The Clearwater City Council last week made its first


decision under its new tree ordinance by voting to reimburse a homeowner for trees that were removed during a
road project.
Last summer, Walnut Street resident Dan Niehoff requested compensation for four trees that were cut down
on his property during the Northeast Area Street and Utility Improvement Project.
At the time, the city had no history of reimbursing
property owners for trees, nor was there any written policy to follow.
The council discussed its options, including reimbursement and setting monetary limits. Later in 2015 the
council adopted an ordinance covering how the city could
deal with the issue.
In that ordinance, the council could reimburse costs
the homeowner presented to the council; set its own costs;
or do nothing at all to compensate the property owner.
Last week the council chose to reimburse Niehoff,
who had gotten quotes from two different tree specialists.
Administrator Kevin Kress said the trees that had
been removed from Niehoffs property were ash trees. He
was asking to replace them with two 8 diameter maple
trees, one 4 maple tree and one 2 maple tree.
Hes asking for maple, which is more consistent
with the ordinance, which asks that we put something
back thats a hearty species, said Kress.
The two quotes were almost identical. Tri-Co Tree
Removers quoted $3,156.88, including tax. JK Landscaping quoted $3,160.
Members of the council didnt dispute the cost.
Mayor Pete Edmonson asked whether the council wanted
a third quote, but they declined.
Id like to get this over with, said Councilman Rol-

lie Lange. Hes been waiting for months.


Im comfortable with two quotes, said Councilman
Chris Ritzer.
Then the council had to decide whether to purchase
the trees and save the sales tax, or have Niehoff buy the
trees and get reimbursed.
Councilman Mike Ranum wanted Niehoff to be responsible for the trees.
If we pay for the trees and if one of the trees dies,
then we have to deal with the warranty part of that, he
said. If he buys them, he has to deal with that. Then our
liability is over. Were done.
The council voted to reimburse Niehoff for purchasing the trees from Tri-Co Tree Removers.
Computer Upgrades
The council approved a contract with Now IT Connects to improve the efficiency, security and storage capacity of citys computer server at a cost of $1,010.50
plus $125 per month in service.
The council also voted to cancel the citys contract with Minco for similar services.
Other Business
In other action the council:
Appointed Richard Petty, Vern Scott and Andrea
Lawrence to the park commission and appointed Councilman Kris Crandall as the councils non-voting liaison.
Approved placing a portable toilet near the hickey
rink in Lions Park.
Approved a step wage increase for James Kirchenbauer of the maintenance department to $18.76 effective
Feb. 10;
Approved a transfer of $30,000 into the fire capital
equipment fund to increase the budget to $220,860 and
keep the fire contract consistent with prior years.

The Palmer supervisors reviewed an overhead that detailed the

Chris Perkins said he has been
working with surveyors, the DNR
and contractors to finalize the plans
and move towards construction and
hoped the board would okay his variances so he could bring the matter to
the county in the next step of the
process.
Supervisor Steve Demeules immediately stated he had major issues
with the whole plan and was concerned about the grade on the property which would cause certain runoff
onto roads, into creeks and into the
lake.
The whole thing is non-conforming, he said.
Perkins argued that he got okays
from the DNR and county officials,
saying they were 100% confident he
would be able to put a house on that
property.
Demeules argued the last letter
he read from the DNR cautioned the
township on moving forward. He also

Dr. Myles N. Brand, a
visionary leader, educator
and reformer, served as the
President of the National
Collegiate Athletic Association (NCAA) from 20032009. He passed away in
September 2009 at the age
of 67 after a battle with
pancreatic cancer. The
NSIC is a 16-team, 17-

questioned Perkins on how he was to


get the grading up in order to hinder
obvious runoff into the creek.
Perkins said he planned to bring
in approximately 1,500 yards of cubic
fill to achieve it.
Demeules and the board balked
at that idea since that would mean the
roads would take the brunt of that
procedure with several truckloads
going in and out of the property
would be necessary.
The board opened the floor to
concerned neighbors who were in
abundance at Mondays meeting to
bend the boards ear.
Charlene Langowski expressed
her concerns including the realization
that she once worked with the DNR
and she said they were always warned
to never spray near the trout stream
(Briggs Creek) because they were
very protective of the fish and their
habitat there. So, Langowski said she
would be very surprised to hear the
DNR was being lenient to the
Perkinses and their encroachments.
She also pointed out that all the
areas around the lakes and streams
suffer from occasional flooding and
she wondered where all that runoff
will spill into and how much more
flooding it will cause.
Rick Peyton said he is Perkins
northern neighbor and is concerned
for the flooding as well and cautioned
that he didnt think 1,500 not even
5,000 yards of cubic fill will keep
the property and neighboring properties from flooding.
Margo Josewski said she may be
one of those neighboring properties
who will be affected by the proposed
Perkins home. She stated that she and

Sheriffs Report
Sgt. Andy Oakes of the Sherburne County Sheriffs Dept. said 83
calls for service came into their station in regards to Palmer Township
activity.A few were traffic, four were
crashes and there were also a couple
ATV and snowmobile citations
handed out, he said.
Fire Dept. Report
Fire Chief Ron Koren said he received 16 calls for service including
three medicals and one auto accident

Last years water test results
were handed over to the township
clerk by a member of the lake association;

roads although some audience members asked to have 115th and 90th
Streets drifts plowed as soon as possible;
