GRID CONNECTED SOLAR POWER PLANT 5 MW
DISTRICT KUPANG (EAST NUSA TENGGARA PROVINCE)

On Wednesday, the twenty-seventh of November two thousand thirteen, we

are 10th Committee for PV Capacity Quota Auction of General Directorate of
Renewable Energy and Energy Conservation located in Directorate General of
Renewable Energy and Energy Conservation Building, Jl. East Pegangsaan No.
1A Cikini, Jakarta, has implemented an online explanation of tender
documents for On Grid Solar power construction with 5 MW capacity at
Regional District of Kupang, East Nusa Tenggara province, as following
explanation :
1. Explanation of the auction will be done via online starts at 10:00 to
13:00 pm
2. Participants who can follow explanation of the auction are each
participant who has been registered in auction website
(www.lelang.ebtke.esdm.go.id)
3. Total of all participants in the explanation is as much as 33 participants
4. Total the whole question is as much as 255 questions
5. The 10th Committee has made a questions summary and answers
were received during the process of explanation as attached
Thus the minutes of the explanation is designed to be used properly.

Questions Resume and Answers
1. If a bidder who use import module offers US$ 24 cents / kWh, while the
bidder B on the same package uses local modules with 40% local
content offered US 28 cents / kWh, does it mean that the price by
bidder B is lower than the bidder A ?
Answer:
Right, because at the time of evaluation price, the bidder with 40%
local content level will be reduced by 5 cents (Incentive).
2. If financial closing can not be completed within three months, can it be
extended? Is there a time limit?
Answer:
If financial close can not be completed within three months, then the
provider will get a warning letter (maximum of 3 times). Each warning
letter is only given 1 month
3. Does the government can guarantee the availability of funds for
investors payments in 20 years?
Answer:
The government guarantees the payment of 20 years contract through
assignment letter to PLN.
4. In relation to solar radiation data required in tender documents, Is the
secondary data can be used?
Answer:
Primary data or secondary data can be used in the technical document
5. How does the preparation of bidding documents, and how much
capacity is allowed to upload each file?
Answer:
Bidding document can be made in the form of 2 pdf files. The First file
is consist of bidding administrative, technical and financial document.
Second File contains bidding price document. Each file is limited to 300
MB. Can be compressed if file exceeds the capacity.
6. Related to the availability of land, is it required an Land Ownership
Certificate and or other form (Notarial Deed)?
Answer:
We only require a statement letter of land availability from business
entities above duty stamp. The coordinates listed in the letter are
binding.
7. In relation with total amounts that will be deposited in an escrow
account and bid security , Does it have a different value for each
business entity?
Answer:
True, each entity will provide different investment value, so it will have

implications to total ammounts for bidding security and escrow

accounts.
8. Related to connection point, field technical, and interconnection
network infrastructure.
Answer:
We just provide information contained in the tender documents. If any
entity considers necessary additional data which is more complete,
then these entity can directly coordinate with PLN area of each location
in order to find the information needed without accompanied by the
committee.
9. How about the cost of interconnection network and how, if it is required
an upgrade at interconnection point?
Answer:
Network costs up to interconnection point is issued by business entity.
PLN has considered technically that network in presented map in
auction document is capable to be connected to solar power without
requiring an upgrade.
10.
What about the format and the legality of the letters of support
that comes from overseas manufacturers?
Answer:
Letters of support should be in the format given in the tender
documents. It can be written in English but also write Indonesian
language. the duty stamp can be adapted from legal system in force in
the country concerned.
11.
In relation to the use of local components, Is these module a
must or can these abort any participants who use import module?
Answer:
The use of local components is not an obligation and can not abort any
participants who use import module.
12.
If the entity that offers the same price between the local module
and import module, which one gets proirotas as the winner?
Answer:
By offering the same price then The entity that use local module with a
minimum of 40% local content will be proritized.
13.
The evaluation system can not find any added value within
participants technical experience or for those who already have a
principal license / location permit as well as other license and land
ownership permit, wherease these things are important for the
certainty of project implementation.
Answer:
Evaluation procedure in accordance with we applied in the tender
documents
14.
Which Bank will provide bidding security and can be used as
escrow saving account ?
Answer:

Bank that provide a bidding security and escrow saving account is a

prime bank which is domiciled in Jakarta.
15.
When the Ministry of EMR will provide the General Electricity
Business Permit (IUKU)?
Answer:
IUKU given after the signing of PPA and plant operation acceptance
which should be expressed by competent authority in providing
Feasible Operation Certification (SLO)

16.
How do I choose a following package, so i can be registered on
bidders list for the desired location?
Answer:
With uploading the bidding documents at desired packages, so
paticipant will be registered automatically in the package

How about writing format of bidding price?
Answer:
Writing of bidding price is up to 2 digits behind the comma. Eg: 23,25
Cents USD / kWh
18.
Is the new company still must attach financial statement?
Answer:
Yes, the new company still attach financial statement
19.
Related to the consortium, leader and share distribution in
consortium?
Answer:
Foreign companies are able to register by doing a consortium with local
company. Leader of a consortium to be local companies. Share
Distribution is according to consortium agreement and consortium
capability.
20.
How about permital process for construction phase?
Answer:
The whole process of licensing issued in the framework of the project
development is business entitys burden. Licensing procedures refer to
the applicable rules and regulations.
21.
How about technical evaluation of all equipment used in the
project?
Answer:
In accordance with the evaluation procedures set out in the tender
documents

How long is allowed from power plant to interconnection point, 5
Km or 10 Km?
Answer:
Interconnection which more than 5 km, then loses after 5 km up to
interconnection point will be paid by business entity

Related to additional time to submit the bidding documents.
Answer:
The committee considers that the established time is enough for any
business entity to prepare all required documents. However, if the
committee think that theres a need to add more time, so it will be
announced later through the website.
24.
Can PV manufacturers and others give more than 1 support?
Answer:
Yes, manufacturers can give more than 1 support
25.
Can authorized agent of foreign products provide support?
Answer:
Yes, Sole agency authorized to provide support
26.
Is the distributor can issue a letter of support?
Answer:
Applicable letters of support from manufacturers or sole agent with
specified format in tender documents
27.
What currency will be used by PLN for paying ?
Answer:
PLN will pay with Rupiah currency, by converting the exchange rates
prevailing at the time of payment.
28.
How if there is a delay in COD?
Answer:
COD delay provisions was stipulated in ERM Ministry Regulation No.
17 / 2013. In the event of agreement expiration, rights and obligations
must be settled in accordance with applicable regulations

What if there is a damage on bidding document ?
Answer:
Incoming bidding document will be backed up automatically. If there
are corrupted files, then it will be taken from back up files stored.

Related to core personnel required, Is it able for employer
reference letter to be replaced with a certificate from the association?
Answer:
Work reference letters can not be replaced with the letter given by the
association
31.
Currently there is no local company who has experience IPP solar
panels. Should not be required when there is a need for a partner or
experienced consultant?
Answer:
The committee did not obligate companies have solar panels IPP
experience

In what year financial statements presented in the bidding
documents?
Answer:
Audited financial statements for the last year
33.
Can participants entering 2 offers?
Answer:

Participants may only enter one quote for the work packages, but
participants can participate in more than one package of quota
auctions
34.
Is DED format can be different?
Answer:
DED format should be in accordance with the format in the tender
documents
35.
What form of CSR should be provided within the project?
Answer:
CSR is given to be adapted from each area regulations
36.
Are all supporting documents must be given any explanation by
using Indonesian language ?
Answer:
Yes, the supporting documents need to be briefed in Indonesian

Answer:
Certificates for inverter which specified in the tender documents must
be fulfilled

In correlation with company administration data submission
Answer:
Entire company both leader or KSO members must fill company
administration data. For foreign companies, data can be customized.

Does company partner which only as a sub-contractors need to
use KSO?
Answer:
If only hired as sub-contractors, so it does not need to use the KSO

Is it okay if two companies use the same vendor in one package
auction?
Answer:
Yes, it is able to use same vendor
41.
Is the auction participants can use experts from sub-contractors?
Answer:
Company of bidders are required to have experts as required in the
tender documents

If electricity network infrastructure in PLTS location is still running
by local government as under construction, Will the auction for this
region still be implemented.
Answer:
PLTS quota project does not have relationship with local government
infrastructure projects
43.
Is the auction participants are required to have the land first?
Answer:
Participants are not required to own or rent land proposed as power

plant location, but participants are prohibited to change the specified

location. The location that has been specified in the tender document
must be used for PLTS construction

Related to TKDN form and TKDN evaluation value
Answer:
TKDN Form for entire solar systems are required for all participants but
price evaluation only consider TKDN module. Participants who fill out
TKDN Form completely will get a value of 100.
45.
How is the procedure of assessment or result ratings for any
using TKDN components or using imported components? Is it based on
price? (eg 25 cents by using imported PLTS will be equal to 30 cents by
using TKDN PLTS) or based on COD ? (eg if COD by using imports PLTS
with the price of 25 cents is one week earlier than TKDN PLTS, will this
imports PLTS get a higher consideration although TKDN PLTS costs 25
cents similarly)?
Answer:
If these have same price evaluation, it will be prioritized by this order :
1. Greater TKDN ; 2. Sooner COD.
46.
Does 5MWp means maximum capacity of solar panel or
maximum capacity that should feed into network?
Answer :
5 WP is the installed capacity of solar panels.

Where is the point of transaction?
Answer:
The Point of transaction is located in plant location

Is the purchase price by PLN that related to bidding price
document already include VAT?
Answer:
Yes, the purchase price is already include VAT

Is it allowed to use thin film modules
Answer:
Yes, its allowed

Related to explanation in the PPA, rights and obligations, as well
as comments submitted at aanwitzing time of related PPA
Answer:
PPA in the bidding document is still in draft, a clause in PPA draft will be
discussed further by PLN. and set out with the agreement of both
parties.
51.
When the funds from escrow account can be used for
construction?
Answer:
The funds from escrow account used to build PLTS after reaching a
financial close.
52.
If there is no agreement between the PLN and business entity, is
it able to withdraw from escrow account ?
Answer:

With justifiable reason, escrow account can be withdrawn with the

consent of ERM general directorate

How about the format and amount of execution security?
Answer:
Format and amount of performance security will be defined by PLN

In relation with Business Entity Administration Form, is it a form
of consortium, whether each company involved in the consortium must
fill out Administration Form internally (each entity) or adequately
represent the Consortium? Then, in the 'Business Entity Management' ,
Should we include only Company's corporate structure corresponding
with companyss deed, or organizational management structure of the
company?
Answer:
Each company must fill out and submit administration form and
corporate structure delivered corresponding with companys deed.
55.
Is BAHP and how its contents?
Answer:
BAHP contains the results of the tender process since registration until
the preparation of lowest bidding price rank. After it was announced,
BAHP will become No Secret status.
56.
How registration with KSO?
Answer:
KSO Registration must be in the name of KSO. Bidding Security on
behalf of KSO. KSO agreement was made according to the format.
57.
May submission time of bidding be extended ? Technical
evaluation is required to complete PLTS geography location which
include contour and soil conditions. Is it possible if the contour detail
and soil conditions on PLTS location can be delivered after being
declared as the winner and before PPA Signing period.
Answer:
Contours detail and soil conditions means that these may include a
general description of PLTS geographical conditions without having to
provide a contour map in DED.
58.
Does SPC company may differ from KSO which follow the
auction?
Answer:
SPC names may be different but composition of membership should
not be changed
59.
Company of bidders is required to have an SBU, what sub-field
must be fulfilled?
Answer:
The committee requires companies engaged in the business of
providing electricity for example power plants construction, general
electrification, and Micro Hydro / Steam Power Plant / Hydroelectric.

60.
What date is the minimum limit of bidding security applied?
Could it be more than 14 days after estimated time of PPA Signing or
should be exactly on that date?
Answer:
The bidding security have been applicable since bids submission
deadline (12/12/2013) up to 14 working days after PPA Signing (more
than 14 days are allowed)
