Plaintiffs respectfully submit the following response to the issues raised in the

Courts January 29, 2016 Order (Doc. No. 1610).

Question 3:

Plaintiffs agree that there is no basis to maintain under seal any of the documents

listed on page 2 and 3 of the Courts Order (Doc. Nos. 610, 698, 719, 730, 783, 786,

788, 790, 814, 823, 826, 827, 830, 833, 845, 848, 874, 994, 1033, 1072, 1073, 1077,

1084, 1107, 1153, 1335, 1420). To the extent Defendants contend that any of these

documents relate to ongoing investigations, Plaintiffs request that Defendants state on

the record the status of each of those investigations.

Plaintiffs also submit that there is no basis to maintain the transcripts listed on page

11

3 (Doc. Nos. 1456, 1472, 1563) under seal. Further, neither Defendants nor any non-

12

party has made an adequate showing to justify maintaining the documents filed by the

13

Arizona Attorney General under seal (Doc. Nos. 1443, 1529). As noted by the Court,

14

MCSO has released the nature of and the principal involved in the investigation.

15

Plaintiffs and Defendants also discussed this investigation openly in Court. See, e.g.,

16

Hrg. Test. of Sgt. David Tennyson on Oct. 9 and 13, 2015.

Plaintiffs take no position regarding whether the documents listed on page 4 of the

18

Courts Order should remain under seal (Doc. Nos. 415, 419, 1062, 1259, 1260, 1313,

19

1314).

Questions No. 6(f), 12, 12(c), and 12(d)

Plaintiffs received the updated listing (MELC1404203a-1404207a) from

22

Defendants on February 4, 2016. Plaintiffs submit that the Court may consider that

23

document, and Plaintiffs stipulate to its admission into evidence as Exhibit 2943a.
