WITNESSETH

WHEREAS, Article II, Section 16 of the 1987 Constitution provides for the protection and
advancement of the right of the Filipino people, to a healthful and balanced ecology;
WHEREAS, the DENR, by virtue of Executive Order No. 192 series of 1987 is the
primary
government agency responsible for the sustainable management and
development of the countrys environment and natural resources;
WHEREAS, the LGU, pursuant to Department Administrative Order No. 92-30, series of
1992, recognized the need to rehabilitate develop, manage, and protect the resources
found within the Central Cebu River Basin through collaborative management
;
WHEREAS,the LGUs share with the National Government the responsibility in the
management and maintenance of ecological balance within their territorial jurisdiction
subject to the condition as provided under the Local Government Code;

WHEREAS, the government has adopted integrated watershed management as a

national strategy for sustainable development per DENR MC 2008-05, Series 2008;
WHEREAS, the government recognizes the vital role of various stakeholders in the
protection, rehabilitation, development, management, and utilization of the natural
resources within the Central Cebu river basins;
WHEREAS, water and other natural resources within Central Cebu is recognized as vital
resources that needs to be properly managed to support the social and economic
development of Cebu;
WHEREAS, the people of Cebu recognize the urgency to satisfy the various accessibility
and water quality that influence the Cebuanos health, social welfare, and economic
progress;
WHEREAS, potential water for domestic, industrial and agricultural use is fast becoming
scarce with evident increase in salinity in the highly populated urban aquifers in the
lowland areas;
WHEREAS, the present state of Central Cebus river-basins, particularly those in Central
Cebu calls for immediate rehabilitation protection and conservation to improve the water
yield capacities of its aquifers and rivers to ensure sustainable water supply for
domestic, agricultural and industrial use;
WHEREAS, the National Water Resources Board (NWRB) is charged under Presidential
Decree No. 1067, otherwise known as the Water Code of the Philippines with the
functions of regulating the utilization, exploitation, development, control, conservation
and protection of water resources;
WHEREAS, Executive Order No. 123 transfers NWRB to DENR upon the approval of
the President of the newly revised organization and manpower structure of the NWRB
Secretariat, for purposes of administrative control and supervision;
WHEREAS, the Office of the President issued a directive creating the Inter-Agency Task
Force on Cebu Water Resource Management to provide the opportunity to partnership
and collaboration among concerned sectors of society for an Integrated approach in
water resource management to be facilitated by the DENR Region 7.
WHEREAS, the Inter-Agency Task Force on Cebu Water Resources Management finds
the need to form the Central Cebu River BasinsManagement Council to sustain and
ensure the coordinated development and management of water, land, forest and other
related river basin resources:;
WHEREAS, the process of and Integrated Water Resources Management promotes the
coordinated development and management of water, land and related resources in order
to maximize the resultant economic and social progress in an equitable manner without
compromising the sustainability of vital ecosystems;
WHEREAS, an important factor to sustain Cebus economic development is the effective
and efficient management of the river-systems, water distribution system, and equitable
user of water as a resource;
WHEREAS, the government agencies concerned with water resources recognize the
need to share responsibilities with the LGUs and Civil Society in the protection,
management and development of the river basin resources of the province in conformity
with existing laws and policies and in adherence to the principle of subsidiarity;

WHEREAS, the purpose and objective of the Central Cebu River Basins Management
Council is to address the urgent and critical water problem and attendant issues of land
use of the Islands of Cebu by effectively and efficiently integrating the development and
management of land, water resources, water supply and sanitation.
WHEREAS, the Body needs to create an Executive Committee responsible for the
coordinating function to be composed by the Archbishop of Cebu as chairperson
together with the Regional Executive Director of the Department of Environment and
Natural Resources;the Governor of the Province of Cebu, the the Mayor of Cebu City,
the Regional Director of the National Economic Development Authority, the Regional
Director of the Department of Interior and Local Government, the Regional Director of
the Department of Public Works and Highways, the General Manager of the Metro Cebu
Water District, the President of the Cebu Chamber of Commerce and Industry, the
Executive Director of the Cebu Uniting for Sustainable Water Foundation, and a
representative of the academe, as members.
NOW THEREFORE, for and in consideration of the foregoing premises, the Parties
herein commit to bind themselves and agree as follows:

1.

FORMATION OF THE COUNCIL

The Central Cebu River Basins Management Council (CCRBMC) herein referred
to as the Council is hereby established to function basically as a coordinative,
advisory and management bodyfor the Central Cebu River Basins.
The Council shall respect the mandates and authorities of the respective
government entities, inherent in their creation.
The Council hereby adheres to the Integrated Watershed and Ecosystems
Resource Management (IWERM) as an overarching strategy to environment and
natural resources management.
The Council adopts to the Integrated River Basin Management, Integrated
Watershed and Ecosystems Management (IWERM) and Integrated Water
Resource Management (IWRM) as approaches to development
The signatory parties to this Memorandum of Cooperation hereby constitutes the
general membership of the Council.
An Executive Committee is likewise established with the Archdiocese of Cebu as
represented by H.E. Most Reverend Archbishop Jose S. Palma, D.D. as
Chairperson together with the Department of Environment and Natural
Resources Region-7 (DENR7) as represented by its Regional Executive Director
Maximo O. Dichoso, the HonorableGovernor of Cebu, Cebu Province; the
HonorableMayor of Cebu City; the Regional Director of the Department of Interior
and Local Government (DILG), the Regional Director of the National Economic
Development Authority (NEDA), the Regional Director of the Department of
Public Works and Highways (DPWH), the General Manager of the Metro Cebu
Water District (MCWD), the President of the Cebu Chamber of Commerce and
Industry (CCCI), the Executive Director of the Cebu Uniting for Sustainable
Water Foundation (CUSWF), and a representative of the Academe, as members
of the Executive Committee.

The Executive Committee, upon the concurrence of the majority of the general
membership assembled, may create or dissolve committees, pass resolutions,
issue advisories, and call on members for coordination.

ROLES AND RESPONSIBILITIES OF THE PARTIES

A. The DENR-7 shall:

1.

Provide technical assistance to stakeholder LGUs in the formulation of

local policy and plan on sustainable ENR management/development as
well as in the implementation of ENR laws, rules, and regulations that are
within their mandate.

2.

Capacitate stakeholder LGUs in the implementation of sustainable ENR

management interventions within CCRB.

3.

Enforce and monitor the implementation of all Environment and Natural

Resources (ENR) laws, rules and regulations.

4.

Conduct research, development, and extension (RDE) activities related to

RB management including geo-hazard assessment and vulnerability
assessment (VA) in coordination with other research institutions and
disseminate information to all stakeholders.

5.

Implement and/or promote climate change adaptation and mitigation

measures.

6.

Develop advocacy on ENR laws, rules and regulations through effective

and efficient IEC.

7.

Manage development projects within CCPL and forestland areas within

the CCRB through the PAMB including ground delineation and zoning of
the PAs, implementation of the Integrated Protected Area Fund (IPAF),
and issuance of appropriate tenure instruments.

8.

Sustain and implement Gender and Development (GAD) programs.

9.

Allocate funds for DENR projects within CCRB operations.

10.

Manage database of CCRB and serve as the lead agency on linkage and
networking with various stakeholders on CCRB management and
administration.

11.

Primarily responsible for the management, conservation, and

development of forest lands and watersheds; and maintaining water
quality.

B. THE PROVINCIAL GOVERNMENT OF CEBU shall:

Provide technical, financial and legislative support to the cities and

municipalities;
Integrate Disaster Risk Reduction (DRR)/Climate Change Adaptation
and Mitigation (CCAM) into the Provincial Development Programs and
Framework Plan (PDPFP);
Establish a common final disposal facility for LGU clusters.

Provide assistance in the resource mobilization for CCRBMC activities

and operations.

C. THE CITIES OF CEBU, MANDAUE, TALISAY, DANAO, AND

TOLEDO AND THE MUNICIPALITIES OF MINGLANILLA, BALAMBAN,
LILOAN, COMPOSTELA, ASTURIAS, AND CONSOLACION shall:
1.

Appropriate funds for the CCRB programs/projects/ activities at the local

level.

2.

Formulate and enact appropriate local ordinance on ENR management

and sustainable development in the CCRB area.

3.

Implement/enforce local Sanitation Code, R.A. 9003, Water Quality Act,

and other laws, rules, and regulations related to ENR protection and
conservation in the locality.

4.

Monitor developers and investors compliance to R.A. 9003, Water

Quality Act, ECC, and other ENR laws, rules and regulations.

5.

Establish and operationalize a sanitary Landfill, material recovery facility,

and septage treatment facility.

6.

Formulate/develop and implement local environmental sustainability

framework plan, LDRRMC plan, and FLUP, among others.

7.

Institutionalize local offices such as Disaster Risk Reduction

Management Council (DRRMC), River Basin Organizations (RBOs),
Barangay Solid Waste Management Committee (BSWMC), and
Municipal Solid Waste Management Board (MSWMB).

8.

Organize, capacitate, and mobilize local Peoples Organizations (POs)

and/or community stakeholders for the conservation, protection, and
sustainable development of ENR in the locality.

9.

Conduct livelihood training programs and implement livelihood projects

which are environmentally sustainable, gender-based, and need-based.

10.

Support to green business industry of the business sector through

ordinances/environmental code.

11.

Contribute to knowledge base generation and management.

12.

Implement public dissemination program re: DRR as well as massive

IEC campaign programs on ENR in coordination with partner
institutions/organizations.

13.

Implement sustainable reforestation projects in partnership with various

stakeholders.

14.

Implement soil and water conservation measures such as gabion dams

construction, contour farming, protection, rehabilitation of easement
zones/riparian zones, and rainwater harvesting, among others.

15.

Implement community-based forestry projects and manage communal

forest with an area not exceeding fifty (50) sq.kms.and enforce forestry
laws, etc.

D. The Metro Cebu Water District (MCWD) shall:

1.

Provide potable water supply and sewerage system.

2.

Provide financial, logistical, technical support to CCRBMC

operations.

3.

Issue periodic advisories regarding water quality and supply and demand
by service area especially during abnormal situations.

4.

Provide and facilitate assistance to the regulatory functions of NWRB.

E. The Department of Agrarian Reform (DAR) shall:

1.

Provide support in the Information Communication and Education (ICE)

campaigns on ENR management.

2.

Organize and mobilize Agrarian Reform Communities (ARCs) within the

River Basins areas.

3.

Capacitate/provide technical assistance to ARCs in the development plan

preparation and in the integration of environmental best practices in
agriculture interventions.

4.

Access resources and prepare proposals for funding.

F. The Department of Agriculture (DA) shall:

1.

Ensure food security.

2.

Promotion of organic farming programs.

3.

Provide technical assistance for agriculture in the communities.

4.

To concretize and localize the National Convergence Initiative (NCI) in

the Central Cebu River Basins.

G. The Bureau of Fisheries and Aquatic Resources (BFAR) shall:

1.

Ensure fish production

2.

Provide technical assistance on aquaculture.

3.

Provide extension services.

H. The National Irrigation Administration (NIA) shall:

1.

Provide financial support to the Central Cebu River Basins projects.

2.

Provide technical assistance on irrigation projects.

The National Economic and Development Authority (NEDA) shall:

1.

Contribute to CCRBMC database management.

2.

Provide technical assistance in policy formulation, planning, and feasibility

study preparation.

3.

Source funds/mobilize resource.

4.

Provide assistance/support to DENR in the presentation of CCRBMC to

RDC-7.

J. The Department of Public Works and Highways (DPWH) shall:

1.

Provide technical support re: R.A. 9003 implementation.

2.

Implement rainwater collection programs.

3.

Mainstream gender sensitivity strategies in every agency program;

4.

Conduct public consultations.

5.

Conduct repair of damaged infrastructure.

6.

To facilitate the repair and rehabilitation of damage due to floods. control

retaining structures such as spur dikes, revetment etc.

J. The Department of Interior and Local Government (DILG) shall:

1.

Ensure the organization of solid waste management councils in each

LGU;

2.

Conduct capability building trainings;

3.

Provide expertise on IEC (policies/directives/Memo circulars).

4.

Ensure the organization of Local Disaster risk Reduction Management

Councils at LGU level.

5.

Conduct capacity building on management/disposal of wastes at the

agency level.

6.

Conduct community empowerment and mobilization.

7.

Implement community-based forestry projects and manage communal

forest with an area not exceeding fifty (50) sq km, and enforce forestry
laws, etc.

K. The Department of Health (DOH) shall:

1.

Provides information, education and communication activities for public

health.

2.

Provides technical assistance for water quality and assessments.

3.

Enforces the sanitation code in the Central Cebu River Basins.

L. The Department of Science and Technology (DOST) shall:

1.

Conduct research and development initiatives and technology transfers.

2.

Promote, assist and, where appropriate, undertake scientific and

technological research and development in areas identified as vital to the
country's development.

3.

Develop and implement programs for strengthening scientific and

technological capabilities through manpower training, infrastructure and
institution-building.

4.

Provide technical assistance in the development and maintenance of

an information system and databank on science and technology for the
Central Cebu River Basins.

5.

Undertake design and engineering works to complement research and

development functions.

6.

Promote, assist and, where appropriate, undertake the transfer of the

results of scientific and technological research and development to their
end-users.

M. The Philippine Atmospheric, Geophysical, and Astronomical Services

Administration (PAGASA) shall:

1.

Provides weather and climatic advisories for the CCRBs.

2.

P. The Department of Education (DepEd) shall:

Blend or integrate environmental education into the Philippine

Standards of Learning Competencies or the Curriculum.

Q. The Department of Finance (DOF) shall:

1.

Provides assistance on fund sourcing for CCRB operations.

R. The Department of Trade and Industry (DTI) shall:

1.

Provides technical assistance for livelihood /entrepreneurial programs

and product development.

Provides micro-financing programs for the communities.

3.

Promotes green economy.

S. The Technical Education and Skills Development Authority(TESDA)

shall:

1.

Provide support in the capability-building programs by providing globally

competitive skills training to communities and LGU technicians.

2.

Develop and integrate SWM and related programs in the skills training
curriculum.

3.

Adopt/integrate environmental best practices (i.e., rainwater catchment

and SWM) at TESDA office and training centers.

4.

Participate in ICE/advocacy programs, projects, and activities for river

management programs & projects.

5.

Participate in consultative bodies per invitation.

T. The Department of Tourism (DOT) shall:

1.

Develop and promote eco-tourism programs in the Central Cebu River

Basins.

2.

Shall be responsible to encourage, promote, and develop sustainable

tourism and eco-tourism as a major socio-economic activity to generate
foreign currency and employment and to spread the benefits of
sustainable tourism and eco-tourism within the Central Cebu River
Basins.

3.

To facilitate and provide technical assistance in the accreditation of

tourism enterprises and individuals.

U. The Department of National Defense/Armed Forces of the Philippines

(DND/AFP/PNP) shall:

1.

Provide support in terms of human resources and logistics.

2.

Provide assistance in human development programs of LGUs.

3.

Provide assistance in information dissemination especially in remote

areas.

4.

Secure and protect the people, vital installations, water resources

infrastructures, and government properties.

5.

Create an environment conducive to economic development.

6.

Provide assistance to partner stakeholders upon request.

W. The ACADEME shall:

1.

Develop advocacy and IEC campaign programs on sustainable ENR

development, protection and conservation measures including SWM,
SWC, IWRM, as well as DRRM.

2.

Produce IEC materials (using all media types: internet, radio, print, etc.)
in cooperation with the LGUs & Civil Society groups.

3.

Conduct RD&E on ENR management technologies and socio-economic

profiling in partnership with other stakeholders such as the DENR, LGUs,
etc..

4.

Develop models/design, contribute to knowledge base for the CCRB

management, and provide technical assistance to LGUs and CCRBMC
in the implementation of ENR management measures.

5.

Initiate or provide technical assistance in capability-building programs

(trainings and seminars).

6.

Develop and integrate community development and environmental

concepts in the curriculum.

X. The RELIGIOUS GROUPS shall:

1.

Formulate parish-based Solid Waste Management Plan and initiate

partnership with LGU in implementation.

2.

Organize chapel-based groups as alternative mechanism in SWM

implementation.

3.

Conduct faith-based environmental IEC campaigns/ecological

evangelization/spiritual-based value formation programs.

4.

Participate in multi-sectoral DRRCs and local River Basin Organizations

(RBOs).

Y.

The CIVIL SOCIETY GROUP/NON-GOVERNMENT ORGANIZATIONS

(NGOs) shall:

1.

Provide technical assistance/advisory on CCRB planning, monitoring,

and evaluation, and provide paralegal services to partner stakeholders
on ENR concerns.

2.

Conduct RD&E on ENR management technologies in partnership with

other stakeholders, develop models/designs, and contribute to
knowledge base for the CCRB management.

3.

Implement upland community development projects in partnership with

other stakeholders and integrate ENR sustainable management
interventions in these projects.

4.

Provide assistance in capability-building initiatives of partner

stakeholders re: CCRB management.

5.

Provide assistance in massive IEC campaigns and/or develop advocacy

re: CCRB management in terms of sustainable ENR practices.

6.

Provide technical assistance on community organization, mobilization,

and capital build-up.

7.

Participate in multi-sectoral DRRCs.

8.

Collaborate with various stakeholders and/or participate in sustainable

ENR management programs of the government.

9.

Develop advocacy among business sector and support massive IEC

campaigns on sustainable ENR.

10.

Actively participate in or support government programs on socioeconomic development of upland communities and in the sustainable
development of the ENR within CCRB.

and operations.

NOW THEREFORE, for and in consideration of the premises, the Council hereby agrees
to perform the following, to wit:

1.

Harmonize the activities of all local government units and government

agencies respective of their mandates as well as the efforts of civil society
groups to undertake Integrated River Basin Management and Integrated
Water Resource Management;

2.

Undertake the collection process and dissemination of data including

maps on land and water resources as quantitative inputs to decision

support systems that the body may utilize for decision-making on water
resources and river basins programs and projects;

3.

Promote broader multi stakeholder participation and involvement in water

resources and river basins through proper mechanism to improve
governance;

4.

Initiate the review of water resource and river basin management policies
and recommend appropriate amendments for consideration and possible
adoption by the concerned agencies and appropriate bodies; and

5.

Create committees/sub-Committees and /or technical working groups as

may be necessary to discharge its functions effectively.

OTHER TERMS AND CONDITIONS

This agreement may be revoked in whole or in part for the purpose or reason of noncompliance and/or violation of the terms and conditions mutually agreed upon by the
parties.
This agreement is subject to periodic review and the provisions hereof shall only
terminated within the effectivity period by mutual consent of all parties concerned.
