1.3

This part of the Specification covers general


matters not covered in other Standard Specification
Parts.
1.2

SAFETY

The Contractor shall be the Principal Contractor as


defined in the Workplace Health and Safety Act
1995 (WHS Act), as provided for in the General
Conditions of Contract for the Works under the
Contract. The Contractor shall be responsible for
the safety of its workers, Subcontractors and the
public as described in the WHS Act. The
Contractor shall also ensure the safety of the public
entering, using and leaving platforms at railway
stations.
The Contractor shall prepare for the Works a
written Safety Management Plan, which shall meet
the full requirements of the WHS Act. The
Contractor shall lodge its Safety Management Plan
with the Superintendent within fourteen days of
award of the Contract and prior to the
Superintendent granting approval for the
Contractor to commence work on site.
The Contractor shall establish safety procedures
and shall ensure that the Contractors workers and
Subcontractors are trained in the procedures and
comply with them.

Where the Contractor is required under the


Contract to carry out work over, under or adjacent
to the operating railway, the Contractor shall
provide to the Superintendent a work method
statement, risk analysis and risk management plan
for such work, a minimum of 14 days prior to the
commencement of the work. If the work method
statement, risk analysis and risk management plan
are inadequate, the Contractor shall carry out any
additional
requirements
imposed
by
the
Superintendent to reduce the risk to the operating
railway caused by the Contractors activities to an
adequate level. Such requirements shall be met by
the Contractor at the Contractors cost.

PROGRAM OF WORK

The Contractor shall submit to the Superintendent


a detailed program of work within fourteen days
from the date of notification of acceptance of the
tender.
In preparing the program, the Contractor shall take
note of particular requirements (if any), given
elsewhere in the Specification.
The Contractor's work program shall be in bar
chart format or other form approved by the
Superintendent with the following minimum
requirements: (a)

The program shall be drawn to a time scale


of working days or weeks as appropriate.
Dependencies shall be shown and critical
activities identified. Generally, activities
within two weeks of critical shall be shown
as critical.

(b)

The bar chart shall consist of the appropriate


activities which accurately represent the
Contractor's proposed method of completing
the whole of the Works and shall include all
major elements of the Works.

(c)

The bar chart shall be sufficiently detailed to


enable the Principal to integrate and
co-ordinate its own or others activities
where relevant.

(d)

The duration of each activity shall be shown


and shall be expressed in working days.
Where applicable progress rates upon which
durations are based shall be shown.

(e)

The weighting of the work content of each


activity shown on the bar chart shall be
shown as a percentage of the total Contract.
The percentage shown is to be generally
based upon the labour, equipment and
material content.

The Program of Work shall take into account the


availability of track possessions, the availability of
isolations of the overhead traction wiring
equipment in electrified areas and all other
constraints as specified elsewhere in these
documents.
If and when requested by the Superintendent, the
Contractor
shall
prepare
and
furnish
supplementary bar charts to analyse and clarify
complicated and questionable areas within the
program. Supplementary bar charts shall be
submitted to the Superintendent within seven
calendar days from the date on which the

Superintendent makes such a request or within a


mutually agreed period.
If and when requested by the Superintendent, the
Contractor shall supply in writing to the
Superintendent, a weekly report comparing actual
progress on key activities to planned progress as
shown in the Contractors Program of Work.
Within two days of the end of each month the
Contractor shall submit to the Superintendent a
progress report including the program bar chart
updated to show the following information at the
close of the month: (a)

Progress achieved on all activities.


Actual start and completion dates of all
activities.
Actual staff and wages personnel employed.

Each progress report shall include comments on


revised, re-scheduled and re-estimated activities
based upon the Contractor's current progress.
If at any time the actual progress of the Works
does not conform to the work program by more
than 10% of the Contract period, with a maximum
of four weeks, the Superintendent may direct the
Contractor to prepare a revised program.
The revised program shall show modifications to
the original program necessary to enable
completion of each stage of the Works by the
relevant completion date nominated within this
Contract or such extended time granted pursuant
to the Contract.
Any revised work program shall be submitted
within seven days from the date on which the
Superintendent gives such direction or within a
mutually agreed period.
An item for "Program of Work" has been included
in the Bill of Quantities and includes payment for all
work associated with the preparation and revision
of the Program of Work, supplementary bar charts
and weekly key activity reports, and the monthly
progress reports.

DRAWINGS SUPPLIED BY THE


PRINCIPAL

The Drawings which are to be read in conjunction


with this Specification are listed and included in the
Drawings section of these Documents.

Documents. Where such a summary is included, a


complete reinforcement schedule showing bar
bending details will be supplied to the successful
Tenderer only.
1.5

DRAWINGS AND/OR SPECIFICATIONS


PREPARED BY CONTRACTOR

The Contractor will be required to prepare such


construction and erection drawings, other than
those submitted with the tender, as may be
specified elsewhere in these documents.
All drawings and/or specifications prepared by the
Contractor
must
be
submitted
to
the
Superintendent for approval and/or review.
Following acceptance and/or review by the
Superintendent, all such drawings and/or
specifications shall become part of the Contract
Documents, but notwithstanding such acceptance
and/or review, the Contractor shall bear full
responsibility for the accuracy and completeness of
the drawings and/or specifications, for the technical
correctness of all portions of the work covered
thereby and for carrying out the work in full
accordance with the Contract Drawings and this
Specification.
All drawings submitted by the Contractor shall be
prepared in ink on A1 polyester drafting film or in
such other manner suitable for reproduction as
may be approved by the Superintendent. The cost
of preparation of all such drawings will be the
Contractor's responsibility and will be deemed to
be included in the relevant Bill Unit Prices. All
drawings will become the property of the Principal
on completion of the work.
1.6

ALTERNATIVE DESIGNS

Tenderers may submit alternative designs and/or


substitute materials to alternative specifications
only for those aspects of the Works noted as such
in the Specification.
Tenderers shall, before preparing their tenders,
obtain written advice from the Superintendent that
the proposed alternative design and/or use of
substitute material will be given consideration.
Tenderers submitting alternative designs will be
required to provide calculations and drawings with
their tenders and Tenderers proposing to substitute
materials to alternative specifications will be
required to provide such specifications with their
Tender.

Final acceptability of any alternative designs or


materials will be dependant upon the checking of
the detailed proposals submitted with the Tender to
ensure that such designs or materials are the
equivalent of the Principals design in strength,
appearance and accessibility for inspection and
maintenance. Where an alternative design or
material does not meet such requirements,
acceptability will be dependant upon the Tenderer
agreeing to suitably modify the alternative design
without variation of the tender price.

The cost of detailed checking by the


Superintendent of any alternative design submitted
in an accepted Tender shall be borne by the
Contractor and payment of such costs shall be
made to the Principal by the Contractor.

If the ordered quantity is greater than twice the Bill


Quantity, a new reduced unit price shall be
negotiated between the Contractor and the
Superintendent.

The value of the difference between the provisional


quantity shown in the Bill of Quantities and the
quantity ordered by the Inspector calculated at the
relevant Bill Unit Price shall be added to or
deducted from the Contract Sum as the case may
be.

The Superintendent will only accept alternative
designs that are based on proven technology and
accepted engineering concepts and principles.
Alternative designs must offer cost and/or
performance benefits to the Principal to be
accepted. The Contractor shall ensure that all
alternative designs are certified by a Registered
Professional Engineer Queensland (RPEQ), or
equivalent acceptable to the Superintendent.
1.7

MEETINGS

Prior to the commencement of work on site, the


Superintendent will arrange for a pre-start meeting
to be held, to be attended by the Contractor, the
Superintendent
and
any
other
persons
representing other railway divisions and/or outside
organisations that have an involvement in the
Contract Works.
During the Works, the Superintendent may arrange
meetings on site at regular intervals to review
progress of the Works and coordinate other
activities if applicable. Other meetings may be
called by either the Contractor or the
Superintendent whenever the need arises.

MATERIALS

All materials supplied by the Contractor for use in


the work shall be of appropriate quality and shall
comply with any relevant Australian Standards or
other requirements specified herewith.
When any firm's name or product is mentioned in
this Specification, the proviso "or approved
equivalent" shall be understood and no alternative
material to that specified shall be used without
approval in writing by the Superintendent. Work or
material described as "approved" or "to approval"
shall mean approved by the Superintendent. Such
approval shall not be considered as relieving the
Contractor of any responsibility.
The Superintendent shall have the right to make
any tests required or considered necessary on any
materials supplied under the Contract to determine
whether they comply with the Specification. The
Contractor shall supply, at its cost, sufficient
samples and/or specimens to enable the tests to
be carried out.
1.10

PROTECTION OF EXISTING FACILITIES

1.10.1 Operating Railway

PROVISIONAL ITEMS AND QUANTITIES

Items in the Bill of Quantities shown as provisional


shall either be a provisional sum or a provisional
item or shall have a provisional quantity.
A provisional sum shall be treated in accordance
with Clause 11 of the General Conditions of
Contract.
For a provisional item or quantity, the item or
quantity will not be paid unless and until the
Inspector has ordered in writing that the work be

In the performance of any work associated with the


Contract that may affect the Operating Railway, the
Contractor shall execute the work in accordance
with the relevant clauses of the Special Conditions
of Contract and in such manner as not to impede,
obstruct or interfere in any manner whatsoever with
existing Operating Railway and Operating Tracks
(including overhead electrification equipment and
signalling equipment) or the normal operation
thereof.

No earth or other material shall be permitted to


contaminate the ballast on existing railway tracks.
The Contractor shall bear the full cost of cleaning
or replacement as required of any ballast
contaminated during execution of the Works by the
Contractor.
The Contractor shall not store any unsecured
equipment or material, or leave any rubbish
adjacent to the Operating Railway, after hours of
work. At the end of each working day, the
Contractor shall secure, clear of the Operating
Track, equipment or materials required for the next
days work activities. Other equipment, material
and rubbish shall be removed from work sites
adjacent to Operating Railway.
Any equipment or material stored on railway
property adjacent to Operating Railway shall be
secured to the satisfaction of the Superintendent.

Parthenium weed is a declared plant under the


Rural Lands Protection Act 1985-90. In ten Central
Queensland Shires covering a rough triangle
formed by joining the towns of Emerald,
Rockhampton and Townsville, Parthenium weed
infestations must be reduced or prevented from
spreading. In all other parts of Queensland, the
plant must be destroyed.
The Contractor shall include in the Construction
Environmental Management Plan a procedure for
controlling the spread of the plant. Such procedure
shall include:
(i)

1.10.2 Services
The locations of services shown on drawings have
been determined as accurately as possible from
records available. Before commencing the Works,
the Contractor shall arrange to check this
information and for the presence of any other
services not shown on the Drawings.
The Contractor shall take care during the progress
of the Works to avoid damage to any pipelines,
drainage structures, water, gas, electricity,
telephone or other services owned either by the
Principal or other Authorities.

Determining and recording the incidence of


the plant along the route and adjacent
properties;
Treating known infestations with herbicide;
Ensuring all vehicles and machinery brought
onto the site are free of Parthenium weed
seed at the commencement of work and
before they leave the site to do work on
other projects;
Educating all personnel working on the
contract as to the significance of the plant;
Ensuring that topsoil containing Parthenium
seed is used in the area from which it was
collected and not spread into clean areas

Any other noxious weeds encountered during the


Works shall be handled by the Contractor in the
same controlled manner as above.
1.12

TEMPORARY WORK

1.12.1 Below High Water Mark


Any damage to such services and/or structures
shall be repaired at the Contractor's cost either by
the Contractor to the satisfaction of the Authority
concerned, or if the relevant Authority so elects,
repairs will be effected by the relevant Authority.
The Contractor shall also be responsible for all
costs incurred by the Service Authority due to
interruptions to the service caused by any damage
done by the Contractor.
In electrified railway areas, any damage to
overhead traction wiring components are serious
safety hazards. Any damage to grading rings
(copper wires buried around existing mast
foundations) or traction bonds (cables attached to
the railway rails) must be immediately reported to
the Inspector or the Protection Officer.
1.11

PARTHENIUM WEED AND OTHER


NOXIOUS WEEDS

The Contractor shall meet the requirements of


Section 86 of the Harbours Act, including obtaining
prior approval from the Governor in Council for any
work below High Water Mark.
This will apply to any temporary work proposed by
the Contractor.
Applications for the Governor in Councils approval
should be made to the Department of Environment
on prescribed forms and be accompanied by a fee
and engineering drawings detailing the scope and
nature of the temporary work. The fee to be paid to
the Department of Environment is generally on the
basis of the value of the temporary work below
High Water Mark.
For further particulars, the Contractor shall liaise
with the relevant Department of Environment
regional centre located in Cairns, Townsville,
Rockhampton, Toowoomba or Brisbane.

The cost of obtaining these approvals and


complying with any conditions shall be deemed to
be included in the Contract Sum.
1.12.2 Alterations to Watercourses
The Contractor shall obtain the approval of the
Department of Primary Industries prior to carrying
out any temporary work which will alter the beds or
banks of any watercourse.
Any remedial work or protection work required by
the Department of Primary Industries due to the
work proposed by or carried out by the Contractor
shall be the responsibility of the Contractor.
Temporary work shall be carried out by the
Contractor at the Contractors cost. At the
completion of the Works, the Contractor shall
obtain a written clearance from the Department of
Primary Industries stating that the watercourse has
been restored to a condition acceptable to that
Department.
1.12.3 Temporary Level Crossings
If desired by the Contractor and if considered
necessary by the Superintendent, the Principal will
provide, free of charge to the Contractor,
temporary level crossings over the railway track or
tracks to enable the Contractor to gain access to
camp and/or work areas, or for the passage of
machinery or earthmoving plant engaged in the
Works. Approach earthworks to such crossings
shall be constructed by the Contractor to the
approval of the Inspector and in electrified areas,
height gauges of an approved design shall be
constructed on each side of the railway track. Full
compensation for the cost of constructing and
removing earthworks, together with any necessary
provision for drainage, shall be deemed to be
included in the Contract Sum.
The Contractor shall provide height barriers at all
locations where the Contractors plant intends to
pass under overhead traction wiring whether live or
not. No vehicle whose unladen height in travelling
mode exceeds 3.9 metres shall be allowed across
Operating Railway Tracks. This height limitation
includes radio antennae and any other extraneous
device fitted to the vehicle.
The height gauges shall be designed to give a
clear indication that a vehicle exceeds the height
limit. The Contractor shall arrange for height
barriers to be designed to resist wind and other
loadings in accordance with Australian Standards.
Prior to fabrication, the detailed drawings of the

height gauge, together with a design certificate


signed by an RPEQ, shall be submitted by the
Contractor to the Superintendent for review and the
design shall be modified by the Contractor as
required.
The height gauges shall be located as far away
from the crossing as possible and in such locations
and with such orientations that a collapse will not
foul any railway track or the principals installations.
No height gauge shall be erected until its location
and orientation has been approved by the
Superintendent.
The Contractor shall be liable for any loss, damage
or injury occasioned by the presence or the
operation of the height gauge and shall indemnify
the Principal accordingly.
All costs associated with the design, fabrication,
delivery, erection, maintenance and removal of the
height gauges and associated warning signs,
together with any temporary works, shall be
deemed to be included in the Contract Sum and no
separate payment shall be made.
If a temporary level crossing is desired, the
Contractor shall make written application to the
Superintendent stating the proposed locations and
required durations of any such crossings. The
Principal will require the Contractor to execute a
Deed of Indemnity acceptable to the Principal and
to pay the prescribed fee. The Principal will
arrange for the construction of the crossings.
The Contractor will be required to comply with all
the Principals Rules and Regulations relating to
the use of such crossings and to obey all directions
from the Principals Officers. The movement of
trains shall have priority at all times and the
Principal shall not be liable for any costs
associated with the delay to earthmoving or other
equipment caused by the passage of trains.
Where considered necessary by the Principal, a
Protection Officer will be provided by the Principal
at all temporary level crossings provided for the
passage of earthmoving or other equipment. Such
level crossings shall only be used during daylight
hours and it shall be the Contractor's responsibility
to ensure the safety of all vehicles using the
crossings.
1.13

AUSTRALIAN STANDARDS

Where an Australian Standard is referred to in


these documents, it shall be understood that
reference is made to the latest edition of such

Australian Standard with any amendments thereto


or to any superseding Australian Standard.
1.14

ITEMS FOR REVIEW OR APPROVAL

Where there is a requirement for the Contractor to


submit for review or approval by the
Superintendent any item including drawings,
samples and the like, the Contractor shall so
submit promptly and progressively and shall allow
fourteen days for the Superintendent to review or
approve any item, unless some other specific time
is specified elsewhere in these Documents for a
particular review or approval.
1.15

ESTABLISHMENT

An item for "Establishment" has been included in


the Bill of Quantities and in this item, the Contractor
shall include the costs of the following.
1.

Mobilisation of the Contractor's plant and


equipment (excluding pile driving plant)
throughout the Contract and demobilisation
on completion.

2.

Provision, maintenance and equipment of all


workshop sheds, stores, offices and the like,
sanitary and other accommodation, first aid,
medical, welfare arrangements and other
services if required.

3.

All temporary lighting, barricades, signs, etc.


for the protection of the Works and the public
if not specifically covered elsewhere.

4.

Taking out of all necessary insurance


policies, attendance at site meetings,
compliance with the Workplace Health and
Safety Act and General and Special
Conditions of Contract.

5.

All other items which are necessary for the


complete and proper performance of the
Contract and which are not provided for
elsewhere in the Bill of Quantities.

The Bill Price for Establishment shall include full


compensation for all costs not provided for
elsewhere in the Bill of Quantities. The Bill Price
shall be paid in two instalments as follows:
(1) 80% upon the Contractor's full
establishment on site;
(2) 20% on the complete dis-establishment
of the Contractors site facilities, in the
Certificate of Practical Completion.

TEMPORARY SITE OFFICE

The Contractor shall provide, service, clean and


maintain an approved office at the work site for the
exclusive use of the Principals personnel for the
duration of the Works.
The position of the office shall be agreed with the
Inspector. If, during the progress of the Works,
relocation of the office becomes necessary, it shall
be relocated with a minimum of inconvenience and
at the Contractor's cost.
The requirements for the office for the Principals
personnel are as follows: -

FLOOR AREA:
Not less than 15 square metres.
STRUCTURE:
Fully weather-proofed, sheeted externally
with metal cladding or similar, lined and
ceiled internally and insulated with one layer
of reflective foil laminate, a fixed metal clad
awning at least 1.8m wide along the front
long side of the building. Windows of not
less than 10% of floor area; at least half of
the windows shall be openable and lockable.
Doors shall be lockable.
FLOOR:
Raised clear of the ground, timber boarding
or similar. Concrete slab on ground, 100mm
thick, under the full extent of the awning.
SERVICES:
Electricity - for lighting, air-conditioning,
refrigerator plus two other general purpose
power outlets.
Water - external connection to the office.
Telephone/facsimile - One Telecom autodetect shared line telephone/facsimile device
equipped with external bell for the exclusive
use
of
the
Principals
personnel.
Alternatively, the Contractor shall provide a
mobile phone where directed by the
Superintendent.
FURNITURE & FITTINGS:
1 plan desk/drawing table of dimensions
1500mm x 900mm.
1 office stool.
1 two-drawer lockable filing cabinet with 50
suspension files.
1 office table with lockable drawers.

The Contractor shall be responsible for the security
of the temporary site office including all equipment
contained therein. Any items stolen or damaged
shall be promptly replaced or repaired by the
Contractor.
The office shall be ready for occupation before any
major site operations are commenced. Relocation
shall be carried out only with the permission of the
Inspector.
The office and all associated equipment shall
remain the property of the Contractor and shall be
removed from the site on completion of the Works
including demolition of the concrete slab. All work
associated with the provision and removal of the
office, equipment and associated facilities listed
above, excluding the cost of telephone rental and
calls, shall be deemed to be included in the Bill
Item for "Site Office". The Contractor shall pay all
accounts for the site office phone/mobile phone
and shall submit to the Superintendent copies of
detailed accounts.
The Contractor shall be
reimbursed the cost of telephone rental and calls
plus 10%.
1.17

WATER

All water needed in connection with the Works for


construction, drinking and other purposes shall be
provided by the Contractor. If required, water
storage tanks shall be of sufficient volume to
ensure that adequate supplies of water for all
purposes are available at all times during the
progress of the Works.
Costs for providing and maintaining the supply of
water shall be deemed to be included in the
Contract Sum.

The Contractor shall set a brass permanent survey


mark in the structure or structures in the position
shown on the Drawings. The permanent survey
mark or marks will be supplied by the
Superintendent.
1.20

PROVISION FOR VEHICLES AND


PEDESTRIAN TRAFFIC

The Contractor shall be responsible for providing


safe, convenient and continuous passage of road
traffic and pedestrians as required by the Local
Authority, Police Service (Qld) and the
Superintendent.
No work in connection with any alterations to traffic
arrangements shall be commenced until approval
in writing, granted by the Local Authority and, if
necessary, the Police Service (Qld), has been
submitted to the Superintendent.
Temporary advance warning devices including
signs, lights, road markings, barriers, barricades
and other devices as specified elsewhere in these
documents or as determined by the Inspector shall
be supplied and installed by the Contractor.
All signs etc shall be provided and located in
accordance with Part 3 of the Manual of Uniform
Traffic Control Devices published by the Transport
Technology
Division
of
the
Queensland
Department of Main Roads.
Temporary warning lanterns of approved design
shall be used during the hours between sunset and
sunrise, in conjunction with all temporary signs etc
which are to remain in position at night.
Signs which are to be used for the warning and
guidance of traffic at night shall be reflective with
the exception that no red lights or red reflectors
shall be used at any time where visible from the
existing operating railway tracks.
For the duration of the Contract or as otherwise
approved, signs, lights, barriers and barricades etc.
shall be maintained by the Contractor in good order
and securely fixed in the correct position.

The Contractor shall supply and maintain a set of


appropriate survey instruments sufficient for
checking the level of work items. The instruments
shall be kept at the site for the use of the Inspector
whenever required. The instruments shall remain
the property of the Contractor.

No defective signs, lights, barriers or barricades etc


shall be used on the Works. All temporary control
devices shall be removed when no longer required.
All devices shall become the property of the
Contractor when no longer required and shall be
removed from site.

Drawings, each sign shall be erected on at least
two 102mm x 4.9mm steel circular hollow section
posts adequately founded at least 1.5m below
ground level, with the soffit of the signs
approximately 1.2m above ground level.
Signs shall be erected within four weeks after the
date of acceptance of the tender. The signs and
supports will remain the Contractors property on
completion of the Works and shall be dismantled
and removed from site by the Contractor on
completion of all site Works
1.22

SURVEY SET OUT

The Contractor shall arrange to set out the Works


to the survey details given in the Drawings, as
required by Clause 28 of the General Conditions of
Contract. The Contractor shall only use a suitably
qualified surveyor to accurately and completely
meet the surveying requirements of the
Specification. Surveying can be carried out on the
corridor of an Operating Railway only when a
Protection Officer is present, unless approved
otherwise in writing by the Superintendent.
Where the Works include a structure or structures
that are located close to the property boundary of
the Principals property or corridor for an operating
railway, before the Contractor commences work on
that structure or structures, the Contractor shall be
responsible for locating the real property boundary
and shall be responsible for ensuring that the
structure or structures are not constructed outside
the Principals property, unless such work is
specifically
allowed,
in
writing
by
the
Superintendent, to take place within a Road
Reserve or other Crown Land.
Where the position of the structure or structures
conflicts with the real property boundary, the
Contractor
shall
immediately
notify
the
Superintendent of the conflict and request a
direction. The Contractor shall ensure that the

HAULAGE OVER PUBLIC ROADS OR


RAILWAY FORMATIONS

The Contractor shall be responsible for identifying


suitable sources of earth, rock and pavement
materials and areas for the disposal of spoil
materials.
Where haulage is to take place over public roads
or existing railway formations, the Contractor shall
obtain prior written approval for such haulage from
the relevant road or railway Authority. Any
conditions specified in the approvals must be
satisfied by the Contractor at the Contractors cost.
In order to establish the condition of an approved
haulage route existing prior to the start of the
Works, the Contractor shall arrange for a joint
survey of the route with the relevant Authority and
shall make a photographic or other agreed record
of the surface condition of the road or railway
formation before haulage is commenced.
The Contractor shall reach agreement with the
relevant Authority concerning the frequency of
inspection of the approved haulage routes for
damage. The cost of the survey shall be borne by
the Contractor.
A Hold Point shall apply prior to the
commencement of haulage over public roads or
railway formations until the Contractor has
obtained the approval of the relevant Authorities
and has completed the above pre-existing
condition survey and the Superintendent has
authorised the use of the route.
Prior to the commencement of haulage over public
roads or railway formations, the Contractor shall
lodge a security to the Principal as provided for in
Clause SC19 of the Special Conditions of Contract
for haulage over either or both public roads and
railway formations as applicable.
The security shall be provided by the Contractor as
a guarantee of good faith that all damage to public
roads and/or railway formations caused by the
Contractors haulage operations shall be paid for

by the Contractor. The cost of work by necessity


carried out by the relevant Authority to restore the
road or railway formation, and not paid for by the
Contractor, shall be paid for from the security.
The security shall be held by the Principal until the
completion of the Works at which time it will be
returned to the Contractor in accordance with
Clause SC19 of the Special Conditions of Contract
provided the Contractor has supplied to the
Superintendent clearances from the relevant
Authorities that there are no further requirements
for repairs to the roads or railway formations.
If an Authoritys road or railway formation has been
damaged by the Contractors haulage operations
and the Authority has requested the Contractor to
carry out repairs, the Contractor shall carry out the
repairs at the Contractors cost to the satisfaction
of the Authority.
If the repairs have not been carried out by the
Contractor within the time specified by the
Authority, the Authority may have the repairs
carried out by others and charge the work to the
Contractor.
The Authority may submit any account not paid by
the Contractor within the specified time to the
Superintendent for payment by the Principal direct
to the Authority. If the Authority is able to
substantiate the account to the satisfaction of the
Principal, the Principal may, after giving notice to
the Contractor, pay the account and debit the
amount against the security provided.

The Contractor shall remove all temporary


benching, stream diversions, temporary drains, etc
and restore the ground to original level. Any
backfilling material shall be placed in layers not
exceeding 150mm thick and compacted by rollers,
mechanical tampers or other suitable equipment.
Full compensation for all costs associated with
clearing up and restoring the site, removal of all
surplus materials and litter and repair of existing
roads and access tracks used during the Works
shall be deemed to be included in the Contract
Sum.
1.25

BILL OF QUANTITIES

1.25.1 Quantities
(a)

The Quantities in the Bill of Quantities have


been determined in accordance with the
description in the "Quantity" column in Table
1.1.

(b)

Variations in quantities resulting from any


variation in the Works ordered by the
Inspector will be measured and evaluated in
accordance with the Contract Bill Unit
Prices.

The Bill Unit Prices for each Item shall include full
compensation for all costs associated with that
Item including those listed in the "Unit Price"
column in Table 1.1 and all other incidental work.

If a dispute arises, the Contractor shall advise the


Superintendent of the details of the dispute within
seven days. The Superintendent shall be available
to mediate between the Contractor and an
Authority if required.
1.24

COMPLETION OF SITE WORKS

On completion of all site Works, the Contractor


shall restore the areas disturbed during the course
of the Works to their original condition and leave
the site in a neat and tidy condition.
