The typically genteel tone ofthe Fairview City Council hit a sour note at a special meeting
on Tuesday evening, May 11, with six councilors and city police calling for the resignation
of a veteran councilor who filed a written complaint against the city and its police
deparbnent.
Councilor Ken Quinby came under fire as council members discussed the outcome of an investigation
into police actions and procedures related to the Gin Sun Restaurant & Lounge on Northeast Halsey
Street.
A series of disorderly incidents, culminating in a drunken melee at the nightspot on Jan. 1, led Police
Chief Ken Johnson in March to seek a non-renewal of the establishment's liquor license. With the
council's support, Johnson's request was forwarded to the Oregon Liquor Control Commission, which so
far hasn't acted on the recommendation.
The probe into the police response was prompted by a complaint Quinby - a patron and part-time
contractor for Gin Sun - filed in early April. He targeted Johnson, Sgt. Bernie Meyer, Officer Michael
Morton and the city itself on allegations including improper application of public records procedures to
an officer's alleged use of profanity and threats during the New Year's incident at Gin Sun.
An extensive report City Administrator Joe Gall presented to the council found all 18 of Quinby's
specific allegations - based on what the councilor considered an unfair attack on a small business - to be
"unfounded," "exonerated" or both. Following city procedure, Gall and Johnson conducted parts of the
investigation internally, along with input from the Multnomah County Sheriffs Office.
With several councilors and officers calling Quinby's complaint "frivolous," "baseless" and costly to the
city in terms of money and morale, the councilor refused to back down.
He claimed the investigation was biased and failed to include interviews with two key witnesses to the
Jan. 1 incident whose names he supplied. Quinby vowed to take the complaint to the Department of
Public Safety Standards and Training (DPSST), the state agency that monitors police practices.
The councilor's stance prompted a flurry of council motions and votes that left Quinby with a
unanimous censure, a request to resign from the council and res,Ronsibili for a . ated $6,000 in

"My suggestion is that Councilor Quinby save the city a lot of heartache and resign from the council so
he can pursue this (complaint)," said Councilor Barbara Jones, "and let the rest of council do what needs
to be done for the good of the city and its citizens."
Jones' comment echoed a statement read by Officer Doug Asboe, president of the Fairview Police
Department, regarding Quinby's questioning officers' actions at the Gin Sun.
"We believe (Quinby) is no longer working in the best interest of the citizens of Fairview, but for his
own benefit," he said as several fellow officers listened and nodded in agreement. "We believe (he)
violated several articles of the city ethics code and (has lost) his ability to make unbiased decisions. "It is
our opinion that Councilor Quinby should resign his position to avoid the embarrassment of a recall
vote."
Quinby, who's served on the Fairview Council for 12 years, was quick to defend his record regarding the
city's police force.
"I don't think any councilor has been more supportive of the police department," he said. "Until three
months ago, 1 was proud of every officer. As a member of the budget committee I've gone out of my way
to support the police department."
Emphasizing the issue now has "nothing to do" with the Gin Sun but rather his belief that police picked
on the business to "send messages," Quinby said he plans to retain his council seat while pursuing his
complaint with DPSST.
"I don't plan to resign. I've done nothing wrong ... Their opinion of me means nothing," he said of his
fellow councilors. "What matters is that 1 hold the best interests of the city in every decision 1 make.
There's no lack of integrity here."
