1 THE COURT: Patriot's Heart Media.

2 MR. BORA: Jeff Bora on behalf of the People,

3 your Honor.

4 THE COURT: Good morning, ma'am.

5 MS. MERONI: Good morning, your Honor. How are

6 you?

7 THE COURT: Good.

8 MR. BORA: Your Honor, this matter comes before

9 the court on motion of the state. The state is

10 seeking the court's guidance in a matter that has

11 come to our attention.

12 It is our understanding that it is still

13 it's within this court's discretion to grant the

14 motion of the petitioner to appear as a special

15 investigator as well as a witness before the grand

16 jury in incidents which she has explained in that

17 motion. However, prior to that motion being

18 disposed of she appeared at our office and did

19 tender to us what we believe to be 17 packets of

20 information to tender to the grand jury.

21 At this time, the motion not having being

22 decided, however, these packets being confidential

23 and not addressed to the state, the state is

24 uncomfortable with keeping them in our possession or

1 tendering them to the grand jury until the court has

2 reached a decision on the motion.

3 THE COURT: state is asking to hold those

4 packets until such time as the court has ruled on

5 the pending matter?

6 MR. BORA: That would be fine, your Honor, if

7 that would be

8 MS. MERONI: But do you mind -- but they -- I

9 met with the state's attorney's office yesterday and

10 they said that they don't have an objection, they

11 just need permission. And I also learned about

12 emergency motions to reconsider and I wrote one up

13 and I went down to the office and asked how to give

14 it to you this morning and 30 she didn't know if I

15 should just hand it to you or if you would like me

16 to do it through this form and I -- to basically

17 reconsider that this matter is indeed an emergency.

18 THE COURT: Ma'am, the court previously ruled

19 that the matter is not an emergency

20 MS. MERONI: I -- I --

21 THE COURT: and that ruling would stand if

22 that's what you're asking the court to reconsider.

23 MS. MERONI: Well, I came across new information

24 that I didn't know at the time. Upon leaving the

1 courtroom I found out that, in fact, there is an

2 election that begins on January 9th in the state of

3 Illinois and so it's an impermissible barrier as my

4 court date to return here for redress on this is

5 January 13th.

6 THE COURT: Ma'am, you have to file a written

7 motion setting forth facts if you want the court to

8 consider it.

9 MS. MERONI: I have it right here.

10 THE COURT: Do you have a written motion?

11 MS. MERONI: Yes, ma'am.

12 THE COURT: Have you tendered a copy of that

13 motion to the state?

14 MS. MERONI: No, I would like to do that if I

15 may.

16 THE COURT: You may.

17 MS. MERONI: There you go.

18 MR. BORA: Your Honor, we would acknowledge

19 receipt of an emergency motion to reconsider.

20 THE COURT: Have a seat, ma'am, and when I have

21 an opportunity I will read your motion and address

22 it.

23 MS. MERONI: Thank you.

24 And also when I was speaking with the

1 state's attorneys yesterday he said that it might be

2 useful if I showed you guys what was in those

3 packets and I would be happy to do that.

4 THE COURT: Would the state please tender a copy

5 of the packet to the court.

6 MR. BORA: Absolutely, your Honor.

7 We are tendering to you a packet entitled

8 jury foreperson through grand juror number 8.

9 MS. MERONI: But I have a copy for you too if

10 you want it this way.

11 THE COURT: You have copies?

12 MS. MERONI: Mm-hmm.

13 THE COURT: Same thing as what is in here?

14 MS. MERONI: Mm-hmm.

15 THE COURT: State, is that acceptable?

16 MR. BORA: That would be acceptable, your Honor.

17 THE COURT: Ma'am, you can tender to the court

18 your copies.

19 MS. MERONI: Okay, thank you very much. I'm

20 confused. Thank you very much.

21 THE COURT: You're welcome.

22 MS. MERONI: Can I give you one too?

23 MR. BORA: If I can have a copy.

24 MS. MERONI: Yes.

1 THE COURT: Have a seat, ma'am, and I will read

2 your emergency motion as soon as I have an

3 opportunity.

4 MS. MERONI: Yes, your Honor. Thank you.

5 MR. BORA: Thank you, your Honor.

9 MR. BORA: Jeff Bora on behalf of the People,

10 your Honor.

11 MS. MERONI: Good morning.

12 THE COURT: Ms. Meroni, the court has had an

13 opportunity to read through the petition that you

14 tendered to the court this morning entitled the

15 emergency petition to reconsider. The court is

16 going to deny that petition to reconsider. The

17 court's earlier ruling would stand.

18 In the motion that you filed this morning,

19 ma'am, you do not set forth with any specificity

20 facts which indicate where voter fraud is taking

21 place, who does it apply to, what city, what county,

22 what municipality, who are the candidates involved

23 in it. Without that, the court going to deny your

24 motion.

1 The court is also going to enter an order

2 ordering the state's attorney's office to keep the

3 packets that you have sent to the state's attorney

4 until we have an opportunity to address your

5 underlying petition and make a determination as to

6 whether there is any legal basis to grant you what

7 you are asking, ma'am.

8 The January 13th court date would stand.

9 MS. MERONI: Okay. If I allow -- if I fill

10 those deficiencies, can I reapply?

11 THE COURT: You have the right to file anything

12 that you choose to file, ma'am.

13 MS. MERONI: Okay. Thank you.

14 THE COURT: You're welcome.

15 MS. MERONI: I made a mistake. I didn't sign

16 that and I found one typo in there. So if I can

17 replace it just with the 11th as my date.

18 THE COURT: You want to tender a corrected copy?

19 MS. MERONI: Yes.

20 THE COURT: The court will accept it.

21 MR. BORA: I will prepare an order, your Honor.
