Dear Members
Welcome to the 2014 sailing programme, there are many events on over
the year and it will be great to see many of you on the water. We will be
hosting the Junior Federation race in September and lets hope the
weather allows the event to take place on the sea. On 21st September
we have Barts Bash which is a race in memory of Andrew Bart
Simpson who tragically passed away whilst sailing. This is a world record
attempt to see as many boats on the water and many other clubs will be
taking part. More information will follow throughout the season.
Please take time to look at all the events that the Sailing and Fundraising
& Social committees have put in for the next year and put them in your
diary.
We welcome Allen Hare as Membership Secretary, but must also thank
Keith Done for his valued input to the role over the last 6 years. With the
changes we now have a new email address for the correspondence of
the club and this is membership@bexhillsc.co.uk so that you are able to
get the up-to-date emails from the club you will need to make sure that
this address is in your email account. There are also many other direct
contact email addresses and they can be found in this programme.
The club survives on the good will and time of all its members, please if
you are scheduled to do a duty make sure that you are able to do it or
swap so that the duty is covered, this is especially important for the bar
as it could end up with the bar being shut when we are all thirsty.
The Galley will be open and fully functioning and we welcome Julie back
for the 2014 season, please come support the galley.
Thank you for re-joining Bexhill Sailing Club and look forward to seeing

SAILING INSTRUCTIONS 2014


Following the RYA report on the dangers inherent on retraction of the centreboard during inversion,
BSC recommends that dinghy sailors are encouraged to use centreboard/daggerboard elastic
tiebacks or tie downs, or other effective mechanism, in addition to existing centreboard brakes, as a
means of preventing centreboard retraction during inversion.
Members not racing but sailing for pleasure are reminded to sign in and out on the Jolly Board
provided.
1.0 RULES
1.1 Racing will take place under the current Racing Rules of Sailing, the prescriptions of the RYA, the Notice
of Race, these sailing instructions and the appropriate class rules. In the event of conflict with the Notice of
Race these sailing instructions shall prevail.
1.2 All events are designated Category C.
2.0 CONDITIONS OF ENTRY
(i) A boat is entirely responsible for its own safety, whether afloat or ashore, and nothing, whether in the
Sailing Instructions or anywhere else, reduces this responsibility.
(ii) It is for the boat to decide whether it is fit to sail in the conditions in which it will find itself. By launching or
going to sea, the boat confirms that it is fit for those conditions and that its crew is competent to sail and
compete in them.
(iii) The boat is required to hold adequate insurance and in particular to hold insurance against third party
claims in the sum of at least 2,000,000.
(iv) Nothing done by the organisers will reduce the responsibility of the boat nor will it make the organisers
responsible for any loss, damage, death or personal injury, however it may have occurred, as a result of the
boat taking part in the racing. The organisers encompass everyone helping to run the race and the event,
and include the organising authority, the race committee, the race officer, patrol boats and beachmasters.
(v) The provision of patrol boats does not relieve the boat of its responsibilities. Although reasonable efforts
will be made to provide patrol boat cover, competitors are reminded that, particularly in extreme weather
conditions, cover should not be relied upon, and in any event they can only be given such assistance as can
be practically provided in the circumstances. This is particularly relevant in winter and spring sailing where
the risk of hypothermia is at its highest.
2.1 Measurement
Boats may be measured before or after any race at the discretion of the Race Committee.
2.2 Identification Sail Numbers
Under exceptional circumstances, and provided that class rules allow, the Race Committee may permit a
boat to use sails carrying an identifying number other than that required by rule 77.
2.3 Eligibility
(a) Helms: Helms who are not Club members, but are members of an RYA recognised club may take part in
up to six Club races, if so authorised by a flag officer, but shall not be eligible for any points or trophies.
(b) Single Handed: Unless laid down by the conditions of a particular event, single-handed racing will not be
permitted except in boats of a class specifically allocated with a Single Handed PY.
(c) Crews: An individual may be signed in as guest crew up to three times in one season.
(d) Non-Sailing Members: Must obtain the permission of the Race Officer before racing. Such permission will
not be given more than four times in a season to any one person.
(e) Cadet Races: Entry is restricted to current Cadet Members.
(f) Novice: A helm who is in their first two seasons of sailing.
2.4 Personal Floatation Devices
Personal floatation devices must be worn at all times whilst afloat. Up to the end of April and after the
beginning of November the wearing of wet or dry suits is obligatory. Wet suits, dry suits or trapeze harnesses
do not constitute personal floatation devices. Compliance with these requirements is entirely the
responsibility of the helm and crew.

2.5 Declarations
The Entry and Declaration sheet must be completed at least half an hour before the scheduled start of the
first race. All helms must complete the declaration form for each race within half an hour of the last boat to
finish racing, or within half an hour of the last boat finishing the second of two races where one is sailed
immediately after the other, or within half an hour of a race being postponed or abandoned. Any boat not
complying with this instruction will be recorded as Did Not Finish by the Race Committee.
2.6 Charity Races
An entry fee of 2.50 per adult, (free for cadets) is payable for designated Charity races in the Club
programme.
2.7 Boats, Equipment and Sailors
The Race Committee may, before the start of the race, reject the entry of any boat.
2.8 Patrol Boats
All craft accepting assistance from a patrol boat MUST OBEY THE ORDERS OF THE COXSWAIN IN
CHARGE. Members are reminded that the principal function of the patrol boats is to save life.
3.0 NOTICES TO COMPETITORS
3.1 Notices to competitors will be posted on the official notice boards.
4.0 CHANGES IN SAILING INSTRUCTIONS
4.1 Changes in the sailing instructions will be indicated on the official notice boards.
5.0 SIGNALS MADE ASHORE
5.1 Signals made ashore will be hoisted on the flagstaff of the clubhouse or on the light board adjacent to the
starters box.
6.0 SCHEDULE OF RACES
6.1 There will be five fleets:
i) Slow - Conventional or Asymmetric boats with a PY of more than the PY of the Laser Radial.
ii) Fast Conventional boats with a PY equal to or less than the PY of the Laser Radial.
iii) Asymmetric - boats with a PY equal to or less than the PY of the Laser Radial.
iv) Catamaran
v) Novice.
In code B races, any class of boats where 5 or more boats start in each sailed race of the series they may
then be extracted from the fleets to accommodate class racing.

6.3 A minimum of two starters is required to form a race. If less than two boats are entered for a fleet, those
boats will sail in the appropriate fleet and will receive points within that fleet only.
6.4 Charity Races
An individual prize will be awarded to the winner of each fleet or class if there are five or more starters within
that fleet or class.
6.5 Times of Warning Signals
The first warning signal is aimed to be five or three minutes as appropriate before the time published in the
Sailing Programme. The order of fleet starts will be shown on the official notice boards.
6.6 Races postponed or abandoned may be re-sailed at a later date.

8.0 COURSE AREA


8.1 The course area will be as defined on the official notice boards.
9.0 THE COURSE
9.1 The course configuration and the order of rounding of marks will be as shown on the official notice
boards. This indicates the number of legs required to complete particular rounds. It does not indicate the
angle between legs.
9.2 Number of rounds
The number of rounds to be sailed will be displayed on the official notice boards.
9.3 The course and number of rounds is deemed to be set thirty minutes before the scheduled start time. Any
alteration after this time shall be signalled to the competitors by making one sound signal and hoisting flag L
which shall be left flying until racing is finished.
10.0 MARKS
10.1 Course marks are inflatable buoys laid for the race unless otherwise defined.
11.0 STARTS
11.1 Starting Line
The starting line is the extension of an imaginary line drawn from the flagstaff of the clubhouse and a transit
pole on the beach and bounded by an outer limit buoy and possibly an inner limit buoy. These buoys may
not necessarily be on the starting line.
11.2 Starting Procedure
Races will be started as follows. This changes rule 26. Times shall be taken from the lights.

Succeeding Fleets will be started at five minute intervals by displaying the warning signal with the starting

12.0 RECALLS
12.1 Individual Recalls
Individual recalls will be in accordance with rule 29.1 except that the visual signal will be one red light set in
place of flag X.
12.2 General recalls will be in accordance with rule 29.2 except that the visual signal will be two red lights set
instead of flag First Substitute, and that the recalled class will start five minutes (three minutes in Back to
Back Racing) after the last scheduled start. Succeeding fleets will start in accordance with the original
sequence.
13.0 PROHIBITED AREA
13.1 All boats must keep clear of the starting line until after the preparatory signal for their respective start.
Any boat infringing the above rule may be protested by a competitor from the preceding start.

14.0 FINISHING
14.1 Finishing Line
Unless otherwise stated on the official notice boards the finishing line is between the flagstaff on the
clubhouse and the outer limit mark.
14.2 Shortened Course
For the Fast Conventional, Asymmetric and Catamaran Fleets, should the course be shortened, the race will
finish with the lap about to be completed by the leading boat in each fleet.
For the Slow Conventional and Novice Fleets, should the course be shortened, the race will finish with the lap
about to be completed by either the leading boat or any other boat in each fleet as designated by the Race
Officer.
15.0 TIME LIMITS
15.1 Rule 35 shall not apply.
(a) The time limit for each race will be posted on the official notice boards. The race will be valid for all those
boats finishing within the time limit.
(b) When the first boat finishes within the prescribed time limit, the race will be valid for those boats which
finish within one hour of the finishing time of the first boat.
(c) When no boat finishes within the prescribed time limit, the race will be abandoned. Notification of any
re-sail date and time will be posted on the notice board as soon as possible.
16.0 PROTESTS
16.1 Protests shall be written on RYA Protest Forms available from the race box and shall be lodged there
within 30 minutes of the last boat finishing, unless extended at the discretion of the Race Committee.
Protests will be heard in approximate order of receipt as soon as possible.
16.2 The protest committee shall be formed of three experienced sailing members at the discretion of the
Race Officer. If possible one of the three shall be from the Sailing Committee.
17.0 SCORING SYSTEM
17.1 Points
RRS Appendix A4.2 is amended in that a boat that starts, but does not finish, shall score points equal to the
number of starters.
17.2 Handicapping
The RYA Portsmouth Yardstick scheme YR2 adjusted by the Sailing Committee as deemed necessary will
be used as the basis of handicapping.
17.3 Lap Average
In each fleet, race lap average will be applied, finishing all boats after the leading boat, except where SI 14.2
applies, in each fleet and calculating the adjusted time from the elapsed time according to the number of laps
completed. The Race Committee shall record each boat as it properly passes through the start/finish line and
this shall be the recorded number of laps completed by that boat. The lap average must be applied when a
boat is lapped by another boat.
17.4 Points system Club Series
(a) Boats which do not race because their regular helm or crew are: (1) engaged on any Club duty or (2)
representing the Club at an Open/Championship Meeting may claim the average of the points scored in the
races that the boat sails in that series, provided that the number of races that the boat sails in that series
exceeds the number of races for which average points are claimed. Regular helm or crew means the helm
or crew who sail the boat in a majority of the races that the boat sails in the series. To score points in this way
the helm or crew must sign on the Entry and Declaration sheet, and write Average Points in the Declaration
column for Club duties, or notify the Vice Commodore for Open Meetings.
(b) Races abandoned and not re-sailed, all starters to score as retirements.
(c) Races to count will be taken as the best against the following dropping scale:
Two or less races sailed, all to count.
Three, four or five races sailed, discard one race.
Six, seven or eight races sailed, discard two races.
Nine or over races sailed, discard three races.
(d) For series races a fleet start will be deemed to have taken place for all scheduled fleets providing one or
more fleet starts. This does not apply in a designated Short Series.

17.5 Exoneration Penalty


(a) A boat that may have broken a rule of Part 2, or rule 31.1. or 42, may, after finishing the race concerned
and before the start of a related protest hearing, notify the race committee that she accepts a 20% scoring
penalty as stated in rule 44.3(c), (except that the minimum penalty is two places if that does not result in a
score worse than DNF). This penalty does not reverse an OCS score, a disqualification under rule 30.3 or a
penalty under Appendix P. It is not available to a boat that caused injury or serious damage, or gained a
significant advantage by her breach: in these circumstances, her penalty is to retire.
(b) When an exoneration penalty is accepted,
(i) Neither the boat nor a protest committee may then revoke or remove the penalty.
(ii) The boat shall not be penalised further in a protest hearing when the protest committee decides that
it was appropriate to the facts found and the applicable rules.
17.6 Advisory Hearing
When there is an incident that will not result in the lodging of a protest or a request for redress, a boat,
protest committee or race committee may request an advisory hearing with the race office, and notify any
boat involved in the incident. An adviser will then call a hearing to learn what may have happened and state
whether any rule appears to have been broken, and by which boat. A boat may as a result notify the race
office that she accepts an Exoneration Penalty when it applies to the incident, or choose to retire, although
there is no requirement for her to do either.
17.7 RYA Arbitration
(a) When a protest or request for redress is lodged, a boat may at the same time request RYA Arbitration, or
the protest committee or race committee may offer it.
(b) If the parties and a member of the protest or race committee agree that RYA Arbitration is suitable, and
arbitrator (who may be that member of the protest committee) will call a hearing conforming to Section B of
Part 5 of the racing Rules of Sailing, except that rule 64.1 will not apply. Instead, when the arbitrator decides
that a boat that is a party to the arbitration hearing has broken a rule for which the Exoneration Penalty is
available, the party will be invited to accept the penalty, and, if it is accepted by a protested boat, the
protesting boat will be allowed to withdraw the protest, changing rule 63.1.
(c) When there is not an agreement to use RYA Arbitration, or when, after RYA Arbitration, a protest is not
withdrawn or the Exoneration Penalty is not applicable to the facts, there will be a normal protest hearing, at
which the arbitrator may be a member of the protest committee. Rule 66 will not apply to the arbitration
decision. A boat may still accept an Exoneration Penalty at any time before the start of a protest hearing and
receive its protection from further penalization. She may also retire.
(d) When redress is offered and accepted at the RYA Arbitration, the protest committee or race committee
may seek to have this reviewed by asking for a full hearing. When redress is offered and not accepted, or not
offered at all, the boat may have her request heard before a protest committee.
18 Club Cup
The Club Cup may be sailed by any sailing member and will be allocated to the first boat that has not had a
helm or crew that has won any other trophy through the season.
19 Bexhill Sailing Trophy
Bexhill Sailing Trophy will be presented to the first and second place boats in Slow Conventional, Fast
Conventional, Asymmetric and Catamaran Fleets. Each series will count as one race (charity races will not
be counted.)
20 Novice Sailing Trophy
Novice Sailing Trophy will be presented to the first and second place boats in the Novice Fleet. Each series
will count as one race (charity races will not be counted).

Bexhill Sailing Club - Constitution


SECTION 1 - NAME AND OBJECTS
1. The name of the Club shall be the Bexhill Sailing Club' (hereinafter referred to in these rules as the Club).
2. The objects for which the Club is formed are: to promote and encourage good seamanship and knowledge of the sea;
to facilitate community participation in the sport of sailing; to provide social and other facilities for Members as may be
from time to time determined.
SECTION 2 OFFICERS, PRESIDENTS, VICE PRESIDENTS AND TRUSTEES.
3. The Officers of the Club shall be Full Members of the Club (as defined in Rule 4) and shall consist of Flag Officers
being a Commodore, a Vice-Commodore, a Rear-Commodore and other Officers being an Honorary Secretary, an
Honorary Treasurer, an Honorary Membership Secretary, an Honorary Sailing Committee Secretary, an Honorary
Fundraising and Social Committee Secretary and an Honorary Wine Officer. Officers shall be elected at the Annual
General Meeting for one year and shall hold office for one year, retiring at the Annual General Meeting in each year,
except that the Flag Officers shall hold office for no more than two consecutive years for each rank. After six years as a
Flag Officer, one year must elapse before seeking re-election as a Flag Officer but a former Flag Officer may be elected
to a Committee in another role.
The duties of the Officers will be decided by the Executive Committee.

The Executive Committee will appoint Cadet Captains and a Sail Training Principal to hold office for one year, with
the right to vote in the Executive and Sailing Committees, from Full Members (as defined in Rule 4).

The President and Vice President(s) shall be Full Members of the Club (as defined in Rule 4) to be appointed at the
Annual General Meeting by a majority of those present and entitled to vote; these appointments being confirmed at
subsequent Annual General Meetings. They may hold office for no more than five years. One year must elapse before
re-election. They should be available for consultation, advice and discussion on any matter raised by a Club Member or
Committee.
The property of the Club shall be vested in not less than two and not more than four Trustees to be appointed at the
Annual General Meeting by a majority of those present and entitled to vote.

SECTION 3 - MEMBERSHIP
4. A Member is defined as a person who has paid the current annual subscription for the category of membership to
which that person has been elected other than a Sail Training Member and a Temporary Member.
A Lapsed Member is a person previously a Member who has not paid the current annual subscription for the category of
membership to which that person was elected.
There shall be the following categories of Membership with power to vote at all meetings of the Club as indicated
hereunder:

A SAILING MEMBER - an individual who actively participates in sailing and at the date of election shall have attained
the age of twenty four years - shall have one vote. A Sailing Member shall have the full use of all the Club facilities.

A FAMILY MEMBER - shall be co-habiting adults or a single parent over the age of eighteen years and all children
within their guardianship under the age at which a Member becomes a Young Member or until the completion of full
time education or age 23 whichever is the earlier. The family unit - shall have up to two votes, exercisable by the
Adult Members nominated in the subscription form. A Family Member, his/her co-habitee (if any) and all the children
within their Membership shall have the full use of the Club facilities subject only to Rule 77.

A NON-SAILING MEMBER previously a Sailing Member who no longer regularly participates in sailing - shall
have one vote. A Non-Sailing Member shall have the full use of the Club facilities for social purposes only, save as
defined in the Sailing Instructions.

AN HONORARY MEMBER - The Executive Committee may elect a Member to Honorary Membership at its
discretion - shall have one vote. An Honorary Member shall have the full use of all the Club facilities.

A LIFE MEMBER - is a Full Member (as defined below) and the Executive Committee may confer, at its discretion
and in appropriate cases, Life Membership on a long serving Member - shall have one vote. A Life Member shall
have the full use of all the Club facilities

A YOUNG MEMBER - being a person who shall be over the age for Cadet Members up to and including the
subscription year of their 23rd birthday - shall have one vote. A Young Member shall have the full use of all the Club
facilities.

A SOCIAL MEMBER an individual who proposes to use the Club for social purposes only - shall have one vote
on non-sailing matters, after being a Member for one year. A Social Member shall have the full use of the Club
facilities for social purposes only.

A SAIL TRAINING MEMBER - an individual who is 18 or over, who is booked onto and attending an RYA level 1/2
course. Their Membership shall cease at the end of the subscription year in which their course occurs. A Sail Training
Member shall have the full use of all of the Club facilities.
The above categories of Membership (excluding the children of Family Members) shall be referred to as Full
Members. The following categories of Membership shall have no vote:

AN ASSOCIATE MEMBER being a person who was previously an Adult Member of the Club but has moved
domicile or through other exceptional circumstances is no longer able to participate in the Clubs activities but who
wishes to remain associated with the Club. An Associate Member shall have full use of the Clubhouse facilities and
may sail in open events at the Club and on no more than six other occasions.

A CADET MEMBER - being a person who, at the date of election, is under the age of eighteen. Such a Member
shall be one who at the commencement of the subscription year joins the Club other than as a Full Member or a
Family Member. A Cadet Member shall have the full use of all the Club facilities, subject only to Rule 77.

A TEMPORARY MEMBER may include Members of another RYA recognised club or organisation subject to prior
notification, participants in courses offered by Bexhill Sailing Club leading to the award of RYA certificates of
competence other than participants in the RYA level 1 and level 2 sailing courses and participants when
accompanied by Club Members in ad hoc sailing experiences organised by the Club. Temporary Membership of
such participants shall be limited to the duration of the relevant course or sailing experience. A Temporary Member
shall have the full use of the Club facilities but:

(a) Shall have no right to enter Club races, unless specifically authorised by the Honorary Sailing Secretary or a
Flag Officer.

(b) Shall have no right to introduce visitors to the Club or the facilities thereof.

(c) Shall have no right to take any part in the management of the Club.

(e) Shall be liable to be expelled from the Club premises or to be prohibited from using the Club facilities if, in the
opinion of Flag Officers, he or she shall not have reasonably complied with the above conditions.

(f) May not purchase alcoholic liquor at the Bar until 48 hours have elapsed from appointment to Membership.

A PROVISIONAL MEMBER - a new Member elected to one of the categories of Membership shall be a Provisional
Member until such time as the Executive Committee confirms their Membership. A Provisional Member shall have
the right to use the facilities as shown for the category of Membership to which the Member has been elected.

A NON-MOTORISED WATER SPORTS MEMBER - an individual who proposes to use the club for water sports
other than sailing and/or sail boarding shall have one vote on non sailing matters, after being a Member for one
year. A Water Sports Member shall have full use of all of the Club facilities.

(d) Is deemed to have notice of and impliedly undertakes to comply with the Club Rules and current Byelaws as if
he or she were a Member of the Club, in so far as the said Rules and Byelaws may be deemed to apply to such
Temporary Member.

Candidates for Membership shall have no privileges whatsoever in relation to the use of the Club or premises.

MEMBERSHIP AND SUBSCRIPTION FEES


5. The rate of Entrance and Subscription fee for each category of Membership shall be proposed by the Executive
Committee, to the Members at the Annual General Meeting, in each year. Any proposed changes shall be approved by
a majority of those present and entitled to vote and shall become operative on the first day of October in the year
following, for the subsequent twelve months. The current rate of Entrance and Subscription fee shall be prominently
displayed in the Club premises.

(a) Membership of the Club shall be open to anyone interested in the sport of sailing on application regardless of
sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs. Membership may however be
limited according to available facilities on a non-discriminatory basis.

(b) Membership subscriptions will be kept at levels that should not pose a significant obstacle to people participating.

(c) The Executive Committee may refuse Membership or remove it (subject to Rule 13), only for good cause, such
as conduct or character likely to bring the Club or sport into disrepute. Appeal against refusal of Membership may
be made to the Members at a General Meeting.

(d) The combined total of Social and Non-Motorised Water Sports Members shall not number more than the greater
of 50 Members or 25% of the Membership entitled to vote.

6. Members shall also make the following annual payments:

(a) An annual boat permit fee of such a sum as the Executive Committee shall from time to time prescribe which
shall allow a Member to keep their boat in the Club's boat park.

(b) All Members save Social Members, Young Members and Cadet Members shall pay the Entrance fee and their
first annual subscription, upon election to the Club. Thereafter the Subscription fee shall be payable on the first day
of October in each year. Members who pay their subscriptions on or before the thirtieth day of September may be
entitled to a discount on the applicable Membership Fee. A Member elected on or after the first day of July in any
year shall pay half the annual subscription applicable for that year and a Member elected after the first day of
September in any year shall not be required to pay any subscription in respect of the year of election, but shall pay,
on election, the Entrance fee and the annual subscription in respect of the year following election. Lapsed Members
must apply for re-election under Rule 10 but the Entrance fee payable under Rule 11 by such Lapsed Members may
be waived at the option of the Executive Committee.
Subject to the provisions of Rules 15, 19 and 20 only Members may use the facilities of the Club.

The Executive Committee on a case-by-case basis shall fix the subscription fees payable by Life Members.
The Executive Committee shall have the power to approve requests made by Members to amend Membership
status within the current financial year and to authorize any adjustments in Membership fees that may arise as a
result of such change in Membership status.

7. Every Member shall furnish the Membership Secretary with a current postal address and at the Members discretion
an e-mail address, both of which shall be recorded in the Register of Members, and any notice sent to such e-mail
address shall be deemed to have been duly delivered. Members who wish to receive any such notice by post shall advise
the Membership Secretary accordingly.
8.

Election and retirement of Members:

Candidates for Cadet Membership must have the application endorsed by a parent or guardian confirming the signatorys
agreement to Membership.
9. An application for Membership shall be in the form from time to time prescribed by the Executive Committee, and
shall include the name and address of the candidate. The Membership form shall require that the Member agree to
contribute to the running of the Club through duties allocated under the watch system.
10. Proposals for Membership shall be in writing and further endorsed with parental consent in the case of Cadets. The
proposal for Membership shall be exhibited for Members comments on the Club notice board for fifteen days. Every
proposal shall be submitted to the Executive Committee at the meeting following the expiration of fifteen days. At that
meeting the Committee may reject or proceed to the election of a candidate on a provisional basis, a simple majority
vote in favour shall decide admittance. Full Membership will normally be confirmed by the Executive Committee after
one years provisional Membership. In exceptional circumstances, which for the purposes of this Rule shall include the
election of Temporary Members and Sail Training Members, the Executive Committee may:
a)

Elect a Member earlier, conditional on the successful expiration of the fifteen days notice.

b)

Confirm a candidate to full Membership at that meeting without any other formality.

c) Delegate the authority to grant Temporary and Sail Training Membership to participants in courses leading to the
award of RYA certificates of competence, to the Sail Training Principal and a Flag Officer and to participants in ad hoc
sailing experiences organised by the Club, to two Members drawn from either of the Executive and/or the Sailing
Committees subject only to formal ratification of such Temporary and Sail Training Membership by the Executive
Committee at the next succeeding Executive Committee meeting.
An Appeal, against refusal to elect, may be made to the Members at a General Meeting and will be decided by majority
vote.
11. Upon election, a candidate shall pay, within one calendar month, such entrance and other fees as shall be requested.
In default of such payment, the election shall be void unless sufficient cause for delay be shown.

12. A Member desirous of retiring from Membership shall give notice in writing to the Honorary Membership Secretary
before the last day of November and shall not then be liable to pay the subscription for that year. Upon re-application
by a past Member the Executive Committee may, at its discretion, excuse payment of an Entrance Fee.
13. In addition to the powers granted to the Executive Committee by Rule 6(b) hereof the Executive Committee may at
its discretion waive the requirement for a Lapsed Member to reapply for membership under Rule 6b but may reinstate
the Lapsed Member to the category of Membership to which the Lapsed Member was previously elected provided that
all arrears of annual subscription and other fees are promptly paid.
Conduct of Members
14. Every Member, upon election and thereafter, is deemed to have notice of, and impliedly undertakes to comply with,
the Rules and the current Byelaws of the Club. Any refusal or neglect to do so, or any conduct, which, in the opinion of
the Executive Committee, is either unworthy of a Member or otherwise injurious to the interests of the Club, shall render
a Member liable to expulsion by the Executive Committee.
Provided that, before expelling a Member, the Executive Committee shall call upon such Member for a written explanation
of the Member's conduct and shall give the Member full opportunity of making explanation to the Executive Committee,
or of resigning.
A Resolution to expel a Member shall be carried by a simple majority vote of those Members of the Executive Committee
present, eligible to vote and voting on the Resolution.
An Appeal, against expulsion, may be made to the Members at a General Meeting and will be decided by majority vote.
15. Full Members shall enter the names of all guests in the Visitor's Book. Not more than three guests may be introduced
in any one day and the same guest may not be introduced more than six times in any calendar year.
16. A Member shall not knowingly remove, injure, destroy or damage any property of the Club and shall make restitution
for the same, if called upon to do so by the Executive Committee or by the Membership Secretary upon the instructions
of the Executive Committee.
17. A Member shall settle any indebtedness for refreshment or otherwise before leaving the Club premises, or in
accordance with any Byelaw relating to the settlement of such indebtedness.
18. Complaints of any nature relating to the management of the Club Premises shall be addressed in writing to the
Honorary Secretary who will refer any such complaint to the Executive Committee for review and action.
19. A Member of any other Club affiliated to the Royal Yachting Association (a list thereof is published by the said
Association) may be authorised to use the premises of the Club, by any Member of the Executive Committee of the Club.
Such authorisation shall specify between which dates the said person may so use the premises.
20. Any person who is a competitor or crew member in any race sponsored by or on behalf of the Club is entitled to the
use of the Club premises within a period of 24 hours before and after the race in which they are competing.
21. The Honorary Secretary or any other person who has received the authority of two members of the Executive
Committee, may expel, temporarily or permanently, any person who has the right to the use of the Club premises only
under Rules 19 and 20.

Limitation of Club Liability


22. Members, their guests and visitors are bound by the following Rule, which shall also be exhibited in a prominent
place within the Club premises. Members of the Club, their guests or visitors may use the Club premises, and any other
facilities of the Club, entirely at their own risk and impliedly accept:
(a) The Club will not accept any liability for any damage to or loss of property belonging to Members, their guests,
contractors, independent contractors, entertainers or visitors to the Club.
b) The Club will not accept any liability for personal injury arising out of the use of the Club premises, or any other facilities
of the Club either sustained by Members, their guests or visitors or caused by the said Members, guests or visitors
whether or not such damage or injury could have been attributed to or was occasioned by the neglect, default or
negligence of any of them, the Officers, Executive Committee or servants of the Club.
23. Membership of the Club and acceptance of these rules by the Member will be deemed to constitute consent to the
holding of relevant personal data for the purposes of the Data Protection Acts and to the use of that data in the furtherance
of the Clubs business and to enable Members to contact each other in relation to the Clubs activities.

SECTION 4 - COMMITTEES
EXECUTIVE COMMITTEE
24. The Executive Committee shall consist of the Flag Officers, all other Officers and six Full Members (excluding Social
Members) who have been elected at an Annual General Meeting to hold office until the commencement of the next
Annual General Meeting.
25. At the Annual General Meeting each year all Members of the Executive Committee shall retire. Members retiring
under this rule shall be eligible for re-election to the Committee. No Flag Officer shall hold office for more than two
consecutive years and one year must then elapse before re-election.
26. Candidates for election to the Executive Committee (who are not Officers of the Club) shall be those Full Members
(excluding Social Members), whose nominations (duly proposed with their consent and seconded in writing by Full
Members of the Club), shall have been received by the Honorary Secretary at least seven days before the date of the
Annual General Meeting.
27. If the number of candidates for election is greater than the number of vacancies to be filled then there shall be a
ballot.
28. If the number of candidates for election is equal to or less than the number of vacancies to be filled then all
candidates shall be deemed to be elected if a simple majority of those present at the Annual General Meeting, and
entitled to vote, vote in favour of such election.
29. In the event of the ballot failing to determine the Members of the Executive Committee, because of an equality of
votes, the candidate or candidates to be elected from those having an equal number of votes shall be determined by lot.
30. If, for any reason, a casual vacancy shall occur, the Executive Committee may co-opt a Full Member (excluding
Social Members) to fill such a vacancy until the following Annual General Meeting.
31. The Executive Committee shall meet at least every two months making such arrangements as to the conduct, place
of assembly and holding of such meetings as it may wish. The Commodore or in his absence a Flag Officer shall preside
as Chairman.
32. Voting shall be by show of hands. In the case of equality of votes the Commodore or Chairman (as the case may
be) shall have a second and casting vote.
33. Seven Members elected to the Executive Committee personally present and entitled to vote shall form a quorum at
a meeting of the Committee.

Powers of the Executive Committee


34. The Executive Committee shall manage the affairs of the Club in accordance with these Rules and shall define the
various duties of the Officers of the Club and of all other Committees of the Club. The Officers and other Committees of
the Club shall in all respects be subject to the control of the Executive Committee.
35. The Executive Committee shall manage the affairs of the Club according to the Rules and shall cause the funds of
the Club to be applied solely to the objects of the Club or for benevolent or charitable purposes. The Executive Committee
may reimburse Members and official volunteers for out of pocket expenses.
In particular the Executive Committee shall ensure that the property and funds of the Club will not be used for the direct
or indirect private benefit of Members other than as reasonably allowed by the Rules and that all surplus income or profits
are re-invested in the Club.
36. The Executive Committee shall make such Byelaws as it shall from time to time think fit and shall cause the same
to be exhibited in the Club premises for a minimum of fourteen days before the date of implementation. Such Byelaws
shall remain in force until the next General Meeting. Such Bylaws shall be approved or set aside by a majority vote of a
General Meeting of the Club.
37. The Executive Committee may appoint such sub-committees as it may deem necessary and may delegate such of
its powers as it may think fit upon such terms and conditions as shall be deemed expedient and/or required by the law.
Officers of the Club shall be ex officio members of all such Sub-Committees together with such other Full Members of
the Club that the Sub-Committees may think fit.
38. A Member of the Executive Committee, of a Sub-Committee or any Officer of the Club, in transacting business for
the Club, shall disclose to third parties that he is so acting.

39. The Executive Committee, or any person or Sub-Committee delegated by the Executive Committee to act as agent
for the Club or its members, shall enter into contract only as far as expressly authorised, or authorised by implication, by
the members. No one shall, without the express authority of the membership in General Meeting, pledge the credit of
the Membership.
40. In pursuance of the authority vested in the Executive Committee by members of the Club, members of the Executive
Committee are entitled to be indemnified by the members of the Club against any liabilities properly incurred by them or
any one of them on behalf of the Club wherever the contract is of a duly authorised nature or could be assumed to be of
a duly authorised nature and entered into on behalf of the Club.
The limit of any individual member's indemnity in this respect shall be a sum equal to one year's subscription at the then
current rate of that category of Membership unless the Executive Committee has been authorised to exceed such limit
by a General Meeting of the Club.
41. On election as an Officer of the Club the Member will become an Honorary Member for such time as the Member is
an Officer of the Club. The Executive Committee may elect a Member to Honorary Membership at its discretion being
bestowed as an honour on a Member on behalf of the Club for exceptional services, either as a long standing Officer of
the Club or due to sailing achievements, or other exceptional circumstances to the credit or benefit of the Club.
42. The Executive Committee will appoint a suitably qualified accounting firm to audit the accounts of the Club. The
appointment shall be made annually. The Membership will be asked to approve the appointment at the Annual General
Meeting following the appointment.
43. In addition to the powers given to the Executive Committee under Rule 6(b) and 13, if, at any time, any fees payable
to the Club by any Lapsed Member or former Member shall be three months or more in arrears and any property being
in the ownership of a lapsed Member or former Member remains upon the Club premises, the Executive Committee may:

(a) Move the property to any part of the Club premises without being liable for any loss or damage to the
property howsoever caused.

(b) Give three months notice in writing to the Lapsed Member or former Member at his last known address as
shown in the Club Register. (If ownership is not known display the details on the Club notice board for a period of not
less than six months.) Thereafter sell the property and deduct any monies due to the Club (whether by way of arrears of
subscription or annual payments, Boat Permit fees or otherwise) from the net proceeds of sale before accounting for the
balance (if any) to the Lapsed Member or former Member.

(c) Alternatively, if the property is un-saleable, after giving notice in writing or displaying on the Club notice
board as aforesaid, dispose of the property in any manner the Committee may think fit and deem the cost of doing so
and any arrears as aforesaid to be a debt owing to the Club by the Lapsed Member or former Member.

(d) The Honorary Sailing Secretary, acting under an instruction from the Sailing Committee, may give notice in
writing to a Member to remove any boat, trailer, trolley or other equipment which the Sailing Committee considers to be
derelict or unseaworthy within a reasonable period being not less than 14 days. The Member may appeal in writing
against the decision to the Executive Committee within 14 days of the date of the notice. In the absence of any appeal
and the failure by the Member to comply with the notice the Executive Committee may move or dispose of the said boat,
trailer, trolley or other equipment.

(e) Further, the Club shall at all times have a lien over Members' or former Members' boats parked on the Club's
premises in respect of all monies due to the Club, whether in respect of arrears of Boat Permit fees or subscriptions or
otherwise.

PROVIDED ALWAYS THAT:


Proper evidence is available to show that all reasonable steps have been taken to trace a lapsed Member or former
Member and that when and if the property is sold the proceeds of sale (less any indebtedness due by the lapsed Member
or former Member to the Club) shall be placed upon Bank Deposit account and retained against the eventuality of a claim
by the owner (whether that person be the said lapsed Member or former Member or otherwise) for a minimum period of
one year. After this time residue to be donated to a charitable cause connected with sailing.

FUNDRAISING AND SOCIAL COMMITTEE


44. The Fundraising and Social Committee will have the duties and powers prescribed by the Executive Committee from
time to time.
45. The Fundraising and Social Committee shall consist of the Officers one of whom will be the Honorary Fundraising
and Social Committee Secretary and not less than three or more than twelve Full Members elected at the Annual General
Meeting each year to hold office until the commencement of the following Annual General Meeting.

46. At the Annual General Meeting each year all Members of the Fundraising and Social Committee shall retire.
Members retiring under this rule shall be eligible for re-election to the Fundraising and Social Committee.
47. Candidates for election to the Fundraising and Social Committee (not being Officers of the Club) shall be those
Members whose nominations, (duly proposed with their consent and seconded in writing by Full Members of the Club)
shall have been received by the Honorary Secretary at least seven days before the date of the Annual General Meeting.
48. If the number of candidates for election is greater than the number of vacancies to be filled then there shall be a
ballot.
49. If the number of candidates for election is equal to or less than the number of vacancies to be filled then all
candidates shall be deemed to be elected if a simple majority of those present at the Annual General Meeting, and
entitled to vote, vote in favour of such election.
50. In the event of the ballot failing to determine the Members of the Fundraising and Social Committee, because of an
equality of votes, the candidate or candidates to be elected from those having an equal number of votes shall be
determined by lot.
51. If, for any reason, a casual vacancy shall occur, the Fundraising and Social Committee may co-opt a Full Member
to fill such a vacancy until the following Annual General Meeting. Provisional Members may be co-opted with the
agreement of the Executive Committee.
52. The Fundraising and Social Committee shall meet at least every two months making such arrangements as to the
conduct, place of assembly and holding of such meetings as it may wish. In the absence of the Rear Commodore the
Hon Social and Fundraising Secretary shall preside as Chairperson.
53. Voting shall be by show of hands. In the case of equality of votes the Rear Commodore or Chairman (as the case
may be) shall have a second and casting vote.
54. Five Members personally present of which three must be elected and not being ex officio Members shall form a
quorum at a meeting of the Fundraising and Social Committee. All Members of the Fundraising and Social Committee
shall be entitled to vote.

SAILING COMMITTEE
55. The Sailing Committee will have the duties and powers prescribed from time to time by the Executive Committee.
56. The Sailing Committee shall consist of the Flag Officers, the Honorary Sailing Committee Secretary, Fleet
Representatives, the Cadet Captains, Sail Training Principal and five Full Members (excluding Social Members) elected
at the Annual General Meeting each year to hold office until the commencement of the next following Annual General
Meeting.
At the Annual General Meeting each year all Members of the Sailing Committee shall retire. Members retiring under the
rule shall be eligible for re-election to the Committee.
57. Candidates for election to the Sailing Committee (not being Officers of the Club) shall be those Full Members
(excluding Social Members) whose nominations (duly proposed with their consent and seconded in writing by Full
Members of the Club) shall have been received by the Honorary Secretary at least seven days before the date of the
Annual General Meeting.
58. If the number of candidates for election is greater than the number of vacancies to be filled then there shall be a
ballot.
59. If the number of candidates for election is equal to or less than the number of vacancies to be filled then all candidates
shall be deemed to be elected if a simple majority of those present at the Annual General Meeting, and entitled to vote,
vote in favour of such election.
60. In the event of the ballot failing to determine the Members of the Sailing Committee, because of an equality of votes,
the candidate or candidates to be elected from those having an equal number of votes shall be determined by lot.
61. If, for any reason, a casual vacancy shall occur, the Sailing Committee may co-opt a Full Member (excluding Social
Members) to fill such a vacancy until the following Annual General Meeting. Provisional Members may be co-opted with
the agreement of the Executive Committee.
62. The Sailing Committee shall meet at least every two months making such arrangements as to the conduct, place of
assembly and holding of such meetings as it may wish. The Vice Commodore or in his absence another Flag Officer
shall preside as Chairman.

63. Voting shall be by show of hands. In the case of equality of votes the Vice Commodore or Chairman (as the case
may be) shall have a second and casting vote.
64. Five Members personally present of which one must be elected and not being ex officio Members shall form a
quorum at a meeting of the Sailing Committee.
WINE COMMITTEE
65. The Wine Committee will have the duties and powers prescribed by the Executive Committee from time to time.
66. The Wine Committee shall consist of not less than fifteen Members who have attained the age of eighteen years.
Twelve Members shall be elected at the Annual General Meeting each year to hold office until the commencement of
the following Annual General Meeting. The Committee shall elect a Committee Secretary. Three other Officers of the
Club shall be appointed by the Executive Committee and shall complete the numbers serving.
67. At the Annual General Meeting each year all Members of the Wine Committee shall retire. Members retiring under
the Rule shall be eligible for re-election to the Wine Committee. Candidates for election to the Wine Committee shall be
those Full Members whose nominations (duly proposed with their consent and seconded in writing by Full Members of
the Club) shall have been received by the Honorary Secretary at least seven days before the date of the Annual General
Meeting.
68. If the number of candidates for election is greater than the number of vacancies to be filled then there shall be a
ballot.
69. If the number of candidates for election is equal to or less than the number of vacancies to be filled then all
candidates shall be deemed to be elected if a simple majority of those present at the Annual General Meeting, and
entitled to vote, vote in favour of such election. The Wine Committee shall not have the power to co-opt Members or to
form sub committees. The Executive Committee shall have the power to nominate the required Members to bring the
committee to full strength.
70. In the event of the ballot failing to determine the Members of the Wine Committee, because of an equality of votes,
the candidate or candidates to be elected from those having an equal number of votes shall be determined by lot.
71. If, for any reason, a casual vacancy shall occur or if insufficient numbers are elected at the Annual General Meeting
to meet the requirements of rule 66, the Executive Committee may appoint Full Members over the age of 18 years to fill
such vacancies until the following Annual General Meeting. Provisional Members may also be co-opted by the Executive
Committee.
72. The Committee shall meet at least every two months making such arrangements as to the conduct, place of
assembly and holding of such meetings as it may wish. The Honorary Wine Officer or in his absence a nominated person
from the Committee shall preside as chairman.
73. Voting shall be by show of hands. In the case of equality of votes the Honorary Wine Officer or Chairman (as the
case may be) shall have a second and casting vote.
74. Four Members (one of whom must be the Honorary Wine Officer or a Flag Officer of the Club) personally present
and entitled to vote of which three must be elected and not being ex officio Members shall form a quorum at a meeting
of the Wine Committee.
75. The purchase for the Club of excisable goods and the supply of the same upon Club premises shall be exclusively
and solely under the control of the Wine Committee.
76. Intoxicating liquor may only be supplied for consumption on the Club premises to persons over the age of eighteen
who are entitled to the use of the Club premises in pursuance of the Byelaws and Rules for the time being in force. No
Member under the age of eighteen may purchase or attempt to purchase intoxicating liquor within the Club premises.
77. The Wine Committee shall cause the Club bar to be opened (subject to terms of the Club Premises Certificate) at
convenient times (and such times shall be prominently exhibited in the Club premises) for the supply of excisable goods
to persons who are entitled to the use of the premises of the Club in pursuance of these rules. No guest may purchase
alcohol.
78. No Member shall take a commission, percentage or other such payment in connection with the purchase of excisable
goods for the Club. Any profit deriving from the sale of such goods shall (after deduction of the costs of providing such
goods) be applied to the benefit of the Club.
79. Proper accounts of all purchases and receipts shall be kept and presented at the Annual General Meeting in each
year and such information as the Honorary Treasurer or Auditors may require shall be furnished to enable any statutory
return or statement and the payment of excise or other duty or tax to be made.

SECTION 5 - TRUSTEES
80. Any General Meeting shall have power to remove any of the Trustees and all vacancies occurring by removal,
resignation or death shall be filled at the same or next General Meeting. The Trustees may only sign documents as
directed and with the approval of the Executive Committee. Any Trustee may attend any Executive Committee meeting
as an observer. The Trustees shall have no vote except on the issue of signing any document on the Clubs behalf where
they shall carry the power of abstention. In the event that the Executive Committee does not accept that the exercise of
an abstention is justified, the Executive Committee shall call a Special General Meeting at which the Trustee shall explain
the reason for the abstention and seek endorsement of the view from the majority of the Members present and entitled
to vote.
81. If for any reason there are less than two Trustees at any one time an additional Trustee or Trustees shall be
appointed, as necessary by the Executive Committee from among Full Members (excluding Social Members) who are
willing to be so appointed. The Trustee or Trustees so appointed shall hold office until the commencement of the next
Annual General Meeting.
82. All the property of the Club, including land and investments, shall be held by Trustees for the time being, in their
own names so far as it is necessary and practicable, on trust for the use and benefit of the Club. In the event of the
death, resignation, or removal from office of a Trustee, the Executive Committee shall nominate a new Trustee in his
place in accordance with Rule 81 and shall as soon as possible thereafter take all lawful and practicable steps to procure
the vesting of all Club property into the name of the Trustee as constituted after such nomination. For the purpose of
giving effect to any such nomination, the Honorary Secretary for the time being is hereby nominated as the person to
appoint new Trustees of the Club within the meaning of Section 36 of the Trustee Act 1925 and he shall by Deed duly
appoint the person or persons so nominated by the Committee.
83. The Trustees shall in all respects act, in regard to any property of the Club held by them, in accordance with the
directions of the Executive Committee and shall have power to sell, lease, mortgage or pledge any Club property so held
for the purpose of raising or borrowing money for the benefit of the Club in compliance with the Executive Committee's
directions (which shall be duly recorded in the Minutes of the proceedings of the Executive Committee).
84. The Trustees shall be effectually indemnified by the Club out of the assets of the Club from and against any liability,
costs, expenses and payments whatsoever which may be properly incurred or made by them in the exercise of their
duties or in relation to any property of the Club vested in them, or in relation to any legal proceedings, or which otherwise
relate directly or indirectly to the performance of the functions of a Trustee of the Club.

SECTION 6 - MEETINGS OF THE CLUB


85. An Annual General Meeting of the Club shall be held each year on a date to be fixed by the Executive Committee
but no later than 31st January and before the expiry of 15 months since the previous Annual General Meeting. The
Honorary Secretary shall give notice of the Annual General Meeting not less than 42 days before such meeting by posting
a Notice of the Meeting on the Clubs notice board. The Honorary Secretary shall at least fourteen days before the date
of such Meeting deliver by electronic mail to each Member Notice of the Meeting and of the business to be brought
forward thereat. Members who require the said Notice to be sent by post shall notify the Honorary Membership Secretary
of that requirement in writing at the time of the renewal of Membership by way of an attachment to the renewal form.
86. No business, except the passing of the Accounts and the election of the Officers, Committees, Trustees, notification
of the appointment of the Auditors, and any business that the Executive Committee may order to be inserted in the Notice
convening the Meeting shall be discussed at such Meeting unless notice thereof be given to the Honorary Secretary in
writing by a Member entitled to vote at least thirty days before the date of the Annual General Meeting.
87. The Executive Committee may at any time, upon giving twenty one days notice in writing, call a Special General
Meeting of the Club for any special business, the nature of which shall be stated in the summons convening the meeting,
and the discussion at such meeting shall be confined to the business stated in the notice sent to Members. The Honorary
Secretary shall at least fourteen days before the date of such Meeting deliver by electronic mail to each member Notice
of the Meeting and of the business to be brought forward thereat. Members who require the said notice to be sent by
post and shall notify the Honorary Membership Secretary of that requirement in writing at the time of the renewal of
Membership by way of an attachment to the renewal form.
88. The Executive Committee shall call a Special General Meeting upon a written request addressed to the Honorary
Secretary by at least 10 Members with the right to vote. The request shall detail in precise terms the reasons the request
is submitted and detail the matters to be discussed. The request shall include a joint and several indemnity in favour of
the Club by the Members requesting the meeting under which the costs to the Club of calling the meeting shall be
reimbursed. The Executive Committee acting through the Honorary Secretary shall give twenty one days notice by
electronic mail or in writing to members of any such Special General Meeting within fourteen days of the Honorary
Secretary receiving the written request. The discussion at such meeting shall be confined to the business stated in the
Notice sent to members.

89. At every General Meeting of the Club the President or the Commodore or, in their absence, a Chairman elected by
those present shall preside.
90.
Fifteen percent of the Membership entitled to vote as at seven days before the meeting, shall form a quorum at
any General Meeting of the Club.
91. Only Sailing, Adult Family, Non-Sailing, Life, Young and Honorary Members shall vote at any meeting of the Club.
Social and Non-Motorised Water Sports Members, after one year of Membership and subject to the restriction set out in
Rule 4, may vote at any meeting of the Club. Other Members may attend but are not entitled to vote.
92. Voting shall be by show of hands. In the case of an equality of votes the Chairman shall have a second or casting
vote, on any matter other than the election of Members of the Executive Committee.
93. On any resolution properly put to a meeting of the Club relating to the creation, repeal or amendment of any Byelaw
or Rule of the Club such Byelaw or Rule shall not be created, repealed or amended except by a majority vote of those
present and entitled to vote.
No amendment or addition to the Rules shall be made except at an Annual General Meeting or Special General Meeting
called for that purpose. The Executive Committee shall have power to decide any question not provided in these Rules
or arising upon the interpretation thereof provided that no such change shall jeopardise the Clubs status as a Community
Amateur Sports Club within the meaning of the Finance Acts, or in any event alter its objects or winding-up provisions.

SECTION 7 - DISSOLUTION OF THE CLUB


94. If, upon the winding up or dissolution of the Club, there remains after the satisfaction of all its debts and liabilities
any property whatsoever, the same shall not be paid to or distributed amongst the Members of the Club. The Executive
Committee shall dispose of the net assets remaining to one or more of the following at the direction of the Membership
in a General Meeting held prior to dissolution:
(i)

To another club with similar sports purposes which is a charity and/or;

(ii) To another club with similar sports purposes which is a registered CASC and / or;
(iii) To the Sports National Governing Body for use by them for related community sports.
SECTION 8 BYELAWS
1. Regular Club racing shall be provided as specified in the Sailing Instructions.
2. The Club Premises shall be open to Members at such times as the Executive Committee shall direct.
3. The Bar shall be open at such hours as may be decided by the Wine Committee subject to any restrictions imposed
from time to time by the Licensing Authority.
4. Members of the Club, their guests and visitors may use the Club premises and any other facilities of the Club entirely
at their own risk, and impliedly accept Rule 22 and before inviting any guests or visitors onto the premises or to participate
in events organised by the Club, members will draw their attention to this Rule.
5. The Executive Committee is empowered to make a charge for admission to the Club Lounge on specified occasions.
6. Smoking is prohibited within the Club buildings.
7. No sound reproduction set or machine shall be operated in the Clubhouse except as authorised by the Fundraising
and Social Committee from time to time.
8. Persons wearing stiletto heels or wet sailing/swimming gear or sandy clothes or footwear shall not use the lounge
except and unless directed by the Executive Committee or a Flag Officer.
9. Upholstered chairs shall not be used externally.
10. No vehicles or boats shall be left on the concrete ramp surround or near the emergency exits from the Clubhouse.
11. No road trailers may be left on the beach or underneath boats unless immobilised or on Club premises.
12. Boats shall be stored on the beach in accordance with the plan prepared by the Sailing Committee.

13. Boats shall be secured on a suitable cradle or otherwise be securely anchored to the beach. Anchorage points must
be buried below the surface of the beach. The use of barrels as anchorage points or supports is forbidden.
14. Club boats may be hired by fully paid up Club Members, including Cadet Members and members of the Sail Training
School, at Club-organised events only. Users may be held responsible for any damage caused to Club boats either on
or off the water, and will be required to unrig, secure and leave them tidy after use.
15. Parents and Guardians are warned that the Club is only able to provide Safety Boat cover during the hours of
organised Club sailing events. Outside these hours, Parents and Guardians have sole responsibility for their children
and wards, and must appreciate that the Club cannot be expected to exercise supervision or control. Even during such
events the Club cannot accept responsibility for children or any other persons not engaged in such events. Cadets under
the age of fourteen must be accompanied by a responsible adult.
16. Sailing apparel shall not be washed, rinsed or otherwise treated in the shower area or changing rooms, and no such
apparel, equipment or other gear shall be left in the Clubhouse overnight and in this event it shall forthwith be removed
to the lost property locker.
17. All boat owners shall carry Third Party Insurance for a minimum liability of 3 million pounds.
18. Dogs (other than dogs trained to assist people with disabilities) are not permitted in the Clubhouse.
19. Members shall be required to affix an up to date Boat Permit to the transom of their boat.
20. The Club requires a good standard of conduct from its Members. When a Members conduct is considered
unacceptable by the Executive Committee it may result in a verbal or written warning, which could ultimately lead to
suspension or expulsion from the Club. If a Member wishes to appeal against any disciplinary action taken against them,
they should do so, in writing, within seven days to the Honorary Secretary of the Club.
