COMPLAINT
Plaintiff Zenith Products Corp. (Zenith), by and through the undersigned attorneys,
alleges as follows:
THE PARTIES

New York Corporation having a principal place of business located at 7708 18th Avenue,
Brooklyn, New York 11214.
JURISDICTION AND VENUE

This is an action for patent infringement arising under the Patent Laws of the
This Court has jurisdiction over the subject matter of this action under 28 U.S.C.
This Court has personal jurisdiction over Mambate. Mambate has sufficient
minimum contacts with the forum as a result of business conducted within the State of Delaware.
Upon information and belief, Mambate has purposefully availed itself of the privilege of
conducting business in this District, and is therefore subject to personal jurisdiction.

Venue is proper in this judicial district pursuant to 28 U.S.C. 1391(b), (c) and
1400(b).
FACTS

Zenith is the owner of U.S. Patent No. D545,180 (the 180 Patent), issued by
the United States Patent and Trademark Office (USPTO) on June 26, 2007 and entitled
Curtain Hook. A Request for Supplemental Examination was filed on July 26, 2013. As a
result of the Request for Supplemental Examination, the USPTO ordered Ex Parte
Reexamination of the 180 Patent. On April 10, 2015, the USPTO duly and legally issued Ex
Parte Reexamination Certificate No. D545,180 C1 confirming the patentability of the sole claim
of the 180 Patent. A true and correct copy of the 180 Patent with its Reexamination Certificate
is attached to this Complaint as Exhibit A.

The 180 Patent is valid and enforceable. The term of the 180 Patent is set to

possesses all rights of recovery under the 180 Patent, including the right to sue for infringement
and recourse for damages.

Mambate has used, manufactured, sold, offered for sale, and/or imported shower
curtain hook products under various brand names (hereinafter the Infringing Product) in the
U.S., and continues to do so.

Mambate has sold and offered for sale, and continues to sell and offer for sale, the
Infringing Product to commercial retailers in this State and judicial district for sales and offers
for sale to residents of this State and judicial district. In particular, the Infringing Product has

been and is being offered for sale and/or sold through at least Newegg Inc. (Newegg), which
is organized under the laws of the State of Delaware, via its website www.newegg.com. A copy
of the offer for sale of the Infringing Product from Neweggs website is attached hereto as
Exhibit B. Upon information and belief, Mambate is aware of the offer for sale of the Infringing
Product on Neweggs website.

Mambate has not sought, nor obtained, a license under the 180 Patent and is not
authorized or permitted to market, manufacture, use, offer for sale, sell or import the subject
matter claimed in the 180 Patent.
COUNT I
INFRINGEMENT OF THE 180 PATENT

The claim of the 180 Patent is presumed valid pursuant to 35 U.S.C. 282.

contributorily infringing and/or inducing others to infringe the claim of the 180 Patent, either
literally or under the doctrine of equivalents, by making, causing to be made, using, offering for
sale, selling and/or importing into the United States, without license or authority, at least the
Infringing Product, which is covered by the claim of the 180 Patent.

Mambate has willfully infringed and, upon information and belief, will continue
to willfully infringe upon the claim of the 180 Patent by the use, manufacture, offer for sale,
sale, and/or importation of the Infringing Product unless this Court enjoins Mambates infringing
activities.

As a result of Mambates willful infringement of the 180 Patent, Zenith has been

infringement of a design patent under 35 U.S.C. 289, increased damages under 35 U.S.C. 284,
together with interest, costs, and attorneys fees under 35 U.S.C. 285, and is entitled to
injunctive relief against such infringement pursuant to 35 U.S.C. 283.
JURY DEMAND
Plaintiff hereby demands a jury trial on all issues appropriately triable by jury.
PRAYER FOR RELIEF
WHEREFORE, Plaintiff prays that the Court enter judgment against Defendant for the
following:
