abouttheterribleconditionsoftheIndianpeople,likeSaratChandra,Premchand,
Faiz,Manto,KaziNazrulIslam,Dickens,Gorki,JohnSteinbeck,VictorHugo,etc.

leaders of Gujarat in the background of the 2002 riots, and his actions were

"What we have said above is nothing new and is only a reiteration of the established
norms of judicial property and restraint expected from everyone discharging judicial
functions.Useofintemperatelanguageofmakingdisparagingremarksagainstanyone
unless that be the requirement for deciding the case, is inconsistent with judicial
behaviors.Writtenwordsinjudicialordersareforpermanentrecordwhichmakeiteven

Bhatt was being attacked by the entire Establishment, which included not only BJP
politicians but even his own fellow police officers who shamelessly denounced him to
please their political masters. Where else could he appeal to but politicians of other
parties,NGOs,activists,etc?
Moreover, in Sanjiv Bhatt's case, there was not even a requirement to make such
observationsofrebukeagainstBhatt,andtheSupremeCourthasrepeatedlysaidthat
stricturesshouldnotbepassedagainstanyoneunlessthatisabsolutelyessential..Bhatt
hadfiledhisappealintheSupremeCourtalleginghewasbeingtargetedbytheGujrat
govt.fordisclosingcertainfactsaboutthepostGodhrakillingsofMuslims.Atmostthe
SupremeCourtcouldhaverejectedhisplea,butwherewastheneedforberatinghim
andhaulinghimoverthecoals?

Whitman, Mark Twain, John Steinbeck, Upton Sinclair, Erich Maria Remarque,
andPabloNerudaoftoday?

Theyhavebecomelargelycommercialized,liketherestofsociety.

literature.Thefirstiscalledartforart'ssake,andthesecondiscalledartforsocial

Thosewhobelongtothefirstschoolbelievethatthepurposeofartandliteratureis

a social purpose, it ceases to be art and becomes propaganda. Followers of this
schoolareKeatsinEnglishliterature,AlexanderDumasinFrench,EdgarAllanPoe
in American, Agyeya and the chayavadi poets in Hindi, and Tagore in Bengali
literature.
Ontheotherhandthosewhobelongtotheschoolofartforsocialpurposebelieve
that art should help society, by attacking oppressive institutions, customs and
ideas,andbyinspiringpeopletofightagainstthemandsecureabetterlife.
InapoorcountrylikeIndiaonlythesecondschoolisacceptable.Artandliterature
in India should attack inhuman and outdated feudal and backward practises like
thecastesystem,andinspirepeopletofightforbetterlivesasSaratChandra,Kazi
NazrulIslam,SubramaniaBharati,Faizetcdid.
Butareourwritersdoingso?IamafraidtheanswerhastobeinthenegativeAll
theycareforismakingmoney.

TheDattudossier
IhaveacopyofthedossieronDattu'sprimafaciecorruptionwithme,andIputup
a fb post some time back giving my email id ( mark_katju@yahoo.co.in ) asking
someonetotakethedossierfrommeandfileaPILaskingforaninvestigation,but
no one did anything. A few lawyers telephoned me, but later backed out, perhaps
thinking that this may affect their law practice. One lawyer even took the dossier
fromme,butlaterreturneditsayinghewasunwell.Sonoonedarestoinvestigate
Dattu, neither lawyers nor media nor anyone else. The govt. of course has the

InfactlongbeforehewasappointedChiefJusticeofIndiaIsenttothethenUnion
LawMinister,Mr.RaviShankerPrasad,acopyofadossier(Istillhaveacopywith
me)containingprimafaciedocumentaryproofofhismassivecorruption(Ialso
gavecopiesofthedossiertoMr.ShantiBhushan,seniormemberoftheCommittee
on Judicial Accountability, media representatives etc). These include photocopies
ofalargenumberofsaledeedsofplotsoflandinBangaloreinthenameofhiswife
Gayathri(whomustbeprivytohisprimafaciecorruption)showinghernamebut
as daughter of K.G. Guruvayya, instead of wife of Dattu, and as an agriculturist.
Whydidtheladyconcealhermaritalstatus?
ManyoftheseplotswerepurchasedinviolationoftheKarnatakLandReformsAct.
Dattu got himself allotted one plot in a scheme in which Karnatak High Court
employees alone could get a plot. A high court judge is not an employee. He got
anotherplotinaschemewhosebyelawssaythatapersonwhoorwhosewifehasa
plot in Bangalore cannot be allotted a plot. A large number of other illegal
acquisitionsofwealtharementionedinthedossier.
Dattu has built a palatial house in Bangalore on 1200 sq.m. land which must be
costing50crores.Wheredidhegetthemoneyforthis.
I requested all persons to whom I gave copies of the dossier that at least they
shouldinvestigatethefactsmentionedinthedossier,butnothingwasdone.

MyguessisthatwhenRaviShankarPrasad,thethenUnionLawMinisterreceived
thediossierIsenthim,hemusthaveshownittoModiandArunJaitley,andthen
theymusthaveblackmailedDattubyshowinghimthedossier,andtellinghimto

TheBJPmaykeeptalkingofenactingacommoncivilcodebuttheywillneverdoit.

Having said they will do so in their election manifesto in the 2014 Lok Sabha
elections what is their stand now ? They say that a consensus is required, and all
the'stakeholders'havetobeconsulted.
But these are just excuses. Who are the 'stakeholders ?' The Muslim Personal Law

backward for their own vested interests. They will oppose tooth and nail even the

legislation.
So the BJP will only pay lip service to making a uniform civil code, though all

Please consider what I have to endure in this process. When I criticize Hindus,
they abuse me, and when I criticize Muslims, they do the same. But Muslims
should remember that whenever any atrocity is committed against Muslims the

Many people have commented on my previous posts saying that shariat is the
mandateofIslam,andthereforemustbefollowed.
ButIregardallreligionsassuperstitiousnonsenseandfalse,andbelievethatthe
truth lies in science. Of course science is constantly developing, and many things
notknowntoittodaymaybyscientificresearchbeknowntoitinfuture.
So my advice to all religious people is to give up religion, which is based on
falsehood,andembracescience,whichisbasedontruth
