ARTIST shall have sole and exclusive control over the production, presentation, and performance of the engagement herein including but not limited to
the details, means, and methods of the performances of the performing ARTIST. ARTIST’S obligations herein are subject to detention or prevention by
sickness, accident, riots, strikes, epidemics, acts of God, or any act or order of any public authority beyond ARTIST’S control.
The entertainment presentation to be furnished by ARTIST herein shall receive billing in such order, form, size, and prominence as directed by ARTIST.
ARTIST is also entitled to a maximum of 15 complimentary tickets for special guests of the ARTISTS.
If before the date of any scheduled performance it is found that PURCHASER has not performed fully its herein agreed obligations or that the financial
credit of the PURCHASER has been impaired, ARTIST may cancel this agreement. In this event, ARTIST shall have the option to perform or refuse to
perform and in either event PURCHASER shall be liable to ARTIST for the full compensation required herein, as well as all attorney fees necessary to
collect the due compensation.
PURCHASER shall provide a reasonable amount of time for sound check at least 3 (three) hours prior to scheduled start time of engagement.
PURCHASER agrees to provide a competent sound technician, to be present both at sound check and throughout the course of the engagement.
PURCHASER shall provide ARTIST with one private dressing room, which will be clean, dry, well lit and air conditioned.
No recording, reproduction or transmission of Performance is allowed without the written permission of ARTIST or ARTIST’S representative.
PURCHASER grants the right to ARTIST to sell ARTIST merchandising items, including, but not limited to: T-shirts, CD’s, photographs, caps, and any
other ARTIST promotional items pertaining to the ARTIST or to the specific Performance.
PURCHASER may cancel this Agreement thirty (30) days prior to Performance without any penalties. Where the PURCHASER cancels this Agreement
after the final cancellation date the Purchaser will be required to pay any balances owing in full and will be responsible for any and all attorney fees
necessary for the ARTIST to recoup the balance due.
In the event this show is not presented because of inclement weather, or an act of God, the act must still be paid in full, provided ARTIST is present and
ready to perform at the designated time as specified in this contract.
Deposit money due to the ARTIST must be received 7 days from the receipt of this contract in the form of a cashier’s check or money order. In the event
that the deposit money and signed contract is not received by the ARTIST in this time frame, ARTIST reserves the right to cancel the contract.
This constitutes the sole, complete, and binding agreement between the parties hereto. The Agreement may not be changed, altered, or modified except by
an instrument in writing signed by both parties. Any claim or dispute arising out of or relating to this Agreement or the breach thereof will be adjudicated
according to the laws of the State of Texas by the appropriate legal authority in the State of Texas.
