Instruction for completing the liquidated damages sheets.


I have made it easy for you. Complete the following questions and I will magically take care of
everything else.
No 1. What is the Project No? (Put it in block F6)
No 2. What is the Project Title? (Put in block F-8)

No 4. Type the C.O.'s Name (Put in block F-12)


No 5. Total Liquidated Damages from CES
(Figures obtained from Tab A1)

No 7. On the sheet entitled "Determination" there are some inputs that you may/may not need.
They are located in blocks G47-G50 and C-50. These blocks are not locked and you make inputs
directly into them.
As you will notice we now have 2 LD rates, one for the first day (because legal is
involved only on the first day) and one for each day after. These two rates need to both be
identified to your contractor.

1. Liquidated Damages for contracting personnel under subject project were determined in the following
manner (per German Tariff Agreement TV AL II/TV AL II (Frz) multiplied by a rate of 35% to account for
benefits (percentage obtained from Civilian Personnel at 480-2137). Civilian/Military rates were
obtained from finance websites www.hq.af.mil/SAFFM/FMC/a31-1 (civilian) and a32-1 (military).

2. In determining the hourly rate for a contract administrator, the average hourly rate was used for liquidated
damages. A firm amount cannot be determined prior to issuance of the solicitation because it is not known which
administrator will be working with the project after award. The average hourly rate is determined to be the most
fair and reasonable method in computing liquidated damages for Operational Contracting personnel.

assessed for each calendar day of delay required to complete work on subject contract.
