Squad, Crime Branch Delhi. Photocopy of the file was handed over in
my office by SI Devinder, the IO of case FIR No. 106/13. Thereafter, I
perused the documents in the case file. I also perused the statements of
the police witnesses comprising of SI Virender, ASI Jaswinder, ASI
Ranjeet and other police staff. After having being satisfied that the
accused Sunil Nayak @ Fundi @ Bunty @ Kabir, S/o Sh. Lal Chand has
committed an offence punishable under Section 186 IPC amongst other
offences I accorded sanction for prosecution of the accused for
obstructing the police personal in discharge of their official police duties
and accused did not follow the lawful instructions given by the police
public servants while on duty.

The complaint under Section 195 was

given by me which is typewritten on 08.08.2013 same is now Ex.PW9/A

signed by me at point A.

On 08.11.2012 I was posted in PS Vasant Kunj (N).

complaint now Ex.PW12/A [OSR] was received by me having being

marked to me by the SHO. After going through the complaint I have
made endorsement Ex.PW12/B I had prepared a rukka and the same was
handed over to DO HC Vijay Pal Singh for registration of the case.
After registration of the case copy of FIR Ex.PW1/A and the complaint
was handed over to me by the DO in the PS itself.

I investigated and

tried to find out the whereabouts of Sweety but she could not be found.
I had produced the witness Sweety in the court and her statement under
Section 164 Cr.P.C dated 18.12.2012 Ex.PW2/DA was got recorded.
Thereafter, Sweety had given another complaint in the PS

dated

06.01.2013 Ex.PW2/B. In the compliant Sweety had alleged that she

was forced to give such a statement under Section 164 Cr.P.C by the
accused persons and his relatives. On receipt of the complaint another
application was filed by me in the court for again recording the
statement of Sweety under Section 164 Cr.P.C and thereafter, another
statement dated 24.01.2013 was got recorded in the court of Ms. Chetna
Singh, Ld. MM Delhi which is Ex.PW2/A. Since, there were allegations
of rape hence Section 376 IPC was added

and thereafter, the

investigations were handed over to W/SI Kailash Kain.
