check payments is two full weeks prior to session date together. Following the cutoff
Nichoal Photography will ONLY accept cash and there will be no exceptions.

CONDITIONS

Deposit and Payment: The client shall make a deposit to retain the photographer to perform the
services specified on the reverse side of the contract. At such time as this order is completed, the deposit
shall be applied to reduce the total cost of services. The client agrees to pay for services in full prior to any
photos taken.
The client also understand that Nichoal Photography only accepts cash and checks. The cut off for check
payments is two full weeks or fourteen days prior to the rendering of services. Following the cutoff only
cash will be accepted.

Cancellations: If the client chooses to cancel this agreement 10 or more days before the session date,
50% of any deposit made to the photographer shall be refunded. If the client chooses to cancel within 10
days of the session date, the deposit then becomes non-refundable and is forfeit.
Photographic Materials: All photographic materials, including but not limited to negatives,
transparencies, proofs and previews shall be the exclusive property of the photographer. If the client
chooses, the photographer shall make physical proofs and previews available to the client for the purpose
of selecting photographs and agrees to pay the proof charge associated with that. If proofs are provided
via CD, the client agrees not to print any of these photos until receiving the full resolution prints via a
medium of their choosing.
Copyright and Reproductions: The photographer shall own the copyright to all images created and
shall have the exclusive right to make reproductions. The photographer shall only make reproductions for
the client or for the photographers portfolio, samples, self-promotions, entry in photographic contests or
art exhibitions, editorial use, or for display within or on the outside of the photographers studio.
Print releases may or may not be included in packages. In the event that the client desires a print release
and it is not included in the package, an extra fee will be assessed. Print releases give the client the option
to print their photos at their discretion, however, the photographer still retains the right to use the
photographs as stated in the above paragraph.
Client Usage: The client is obtaining prints and digital copies of photographs for personal use only, and
shall not sell said prints or digital copies or authorize any reproductions thereof by parties other than the
photographer. If the client is obtaining a print or digital copy for reproduction, the photographer asks that
you notify them prior to usage. The client shall also request that credit for the photographer be placed
adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to
do so.
Failure to Perform: If the photographer cannot perform this agreement due to an unforeseen or even
beyond the control of the photographer, then the photographer will return the deposit to the client but
shall have no further liability with respect to the agreement. This limitation on liability shall also apply in
the event that photographic materials are damaged in processing lost through camera malfunction, or
otherwise lost or damaged without fault on the photographer.
Inherent Qualities: The client is aware that color dues in photography may fade or discolor over time
due to the inherent qualities of dyes. The client releases the photographer from any liability for any claims
whatsoever based upon fading or discoloration due to such inherent qualities.
Photographers Standard Price List: The charges in this agreement are based on the photographers
standard price list. This price list is adjusted periodically and future orders shall be charged at the prices in
effect at the time when the order is placed.
Clients Originals: If the client is providing original prints negatives, or transparencies owned by the
client to the photographer for duplications, reference, or any other purpose, the photographer shall not be
liable for any amount in the event of loss or damage to the original.
Miscellaneous: This agreement incorporates the entire understanding of the parties. Any modifications
of this agreement must be in writing and signed by both parties. Any waiver of a breach or default
hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or
any other provision of this agreement.
