Structure and Guidelines for the
Operationalization of the Joint Regional and Provincial
Committees on DAR, DENR, LRA and NCIP Concerns
Section 1. Rationale Pursuant to the provisions of the Joint DAR-DENR-LRA-NCIP
Administrative Order No. 01, Series of 2012 entitled
Clarifying, Restating and Interfacing the Respective Jurisdictions,
Policies, Programs and Projects of the Department of Agrarian
Reform (DAR), Department of Environment and Natural Resources
(DENR), Land Registration Authority (LRA), and The National
Commission on Indigenous Peoples (NCIP) in Order to Address
Jurisdictional and Operational Issues Between and Among the
Agencies, and Memorandum Circular 8, s2012, entitled
Implementing Rules of Procedure of the Joint DAR-DENR-LRA-NCIP
Administrative Order No. 1, s2012, this Joint Operating Manual
is promulgated and entered into.
This document shall be known as the Operating Manual of the
Caraga Joint Regional Committee and Provincial Committee.
Section 2. Compositions a) A Joint Regional Committee (JRC) shall be constituted
among the member agencies composed of the Regional
Directors/Administrator for the following agencies:
i.

Department of Agrarian Reform (DAR)

ii.
iii.
iv.

Department of Environment and Natural Resources


(DENR)
National Commission on Indigenous Peoples (NCIP)
Land Registration Authority (LRA)

b) The chairmanship of the Joint Regional Committee shall be


rotated annually among the Regional Heads of the abovementioned Agencies. The Chair must be of third level
position or its equivalent.
c) Each Regional Member shall nominate their respective

Alternates to the committee who will have the same


authority and representation when the Regional
Members are unable to attend meetings and other
activities;
Representatives to the Technical Working Group;
Head of Field Offices at the provincial level to
compose the Provincial Committees, whose term
shall be co-terminus with the term of their Regional
principals.

d) The JRC members shall elect among themselves a cochair. To ensure sustainability and continuity, the co-chair
will be the Chair for the next ensuing year;
e) The Joint Provincial Committees will be chaired and cochaired by the head of office of the agency as in the JRC;
Section 3. Incumbent Members, their Alternates and
Representatives
a) The set of incumbent members composing the Joint
Regional
Committee,
The
Technical
Working
Group/Secretariat and the different Provincial Committees
for Caraga region is hereto attached as Annex 1

b) For the use and ease of communication, this Annex 1


shall be updated by the chair of the JRC in any given year.
c) For the CY 2015, the name of members and their duly
appointed representatives as enumerated in Sec. 2(c) are
those indicated in the current Annex 1.
Section 4. Roles and Responsibilities
In the performance of their functions, responsibilities, as well as
the authority, the following committees and group shall be guided
by conflict sensitivity, transparency and expediency of service.
a) The Joint Regional Committee shall:
i.

Address or resolve jurisdictional, operational and


policy issues elevated to it by any provincial
committee that affect the implementation of CARL,
IPRA, Public Land Act, Land Registration Act/Property
Registration Decree in relation to their respective
mandates.

ii.

Specify conflict-sensitive mechanics and rules to be


applied by the Agencies in the resolution of policy,
jurisdictional and operational issues within identified
contentious and potentially-contentious areas, in
relation to the mandated JAO mechanism.

iii.

Facilitate, thru their respective head of field offices at


the provincial level, the identification of contentious
or potentially-contentious areas but not including but
not limited to the unimpeded flow and exchange of
documents, data, survey plans, maps and other
information materials among the concerned agencies
and the identification of jurisdictional cases/issues
which remain unresolved at the provincial level,.

iv.

Explore the stages of proceedings made on the


subject issue/case thru their appointed technical staff
(TWG-Secretariat) with the latters recommendations
and suggestions in resolving the jurisdictional issue/s
in accordance with the JAO 01-2012.

v.

Whenever necessary, invite other agencies or


sectoral representative/s from the concerned LGU/S
and the Civil Society Organizations including IP
groups, following a process of invitation such as but
not limited to good track record, to shed light on the
issue emanating from their respective area of
jurisdiction to ensure an early resolution of the case,
and conflict-sensitivity.

vi.

Conduct annual planning to identify, among others,


capacity building needs, sustainability measures,
including resource and logistical mobilization, and
organizational
development
for
the
member
agencies.

vii. Adopts conflict-sensitive policies, processes, and


procedures for its day-to-day operations, as well as
for the provincial committees, the TWG, the
Secretariat, and other bodies that it will establish
within its mandate.
viii. Conduct bi-annual regular meetings.
ix.

Elevate expeditiously to the National Joint Committee


policy issues the subject matter of which cannot be
resolved at the regional level.

x.

Perform other functions such as, but not limited to,


the creation of ad hoc committees, conduct of

relevant activities, and establishment of partnership,


in pursuance to its mandates.
b) The Provincial Committee shall:
i.

Identify jurisdictional and operational issues within


identified contentious and potentially-contentious
areas at their level.

ii.

Adopt mechanisms and rules issued by the Joint


Regional Committee in the resolution of policy,
jurisdictional and operational issues within the
identified contentious and potentially-contentious
areas.

iii.

Facilitate the unimpeded flow and exchange of


documents, data, survey plans, maps and other
information
materials
among
the
concerned
agencies.

iv.

Conduct regular quarterly meetings.

v.

Submit quarterly narrative reports on activities and


initiatives undertaken by them at their level,
including the number and nature of case resolved by
them.

vi.

Submit and make recommendations to the JRC on


matters pending before the latter on unresolved
cases/issues, or on other urgent matters as
requested by the JRC.

vii. Invite other agencies or sectoral representative/s


from the concerned LGU/s and the Civil Society
Organization including IP groups as resource persons

to arrive at a conflict-sensitive resolution of matters


pending before it.
viii. Create a technical working group to act as the
secretariat and this must come from the agency
acting as an incumbent chair of the committee, or as
agreed otherwise.
ix.

Elevate
to
the
Regional
Committee
those
cases/issues
which
remain
unresolved
after
exhaustion of administrative remedies on their level,
including the attendant pertinent documents thereto.

x.

Perform other functions as may be directed by the


JRC.

c) The Technical
Secretariat to:

shall

act

as

i.

Coordinate with host of the agencies on the date and


venue of the meeting and send out invitations for the
JRC meeting.

ii.

Prepare agenda based on prior coordination with the


Provincial
Committees
on
their
unresolved
issue/concern.

iii.

Prepare Meeting Excerpts and ensure its distribution


to the JRC members.

iv.

Track the status of issues/concerns submitted by the


Provincial Committee and agreements made by the
JRC.

v.

Review and evaluate the stages of the proceedings


made on the elevated unresolved issue/case by the
Provincial Committee and explore other remedies on
specific cases/issues available under existing laws
and make recommendations to the JRC.

vi.

Collate, case-document, gather references, and


prepare a case brief (expounding on the parties,
relevant
dates,
factual
issues,
initial
recommendations, among others) for the use of the
JRC.

vii. Prepare an annual report for approval by the JRC to


be submitted by the latter to the National
Committee. The contents thereof shall be determined
by the JRC to guide the Secretariat.
viii. Prepare all pertinent documents for turn-over to the
incoming chair of the JRC.
ix.

Perform other functions as may be directed by the


JRC.

Section 5. Meetings
a) The JRC must meet bi-annually every month of February
and August of each year.
b) Special meetings may be called upon to request by any of
the JRC members. Thereafter, the chair within 15 days
from the receipt of the request will then communicate to
the Secretariat so that preparations for the said meeting
shall be made.

c) The Provincial Committees meetings shall be conducted


every 2nd week of January, May, July, November.
d) Special meetings may be called upon the request by any
Provincial Committee member. Thereafter, the chair within
15 days from receipt thereof shall schedule a meeting of
the Provincial Committee to tackle the matter raised in the
request, among others.
e) In the absence of the Chair of the JRC or of the Provincial
Committees as the case may be, his/her designated
alternate shall act as Chair during the meeting or activity.
f) The Co-chair will act as the chair in case of absence of
both previous and his/her alternate.
g) The chair of the JRC and/or the Provincial Committee shall
ensure proper (photo and narrative) documentation,
minute-taking, among others, of its proceedings and
processes.
Section 6. Institutional Arrangements
a) The JRC members shall designate the host agency every
meeting and the latter shall ensure logistical (venue, food)
support. The same shall be true to the Provincial
Committees.
b) The Secretariat shall maintain an updated matrix of
contact details (including phone details which may not be
shared publicly without the consent of the concerned
personnel) for ease of communication among members.
And provide copies to the members.

Section 7. Effectivity. This Joint Operating Manual shall take


effect immediately.

In consonance with the agreements by member agencies on
its first meeting held last March 12, 2015 at the DENR Regional
Learning Center chaired by the DENR has specified the
composition and chairmanship of the Joint Regional Committee,
the Technical Working Group with the Secretariat and the different
