We need to have a final product, reviewed through SBI, to provide to CBP front office by noon. We do
not need much, if any, detail. It is top level discussion. We do not need type of contract, just the
framework of how we will do something other than just throw Hidalgo Co $60M or so and walk away
until Dec 08 when we go check on our levee fence. Greg and (b) should engage with you as well.

Here are few of the bullets.

This will still be a contractual relationship, just not one based on the FAR. Even without the contract
being a FAR based contract, there are methods to ensure that CBP can ensure accountability and
provide necessary oversight to the project.

Have an on site presence to work along side Hidalgo Co so we can get a first-hand assessment of
progress as well as address the myriad of daily issues that will come up.

Have terms and conditions in the contract that require an effective level of cost and schedule
reporting.

Manage the effort through the use of disciplined change control process

Greg/Rowdy: what are the chances of an extension? Mid morning gives us little opportunity to research.
If you want it bad ..... It may take some research to give this a rounded answer. Not sure we have any
direct experience.

Any relief would yield a better product.

Part of the get backs from today’s SRT is a set of FAQs on the Hidalgo Contract. Specifically, we need to
provide information that establishes how CBP will ensure accountability and oversight for the contract.
Questions were raised regarding fraud and financial accountability. Greg assured them that we

are not the first agency to use a non-FAR based contract and that other agencies have written contracts
that had controls for contractor performance and invoicing. You get the idea. They want an
explanation of the type of contract that we will write in Q & A form.

This is a tight turn around tasking being coordinated by (b) (6)

Barbara Vail may be able to answer any specific questions that you might have.
