MEMORANDUM OF AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This AGREEMENT made and entered into by and between:
The Philippine Public School Teachers Association (PPSTA), a
corporation duly organized and existing under the laws of the Philippines,
with principal office at 245 Banawe Street, Quezon City, represented in this
transaction by the President, Dr. Kahar H. Macasayon hereinafter referred
to as PPSTA.
-and_______Lapuyan National High School______ a state-owned
institution, with office address at ___Poblacion, Lapuyan, Zamboanga del
Sur___ and herein represented by its Secondary School Principal-1 Nihma N.
Ismula, Disbursing Officer Rowena P. Suico, Senior Book Keeper Emelda
M. Fernandez and ________________ President of the ____________________, a
local
chapter
of
the
PPSTA
with
office
address
at
___________________________________.
-WITNESSETHWHEREAS, under its by-laws, all public school teachers and employees
of the Department of Education may apply for membership in the PPSTA;
WHEREAS, the PPSTA aside from awarding Mutual Aid (MAS 65) and
Retirement Benefits (MRBS Plus), also provides Scholarships and Sariling
Sikap Loans (Regular Loan, Instant Loan, Emergency and Calamity Loan) to
its members;
WHEREAS, the faculty and staff of Lapuyan National High School
have expressed their desires to become members of both the Philippine
Public
School
Teachers
Association
(PPSTA)
and
the
________________________ through the submission of

their individual and duly accomplished application forms for membership.

NOW, THEREFORE, for and in consideration of the foregoing premises
and Mutual covenants expressed, both parties hereby agree and stipulate, as
follows:
1. The School, through its ______________ and Disbursing Officer, shall
effect the collection of monthly dues for membership, premium
dues, loan amortization of principal borrower and/or co-makers,
pursuant to the authorization to deduct signed by the members,
through payroll deduction scheme;
2. The ____________ and Disbursing Officer shall remit to PPSTA its
monthly collections through money orders or bank transfer as the
case may be. Remittances shall be accompanied by a collection list
to ensure that payments of members are posted in their individual
ledger;

3. Check payments shall be accompanied by their corresponding

listings. Otherwise, payments shall be considered as mere deposits
only.
4. The PPSTA shall only grant membership to individual employees and
teachers of _____________________ school upon receipt of payment
duly accomplished Membership Forms;
5. The PPSTA, through its Treasurer, shall issue receipts for all remitted
collections;
6. The PPSTA shall, whenever necessary and eligible, grant all the
benefits due its members of good standing;
7. The PPSTA shall allow the maximum retention of 5% of the total
remittances made by the school as follows:
MAS 65
2%
MRBS Plus
2%
Sariling Sikap and Other Loans
1%
8. The School hereby guarantees that it shall permit to PPSTA the
contributions, insurance premium, membership fees and payments
collected from the members within a period of thirty (30) days from
collection thereof. The School, through its _________ and the
Disbursing Officer shall be held solidarily liable to PPSTA in case
there are membership dues, premium dues and other fees which
have been proven by substantial evidence to have not been
remitted to PPSTA;
9. This Agreement takes effect upon signing by both parties and may
be revoked/cancelled/terminated for cause by either party. It shall
be binding not only between parties hereto but also upon their
prospective successors and assigns;
10. The School shall not entertain any request for stoppage of
deductions from members without written clearance/authorization
from PPSTA. The school shall require the assigned/separated/retired
members to obtain clearance from PPSTA prior to processing and
payment of their benefit. The School through its Disbursing Officer
shall accordingly deduct the balance of the loan obligation from the
unpaid salaries and benefits of the members.
11. PPSTA shall submit the application for membership/loan
applications of the personnel of the school which shall include their
consent and approval of the deductions to be made on their
salaries.
12. Any suit arising out of this Agreement shall be instituted in the
proper court of Quezon City or ______________________, Philippines
only.
13. ______________________________________________,

vested on them by law, hereby represents and warrants that it has
its power to execute this Agreement and to observe and perform
the terms and conditions hereof.

instrument which is a Contract of Lease and they acknowledge to me
that the same is their own, free and voluntary act and deed as well as
that of the institutions they represent.
The foregoing instrument consist of three (3) pages including this
page on which this Acknowledgement is written and each and every
page of which has been signed by the aforesaid parties, and their
witnesses, and sealed with my notarial seal.
