have a visible presence at protest location and other


areas of concern.
OPD elements will remain mobile and flexible ready to respond
to address crowds and crime concerns.
OPD will cite and arrest law violators when appropriate and safe
to do so.
ACSO mutual aid liaison has been notified of this event.
Outside LE Agencies (mutual aid) may be used for crowd control
and/or deployment to predetermined quadrants/facilities if
needed.

Execution
Motor squad(s) and Dual Purpose Motors squad(s) will be available to
facilitate march and provide traffic control.
One Bike Squad will be available to provide patrols and monitor protesters
that become mobile on bicycles.

Video teams will be available during the operation; one team will have live
stream capability.

TNT will be used to attempt communication with the crowd (ATV(s) with
sound equipment and SUV with LRAD).
Outside Agency Air Support will be available for the operation.

Alpha Company
No later than (NLT) 1500 hours, deploy to one Alpha Company platoon to
FOP in squad sized elements maintaining a visible presence to monitor
protester activity.
Maintain close, visible presence with the crowd.
On order, facilitate marches, by trailing and/or paralleling the protesters.
Identify and cite/arrest individuals committing crimes, when tactically
feasible to do so.
On order, maneuver to assist in crowd containment and control, and mass
arrests, if required. This may include preventing crowd access to critical
infrastructure and/or freeways.

Bravo Company
NLT 1600 hours, deploy Bravo Company Platoons to quadrants 1-2, patrolling
the quadrant in squad sized elements maintaining a visible presence to
monitor protester activity.
On order, deploy to the PAB, to maintaining a visible presence/deterrence
should protesters march to the PAB or towards the freeway.
On order, facilitate marches, by trailing and/or paralleling the protesters.
Maintain close, visible presence with the crowd.
Identify and cite/arrest individuals committing crimes, when tactically
feasible to do so.
On order, maneuver to assist in crowd containment and control, and mass
arrests, if required. This may include preventing crowd access to critical
infrastructure and/or freeways.

No later than (NLT) 1600 hours, deploy Charlie Company to quadrants 3-4,
patrolling the quadrant in squad sized elements maintaining a visible
presence to monitor protester activity.

maintain a visible presence to monitor protester activity.
On order, facilitate marches, by trailing and/or paralleling the protesters.
Maintain close, visible presence with the crowd.
Identify and cite/arrest individuals committing crimes, when tactically
feasible to do so.
On order, maneuver to assist in crowd containment and control, and mass
arrests, if required. This may include preventing crowd access to critical
infrastructure and/or freeways.

Maintain close, visible presence with the crowd.
Identify and cite/arrest individuals committing crimes, when tactically
feasible to do so.
On order, maneuver to assist in crowd containment and control, and mass

Frank Ogawa Plaza

On order, provide force protection for vital facilities and/or MFFs.

Bike Squad
NLT 1500 hours, deploy to the protest rally point at FOP, maintaining a visible
presence and citing for infractions.
Monitor protester activity and identify criminal elements. Pay attention to
bicycle violations.
On order, patrol the downtown area, maintaining visibility, enforcing laws, and
citing for infractions.
Recon march route and target locations.
On order, trail and/or parallel marches. This will be a primary assignment, if the
demonstrators become mobile on bicycles.

TNT Field Units
NLT 1500 hours, respond to FOP, prepared to respond to crowd activity.
Conduct liaison with event leaders throughout the operation.
Communicate with crowd during rally and march, in order to provide support,
guidance, and direction.
Be prepared to provide dispersal orders and egress routes.

Contingency Plans
Individuals obstruct free flow of traffic at major thoroughfares
OPD will assess the time, place, and manner in which people are
engaged in these acts
The IC will determine whether or not to remove people based on the
level of disruption, weighing practicality of moving the crowd to a
sidewalk, duration of disruption, and impact of mass arrest if
demonstrators refuse to comply

Individuals march toward or on freeway


OPD will work with CHP in an attempt to prevent protesters from
accessing freeway.
If crowds enter freeway, OPD will work with CHP to quickly remove
protesters from freeway.
If possible, OPD will attempt to issue citations for violation.

Individuals damage property


At the direction of a commander and when tactically feasible, arrest team(s) will
make surgical arrests of individuals who damage or destroy property.

Individuals set fires


OPD will use fire extinguishers to put out small trashcan fires. If needed, OPD
escort officers will provide force protection to OFD to put out larger fires. At the
direction of a commander, arrest team(s) will make surgical arrests of individuals
who set fires.

Contingency Plans
Protesters take over a building or private lot refusing to leave
Attempt to identify building or lot owner and determine if police
services are requested for trespassing (unless obvious crimes are
occurring).
If police services are needed or requested, MFF will establish
containment of building or lot, isolating the area from any crowds.
MFF personnel will provide announcements for individuals to vacate
the property.
If necessary, MFF personnel will develop a plan to safely clear the
building or lot using appropriate number of officers.

Force & Arrest Posture


OPD may encounter non-violent passive resistors (i.e. individuals
that go limp). The following techniques shall be used (TB III-G):

Handcuffing
Verbal Persuasion
Lifting, carrying, use of dollies or stretchers (if available)
Use of control holds when approved by a sergeant

OPD may encounter individuals who lock arms. Officers shall


inform each individual that they are under arrest and provide verbal
direction to give the arrestee a chance to comply before force is
used to unlock arms.
Persons who make it clear (e.g. sitting down, locking arms) that
they seek to be arrested shall be arrested and not subject to other
dispersal techniques, such as the use of batons or chemical agents.

Force & Arrest Posture


OPD will target specific and identified criminal offenders for immediate
arrest within the crowd.
Tango teams will have the capability to deploy direct fire SIM (40 MM and
DSFB rounds). These munitions will be used as a force option against
individuals that are an immediate threat to life or serious bodily injury or
substantial destruction of property which creates an imminent risk to life.
OPD will provide unlawful assembly announcement, if necessary.
OPD will engage in arrests of remaining protesters who do not disperse
pursuant to announcement.
The use of chemical agents may be used if authorized by the incident
commander.
Baton jabs are not authorized to move a non-compliant individual.
Tasers and Aerosol Handheld Chemical Agents (OC) may not be used
indiscriminately against crowds but only against individuals engaged in
serious unlawful conduct or who are actively resisting (TB III-G).
No exception to UOF policy or law (Graham v. Connor). All force must be
objectively reasonable

Force & Arrest Posture

We may encounter individuals that stand directly IFO of
officers assigned to skirmish lines & blow whistles or
use other devices (blow horn, etc.) that may cause pain
to ears/can lead to injury; & delay/obstruct discharge
of duties.

Note: M.A. resources will have attached Pathfinders / In the event M.A. resources arrive with
unauthorized munitions, efforts will be made to assign them to force protection if possible.

Force & Arrest Posture


Outside LE agencies should only deploy
chemical agents at the direction of OPD.
Outside LE agencies should not use electronic
weapons on crowds.
Outside LE agencies should not use weapon
launched less-lethal impact munitions unless
directly threatened by an individual who is an
imminent threat to their safety.

Media
The media has a right to cover protests from any location
the public is normally allowed.
Leave the media alone and focus on protesters and those
committing criminal acts.
When in doubt, Let the media film.
If they ask for a statement/questions, direct them to the
PIO (one with each Platoon).
If a detained individual claims to be media, contact the
PIO.
Media personnel are not exempt from arrest if they are
involved in criminal acts.

Administration
Arrests
Officers shall cite out misdemeanor violations unless
there is reasonable likelihood that the offense would
continue or resume or that the safety of persons or
property would be immediately endangered by the
release of the person (853.6i(7) PC).
OPD Mobile booking team and prisoner transport vans
will be available if needed.
In Crowd Control situations monitor arrest tempo and
capacity of movement.
On order from IC to conduct mass arrest or cite and
release.

Administration
Reports
ALL MFF members shall complete supplemental reports,
documenting involvement in operation unless otherwise
directed.
Officers shall complete Preliminary Use of Force Reports
(PUFR) for all UOFs.
Officers shall complete Arrest Supplemental Information (ASI)
sheets for all arrests.
UOF and report writing completed at Squad level. Supervisors
will complete unless directing force.
Stop Data reporting is suspended during MFF operations. FIs
will not be required. Document stops on supplemental report
form.
Supervisors shall review all supplemental reports and sign the
bottom of the page.

Administration
PDRDs
PDRDs shall be worn, if issued.
In addition to usage per DGO I-15.1, members shall also
activate their PDRDs in all of the following circumstances:
When on skirmish lines, or otherwise in contact with
protesters
When conducting contacts, detentions, and arrests
When processing prisoners

Do not turn PDRDs off until the conclusion of these


circumstances.
Non-functioning PDRDs shall be removed from the
uniform and stored on the person (advise supervisor).
Note time and reason for non-functioning PDRD in
supplemental report.

Administration
Complaints
Complaint units are responsible for responding to the field
and processing complaints.
Supervisors of officers receiving complaints shall advise radio
of the complainants name (or description if no name
available) and location. Dispatch shall notify complaint units.
Complaints to be handled based on conditions:

Under normal circumstances (static position, not engaged in


confrontations with protesters): officers shall advise their supervisor
of the complaint, without delay. Supervisors shall then advise the
radio, without delay.
Officers moving in skirmish line and/or in direct contact with
confrontational protesters: officers shall note the time, location, and
description of the complainant, and advise their supervisor, as soon
as tactically feasible. Supervisors shall then advise radio, as soon as
tactically feasible.

Administration
End of Operation Report Flow
At the end of the operation, supervisors will complete an Unit
Log documenting number of arrests / cites, UOF, injuries and
property damage for their personnel.
Supplemental Reports, ASIs, PUFRs, Unit Logs, Mass OT slips
reviewed at Squad and Platoon Leader levels, then submitted
to Company Commander.
Company Commanders submit documentation as follows:

PUFRs -> UOF Investigator
Mass OT slips -> Deputy Operations Section Chief
Unit Logs -> Deputy Operations Section Chief (retain copy for After
