1. We have heard Mr. Joshi, learned counsel

appearing for the petitioner, Mr. P.R.Nanavati,
learned counsel for respondents no.2 and 3 and
Mr.Dave,learnedAGPforrespondentno.1.
2. Therespondentno.2isdirectedtoproducecolour
photographsofthedocumentsproducedfrompages
70to74.
3. It prima facie appears that contention of the
petitioner is that the weighing bridge is non
existing whereas, Mr. Nanavati for respondents
no.2and3contendsthatin2010,weighingbridge
was purchased and it was installed in 2011.
Thereafter, it was nonfunctional and for the
purposeofrunningweighingbridge,contractwas

giventooneRameshwarWeighbridgeforrepairing
or by replacing and since Rameshwar Weighbridge
company was in the process of dismantling, SCA
No.13799/14 was preferred by Rameshwar Marine
Servicesandthecontractwascancelledandthe
publicadvertisementwastobeissued.
4. Itprimafacieappearstousthatsuchanattempt
is by way of eyewash. Even if the photographs
areconsidered,whichareproducedbyrespondents
no.2and3withtheaffidavitinreply,itshows
that the weigh bridge does not appear to be on
the site. Such may lead to mischief or
illegalityofthepublicpropertybyshowingthat
somethingispurchasedandisinstalled. Hence,
beforewedirectforfurtheractionagainstthe
officer/sofrespondentnos.2and3,itisjust
andproperthattheactualpositionofsitewith
the panchnama is brought on record and
thereafter,themattermaybeconsideredfurther.
Hence,theDistrictJudge,Rajkot,isdirectedto
depute one officer not below the rank of
Registrar to draw the panchnama and take
photographsofthesitelocatedatNavlakhiPort
for which the photographs are produced in the
present petition. The said officer shall draw
the panchnama in presence of Mamlatdar of the
concernedareaandthephotographsshallalsobe
taken.Thepetitioneraswellastheofficerof
respondentno.2shallbeatthelibertytoremain
presentatthetimewhenthepanchnamaisdrawn

andthephotographsaretaken.Thereportshall
besubmittedwithinthreeweeksfromtoday.The
Maritime Board shall deposit the amount of
Rs.10,000/ towards probable cost and
remuneration and such amount shall be deposited
withinoneweekfromtodaywiththisCourt.
5. S.O. to 16.09.2015. The petitioner as well as
respondent no.3 shall ensure that the order is
communicatedandthereportissubmittedwellin
time.
