arepresentedannuallytolocalorganizationsthatdemonstrateleadership,effectiveness,and
resultsinmakinganimpactontheenvironment.
Allfivewerechosenbyagroupofindependentjudges,environmentalexperts,andPEC
staffinresponsetoacallforentriesearlierthisyear.
Withtheseawards,eachwinnerwilldesignatea$5,000cashprizetobeusedinsupport
ofanonprofitenvironmentalprogramoftheirchoice.

The
ConnoquenessingWatershedAlliance
replantedariparianbufferalongsevenmilesofsewerlinecrossingsfollowingthecompletionof
amajorhabitatimprovementprojectinThornCreek.
Ateachstreamcrossing,30nativetreeandshrubseedlingswereplantedonbothsidesof
thestreambank,withatotalofover1,500seedlingsplanted.Fourinstreamdeviceswere
constructedtocreateanimmediatefishhabitat.
Morethan30instreamhabitatdeviceshavebeeninstalledwhichhavestabilizedover
5,000feetofstreambankandleveragedover$300,000inwatershedimprovementsthrough
grants,donations,andpartnerships.
Thisprojecthasbroughttogethermanystateandlocalpartners,includinggovernment
agencies,localmunicipalities,internationalcorporations,concernedcommunitymembers,local
businesses,andaschooldistrict.Thusfar,closeto20differentgroupsorindividualshavebeen
activeparticipantsintheproject.

CrawfordCountyRiparianRestorationProgram,Meadville:
TheCrawfordCounty
RiparianRestorationProgramaddressedtheenvironmentalneedtoestablishforestedriparian
plantingsalong30differentstreamsthathavebeenidentifiedasimpairedwaterways,including
nearly20milesofstreamsintheOhioandtheLakeErie/GreatLakesriverbasins.
Overthepast16years,itisestimatedthatover75,000treesandshrubshavebeenplanted
withthehelpof4,500studentsfrom12localmiddleandhighschoolscompletingmorethan100
differentconservationprojects.
EveryhighschoolinCrawfordCountyhasbeeninvolvedinthisprojectaswellasover
550privatecitizensandmembersoflocalorganizations.Onestudentparticipantbecamethe
ErosionandSedimentationSpecialistinthelocalcountyconservationdistrictandanotherisnow
alocalforester.
Alltold,morethan110acresofstreamsidebuffershavebeenenhancedthroughthis
program,impactingtheplants,animals,andcitizenswithintheOhioandLakeEriewatersheds
andbeyond.

greenhousegasemissionsoriginatefromcommercialbuildingsand30percentoftheenergy
usedbytheaveragecommercialbuildingiswasted.
ThePittsburgh2030Districtaimstocreateastrongerdowntownbyhelpingproperty
ownerstoworkcollaborativelytogetherandwithasetofstatedcommongoalstoimprove
indoorairquality,reduceresourcesused,increaseassetvalue,andcreatesolidreturnson
investment.
Injustthreeyears,Pittsburghhasbecomethelargest2030Districtintheworldtodate,
consistingof436buildingswithover65.5millionsquarefeetofrealestateinDowntown
PittsburghandOaklandallactivelyworkingtowards50percentreductionsinenergy
consumption,wateruse,andtransportationemissionsbytheyear2030.
Through2015,380propertiessavedtheequivalentenergyuseof5,562homes.
Additionally,96downtownbuildingsachievedatenpercentreductioninwateruse,representing
362homesannualwaterusage.

The
PittsburghBotanicGarden
istransforming460
acresofabandonedmininglandjusttenmileswestofthecityintoaworldclassbotanicgarden.
Oncecompleted,thePittsburghBotanicGardenwillbeoneofthelargestbotanicgardensin
America.
Itwillbecomprisedof18distinctgardens,fivediversewoodlandexperiences,avisitors
center,acelebrationcenter,andacenterforbotanicresearch.Whatsmore,itisaworldclass
exampleofcoalminerestorationandremediationandwillbetheonlybotanicgardeninthe
UnitedStatesbuiltonreclaimedland.
TheGardenspassiveacidminedischargetreatmentsystemremoves912poundsof
pollutantsperyearasittreats4.2milliongallonseachyear.ThepHofthistreatedwaterhas
improvedfrom3to7.Additionally,therearenow111differentspeciesofbirdsthatcanbe
observedattheGardenasaresultoftheremediationandrestorationwork.

regulations.CounselforPIPPsaidDEPscutandpasteexercisehedescribedas
meaninglessindividingtheregulationsintoChapter78(conventional)and78a
(unconventional)doesnotmeettherequirementsofthatlaw.

Section1741.1E.EnvironmentalQualityBoard.(a)Regulations.Fromfunds
appropriatedtotheEnvironmentalQualityBoard,theboardshallpromulgateproposed
regulationsandregulationsunder58Pa.C.S.(relatingtooilandgas)orotherlawsofthis
Commonwealthrelatingtoconventionaloilandgaswellsseparatelyfromproposedregulations
andregulationsrelatingtounconventionalgaswells.Allregulationsunder58Pa.C.S.shall
differentiatebetweenconventionaloilandgaswellsandunconventionalgaswells.Regulations
promulgatedunderthissectionshallapplytoregulationspromulgatedonoraftertheeffective
dateofthissection.
CounselforPIPPsaidthenatureofconventionaldrillingissodifferentfrom
unconventionaldrillingitdeservedtobetreatedthroughaseparateprocessastheFiscalCode
amendmentenvisionswithoutbeingpollutedbytheunconventionalindustry.
Instead,PIPPsaid,DEPandtheEQBadoptedoneregulationdealingthedrillingthathas
oneIRRCnumberandwhichwasconsideredatthesamesetofpublichearings.PIPPcounsel
notedanattemptattheEQBmeetingtoconsidereachchapterseparatelywasvoteddown.
PIPPcounselsaidthefactsofapplyingtheFiscalCodelawwillnotchangeregardlessof
theactionstheIRRC,legislativecommitteesorotherpartiestakeintheasyetincomplete
regulatoryreviewprocess.

DEPandtheEnvironmentalQualityBoardsaynopossibleharmcouldoccurto
conventionaloilandgasdrillers(astandardforgrantingCourtrelief)untilandunlessthe
regulationsarepromulgated,meaningwhentheyarepublishedasfinalinthePABulletin,after
theIRRC,legislativecommitteesandtheOfficeofAttorneyGeneralact.
Courtactiontoblocktheirpublicationbeforetheygothroughthecompleteregulatory
reviewprocessandarepromulgated(publishedinthePABulletin)ispremature.DEPandthe
otherrespondentsalsoarguedPIPPAdidnothavestandingtofilethelawsuit.
Inaddition,DEPsaidtheplainlanguageofthe2014FiscalCodeamendmentdidnot
directtheEnvironmentalQualityBoardtowithdrawtheregulationstheyhadalreadypublished
asproposedandstartover.
DEPcounseltoldtheCourtthefactsofthiscaseneededtobedevelopedbecausethere
aremanysubstantivedifferencesbetweentheregulatoryrequirementsinChapter78coveringthe
conventionalindustryandChapter78acoveringunconventionaldrilling.
DEPalsopointedouttheregulationshaveundergonethemostextensivepublic
participationprocessinDEPshistory12publichearings,2separatepubliccommentperiods,
andmorethanadozenpublicmeetingswiththeoilandgastechnicaladvisoryboards.
ThefinalrulemakingrepresentsthefirstcomprehensivechangestoDEPsdrilling
regulationsin15years,since2001andwasdevelopedinresponsetochangesindrilling
technologyandpracticesandlegislationpassedbytheGeneralAssemblyin2012andsignedinto
lawbyGov.Corbett.

MondaythatoutsidecounselhadbeenretainedfortheEQB,however,theBoardhadnoinput
intotheresponsefiledbyLevinewiththeCourtbecauseoftheshortdeadlineforaresponse,
Quigleysaid.
Onaconferencecallandinemailexchanges,severalmembersoftheBoardexpressed
concernaboutthelackofinputandonthedecisiontoretaincounsel,includingRep.JohnMaher
(RAllegheny),MajorityChairoftheHouseEnvironmentalResourcesandEnergyCommittee,
whositsontheEQB.
The
EQBvoted15to4inFebruary
toapprovethefinalregulations,withRep.Maherin
thenegative,sotheBoardwasdividedwhenittookaction.

PennsylvaniaportionoftheChesapeakeBayWatershedhave
respondedtothesurvey.
Thesurveyisdesignedtohelpidentifythose
conservationBMPsinstalledbyfarmerswithoutstateor
federalcostsharefunds(noncostsharedBMPs)onfarms
acrosstheChesapeakeBaywatershed.
Thesurvey,whichistobecompletedbyApril30,wasdesignedtocapturethose
conservationpracticesfarmershaveinstalledattheirownexpensetomaintaintheviabilityof
theirfarmswhileprotectingwaterqualityintheircommunities.
FordecadesmanyofPennsylvaniasfarmershavebeendoingtherightthinggrowing
theirfarmsandworkingtominimizeanyimpairmenttotheirlocalwaterquality,said
AgricultureSecretaryRussellRedding.Youcanthavehealthyfarmswithouthealthy
waterways.Ourfarmersknowthis,whichiswhymanyofthemhavebeenworkingtowardthese
coequalgoalsontheirown.Wewanttoensurethattheireffortsareaccountedforandgiveour
producerscreditforalltheyredoing.
Thesurvey,whichisconfidential,wasdevelopedtohelpcollectdataforthoseBMPsthat
maynothavebeencostsharedandthereforearenotonrecordasapartofthestateseffortsto
improvethehealthofthewaterways,inparticulartheChesapeakeBay.
Earlierthisyear,weunveiledastrategytorestorethehealthoftheChesapeakeBay
watershed,anditssuccessreliesontheagricultureindustrymaking75percentofPennsylvanias
totalnutrientloadreductions,saidRedding.Whileagriculturewilldoourparttocontinue
meetingthestatesobligationstoahealthierBaywatershed,itsalsoimportantthatwerecognize
andcapturethegoodworkourfarmersaredoingontheirown.Ithankeveryonewhohas
respondedtothesurveyalreadyandurgethosewhohaventtocompletethesurveyandhelpus
continuesharingagriculturesstory.
DatafromthesurveyonthenoncostsharedBMPswillbeaggregatedsonoindividually
identifiableinformationisavailable,thensubmittedtotheDepartmentofEnvironmental
Protectionforreviewandanalysis.DEPwillsharethosefindingswiththeU.S.Environmental
ProtectionAgency.
Currently,PennsylvaniahasonlyreportedthoseconservationBMPsthatwerefunded(in
wholeorpartially)bystateorfederaldollars.ThissurveyquantifiestheBMPsandallowsfor
federallyapproveddocumentationoftheaccuracyofthisselfreporteddatathroughfollowup
farmvisits.
Weneedeveryonesinputthemorewecanquantifyourgoodwork,thefurtherweare
towardagriculturesnutrientreductiongoals,Reddingadded.

"Thisrecognitionisquiteanhonorforthecountlesspeopleandorganizationsthat
contributedtoManureExpo,"Meinensaid."Professionalswereexposedtoinformationand
equipmentthatallowsimultaneousandpracticalprogressforanimalagriculture,cropproduction
andenvironmentalstewardship.Frombeginningtoend,thatwasouroverarchinggoal.
"Theenvironmentalbenefitspromotedattheexpoarereal,"hesaid."Theattendeeshave
enormousinfluenceonenvironmentaladvancementacrossthisregionandallofNorthAmerica.

TheDepartmentofEnvironmentalProtectionTuesdayannounceditisrestartingaprocessto
improvestatewideconsistencyinthewayDEPconductsinspectionsofregulatedentitiesand
activities,ensurescompliancewithstateandfederallawsandregulations,andhandles
enforcementcases.
Theresultofthisprocesswillbeageneral,inspection,compliance,andenforcement
policyaimedatimprovingconsistencyforallourprogramspecificpolicies,saidDEPSecretary
JohnQuigley.Thisfoundationwillhelptoensurethatourworkacrossallprogramsisinternally
aligned,consistent,andincompliancewithstateandfederalregulatoryrequirements.
InkeepingwithDEPscommitmenttotransparency,theprocesswillincludeapublic
noticeandcommentperiod,anticipatedtooccurinthesummer.

PennFutureSettlementEnsuresGreenWaterInfrastructureFundingInPittsburgh
Settlementofalawsuitbetween
PennFuture
andtheCityofPittsburghandthe
PittsburghWater
andSewerAuthority
willensurethatfuturedevelopmentprojectsreceivingsubstantialpublic
fundswillusegreeninfrastructureandlowimpactmanagementpracticestomanagestormwater
andpreventoffsitedischargesthatcommonlycarrypollutiontoareastreamsandrivers.
PennFutureannouncedagreementinacaseconcerningtheCity'senforcementof2010
legislationthatrequiredtheuseofgreeninfrastructureandlowimpactmanagementpracticesto
ensurethatthedevelopmentnotallowtheoffsitedischargeofprecipitationfroma95percentor
lessrainfallevent.
"ThissettlementnotonlyensurestheCity'suseofgreeninfrastructurebestpractices,it
willimprovepublichealthandsafetywhilesavingtaxpayermoney,"saidLarrySchweiger,

PennFuturebroughtthissuitintheU.S.DistrictCourtfortheWesternDistrictof
PennsylvaniapriortoMayorPeduto'sadministration,allegingthatthePittsburghWaterand
SewerAuthorityandtheCityofPittsburghhadnotrequiredgreeninfrastructureandlowimpact
developmentpracticestocontrolstormwaterona50acrepropertybeingdevelopmentbythe
BuncherCompanyintheStripDistrictbetween11thand21stStreets.
"It'snotenoughtohaveforwardthinkingpoliciesiftheyarenotenforced,"addedGeorge
Jugovic,Jr.,chiefcounselforPennFuture."Byagreeingtosubmititsgreeninfrastructure
ordinancetobemadeapartofitsstateapprovedstormwatermanagementprogram,theCity
ensuresthatthisandfutureadministrationswillreducepollutiontoareastreamsfrompublicly
fundeddevelopmentsusinggreeninfrastructuretechniquesasoriginallyintendedbythe
ordinance."
Theordinance,authoredbythencouncilmanPeduto,soughttoensurethatenvironmental
bestmanagementpracticeswereemployedbytheCitytoreducestormwaterpollution.
Stormwaterrunoffcarriesmanytoxicpollutants,dirtandgarbagetoriversandstreams.
Studiesshowthatthispollutionrivalssewageplantsandlargefactoriesasasourceofharmto
waterways.
Theuseofgreeninfrastructureandlowimpactmanagementpracticesincluding
bioswales,raingardens,greenroofs,rainbarrels,andbufferscaptureandreturnstormwater
runofftorestorepartofthenaturalwatercyclethatislostbecauseofdevelopment.

flooding,"CommissionerMillersaid."Ifthemortgageonahomeisbackedbythefederal
government,whichmanyare,thenthehomeownermustbuyfloodinsurance."
Toappealahome'splacementinwhatisofficiallycalledaSpecialFloodHazardArea,
thehomeownermustshowthelowestadjacentgrade,orthelowestgroundtouchingthe
structure,isatorabovewhatiscalledtheBaseFloodElevation.
TheBaseFloodElevationisthecomputedelevationtowhichfloodwaterisanticipatedto
riseduringthebasefloodusedindeterminingthelandisinaSpecialFloodHazardArea.
CommissionerMillernotedthatitisthehomeowner'sresponsibilitytoprovidethis

Countyandtwoofitsaffiliatescovering$393,000inpenaltiesforviolationsatsitesin

DEPfinedRiceDrillingforviolationsinAmwellTownship,WashingtonCounty,
includinginstallingawaterlinebetweenawellpadandanimpoundmentwithoutapermit,
buildingapipelinethroughawetlandthatwasnotauthorizedbypermit,andputtingthreewater
linesunderastreamwhenthepermitauthorizedonlyonepipeline.
Thecompanywasalsocitedfor21streamcrossingswithoutproperDEPpermitting.
AlphaShaleResources,LP,aRiceaffiliate,wascitedforanAugust9,2012,spillatitsAlpha
Unit21HgaswellinJacksonTownship,GreeneCounty.Inthisinstanceafrackingfluidtank
overflowed,spilling100barrelsofproductionwaterontheground.
RicePoseidonMidstream,LLC,anotherRiceaffiliate,wascitedfornotusingbest
managementpracticesinerosionandsedimentcontrolthatcontributedtoalandslideonApril5,
2015,thatforcedthetemporaryclosingofMuddyHollowRoadinHolbrook,GreeneCountyand
impactinganearbystream.

ConventionalandUnconventionaloilandgasindustriesseparately.
Act126,passedbystatelegislatorsandsignedbyGovernorCorbett,mandatedthe
DepartmentbifurcatetheconventionalandunconventionalregulatoryinstrumentsoftheOiland
GasAct.
DEPinsteademployedawordprocessingexerciseanddeliveredtwovirtuallyidentical
documentsinChapter78forconventionaloperationsandChapter78aforunconventional.
Theseseparatesetsofregulations,afteryetanotherperiodofpubliccommentand
advancednoticeoffinalrulemakingwerethensentto
EQBinJanuaryof2016
asonepackage.
Twosetsofregulationsbutonlyoneupordownvote.Thatisnotseparate.Assuch,webelieve
theseregulationsareunlawful.
Withregardtoyourclaimthatconventionaloperatorshaveincurredthreetimesasmany
violationsastheunconventional,perhapssomefactualinsightwillpaintamoreaccurate
pictureTherehavebeen9,884unconventionalwellsdrilledintheCommonwealthasofmy
sittingdowntowritethisresponse.Inthatsametimespantherehavebeen29,269conventional
wellsdrilled.
Therearealsoover100,000additionalconventionalwellscurrentlyinsafeoperation.
Consideringthisskewedratioitisnosurprisethattheconventionaloperatorsincurmore
violations.
Whatyouclaimtobefacts:
1)Conventionalwellscausewaterlossandcontaminationjustlikeunconventionalwells.
DuringtheConventionalOilandGasAdvisorymeetingonMarch26thinHarrisburg,Kurt
KlapkowskimadethisstatementConventionalindustrysimpactisrelativelytemporaryin
nature.Youdontseelongtermimpactsnecessarily.Ontherareoccasionthatwatersupplies
areaffectedbyconventionalactivitiesitclearsupinashortperiodoftime.Also,pollutingthe
watersoftheCommonwealthisalreadyaviolationoftheOilandGasAct.
2)Conventionalwellshavemoreviolationsthanunconventionalwells.
TheDEP2014OilandGasAnnualReportstates:In2014,1,449violationswereidentifiedat
conventionalsites,and412violationswereobservedatunconventionalwellsites.Whatitfailed
topointoutfromitsownonlinereportswasthat:
a)Conventionalwellsitesoutnumberedunconventionalwellsitesbymorethan12:1in2014.
(121,988activeconventionalwells,9,848activeunconventionalwells).Thisrevealsthatthere
was1violationforevery84conventionalwells,asopposedto1violationforevery24
unconventionalwells.
b)Ofthe12,703inspectionsofconventionaloperationsconductedin2014,11,905inspections
didnotrevealanyviolations.Thatisa93.7percentcompliancerate.Thatisanamazingstatistic
giventhattheDepartmenthasturneduptheheatonourindustryinrecentyearswithmore
inspectorsconducting24percentmoreinspectionsthanin2008.
c)40percentoftheviolationsidentifiedinconventionaloperations(583)in2014weremerely
administrativeviolations,notenvironmentalhealthandsafetyviolations.
d)12operatorswereresponsibleforover45percentofalltheviolationsidentified.
3)Bothunconventionalandconventionalindustriesemployfracing..
Whilethisistruethetechniquesarecompletelydifferent.Theconventionalindustrydrills
verticalwellsusuallynomorethan2,500feetdeep.Ourfracturespropagatenomorethan150
feethorizontallyfromthewellbore.Atypicalconventionalfracstageusesafewthousand
gallonsofwaterandabout80sacksofsand.Unconventionalwellsaremuchdeeperand
kickoffhorizontallyupto9,000feetindifferentdirections.Alongthis9,000footsection
dozensofstagesarefracdwithmillionsofgallonsofwaterandchemicals.
4)Conventionalwellsaredrilledthroughthesamesensitiveaquifers.
Thisistrue.Thereareveryclearregulationsthathavebeeninplacesincetheimplementationof
Act223,TheOilandGasActof1984thatprotecttheseaquifersthroughtheuseofcementedin
casingstrings.
5)Conventionalwellscreateabiggerfootprintontheland.
Evenifyoutakeallthe121,988conventionalwelllocationswearestill3.5timessmallerthan
thefootprintoftheunconventional.
a)Fortythreeconventionallocationscanfitontooneunconventionallocation.
b)Conventionallocationroadsareverysmall,usually12feetwide.
c)Theunconventionalindustrybuildstwolaneroadsastheyneedlargerroadstoaccommodate
theheavytrucktraffic.TheydoabetterjobofbuildingroadsthanmosttownshipsandtheForest

d)Conventionalpipelinerightofwaysbearlittletonoimpactastheyaremostoftenburiedin
theditchesofourlocationandaccessroads.

6)SmallerCompanies,FewerResources?Whenwaterresourcesarepolluteditistheobligation
undercurrentregulationforthecompanyresponsibletofixtheproblem.Thereisnoprecedent
wheretaxpayershavehadtopickupthebillfortheinfractionsofasingleconventionalproducer.
Smallbusinessesarethebackboneoftheconventionaloilandgasindustryofthis
Commonwealth.Yourcommentsareaninsulttoanindustrythathasperseveredthroughbooms
andbustsforover155yearsandwhoseproductsbenefiteverysinglepersonlivinginthis
Commonwealth.
OftheconventionaloperatorsintheCommonwealthtoday,virtuallyallaresmall
businesses.InacornerofPennsylvaniathatIndustryhaslargelyabandoned,smallbusinessis
whatmakesoureconomywork.ThousandsofPennsylvaniansrelyontheconventionaloiland
gasindustrytoprovidealivingfortheirfamilies.
TheChapter78regulations,ifimplementedandenforcedaswritten,wouldbetheendof
thisindustry.ItistimethatHarrisburgrealizesthatthereislifeWestoftheSusquehannaRiver.
Environmentalistsmaketheproductionoffossilfuelsanissueofmorality.
Aretheirverylivesnotenrichedbytheproductsproducedbythisindustry?Howisitnot
anissueofmoralitytopotentiallyputthousandsofpeopleoutofworkanddecimate

PennEastsubmitteditsprefilingapplicationwithFERConOct.7,2014,anditsformal
applicationforpermissiontobuild,ownandoperatethePennEastPipelineonSept.24,2015.
Todate,PennEasthasconductedextensivepublicoutreach,performedfieldsurveyson
morethan60percentoftheroute,respondedtotwocomprehensivedatarequestsfromFERC
