DECLARACION DE PRINCIPIOS ENTRE ESPANA, MARRUECOS

MAURITANIA SOBRE EL SAHARA OCCIDENTAL

En Madrid, a 14 de noviembre de 1975 y reunidas las Delegaciones que legftimamente

representan a los Gobiernos de Espafia, Marruecos y Mauritania, se manifiestan de acuerdo
en orden a los siguientes principios:
10) Espafia ratifica su resoluci6n - reiteradamente manifestada ante la ONU de descolonizar el territorio del Sahara Occidental poniendo tdrmino a las responsabilidades y poderes que tiene sobre dicho territorio como Potencia Administradora.
20) De conformidad con la anterior determinaci6n y de acuerdo con las negociaciones propugnadas por las Naciones Unidas con las partes afectadas, Espafia procederd
de inmediato a instituir una Administraci6n temporal en el territorio en la que participardn
Marruecos y Mauritania, en colaboraci6n con la Yemad, y a la cual serd.n transmitidas
las responsabilidades y poderes a que se refiere el pfrrafo anterior. En su consecuencia,
se acuerda designar a dos Gobemadores Adjuntos, a propuesta de Marruecos y Mauritania,
a fin de que auxilien en sus funciones al Gobernador General del territorio. La terminaci6n
de la presencia espafiola en el territorio se llevard a efecto definitivamente antes del 28
de febrero de 1976.
3o) Serd respetada la opini6n de la poblaci6n saharaui, expresada a trav6s de la
Yemai.
40)
Los tres parses informarn al Secretario General de las Naciones Unidas de lo
establecido en el presente Documento como resultado de las negociaciones celebradas
de conformidad con el Artfculo 33 de la Carta de las Naciones Unidas.
50) Los tres parses intervinientes declaran haber llegado a las anteriores conclusiones con el mejor espfritu de comprensi6n, hermandad y respeto a los principios de la
Carta de las Naciones Unidas, y como la mejor contribuci6n al mantenimiento de la paz
y la seguridad internacionales.
60) Este Documento entrard en vigor el mismo dfa en que se publique en el Boletin
Oficial del Estado la <Ley de Descolonizaci6n del Sahara> que autoriza al Gobierno
espafiol para adquirir los compromisos que condicionadamente se contienen en este
Documento.

DECLARATION' OF PRINCIPLES ON WESTERN SAHARA BY SPAIN,

MOROCCO AND MAURITANIA

On 14 November 1975, the delegations lawfully representing the Governments of

Spain, Morocco and Mauritania, meeting in Madrid, stated that they had agreed in order
on the following principles:
1. Spain confirms its resolve, repeatedly stated in the United Nations, to decolonize
the Territory of Western Sahara by terminating the responsibilities and powers which it
possesses over that Territory as administering Power.
2. In conformity with the aforementioned determination and in accordance with
the negotiations advocated by the United Nations with the affected parties, Spain will
proceed forthwith to institute a temporary administration in the Territory, in which Morocco and Mauritania will participate in collaboration with the Yema'a and to which will
be transferred all the responsibilities and powers referred to in the preceding paragraph.
It is accordingly agreed that two Deputy Governors nominated by Morocco and Mauritania
shall be appointed to assist the Governor-General of the Territory in the performance of
his functions. The termination of the Spanish presence in the Territory will be completed
by 28 February 1976 at the latest.
3. The views of the Saharan population, expressed through the Yema'a, will be
respected.
4. The three countries will inform the Secretary-General of the United Nations of
the terms set down in this instrument as a result of the negotiations entered into in
accordance with Article 33 of the Charter of the United Nations.
5. The three countries involved declare that they arrived at the foregoing conclusions in the highest spirit of understanding and brotherhood, with due respect for the
principles of the Charter of the United Nations, and as the best possible contribution to
the maintenance of international peace and security.
6. This instrument shall enter into force on the date of publication in the Bolettn
Oficial (Official Gazette) of the State of the "Sahara Decolonization Act" authorizing
the Spanish Government to assume the commitments conditionally set forth in this
instrument.

the Government of Spain to implement its provisions, in accordance with paragraph 6.

R6unies A Madrid le 14 novembre 1975, les ddl6gations repr6sentant 1dgitimement

les Gouvernements de 1'Espagne, du Maroc et de la Mauritanie se sont d6clar6es d'accord
sur les principes suivants :
1. L'Espagne r~affirme sa r6solution, exprim6e A maintes reprises devant
l'Organisation des Nations Unies, de d6coloniser le territoire du Sahara occidental en
mettant un terme aux responsabilit6s et aux pouvoirs qu'elle a sur ce territoire en qualit6
de Puissance administrante.
2. En cons6quence de ce qui prdc~de et conform6ment aux n6gociations avec les
parties intdressdes tenues sur les instances de l'Organisation des Nations Unies, l'Espagne
proc6dera immddiatement A l'instauration d'une administration temporaire dans le territoire, A laquelle participeront le Maroc et la Mauritanie en collaboration avec la Djemdfa,
et A laquelle seront transmis les responsabilit~s et les pouvoirs vis6s au paragraphe
pr6c6dent. En cons6quence, il est convenu de nommer, sur la proposition du Maroc et
de la Mauritanie, deux gouverneurs adjoints qui assisteront le Gouverneur g6n6ral du
territoire dans ses fonctions. La pr6sence espagnole prendra d6finitivement fin avant le
28 f6vrier 1976.
3. L'opinion de la population sahraouie, exprim6e par l'interm6diaire de la Djemaa,
sera respect6e.
4. Les trois pays informeront le Secr~taire g6n6ral de l'Organisation des Nations
Unies des dispositions consign6es dans le pr6sent document A l'issue des n6gociations
tenues conform6ment A l'Article 33 de la Charte des Nations Unies.
5. Les trois pays d6clarent 8tre parvenus aux conclusions qui pr6c~dent dans le
meilleur esprit de compr6hension, de fraternit6 et de respect des principes de la Charte
des Nations Unies; ils y voient le meilleur moyen de contribuer au maintien de la paix
et de la sdcurit6 internationales.
6. Le pr6sent document entrera en vigueur Ala date de la publication au Journal
officiel de l'Etat de la (<Loi sur la d6colonisation du Sahara>> qui autorise le Gouvernement
espagnol A confirmer les engagements conditionnels 6nonc6s dans le pr6sent document.
