Introduction
Latam Commons 2008: Public Domain, Creative Commons, and Open Education was held
in November 2008 in Santiago, Chile. It was organized by the Chilean NGO Derechos
Digitales, with support from the DUOC of the University of Chile, and jointly financed by
Derechos Digitales and ccLearn, the education division of Creative Commons. The event
brought together participants from eight countries in Latin America, and had an ambitious
participatory format that took advantage of the knowledge and experience of the
participants and guests in the discussion of three distinct, but related, themes.

Meeting of Creative Commons Latin American Leads

The various leaders of Creative Commons jurisdictions in Latin America met face-to-face,
providing visible evidence of the network of people that has made the international
expansion of Creative Commons possible. The presence of Creative Commons project
leaders from across Latin America marked the first focused meeting of Creative Commons
representatives in the region. As a group, these people have worked to "port" the licenses
to their local jurisdictions and to publicize and promote Creative Commons' work. The
dialogue demonstrated that even beyond the initial work of porting the licenses, these local
chapters of Creative Commons and their leads are playing an important role in their own
countries in raising awareness of law and technology issues, both relating to intellectual
property and to privacy, educational and cultural rights, and more. The meeting showed the
ways in which this community is becoming increasingly visible as a regional point of
reference for its views on technology adoption, legislative changes in law and technology,
and the visibility of technological practices in local social contexts.
The group recognized that maintaining relationships with the artistic and technology
communities is important to Creative Commons' work, although some actors in these
communities--such as collecting societies that consider open licenses as a foreign intruder-may be opposed to discussions of open licensing or other changes in the sector. Likewise,
the leaders confirmed that maintaining sustainable sources of funding was a consistent
challenge for the development of regional chapters. Regarding governance, the group
raised questions about the future of the international structure of Creative Commons. In
particular, there were concerns about the levels of support for projects that allowed for
greater presence in the regions and the inclusion of truly democratic and participatory
processes that, among other options, can facilitate the operation of specific initiatives
designed for a given region.
For some chapters, much of their activity after completing the license porting process has
focused on issues related to the adoption of licenses and the educational sector. However,
all the chapters also work to raise awareness of issues related to law in technology-related
fields, and some have begun projects to modify public policies or legislation in their
countries. All agreed that the possibility of developing projects relating to issues of

common interest to the Creative Commons chapters throughout the region was something
that should be explored.
This dialogue, which also included staff from the central Creative Commons organization,
demonstrated the achievements of the Latin American regional chapters, but also
highlighted the principal challenges and obstacles facing the movement. The meeting
highlighted questions regarding the future paths of the chapters and the challenges facing
the chapters in areas such as funding, governance, and goals. The issues discussed
reflected, in large part, the characteristics of the distributed network of volunteers, and were
representative of the sustainability and programmatic challenges confronting many Creative
Commons chapters around the world.

Open Education Workshop

There is broad recognition in the education sector that new standards are necessary to
facilitate the integration of new technological capacities into educational practice. In fact,
educational issues recurred throughout the meeting of the Creative Commons Latin
American leads. The concept of "open education" in this region is an important and crosscutting theme, and as the use of new information and communications technologies (ICTs)
increases in the region, it is apparent that new legal approaches are needed to take
advantage of these technological innovations.
Against this background, the second day of the encounter in Chile was dedicated to the
topic of open education. In addition to the participation of the regional Creative Commons
chapter leaders, the event invited participation from Chilean educators, librarians, editors,
and activists with an interest in the theme.
The day's events utilized an open structure to facilitate the sharing of knowledge and
experiences among participants. The workshop served as a platform to begin work on
concrete projects in open education and openly licensed educational materials, and worked
to deconstruct the idea of openness.
The participatory methodology of the workshop dedicated to open education began with a
session in which participants brainstormed ideas related to open education that they
wished to discuss. These shared ideas later served to construct an agenda for the further
development of the dialogue. The list of themes and ideas elaborated by participants for
discussion included the following points for discussion (in no particular order, and without
eliminating repetitions):

Volunteers grouped the proposed points in five (5) broad categories to be further explored
as points in the agenda in sessions facilitated by some of the participants. The agenda for
the following part of the day was developed as follows:
1. Open access to information

Facilitated by Pedro Mendizbal (CC Peru)
The five tracks proceeded simultaneously, permitting participants to choose which
workshops to attend. Each of the themes was introduced by the facilitator, who then
moderated the participation of the people in each group to promote discussion and
dialogue. The goal of each session was to reach a shared understanding of the ideas and
concepts, and of the possible ways forward as a region. Brief summaries of the dialog
within each group were then shared with the rest of the participants to prepare the
participants for the group exercises to follow.
The activities revolved around concepts and ideas related to "openness" (open access,
open education, and free licensing), with the new dynamics of production that are facilitated
by new technologies (collaborative production) and the necessity of modifying
environments that are particularly sensitive to these issues (public policies).
The discussions focused on the concepts of "open" and "free," and participants drew on
their own experiences and knowledge to discuss the range and the meanings of the terms
and how these influence the different topics. Through the collaborative experience, it was
possible to affirm that the idea behind these concepts is not a new one; in fact, it has been
a human goal in many disciplines throughout history. However, it is recognized that the new
technological tools and environments, along with developments in intellectual property,
have been transformative and have made it necessary to focus on "openness" and
"freedom" as crucial aspects of the access, production, and dissemination of knowledge. In

this sense, the technological capacities that incentivize cooperation and facilitate the
publication of knowledge can be assimilated as methods for collaboration among
disciplines, peers, students, and in society as a whole.
Participants then discussed how to mobilize change and affect public policy, which in
copyright is highly constrained by international obligations. The open licensing options that
are available are manifestations of private choices; therefore, we had to consider their
impact and adoption in a context in which the participants could incorporate these options
into their daily lives and thoughts.
Finally, in addition to the dialogue surrounding the benefits, challenges, and issues for each
of the topics discussed, participants pointed to known projects in the Latin American region
that exemplified each general theme. Participants then discussed this list of projects in the
region associated with the theme of open education.
The workshop closed with a general analysis from the participants. There was agreement
that ongoing enhancement of the technological capacities of Latin American communities
has led to the promotion of educational content being widely available online. However, the
majority of participants indicated that there is a trend toward restricting access to goods via
intellectual property constraints, usually associated with commercialization. Nonetheless,
there are many people and organizations who seek to facilitate access to information by
means of open intellectual property policies and the promotion of the public domain.
Participants also noted the way in which the idea of open education is linked with a trend
toward certification, standardization, and accreditation. While it is useful that some projects
seek to provide access without charge, we must also recognize that there are many other
barriers to accessing valuable material, with the result that these materials remain closed.
Although there has been a considerable amount of work done to promote universal Internet
access, this access is not necessarily associated with access to content and information.
Participants also touched on many of the themes that are standard in these types of
discussions, such as the common use of "open" to mean "free of charge," when in reality it
implies a broader range of uses associated with the control of copyright and authors' rights.
In relation to this topic, Creative Commons licenses were mentioned, and a discussion
ensued regarding the range of benefits that result from access. The idea of openness has
been most accepted in university environments, and participants discussed the necessity of
expanding awareness and adoption in other educational levels, as well as to extend the
progress in this area to the general public.
The closing analysis was illustrated with regional experiences in areas such as
collaborative production, public initiatives, support for free software through public policies,
etc. Among the primary supporters of such experiences have been citizens and civil
society, which have been largely responsible for the promotion and training in digital
content and new technologies and who have pushed for the adoption of favorable public
policies and the acquisition of economic and digital resources for the projects.

In spite of the great advances that have been made in projects and social practices
surrounding open education in Latin America, participants agreed that the topic of greatest
concern is education and training in licensing issues and practices. We need to build
awareness of the fact that licenses provide the legal framework that defines the meaning of
the rights granted, and we need to raise awareness of those rights in the educational
community. In addition to the topic of licensing, participants mentioned other areas of
concern, such as access for persons with disabilities and awareness of universal access to
resources. However, they recognized that social networks are informing the citizens of
these issues throughout the region and broadening the spectrum of participants in the
conversations, thereby achieving greater impact.

The Public Domain

The final day of "Latam Commons 2008: Public Domain, Creative Commons, and Open
Education" was open to the public, with presentations, conferences, and discussions on the
issue of the public domain in Latin America (http://accesoalacultura.cl/). This seminar
follows an earlier seminar on copyright exceptions and limitations sponsored by Derechos
Digitales, and is part of an ongoing project to explore the idea of equilibrium in intellectual
property policy.
The seminar presented a complete analysis of the concept of the public domain as an
equilibrating mechanism for intellectual property rights, which allows consideration of the
importance of the community and the "public." In general terms, the public domain is a
positive tool, considered to be a useful option for access to public information, and is
defended in areas in which Chile is committed to international forums such as WIPO.
However, because the concept of the public domain is rooted in the logic of copyright and
related rights, it can also be a problematic concept in contexts where such logic does not
have a firm social basis.
The public domain has suffered from the strengthening and lengthening of the term of
copyright protection as a result of international treaty obligations, and the analyses noted
the importance of Creative Commons licenses as a legal option in the face of laws that do
not even permit the author to give up the control granted by copyright. Several examples
were presented of complicated situations in different countries that clearly showed the
important differences among the legal provisions and social practices in the region. In
particular, the importance of the educational sector was reflected in the presentation on
open access to scientific literature on the internet.
Finally, the presence of Creative Commons staff served to accentuate (i) the importance of
the concept of public domain in the context of the development of the Creative Commons
project; (ii) the ccLearn project, through which Creative Commons is working for the
elimination of legal, technical, and social barriers to the sharing and reuse of educational
materials; and (iii) the CC0 license, which seeks to expressly identify works that, through
the passage of time or the author's decision (where permitted), have passed into the public
domain.

Introduccin
Latam Commons 2008: Dominio Pblico, Creative Commons, y Educacin Abierta se
desarroll en noviembre de 2008 en Santiago de Chile, Fue organizado por la ONG
Chilena Derechos Digitales con el apoyo de la DUOC UC y financiado con recursos del
proyecto ccLearn y de la propia ONG Derechos Digitales. El evento reuni a participantes
de varios pases del continente y se dise con un alcance y formato ambicioso que
aprovechaba a los invitados y asistentes para la discusin de tres temas independientes
pero altamente relacionados.

La reunin de lderes Creative Commons en Amrica Latina.

La presencia de los lderes de Creative Commons en Amrica Latina se convirti en una
oportunidad para mirar la red de personas que posibilitan el alcance internacional de
Creative Commons. Efectivamente, la presencia de los lderes de los proyectos Creative
Commons de Amrica Latina sirvi de marco para la primera reunin a puerta cerrada de
representantes de Creative Commons en la regin. De esta manera el primer da recogi a
un grupo de personas que desde sus pases estn trabajando el proyecto de localizacin
de las licencias y de darlas a conocer. El dilogo evidenci como stos captulos locales de
Creative Commons y sus responsables vienen jugando importantes papeles en sus
entornos, ms all del tema de las licencias, respecto de la sensibilizacin sobre temas de
derecho y tecnologa, especialmente en relacin con Propiedad Intelectual, pero tambin
para privacidad, derechos a la educacin y cultura, etc. La reunin sirvi para constatar
como esta comunidad se est convirtiendo en punto de referencia regional en torno a
miradas paralelas sobre adopcin tecnolgica, aproximaciones legislativas en temas de
derecho y tecnologa y visibilidad de prcticas tecnolgicas en contextos sociales
importantes para sus propias comunidades.
El grupo reconoci que las relaciones con las comunidades de artistas y quienes estn en
contextos tecnolgicos son muy importantes, sin embargo algunos actores de estas
comunidades representan los principales obstculos para las discusiones sobre los
cambios en el sector, como sucede con las Sociedades de Gestin Colectiva que
consideran las licencias abiertas como una introduccin de una figura foranea. Las
sociedades de gestin colectiva de Amrica Latina tienen una estrecha vinculacin con sus
homologas espaolas por lo que es necesario plantear acercamientos con stas cuando se
piense en aproximaciones regionales
Ms all de respuestas la reunin plante preguntas sobre problemticas respecto a la ruta
y los retos que los captulos enfrentan en temas tan diversos como el de financiacin,
gobernabilidad y metas.
En relacin con el tema de financiacin los lderes afirmaron que la financiacin de sus
actividades representa un importante obstculo para el desarrollo de los captulos de la
regin, consideran que la dificultad y en ocasiones ausencia de recursos, no permite

estabilidad en el tema de su sostenibilidad.
Respecto de la gobernabilidad se plantearon preguntas en torno al futuro de la estructura
internacional de Creative Commons, se cuestion sobre la existencia de proyectos que
permitieran una mayor presencia de las regiones y la inclusin de procesos realmente
democrticos y participativos que, entre otras opciones, puedan repensar el proyecto con
iniciativas especficas concebidas para la regin.
Se mencion entonces que la actividad de los captulos con posterioridad a la localizacin
de las licencias se concentra especialmente en temas relacionados con el sector educativo
y su adopcin de las licencias, pero tambin se ocupan de actividades de sensibilizacin
sobre otros temas relacionados con de derecho en entornos tecnolgicos y algunos han
incursionado en proyectos para modificar la agenda pblica en polticas y legislacin. La
posibilidad de encontrar temas y proyectos comunes que mantengan el inters comn de
una red de nodos autnomos con posterioridad a la localizacin de las licencias es un
tema que todos coincidieron en que se debe explorar y explotar, Incluso se mencion la
necesidad de mejorar los sistemas de informacin internos que permitan al nivel central de
Creative Commons conocer las iniciativas en curso regionalmente.
Este dilogo, que cont con la presencia de funcionarios de Creative Commons, sirvi para
evidenciar los avances de los captulos en la regin, pero tambin como ya se dijo para
mostrar sus principales retos y obstculos. Los temas que se discutieron parecen reflejar
en buena parte caractersticas propias de redes distribuidas que soportan su labor en el
trabajo voluntario y representan por si mismos una importante aproximacin a los retos que
enfrenta la sostenibilidad de la red internacional de Creative Commons.

Jornada sobre educacin abierta

Un sector que reconoce la necesidad de nuevas aproximaciones y estndares para su
evolucin y correcta apropiacin de las capacidades tecnolgicas es el sector educativo.
De hecho el tema fue recurrente durante la reunin de lderes de Creative Commons en
Amrica Latina del primer da. El concepto de educacin abierta en esta regin es un
tema transversal en el que se estn invirtiendo sustanciales esfuerzos puesto que ya es
evidente la necesidad de aproximaciones juridicas que hagan frente a nuevas formas de
acceder y producir conocimiento que han sido especialmente potenciadas con la
apropiacin de Tecnologas de la Informacin y las Comunicaciones (TIC) que se
encuentran en crecimiento en la regin.
Este entorno sirvi de marco especial para la segunda jornada del encuentro en Chile, ese
segundo da fue dedicado precisamente al tema de educacin abierta. En esta oportunidad
a los lderes de los captulos regionales de Creative Commons se sumaron invitados
esencialmente chilenos interesados en el tema: docentes, bibliotecarios, editores, etc.
La metodologa que se abord en esta oportunidad fue la del desarrollo de actividades con
una estructura horizontal de transferencia de conocimiento que se soporta en la reflexin

de los actos cotidianos para compartirlos entre los presentes. La jornada sirvi como
plataforma para abordar proyectos concretos en educacion abierta y materiales educativos
con licencias libres y una labor de deconstruccin de conceptos inherentes a la idea de
apertura.
La metodologa participativa de la jornada dedicada a educacin abierta empez con una
lluvia de conceptos que los asistentes asociaban con esta temtica y que deseaban
discutir. Los temas enunciados serviran posteriormente para construir una agenda para la
jornada. El listado que los asistentes elaboraron de temticas que deseaban abordar se

Las temticas se adelantaron en forma simultanea permitiendo a los asistentes elegir
libremente la mesa en la que participaran. Cada uno de los temas fue presentado por el
facilitador quien luego moder la participacin de la gente en cada mesa favoreciendo la
discusin y el dilogo. La finalidad de la actividad en este caso era lograr consensos en
torno a las ideas y conceptos. Los consensos de cada mesa fueron luego socializadas
entre todos los asistentes.
Las actividades giraron en torno a conceptos e ideas relacionados con apertura (acceso
abierto, educacin abierta y licenciamiento libre), con las nuevas dinmicas de produccin
que facilitan las tecnologas (produccin colaborativa) y a la necesidad de modificar
entornos especialmente sensibles a estos temas (polticas pblicas).
Como ya se dijo las discusiones tuvieron como eje central los conceptos abierto y libre,
los asistentes aprovecharon sus propias experiencias y conocimientos para discutir el
alcance de los trminos y como stos influyen en los diferentes temas. A travs de la
experiencia colaborativa se pudo establecer que la idea detrs de estos conceptos no es
nueva, de hecho constituye una meta humana en las diferentes disciplinas a travs de la
historia, sin embargo, se reconoce que los nuevos entornos tecnolgicos y desarrollos en
la propiedad intelectual han sido un detonante y generado la necesidad de poner sobre el
tapete el tema como estrategia y fin para el acceso, produccin y difusin del
conocimiento. En este sentido las capacidades tecnolgicas que incentivan la cooperacin
y facilitan la difusin pueden ser asumidas como prcticas para la colaboracin entre
disciplinas, entre pares, entre discentes, en la sociedad como un todo.
La discusin entonces sobre como afectar y movilizar polticas pblicas, que en el tema de
derecho de autor se encuentran altamente mediadas por compromisos internacionales, y
las opciones que ofrencen las opciones de licenciamiento abierto, como manifestaciones
de prcticas privadas, aparecieron como elementos de reflexin necesarios dentro de este
contexto que los asistentes pueden retomar en sus prcticas y reflexiones cotidianas
Finalmente, ms all de los dilogos sobre los conceptos, las opciones, los beneficios, los
retos y las problemticas en cada una de las temticas abordadas fue especialmente
interesante que los asistentes mencionaran la existencia de proyectos en la regin que
ejemplificaban cada tema.
Precisamente la jornada se cerr con un listado de proyectos de la regin asociados con la
temtica (Anexo No. 1 Recopilacin de datos bsicos de proyectos en la regin
relacionados con Educacin Abierta y Recursos Educativos Abiertos) y se propicin un
anlisis general de los asistentes. Se seal como la mejora de las capacidades
tecnolgicas de las comunidades han propiciado la promocin de contenidos
educacionales ampliamente asequibles por Internet. La mayora indicaron que aparece una
tendencia hacia la idea de restringir al acceso a bienes que se asocian con
comercializacin a travs de su conexin com Propiedad Intelectual, mientras que al
mismo tiempo se busca facilitar el acceso a la informacin, a travs de la gestin de
propiedad intelectual y la promocin del dominio pblico.

De otro lado reconocieron los asistentes como la idea de Educacin Abierta est vinculada
com una tendencia hacia la certificacin, estandarizacin y acreditacin. Si bien se busca
facilitar el acceso sin cobro, tambin se pretende ir ms all y se reconoce que persisten
barreras para el acceso a material valioso que permanece cerrado. Aunque se viene
trabajando en el acceso universal a la red ste acceso no necesariamente se asocia con el
acceso a los contenidos.
Los asistentes se ocuparon de temas ya normales en este tipo de discusiones como el de
asociar el concepto de abierto con grtis cuando en realidad implica usos ms amplios
asociados con el control del derecho de autor. En relacin con este tema se mencionaron
las licencias Creative Commons y se discuti sobre el alcance y beneficios que se derivan
de dicho acceso, tambin se reconoci que la idea de apertura ha calado ms en el
entorno universitario y se llam la atencin sobre la necesidad de abordar otros niveles e
incluso generalizarlo hacia la ciudadana en general.
El anlisis se ejemplific con experiencias regionales en temticas como produccin
colaborativa, iniciativas pblicas, apoyo a Software Libre desde polticas pblicas, etc.,
indicando como el gran impulsor de tales experiencias han sido realmente los propios
ciudadanos y sus organizaciones sociales quienes son realmente los responsables de la
promocin y capacitacin en contenidos digitales y quienes han conseguido que los
organismos pblicos propicien polticas pblicas, recursos econmicos y digitales para los
proyectos. En concreto Werner Westerman present el portal chileno Edicin Libre, Ariel
Vercelli hizo una exposicin sobre el proyecto Flacso para licenciamiento de contenidos
abiertos que se desarroll en Argentina y Renata Avila y Teresa Sanpedro explicaron la
experiencia de Ceducar en Centroamrica.
A pesar de los grandes avances que se vienen dando en proyectos y prcticas sociales los
asistentes coinciden en que el tema que se encuentra a la retaguardia es el de promocin
y capacitacin en licenciamiento. La importancia del licenciamiento permite garantizar el
entorno legal que define el significado de los derechos y generarconciencia sobre los
mismos entre la comunidad educativa. Adems del tema de licenciamiento los asistentes
mencionaron que hay otros pendientes como discapacidad y conciencia sobre de acceso
universal a los recursos., pero reconocieron que las redes sociales estn informando a la
ciudadana y ampliando el espectro para lograr un mayor impacto.

El Dominio Pblico
Latam Commons 2008: Dominio Pblico, Creative Commons, y Educacin Abierta
se cerr el tercer da con un evento pblico de presentaciones, conferencias y discusiones
en torno al tema de dominio publico en Amrica Latina http://accesoalacultura.cl/ (el
programa del evento aparece como Anexo 2). Esta jornada es la segunda etapa de un
proceso de problematizacin de la idea de equilibrio en la propiedad intelectual en que se
encuentra comprometida la ONG Derechos Digitales y que tuvo como primera actividad un
seminario similar en torno a excepciones y limitaciones.

Se present un anlisis muy completo del concepto del dominio pblico como un equilibrio
del derecho de autor que permite repensar la importancia de la comunidad y de lo
"pblico". En trminos generales el dominio pblico se muestra como un concepto positivo,
como una opcin real para el acceso a la informacin pblica, como la defensa de un tema
en el que Chile se encuentra comprometido a nivel internacional en foros como la OMPI,
pero tambin se mencion la problemtica que representa cuando se analiza su trasfondo
como concepto derivado de la lgica de derecho de autor en contextos sociales en los que
la idea es ajena.
Adems de confirmar que en la regin el dominio pblico ha cedido importante terreno con
la ampliacin de los trminos de proteccin que se deriva de las obligaciones de los
tratados internacionales, en los anlisis que se hicieron de las legislaciones regionales
Creative Commons aparece como una opcin legal frente a leyes que no permiten ni
siquiera la renuncia del autor del control que le da el derecho de autor. Los ejemplos que
se presentaron sobre situaciones complicadas en los diferentres pases mostraron
importantes diferencias entre sus previsiones legales y las prcticas sociales. En todo
caso, la importancia del sector educativo qued reflejado en la presentacin sobre acceso
abierto en la literatura cientfica a travs de Internet.
Finalmente la presencia de funcionarios de Creative Commons sirvi de marco para
presentar (i) la importancia del concepto de dominio pblico en el contexto del surgimiento
y concepcin del proyecto Creative Commons (ii) el proyecto ccLearn mediante el cual
Creative Commons apoya la eliminacin de barreras legales, tcnicas y sociales para
compartir y reutilizar materiales educativos y, (iii) la licencia CCZero que busca identificar
expresamente las obras que por el paso del tiempo o por decisin del autor (en las
jurisdicciones que lo permiten) pasan al dominio pblico.
