A RESOLUTION MANIFESTING THIS SANGGUNIANS INTENTION NOT TO FILL IN

THE VACANT POSITION IN THE SANGGUNIANG BAYAN
WHEREAS, due to the death of the late Honorable Vice Mayor Demetrio C. Bagayas, there is now
a vacancy in the Sanggunian when the First Councilor, Hon. Glicerio U. Patricio, Jr., started his function as
the successor to the Office of the Vice Mayor;
WHEREAS, considering the proximity of the election time, this Sanggunian manifested its intention
not to fill in the vacant position;
WHEREFORE, on motion of Hon. Tambuang, duly seconded by Hon. Teves, it was
RESOLVED, AS IT IS HEREBY RESOLVED, TO MANIFEST THIS SANGGUNIANS
INTENTION NOT TO FILL IN THE VACANT POSITION IN THE SANGGUNIANG BAYAN;
RESOLVED FINALLY, to serve copy of this Resolution to the Office of the Provincial Governor,
for her information, reference and guidance;

JR. MUNICIPAL VICE MAYOR AS ONE OF THE OFFICIAL SIGNATORIES OF THE
MUNICIPAL GOVERNMENT OF BANAYBANAY, DAVAO ORIENTAL IN ITS

WHEREAS, due to the untimely death of the late Hon. Demetrio C. Bagayas, the Office of
the Vice Mayor must be filled in by the First Councilor following the law of succession;

Mayor, endowed with the same duties and functions, which include signing of warrants drawn on
municipal treasury for all expenditures appropriated for the operation of the Sangguniang Bayan

ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) & SIGN PERTINENT DOCUMENTS
REPRESENTING THE LGU OF BANAYBANAY WITH THE DEPARTMENT OF AGRICULTURE
& BUREAU OF SOILS AND WATER MANAGEMENT (BSWM) REGARDING THE CBCF
ESTABLISHMENT AND IMPLEMENTATION
WHEREAS, the BSWM in support to the Executive Order 481 otherwise known as the "Promotion
and Development of Organic Agriculture in the Philippines" will implement the "Organic Fertilizer
Production Project (OFPP);
WHEREAS, the BSWM advocates the utilization of organic fertilizers as one of the methods to
minimize groundwater pollution, restore soil fertility, reduce the vulnerability of marginal farmers on the
high cost of chemical fertilizers, and promote the gradual adoption of Organic-Based Agriculture nationwide;
WHEREAS, the DA-RFUXI as focal agency in the Region in charge of agricultural programs and
has the technical and administrative capability to handle the implementation, monitoring and regional
coordination for the establishment of CBCF;
WHEREAS, the LGU BANAYBANAY as the proposed beneficiary has the logistical capability to
start the Organic Fertilizer Production Project and capable to handle the establishment, Operation,
Maintenance and Management of the CBCF;
WHEREAS, the BSWM, DA-RFU Xi and LGU BANAYBANAY agree to cooperate, collaborate
and jointly implement the establishment of the Community-Based Composting Facility (CBCF);
WHEREFORE, on motion of Hon. Mamukid, duly jointly seconded by Hon. Alingalan, Hon.
Mante and Hon. Tambuang, it was
RESOLVED, AS IT IS HEREBY RESOLVED, TO AUTHORIZE THE MUNICIPAL MAYOR,

WHEREAS, the mudflow at Barangay Puntalinao has been a long concern of this LGU and
has been forwarded to the concerned government agency, DPWH, to address the problem;
WHEREAS, through the representation of a well-respected provincial official, Hon. J.
Mayo Z. Almario, we hope that a concrete action may be done by the DPWH to block the mudflow
that caused inconvenience and danger to the traveling public;

GOVERNOR, TO CANCEL THE SMALL MINING PERMIT OF MS. EUGENIA VILLACRUZ FOR
FAILURE TO REPAIR THE AREA WHICH CAUSED THE MUDFLOW DUE TO HER PREVIOUS
MINING OPERATION
WHEREAS, when Ms. Eugenia Villacruz asked for the endorsement of her application for a
Small Scale Mining permit, she promised this Sangunian that she will repair the previous area she
was mining that caused the mudflow at the national highway;
WHEREAS, until this day, Ms. Villacruz have not done any action to prevent the mine
tailings to overflow to the highway during rainy days;
WHEREFORE, on motion of Hon. Tanbuang duly jointly seconded by Hon. Dignos and Hon.
Celmar, it was
RESOLVED, AS IT IS HEREBY RESOLVED, TO REQUEST HON. CORAZON N.
MALANYAON, PROVINCIAL GOVERNOR, TO CANCEL THE SMALL MINING PERMIT OF MS.
