An act to provide for the regulation and control of training of apprentices and for matters connected
therewith
Apprenticeshiprequirements

TheprovisionsofHealth,SafetyandWelfareasmentionedintheFactoriesActshallalsoapplyto
theapprenticesasiftheyareemployedinthefactory(Section4)
Ifanypersonalinjuryiscausedbywayofaccidentarisingoutofandinthecourseofhistraining,
employershallbeliabletopaycompensationinaccordancewiththeWorkmenCompensationAct,
subjecttothemodificationspecifiedintheschedule(Section16)
If the contract is terminated on account of failure of employer in carrying out the terms and
conditions mentioned in the contract, such employer shall be liable to pay the apprentice
compensationofanamountequivalenttohis3monthsofstipendlastdrawn(Rule10orRule8
pleasecheck)

To pay such stipend at a rate not less than the prescribed minimum rate or the rate which was
beingpaidbytheemployeron1stJanuary1979tothecategoryofapprenticesunderwhichsuch
apprenticefalls,whicheverishigher(Section13)
The minimum rate of stipend payable to trade apprentices during 1st, 2nd, 3rd and 4th year of
trainingshallbeminimumRs680,Rs780,Rs900andRs1020respectivelypermonth(Rule11(1))
The minimum rates (per month) of stipend payable to Graduates, Technician (Vocational)
ApprenticesshallbeRs1630/forEngineeringGraduates,Rs1160/forSandwichCourse(Students
fromdegreeinstitutions),Rs1160/forDiplomaHolders,Rs940/for SandwichCourse(Student
fromdiplomainstitutions)andRs900/forVocationalCertificate(Rule11(2))
Stipendshouldbepaidby10thofthenextmonth(Rule11(3))
Nodeductiononaccountofcasualleaveormedicalleave(Rule11(4))
Nostipendshallbepaidforextraordinaryleavetakenbysuchapprentice(Rule11(4))

Continuance of payment shall be subject to the work and conduct of the apprentice being
satisfactory.(Rule11(6))
Iftheworkandconductisnotsatisfactory,employershallreporttotheApprenticeshipadviserand
with hisconsentmay stopmakingpayment.Insuchcases,opportunityofbeing heardhastobe
giventoapprentice(Rule11(7)
If Apprenticeship Advisor do not give decision within 30 days of the receipt fo report it shall be
deemedthathehasgivenhisconsenttostopmakingpaymentofstipend(Rule11(8))

Hoursofworkhavetobewithin10AMand6PM.Foradditionalhoursofwork,permissionofthe
apprenticeshipadviserisrequired

Total number of hours per week shall be 42 to 48 hours (including time spent on related
instructions)
Graduate, Technician and Technician (vocational) apprentice shall work according to the normal

Such person shall appear for a test to be conducted by the National Council to determine his
proficiency

It is not obligatory on the part of employer to offer any job to such apprentice neither it is
obligatoryonthepartofapprenticetoacceptanyjobprovidedbysuchemployer(Section21)

Factory must be kept clean from any drain, privy or other nuisance. Cleanliness must be
maintainedinparticularin:
a) Dirt and refuse to be cleaned and removed everyday from the floor, benches of workers,
staircasesandpassage.Thesemustbedisposedoffinaneffectivemanner
b) Washingoffloorsofworkroombyusingdisinfectantsatleastonceeveryweek.
c) EffectiveDrainageSystemincaseswherefactoryprocessislikelytowetthefloor
d) Insidewalls,partitions,ceilings,topsofrooms,allwallsides,topsofpassagesandstaircases
shall be repainted and varnished atleast once on every five years (if they are painted
otherwisethanwithwashablewaterpaintorvarnished)
e) Ifpaintedwithwashablewaterpainttheywillberepaintedwithatleastacoatofsuchpaint
atleastonceinthreeyearsandwashedatleastonceinsixmonths
f)
In any other case they should be white washed or colour washed atleast once in every
fourteenmonths
g) Doors,windowframesandallothermetallicorwoodenframeworkandshutterstobekept
paintedandvarnishedandthesametobecarriedoutatleastonceineveryfiveyears
Thedatesonwhichtheabovementionedarecarriedoutwillbemaintainedinaregister
Effective arrangements should be made for disposal of wastes and effluents and prior
approvalsshouldbetakenfromthelocalauthoritiesforconnectionwiththepublicsewerage
system(Section12readwithRule22)
Measuresshouldbetakentopreventdustandfume(Section14)
AdequatemeasuresshouldbetakenforArtificialhumidification(Section15)
Factory rooms should not be overcrowded to an extent that it affects the health of the

b) All glazed windows and skylights used for lighting should be kept clean in inner and outer

DrinkingWater:
There should be provision for sufficient supply of wholesome drinking water for all workers
employed
Allpointsaretobemarkeddrinkingwaterlegiblyinalanguagethatisunderstoodbymajority
ofworkers
Allpointsofdrinkingwatershouldnotbesituatedwithinagapof6metersfromanywashing
place,urinal,latrine,spittoon,opendrain
Factories hiring more than 250 workers will have provisions for cooling drinking water during
hotweather(Section18)
Latrines and Urinals: Separate for males and females. In case where there are more than 250
workers,thefloorandinternalwallsupto90cmsheightshallbeinglazedtiles.Itshouldbekept
clean, adequately lighted and ventilated. There should be one latrine for every 25 persons and
oneurinalforevery50maleworkers(Section19r/wRules45,48)

FencingofMachinery:Everymovingpartofaprimemover,everyflywheelconnectedtoaprime
mover, the headrace and tailrace of every waterwheel and water turbine, electric generator,
motor or rotary converter, transmission machinery and every such dangerous part of any
machineryshouldbesecurelyfencedbysafeguards(Section21)
Workingnearmachineryinmotion:Wherethemachineryisinmotion,operationorexamination
shall be carried by trained adult male worker wearing tight fitting clothing. The worker shall not
handlebeltatamovingpulleyunlessthebeltisnotmorethan15cmsinwidth.Thebeltjointis
eitherlacedorflushwiththebelt.Womanoryoungpersonshallnotbeallowedtoclean,lubricate
oradjustanypartofaprimemoverorofanytransmissionmachinerywhileitisinmotion(Section

YoungPersonondangerousmachine:Hehasreceivedfullinstructionsofdangersandprecautions
thereofhasbeenexplainedandisallowedtoworkonlyifhehasgivenfulltrainingorisworking
