Subject: Mercy petition, to suspend conviction of Ch. O. P. Chautala, Former Chief
Minister of Haryana.
Greetings,
Kadyan Khap International, conveyed its hearty congratulations to everyone including Ch.
Om Prakash Chautala, on the eve of Diwali festival and appeals before your good self to
please consider this mercy petition, to suspend the conviction of Ch. O. P. Chautala, due to
his old age with disability and I can feel the problems faced by him during judicial custody
in Jail.
History of the case, in which he was convicted:
Former Haryana Chief Minister Om Prakash Chautala, moved Delhi High Court to seek a
60-day parole for treatment.
On August 3, Chautala and his son Ajay Singh Chautala's appeal against the high court
verdict was dismissed by the Supreme Court.
However, the two were given leave to move high court for parole on health grounds.
Chautala, his son and three others are all serving 10-year sentence in the teachers'
recruitment scam.
Chautala, 82, wanted parole to get his polio-affected legs treated.
In his petition filed on September 8, Chautala ckauned had last availed one-month parole
in May this year, which was later extended till May 28. Rules state there must be a gap of
at least six months between paroles.
The father-son duo and 53 others, among them two IAS officers, were convicted in January
2013 for rigging recruitment of 3,206 junior basic trained (JBT) teachers in Haryana in
2000.
On March 5, the high court had upheld guilty verdict suspects in the case saying: The
overwhelming evidence showed the shocking and spine-chilling state of affairs in the
country."
Besides the Chautalas and whistleblower IAS officer Sanjiv Kumar former Director of
Primary Education the high court had also awarded a 10-year sentence to IAS officer
Vidya Dhar, then Officer on Special Duty (OSD) to the Chief Minister, and Sher Singh
Badshami, then an MLA and political adviser to Chautala senior.
The high court had modified the trial court's order and sentenced others except the five to
two years of jail.
Grounds of Mercy petition:
1. The said decisions were taken by the cabinet or some other individuals, whereas Ch.
O. P. Chautala was not involved directly in the said scam, as Chief Minister.

2. Ch. O. P. Chautala and his popular name knows by everyone along with physically
handicapped situations, whereas everyone can feel problems faced by him, during
custody.
3. Kadyan Khap International, in the opinion that conviction and custody, is a lesson
for a person, to realize their guilt and fault.
4. Ch. O. P. Chautala, at the age of 82 years with disability, doesnt allow him, to
break any laws of the land, being permanent disabled till last breath.
5. No doubt, Ch. O. P. Chautala needs medical aid and treatment for recovery from
permanent disability.
6. We feel that Ch. O. P. Chautala facing unnecessary pain and sufferings, during
custody and he has legal and human rights, to avail medical treatment facility.
7. We are also in the opinion that Honble Court of Law, taught lesson to Ch. O. P.
Chautala for his wrong doings, which he feels in the interest of public but
procedure, adopted by them, was against natural justice for sufferers and effected
parties.
Hence keeping in view above said explanations, our prayers for suspension of conviction to
Ch. O. P. Chautala may kindly be considered and accepted, in the interest of public at
large, to set example of kindness, when we have fundamental rights along with duties, as
defined under article 51 A (g) of Indian Constitution, treated animals in humane way then
Ch. O. P. Chautala have also feelings and can speak his grievances and sufferings. It would
also be pertinent to mention here that I am not followers of INLD and have difference of
opinion well but my conscious allowed me to move this mercy petition, without any
consultations of INLD supporters or any political class of leaders.
