APPLICATION
PETITIONER, through counsel hereby respectfully applies to
have the land hereinafter described brought under the operation
of the Land Registration Act (Act 496) and the Property
Registration Decree (P.D. No.1529), as amended, and to have the
title thereto registered and confirmed:
1. That the applicant is the owner in fee simple of Lot No.
____, a certain parcel of land located in the City of Talisay,
Province of Cebu, and is situated, bounded and described
as follows:

A machine copy of the narrative technical description of
Lot ____ is attached and made an integral part of this
application as Annex A.
2. That the said parcel of land is assessed for taxation
purposes for the current year in the amount of
__________________, Philippine currency. A machine copy of
Tax Declaration No. ____________, which covers Lot _____ is
attached and made an integral part of this application as
Annex B.

3. That to the best of the knowledge and belief of the


petitioner, there is no mortgage or encumbrance of any
kind whatsoever affecting said land, nor any other person
having any interest therein, legal or equitable, in
possession, remainder, reversion or expectancy;
4. That the applicant has acquired said land in the following
manner:
4.1. Petitioner acquired the subject property from
GEORGE T. OQUIAS by virtue of a Deed of Assignment
dated March 20, 2013. A copy of the said Deed of
Assignment is hereto attached as Annex C.
4.1. He acquired the subject property by sale between
the applicant and FLORA O. FIN on August 11, 1989. A
copy of the Deed of Sale evidencing the said
transaction is hereto attached as Annex C-1;
4.2. FLORA O. FIN acquired the subject property by sale
from JULIANO L. PAYONO on April 28, 1981. A copy of
the Deed of Sale evidencing the said transaction is
hereto attached as Annex C-2;
5. That the subject land has no actual occupants and is in
fact possessed and occupied by herein applicant;
6. That the names in full and address, as far as known to the
undersigned, of the owners of all adjoining properties, are as
follows: South East by lot owned by Rosario Sepulveda with
address at Lapu-Lapu St., Danao City; North West by lot owned by
Guillermo Quindao with address at Cambiohan, Danao City; North
East by lot owned by Wilfredo Ypil with address at Mabini St.,
Danao City, Felix Barriga with address at Mabini St., Danao City,
and Emiliano Gonzales with address at Cebu City;
7. That the said parcel of land is the property of the
applicant and is not bounded by any road or street;
8. The Applicant is a Domestic Corporation organized and
existing under Philippine Laws with principal office address
located in No.12, Dagohoy St., San Antonio Viallage II, Banilad,
Cebu City, and is hereby duly represented by its President,
CHRISTY SANDY G. MICHAEL, by virtue of a Secretarys Certificate
is attached and made an integral part of this application as
Annex D.
9. That the following documents are attached and hereto

made an integral part of this application:


a. Approved tracing cloth plan of Lot No. _________ (Annex
E)
b. Technical description of Lot No. ________ (previously
attached as Annex A)
c. Certification from the Department of Environment and
Natural Resources Community Environment and Natural
Resources Office that Lot _____ is within the Alienable and
Disposable Block ____, Land Classification Project No. ____
(Annex F)
d. Certification of Non-Availability of Geodetic Engineers
Certificate (Annex G)
e. Certification from the Department of Environment and
Natural Resources Community Environment and Natural
Resources Offices that Lot No. ____ is not covered by any
subsisting public land application; (Annex
f. Survey Plan, as approved by the Bureau of Lands (Annex
g. Tax Clearance Certificate issued by the City Assessor of
Talisay (Annex
h. Certificate of No Encumbrance issued by the City
Assessor of Talisay (Annex
i. Court Clearance issued by the Office of the Clerk of Court
of the Regional Trial Court and Municipal Trial Court of
Talisay City (Annex ___ and ___, respectively)
j. Certified true copy of Tax Declaration No. _____ (Annex
xxx
PRAYER
WHEREFORE, it is most respectfully prayed of this Honorable
Court that, after due notice, publication and hearing, the said Lot
No. ____, _____ Cadastral be registered in accordance with law and
a certificate of title be issued covering the aforementioned parcel
of land in the name of the applicant, ______________.
If the Property Registration Decree, Presidential Decree No.
1529, be not applicable, the applicant, in the alternative, hereby
applies for and invokes the benefits of the Public Land Act,
Chapter VIII, Section 47 and Section 48, paragraph b of
Commonwealth Act No. 141, as amended.
The applicant further prays for such other reliefs and
remedies as may be consistent with law, justice and equity.
