Memorial Day throughout the Nation By Jack Mc Cabe

ts the summer of 1865 in


Waterloo, New York, and
druggist Henry C. Welles

had an idea. The Civil War


had just ended, and Welles
idea was to place patriotic

flowers on the graves of soldiers who had died for the


cause. Nothing happened
about this thought until the
spring of 1866, when Welles
brought his plan to Civil War
hero General John B. Murray,
who completely supported the
idea. In a committee run by
Welles and General Murray,
on May 5, 1866, the village of
Waterloo was decorated with
evergreens and mourning
black, along with flags at halfmast. Ceremonies and the
decorating of graves took

place at three cemeteries, as


residents, civic society members, and veterans marched to
and from the grave sites led by
General Murray and martial
music.
Waterloo celebrated the
following year on May 5, then
joined with other communities in holding the observance
on May 30, 1868, in accordance with General Order
Number 11 by General
John A. Logan, National
Commander of the Grand
Army of the Republic. This

first observance saw flowers


placed on the graves for
Decoration Day of both
Union and Confederate soldiers in Arlington National
Cemetery.
This is one of many stories as to how Memorial Day
began with several cities and
towns claiming to have started the holiday. Womens
groups say that they were decorating graves in the South
before the Civil War ended,

Married couple gets divorced yet stays together so what changed?

has
changed, in fact, a
lot more than you
might think, at first glance.
Firstly, the couples friends,
family and acquaintances are
confused as to why they got
divorced in the first place,
given that nothing has really
changed in their eyes.
However, there is a major
change in the eyes of the state
and federal governments,
employer retirement plans
and the tax treatment of any
former spouse beneficiaries of
any life insurance policies and
annuities. This change is a
really big deal, indeed!
Whether or not this couple resides under the same
roof, they are legally no longer
married in the eyes of the law
and no longer entitled to the
tremendous spousal benefits
at the death of the first spouse.
IRAs allow for a non-taxable
spousal rollover that disappeared with the divorce
decree. A non-spouse, named
as the employers 401k or pension plan beneficiary, will no
longer enjoy the right to rollover the proceeds of the
account into their name taxfree. Ex-spouses can no longer
roll-over the proceeds of a
non-qualified tax-deferred
annuity without paying tax on
the deferred gains in the
account.
Ex-spouses can no longer
take advantage of spousal discounts in the purchase of a
long-term care policy. Ex-

spouses may lose the pension


benefits of their former
spouses pension plan due to
their divorce as well, whether
receiving benefits currently or
at their ex-spouses death.
And if married less than a cer-

tain period of time and


divorced, they might lose
spousal Social Security benefits as well!
State and Federal Estate
Tax rules allow for the tax-free
passing of assets between
spouses; this too would be lost
upon divorce. This one item
may trigger the largest loss to
the survivor of the former

married couple.
These are but a few of
the items that change when a
couple gets divorced and for
all intents and purposes,
remain married as was
before. There may be a lot at

stake that perhaps the attorney forgets to mention when


first approached by a married
individual looking to discuss
divorce.
Upon a divorce, employer retirement plans usually
result in a negotiated settlement to the non-employee
spouse called a Quadro, the
acronym for a Qualified

Domestic Relations Order.


For couples that remain
together yet get divorced, this
could very well be a bitter pill
as the benefits offered by the
current plan may not be surpassed or duplicated in an

IRA or the recipient spouses


employer 401k plan. This is
one serious area that might be
considered when contemplating divorce, if the future is to
be that the couple remain
together.
Then there are the legal
expenses incurred by both
parties to consider. If there is
no big, glaring, overwhelming

reason or many reasons to get


divorced and after considering
the points brought to light in
this column, maybe planning
a divorce should be postponed, if the couple desires to
remain together as a couple
anyway.
Divorce rate statistics are
very high in our society. Just
ask any school age child how
many of his or her peers parents are divorced and the
numbers may frighten you.
Lets also not forget the cost of
duplication, the purchase of
another home and everything
that goes into it from pots and
pans, sheets and towels, furniture, utility bills and property
taxes too. After contemplating everything involved, you
might even find your spouse a
little more agreeable to live
and work with. If not, you
may always remain friends or
friendly as the case may be.
Divorce is much more
that a legal battle; it has consequences of taxation, income
today and tomorrow as well as
quality of life. In my career,
Ive counted more than a few
couples who were former married couples now living
together, with caring feelings
for each other that would be
better served in the future
when one passes if they
remained married. The good
news is for a few dollars and
an appointment at the courthouse, they can marry again.

IRS warns: Thats not us calling you

any communication
about your tax return and
verify that the query is actually
from the IRS. Why the need
for caution? The contact may
be from a bogus IRS agent who
intends to steal your financial
identity.
The scam can take many
forms and often starts with an
official-looking e-mail complete with IRS logo that warns
you of a problem with your
return. To correct the situation,
youre instructed to click on an
embedded link. The link sends
you to a website that asks a
series of personal questions.

Simply note the callers information and disconnect.


Whether youre contacted by e-mail, phone call, or
standard mail paper notice,
please call our office immediately. Well help you determine
if the communication is real
or not and guide you on the
best way to respond.

Answers you supply can be


used to file fraudulent tax
returns or extract money from
your bank accounts.
Another tactic is a phone
call from a fake IRS agent
demanding
information.
Sometimes the phone call will
follow a recent e-mail intended
to make the communication
seem legitimate. The caller
might even know the last four
digits of your social security
number.
Here is what you need to
remember: The IRS will never
initiate contact with you by email.
How can you stay safe
from scams? If you receive an
out-of-the-blue e-mail purporting to be from the IRS, do not
click any link or reply in any
way. If you receive a phone call
about your tax return, do not
provide any personal details.

5 signs your home insulation is not working

ome insulations can lose


performance over time,
sustain damage or simply
no longer meet updated building codes. Its an issue that can
be costly, because if your
homes insulation isnt doing its
job, you could be wasting
money and resources.
You dont have to be a
trained professional to know
you have a problem. Here are
several signs that your insulation is lacking:
1. Energy bills - High energy
bills are the biggest red flag,
especially relative to the size,
age or condition of the home. If
you have a run-away energy
bill, your insulation may need
to be upgraded. This can be the
case, even in a newer home.

2. Drafts - Do you need to put


on a sweater even with the
heat on, or does your air conditioner run incessantly without
making enough of a difference?
Thats a sign of a deficiency in
your building envelope.
3. Inconsistent temperatures Is it warm in one room, but
cold in another? Are your walls
or interior closets cold to the
touch? Its possible that while
your whole home may not need
attention, certain rooms may
need to be addressed.
4. Condition of insulating
materials - Consider the age of
your insulation. Would it stand
up to todays building codes? Is
it in good shape or is it crumbly? If your insulation has
degraded or isnt performing,

its time for an upgrade. But be


careful, as certain types of older
insulation, such as Vermiculite
insulation,
may
contain
asbestos. If youre unsure, do
not disturb it and hire a professional to conduct testing
and/or removal. This should
not be a do-it-yourself job.
5. You detect pests and/or
moisture - Insulation and
your building envelope can be
compromised by the presence
of pests. Moisture is an even
bigger obstacle to optimal
thermal performance, as some
types of insulation can sag or
collapse when damp, leaving
voids and causing air to flow
in and out of the building
envelope.
While some solutions

may be more complicated,


requiring the opening of the
existing wall cavities, others
can be addressed more easily.
The best way to improve thermal performance and increase
energy efficiency is to upgrade
attic
insulation.
Laying
Comfortbatt insulation over
existing material to achieve a
minimum depth of 16 inches,
or an R-value of R50, is a simple DIY project that can generate immediate results. To fully
assess your home and explore

Take some time out from
multitasking. The ability to
multitask is a cherished commodity for parents and working

and women can benefit from

Something as simple as focus-

The time has come for grill masters to gear up

rilling season has


returned for the millions of people who
live in regions where grilling is
unlikely to happen during the
winter months. While standard
fare like hot dogs and hamburgers may suffice for backyard
barbecues with lots of friends
and family, when the party is
smaller, grill masters may want
to up their games and try their
hands at something new. Tritip steak is cut from the bottom
of the sirloin and is popular on
the West Coast of the United
States, but this cut, which is
suited to marinating and rubbing, can be enjoyed anywhere.
Those who want to give
tri tip steak a shot may find it
sold as bottom sirloin roast in
their local grocery store or
butcher shop. But once you
find the right cut, the following
recipe for Grilled Tri-Tip with
Black Olive Aioli courtesy of
Bill Niman and Janet Fletchers
The Niman Ranch Cookbook (Wiley) is sure to please
you and your guests the next
time you fire up the grill.
Grilled Tri-Tip with Black
Olive Aioli
Serves 4 to 6
1 tri-tip steak, 2 pounds
1 tb olive oil
2 tbs fresh rosemary leaves,
chopped
1 tb freshly cracked black pepper
cup finely chopped pitted
oil-cured black olives
1 cup aioli (see below)
1 tb coarse sea salt
Cayenne pepper
Place the steak in a small,
nonreactive baking dish.
Combine the olive oil, rosemary and black pepper in a

small bowl and stir well. Rub


the mixture evenly over the tri
tip. Cover with plastic wrap
and refrigerate for at least 8
hours or up to 24 hours.
Remove the tri-tip from
the refrigerator 1 hours before
cooking.
Prepare and light a charcoal grill for direct cooking.
Add the olives to the aioli
and season with cayenne.
When the grill is at its
hottest (when the coals are red
and glowing and its too hot to
hold your hand over the grill
for more than a couple of seconds), remove the tri-tip from
the marinade, wipe off any
excess marinade, and season on
both sides with sea salt. Place

the steak on the cooking grate


directly over the coals, cover
the grill, and cook, turning
once, for about 20 minutes, or
until a thermometer inserted
into the thickest part reads 130
F for medium rare. Transfer to a
cutting board and let rest for 5
to 10 minutes.
Cut the tri-tip into thin
slices across the grain and
arrange on a platter. Serve with
aioli.
Aioli
Makes about 1 cup
1 small clove garlic
tsp kosher salt
1 tsp Dijon mustard
2 tsp fresh lemon juice
2 egg yolks
1 cup olive oil

To make by hand, chop


the garlic and salt together on
a cutting board until a paste
forms. Transfer to a deep mixing bowl and wrap a damp
towel around the base of the
bowl to keep it from sliding
around the counter as you
work. Whisk in the mustard,
lemon juice and egg yolks.
While whisking continuously
and vigorously, add the olive
oil in a slow, thin, steady
stream until all of it has been
incorporated and the mixture
is thick and completely emulsified.
To make the aioli in a
food processor, place the garlic
and salt in the work bowl and
process to chop as finely as pos-

sible. Add the mustard and


lemon juice and pulse to combine. Add the egg yolks and,
with the motor running, add
the olive oil in a slow, thin,
steady stream until all of it has

been incorporated and the


mixture is thick and completely emulsified.
Cover and refrigerate for
up to 24 hours until needed.
