Some quick points on the exclusive jurisdiction of the Bangsamoro

Government over Lake Lanao.

The aspects of jurisdiction of the Bangsamoro government over Lake


Lanao are of two kinds. One is its exclusive jurisdiction in the aspect of
environment protection, while the other pertains to power
generation.

Section 3 (15) Article V of the proposed organic law states that The
Bangsamoro Government shall have authority to regulate power generation,
transmission, and distribution operating exclusively in the Bangsamoro and not
connected to the national transmission grid. xxx when power Generation,
transmission, and distribution facilities are connected to the national
transmission grid, the Central government and the Bangsamoro
Government shall cooperate and coordinate through the intergovernmental
relations mechanism.

Our Contention: Because of the important role that Lake Lanao plays in the
power supply industry in Mindanao, there should be a clear delineation as to who
between the Central and the Bangsamoro government should manage.
Otherwise, all stakeholders of the energy industry in Mindanao, will be at the
mercy of the Bangsamoro government.

The scenario of the Bangsamoro government claiming an all exclusive


jurisdiction over Lake Lanao is not unlikely to happen considering the behavior
of the people from the Lanao Region when the Member-Consumers of
LASURECO intentionally refused to pay their electric bill on the contention that
they own Lake Lanao. Their perspective over their ownership on Lake Lanao will
affect the interest of the Mindanao Stakeholders on Energy considering that Lake
Lanao is one of the main sources of the Agus-Pulangui Hydropower Complexes
(APHC) which supplies more than 50% of the power supply in Mindanao.

Worth noting is the fact that the APHC is the cheapest energy source in the entire
country making electricity rates in Mindanao cheaper compared to the Luzon and
the Visayas Regions.

Why we support the MINPOCOR bills? APHC will continue to be in the hands
of a Government Owned and Controlled Corporation that will own, manage, and
operate the Agus-Pulangui Hydroelectric Power Complexes (APHC). The

continued ownership of the government over APHC will assure a cheaper energy
generation rate compared to the rate should it be privatized.

WHAT WE WANT TO BE ASSURED AS A STAKEHOLDER IN THE POWER


GENERATION ASPECT OF LAKE LANAO? with the recent passage of the
pending Mindanao Power Corporation bills, specifically the consolidated bill on
House Bill No. 676, House Bill No. 2621, and House Bill No. 4883 in the House
Committee level, it is respectfully suggested that the Mindanao Power
Corporation, the proposed Government Owned and Controlled Corporation that
will own, manage, and operate the Agus-Pulangui Hydroelectric Power
Complexes (APHC), shall not be deviated with any of its powers to secure the
necessary resources to operate the APHC from Lake Lanao and the Agus River.
It should not be prevented from maximizing the capacity of the hydroelectric
power plant so it can continue to give cheap electricity rate in Mindanao,
essentially benefitting our poor consumers.
