Application of Act no. 474/2005 Coll. of Slovaks Living Abroad and on amendments to certain laws
When issuing a certificate of a Slovak living abroad
National Council of the Slovak Republic approved the Act. 474/2005 Coll. of Slovaks Living Abroad and on
amendments to certain laws (hereinafter the "Act no. 474/2005 Coll."). The Act came into force on 1 January
2006. This Act regulates the competence of state administration in matters relating to, inter alia, relations
between the Slovak Republic and the Slovaks living abroad.
I.
1.

Definitions For the purposes of the Act

According to 2. a) of that Act, the Slovaks living abroad means a person who does not have
permanent residence in the Slovak Republic and

a.

a citizen of the Slovak Republic or

b.

not a citizen of the Slovak Republic, but kept the national consciousness, and he or his ancestor in the
direct line (parent, grandparent or great-grandparents) has / have Slovak nationality.

Permanent resident 's stay in place permanent residence allowances (Law no. 253/1998 Coll., on the reporting
of citizen of the Slovak Republic and the population register of the Slovak Republic). The application for a
certificate the applicant shall indicate the permanent address identical to the address of permanent residence,
which is included in the travel or identity document.

Slovak nationality shall be proven by original official document or an officially certified copy, containing a record
of Slovak nationality of the applicant or his direct ancestors (this figure can be put on the official document,
which is especially - birth certificate, baptismal certificate, extract from register, marriage certificate, certificate
of citizenship or a certificate of permanent residence; school report, etc.).

National awareness means active demonstrations of being the Slovak nation and recognition of values
representing the Slovak language, Slovak cultural heritage and traditions. National awareness is evidenced by
a document or declaration by the applicant demonstrable results of his public activity, or written testimony
compatriots' organization operating at the place of residence of the applicant, and if such organization or
association in his place of residence does not act, the written testimony of at least two Slovaks living abroad
who have Stay in the same state of fact concerning the applicant's national consciousness. National awareness
is evidenced through the mastery of the Slovak language and personal interview at application.

The applicant for the Certificate of Slovak living abroad (the "Certificate") - a person who qualifies
under Law No. 474/2005 Coll., Shall attach to the application:

1.

to demonstrate the Slovak nationality of any official document referred to in paragraph I / 3, the terms of

the original document that the applicant returns after proving the office or the relevant embassies and
consulates abroad;
2.

to establish a national awareness of any of the documents referred to in point I / 4;

3.

Two color photographs with dimensions of 3.5 x 4.5 cm (not produced in fotoautomatoch);

4.

photocopy of valid passport or a valid identity document of the applicant , where the personal data,

photographs, a number, a series of document and its validity in order to have the correct personal data in the
certificate;
5. The certificate may be issued at the written request of the applicant - a person who
a) it has not been convicted of an intentional criminal act or an act under the laws of the Slovak
Republic intentional crime;
b) has no activity detrimental to the interests of the Slovak Republic.
Documents confirming the integrity of the applicant
a.

extract from the Slovak Republic, certifying that the applicant has not been convicted of an intentional
criminal act or an act under the laws of the Slovak Republic an intentional offense. This document is valid for 6
months

from

the

date

of

issue. Information

about

applying

for

criminal

record

are

at:

www.genpro.gov.sk (foreign applicant may apply for a criminal records of the Slovak Republic through the
Embassy together with payment of the appropriate consular fee) ;
a

a similar confirmation as criminal records of the Slovak Republic, issued by the competent authority, which the
applicant is a citizen or in which the applicant resides (third country outside the Slovak Republic and their home
country). Confirmation in a foreign language must be officially translated into Slovak.
The documents accompanying the application must be legible (including stamps on documents) and must be
officially translated into the Slovak language (including stamps, signatures and official stamps, the official
translations of documents in the Slovak language or other official certificate). If the documents are issued in the
Czech language, a translation into Slovak language is required.
An application for a certificate shall be filed with the Office for Slovaks Living Abroad (hereinafter the
"Authority"), Radlinskho 13, 817 80 Bratislava 15, or abroad at the Slovak Embassy or consular office
of the Slovak Republic (hereinafter referred to as "representative office" ) in the state of residence of
the applicant.
If the applicant requests the certificate and their minor child (under 18 years), it shall attach to the application
the child's birth certificate with an official translation into Slovak. The applicant must also attach to the
application a written consent of the other parent of a minor child with his registration certificate to the
applicant. Signature of other parent in this written consent must be notarized, and if it was drawn up in a foreign
language must be officially translated into Slovak.
If it is to issue a separate certificate for a child under 18 years is required to the application a written consent of
his legal representatives or its officially appointed guardian, with the issuance of a certificate to the applicant,
which must be signed by the legal representative of the Office verified the fact that if the agreement drawn up in
a foreign language must be officially translated into the Slovak language (parental consent executed in the
Czech language is not necessary official translation into Slovak).

The Office shall decide on the request of the applicant within 60 days of receipt of the application to the
Office, even if the application has been lodged at the Embassy. Applicant submits the application together with
all required documents.
The applicant takes the certificate issued to the authority or the relevant embassies. The applicant at the
personal submission of applications to the Office or at the Embassy indicated on the appropriate forms and
certificates issued to personally assume office or embassies.
The certificate, which proves the status of a Slovak living abroad is valid only in Slovakia and only with a valid
identity card or a valid travel document.
In case of loss, destruction or damage certification or change in the data included therein (eg. Change of name
at marriage, etc.) Certificate holder may apply for a new certificate. To obtain a new certificate is required in
addition to these reasons, repeated issue of the certificate accompanied by relevant official documents (eg.
The proof of reporting the loss or theft issued by the competent police authorities, evidence of change in the
particulars of the applicant, marriage certificate, etc.), A photocopy of a valid travel or identity document and
one color photo with the dimensions given in paragraph II / second In case of issue of the certificate, in which
the changes occur statement been more than six months should be added to obtain a new certificate and proof
referred to in point II / 4thAlso in case of loss, destruction or damage certification or change in the data is the
application procedure the same as in the initial request. It is served either directly or through the Office of the
Embassy of the Slovak Republic abroad.
According to 4 ods. 6 point. h) of Act no. 474/2005 Coll. The Office shall keep a register of certificates issued
under 7th
Office simultaneously warns applicants that when the request is appropriate to include a temporary address or
the contact address of the applicant in the Slovak Republic (name, street, number, city municipality, phone
number or e-mail).
The administration fee for issuing the certificate
By law the Ministry of Finance no. 145/1995 Coll. on administrative fees, as amended, item 265 Administrative
Charges Tariff annexed cited law, an administrative fee shall be paid and collected upon application as follows:

For the collection of application fee and issue the relevant consulates and embassies abroad, the same applies
to item 265 tariff of administrative fees above law.
