AN INTERIM URGENCY ORDINANCE OF
THE CITY OF CLAREMONT, CALIFORNIA
ENACTED PURSUANT TO GOVERNMENT
CODE SECTION 65858 TO EXTEND INTERIM URGENCY ORDINANCE NO. 2015-03
FOR AN ADDITIONAL 10 MONTHS AND 15
DAYS AND CONTINUE THE TEMPORARY
PROHIBITION AGAINST THE ISSUANCE OR
APPROVAL OF NEW PERMITS, LICENSES
OR OTHER ENTITLEMENTS TO ESTABLISH OR OPERATE MASSAGE ESTABLISHMENTS, ALL NEW BUSINESSES THAT
PROVIDE MASSAGE THERAPY AS AN ANCILLARY SERVICE TO THE PRIMARY USE,
AND THE EXPANSION OR MODIFICATION
OF EXISTING MASSAGE ESTABLISHMENTS WITHIN THE CITY
WHEREAS, on January 13, 2015
pursuant to Section 65858 of the California
Government Code, after public notice and a public
hearing, the City Council of the City of Claremont
(City Council) adopted Ordinance No. 2015-03, an
interim urgency ordinance, which temporarily
prohibits the issuance or approval of new permits,
licenses or other entitlements to establish or operate
massage establishments, all new businesses that
provide massage therapy as an ancillary service to the
primary use, and the expansion or modification or
existing massage establishments in all locations in the
City of Claremont; and
WHEREAS, Section 65858(a) of the
California Government Code provides that Ordinance
No. 2015-03 shall expire and be of no further force
and effect 45 days from its date of adoption; and
WHEREAS, Section 65858(a) of the
California Government Code provides that prior to the
expiration of Ordinance No. 2015-03, the City may
extend Ordinance No. 2015-03 for an additional ten
months and fifteen days after giving notice pursuant to
Section 65090 of the California Government Code and
conducting a public hearing; and
WHEREAS, prior to this hearing, the
City Council authorized the issuance of a written
report describing the measures and actions taken by
the City to alleviate the circumstances and conditions
which led to the adoption of the Ordinance No. 201503 since its adoption on January 13, 2015, as required
by Government Code section 65858(d) (Council
Report); and
WHEREAS, based on the Council
Report, the City Council has determined that the
circumstances and conditions that led to the adoption of
Ordinance No. 2015-03, which are set forth in the recitals
of Ordinance No. 2015-03 and are fully incorporated
herein by this reference, have not been alleviated as of the
date of this Ordinance and continue to create concerns
described in Ordinance No. 2015-03; and
WHEREAS, the City Council now
seeks to extend the temporary prohibition on the
issuance or approval of new permits, licenses or other
entitlements to establish or operate massage
establishments, all new businesses that provide
massage therapy as an ancillary service to the primary
use, and the expansion or modification or existing
massage establishments in all locations in the City of
Claremont as currently authorized under Ordinance
No. 2015-03, to continue studying possible
amendments to the Citys zoning regulations to help
ensure that massage establishments are regulated in a
way that protects the community and complies with
applicable law; and
WHEREAS, the purpose for
extending Ordinance No. 2015-03 is to avoid the
potentially significant adverse impacts to the
publics health, safety, and welfare described in
Ordinance No. 2015-03; and
WHEREAS, the City Council has
determined there is a need to extend Ordinance No.
2015-03 for an additional ten months and fifteen days
as authorized under section 65858(a) of the California
Government Code; and
WHEREAS, it is the present intent of
the City Council to keep this interim urgency
ordinance in effect only until such time the Council
adopts an amendment to the Zoning Code pertaining
to massage establishments; and
WHEREAS, the notice and public
hearing required by section 65858(a) of the California
Government Code for the extension of Ordinance No.
2015-03 has been provided in accordance with
applicable law.
THE CITY COUNCIL OF THE
CITY OF CLAREMONT DOES ORDAIN AS
FOLLOWS:
SECTION 1.Adoption of this urgency
interim ordinance (Ordinance) shall constitute an
extension of Ordinance No. 2015-03 pursuant to section 65858 of the California Government Code.
SECTION 2. During the time this Ordinance is in effect, the City shall not issue any use
permit, variance, building permit, business license or
other applicable entitlement for the issuance or approval of new permits, licenses or other entitlements to
establish or operate massage establishments, all new
businesses that provide massage therapy as an ancillary service to the primary use, and the expansion or
modification or existing massage establishments in the
City of Claremont.
SECTION 3. This ordinance extends
the moratorium for ten months and fifteen days on
the following:
A. the approval, issuance, or transfer of any use permit, variance, building permit, business license, or
other applicable entitlement for the establishment or
operation of new massage establishments in the City,
as well as the expansion or modification of existing
massage establishments. For purposes of this ordinance, the terms massage establishment and massage technician shall have the meanings set forth in
Chapter 5.36 of the Claremont Municipal Code.
B. All of the above recitals are true and correct and
incorporated herein as if set forth fully herein.
C. The City Council hereby finds and determines
that adoption of this Ordinance and the extension of
Ordinance No. 2015-03 is necessary for the preservation of the public health, safety, and welfare in
order to prevent establishment of new massage establishments and the expansion or modification of
existing massage establishments at locations that
may potentially conflict with and be inconsistent
with the intended amendment to the Zoning Code.
Minimizing incompatibility of land uses promotes

orderly development, which is necessary to encourage quality neighborhoods. Furthermore, this is a


matter of importance to the entire City of Claremont
and is not directed at any particular property.
SECTION 4. The extension of Ordinance No. 2015-03 applies to any new massage establishments, or massage technician, as these
phrases are defined in Chapter 5.36 of the Claremont
Municipal Code, along with all new businesses that
provide massage therapy as an ancillary service to
the primary use, and existing massage establishments intending to expand or modify. The requirements of this ordinance shall have no application or
effect upon and shall not be construed as applying to
any persons designated as follows: State-licensed
physicians, surgeons, chiropractors, acupuncturists,
acupressurists, physical therapists, osteopaths, registered or licensed vocational nurses, barbers, cosmetologists, aestheticians, and manicurists. Except
as amended by this ordinance, Chapter 5.36 of the
Claremont Municipal Code shall remain in effect
during the effective period of this ordinance and any
extensions of this ordinance.
SECTION 5. The City Council
hereby directs the Planning Division continue to
study and review potential amendments to the Citys
zoning code related to massage establishments to reestablish appropriate regulations which apply to
zoning-based regulations and other regulations that
are compatible with the intent of various commercial
districts and surrounding neighborhoods.
SECTION 6. The City Council finds
that this ordinance is not subject to the California
Environmental Quality Act (CEQA) pursuant to
Section 15060(c)(2) in that the activity will not result in a direct or reasonably foreseeable indirect
physical change in the environment and Section
15060(c)(3) (the activity is not a project as defined
in Section 15378) of the State CEQA Guidelines,
because it has no potential for resulting in physical
change to the environment, directly or indirectly.
SECTION 7. If any provision of this
Ordinance or the application thereof to any person or
circumstance is held invalid, such invalidity shall
not affect other provisions or applications of the Ordinance which can be given effect without the invalid provision or application, and to this end the
provisions of this ordinance are severable. The City
Council hereby declares that it would have adopted

SECTION 8. This Ordinance shall be
adopted by a four-fifths vote of the City Council.
Upon adoption, the Mayor shall sign this Ordinance,
and the City Clerk shall attest thereto and shall
within 15 days of its adoption cause it, or a summary
of it, to be published in the Claremont Courier, a
weekly newspaper of general circulation, printed,
published and circulated in the City of Claremont.
The term of this Ordinance shall be in effect beginning March 10, 2015 for ten months and fifteen days
and shall thereafter be of no further force and effect,
unless earlier repeal or extended by the City Council as provided for in Government Code Section
65858.

DETAILED SUMMARY OF MATTER TO BE VALIDATED:
California Municipal Finance Authority (``the Authority``) has established the Property Assessed Clean Energy (``PACE``) Program (the
``CMFA PACE Program``). The Authority seeks to
implement the CMFA PACE Program in 31 counties
and 42 cities throughout California to encourage and
facilitate the installation of distributed generation renewable energy sources, energy and water efficiency
improvements, seismic stengthening improvements
and/or electric vehicle charging infrastructure by residential and non-residential property owners, which
will save participating property owners money while
conserving rescurces and reducing carbon emissions,
all in furtherance of the Legislature's goals as set forth
in California Streets & Highways Code Section
5898.10 et seq.
The Authority seeks to validate all proceedings, actions, liens and contracts connected with
the CMFA PACE Program, and to obtain an order
from the Superior Court that the proceedings, actions,
liens and contracts related to the CMFA PACE Program are valid, legal and binding and are in conformity with the applicable provisions of all laws and
enactments at any time in force or controlling upon
such proceedings, including but not limited to, the
provisions of Article XIII D of the California Constitution, the due process and contract clauses of the
Constitution of the United States, and their equivalent clauses in the California Constitution.
The Plaintiff has filed a civil complaint
against you. If you wish to contest the legality or validity of the matter that is the subject of this lawsuit,
you must appear and file with the Court a written
pleading in response to the complaint not later than
April 6, 2015. Your pleading must be in the form required by the California Rules of Court. Your original
pleading must be filed in this Court with proper filing
fees and proof that a copy thereof was served on
Plaintiff's attorneys.
Unless you so respond, your default
will be entered upon Plaintiff's application, and this
Court may enter a judgment against you for the relief
demanded in the complaint. Persons who contest the
legality or validity of the matters which are the subject of this lawsuit will not be subject to punitive action, such as wage garnishment or seizure of their real
