BUGusa, Inc., Worksheet

Use the scenarios in the BUGusa, Inc., link located on the student website to answer the
following questions.

Scenario: WIRETIME, Inc., Advertisement

Has WIRETIME, Inc., committed any torts? If so, explain.
Yes, because the tort is classified as strict liability which states where a tortfeasor
may be held liable for acts regardless of intent or willfulness such as defective products.
WIRETIME Inc made this false allegation with no evidence what so ever.

Scenario: WIRETIME, Inc. (Janet)

Has WIRETIME, Inc. committed any torts? If so, explain.
Yes, because the tort is classified as intentional tort is where the tort feasor was
willful in bringing about a particular event that cause harm to another party. WIRETIME
Inc. knows that Janet is in a legal and binding contract with her current employer but they
are still willing to ignore the agreement for personnel gain.

Scenario: WIRETIME, Inc. (Steve and Walter)

Discuss any liability BUGusa, Inc., may have for Walters actions.
Walter should have not kept Steve hostage in a sound proof room and integrated him
about what kind of information he was reporting to WIRETIME. BUGusa took on many
different liabilities; the first problem was that he held an employee hostage and didnt

allow him to leave. Steve could come back and file a law suit stating that he was held
hostage at work by another employee and due to this he now suffers from anxiety,
claustrophobia, and mental anguish. BUGusa could have dealt with the situation better.
They could have filed a lawsuit against Steve and WIRETIME for spying. BUGusa was
already in the papers for the condition of their products. No one wants to support a
business that keeps their employees hostage for 6 hours and questions them.

Scenario: BUGusa, Inc., Plant Parking Lot

What defenses may be available to BUGusa, Inc.? Explain your answer.
In the defense to BUGusa, the vendors do not work for the company. The vendor that
was waiting for the dock associate to come back from his lunch break should have waited
in his car instead of waiting by the dock doors, especially if he saw that the light was
dimming out. BUGusa was a lit area and took the necessary steps to ensure that their
employees wasnt walking around the parking lots, or behind the building in the dark.
Everyone in Shady Town knew of the recent robberies and was made aware that BUGusa
property was being hit. It was known that cars of the employees were being vandalized in
the parking lot. It is saddening that the vendor was attacked waiting for a BUGusa
employee, however, BUGusa doesnt have any liability for another persons actions.
