On 08 September 2015, all the accused in this case were arraigned, except for accused ARCADIO B. GAPANGADA JR., who was arraigned on 18 February 2015, . Accused JUANCHO M. ANDAYA, ANTONIO S. ZORNOSA JR., MARIO O. MERCOLISA JR. are incumbent members of the Sangguniang Bayan of Majayjay, Laguna while accused SERNARDO I. DE VILLA is the incumbent Barangay Chairman of Brgy. Villa Nogales, Majayjay Laguna. . Section 13 of Republic Act 3019 sanctions the suspension of any incumbent public officer against whom any criminal prosecution under said Act is pending in court. In a long line of cases, the Supreme Court explained the mandatory nature of said provision that does not allow any discretion from the court. Among these cases is Beroa v. Sandiganbayan, G.R. Motion “9 Suspend from Office Page 2064 - Section 13 is so clear and explicit that there is hardly room for any extended court rationalization of the law. Section 13 unequivocally mandates the suspension of a public official from office pending a criminal prosecution under RA 3019 or Title 7, Book HI of the Revised Penal Code or for any offense ,.. involving public funds or property or fraud on government. This Court has repeatedly held that such preventive suspension is mandatory, and there are no ifs and buts about it. 4. In view of said provision, the prosecution moves for the suspension from office of the four (4) accused and that they be ordered to cease and desist from further performing and/or exercising their functions, duties and privileges in connection with their positions.
