    Intra agency EPA email from Aaron Setran to David Albright regarding BIA jurisdiction over Pine View Estates, which was developed on an Indian allotment. Email sent 9/3/09 at 9:31 a.m. CC:d Rich Campbell. Mr. Setran stated that he would see which office at BIA had jurisdiction over Pine View. He was responding to an email from David Albright, who wrote, "It is now time to bring in BIA. Aaron, can you set up a call - unless you prefer to make the contact yourself." EPA had learned from PTP consultant Brenda Stein that day that, "PTP packed up and left. I was worried that they did not jump through any hoops before they left. What should we do now?"     I'll look into which office/person at BIA has jurisdiction. My understanding is that the original BIA person
    associated with the Pineview development project and lease agreement, Curtis Milsap, is now retired.

    I think everyone thinks the homeowners association owns it. PTP packed
    up and left. I was worried that they did not jump through any hoops
    before they left. What should we do now?

    see page 8 of the permit, Section D.2.a.ii. If effluent concentrations
    for TSS, BOD and N-N exceed the stated limits, re-sampling and
    notification to EPA are required. Detection of Fecal Coliform or
    Nitrates in the monitoring wells (see Section D.2.a.iii) has the same
    requirements. I know that this permit is not the easiest permit to
    follow, and that will change once we re-issue it.......but first we have
    to find out who currently owns the wastewater infrastructure; any ideas?

    Results

    Aaron,
    Where can I find the highest allowable results for the sampling for
    Pineview? I need to know when the results are too high for EPA
    standards.
    I need to know for the following:
    Total suspended solids in mg/L

    Nitrate Nitrogen in mg/L


    Biochemical Oxygen Demand in mg/L
    Total KJeldahl Nitrogen in mg/L
    It was never part of the permit and I need to be sure I respond
    correctly if the results detected in sampling are too high.
    Can you help?
