I'm close to losing everything I had built over 40 years of hard work because the bank didn't include
all of my monthly costs (including Credit card from that bank) when allowing me a loan for $1.5 million.
Without tax records, with only a letter from my agent in Jersey Islands that may have been "DOCTORED
BY THE BANK". My wife and I are now struggling financially and personally.

My Husband and i are both victims of loan application tampering by Legacy Financial Services staff
who inflated our income figures on our Loan Application Form without our knowledge. The bank staff
involved purposely set us up to take us down. They knew that their actions would cause us to lose our
home. The loan would not have been approved if the real income figure was used. We owned our home
in 2007 and now we face eviction. Their greed has ruined our lives. We must have a Royal Commission.

I'm currently in the middle of a four year battle with Westpac regarding my home loan, and regardless of
multiple examples of fraudulent and deceptive behavior and documentation I've provided its like I don't
exist. Its the same scenario with FOS - my dispute was lodged well over 18 months ago and two case
officers, one dispute analyst and a banking expert and they still try to send me in ever increasing circles
whilst trying to cover the banks back through manipulating the Terms of Reference in totally bias and
unethical way. I will not give in or walk away from this and I will bulldoze my own home on national tv
before ever giving it to Westpac -the pack of liars and cheats.

A Royal Commission with wide range terms of reference is needed to expose so many 1,000's of cases
involving the fraudulent lending practices of not just the big four banks, but statistically more often by
the smaller banks like the Bendigo Adelaide Bank and other non-bank lenders. The scope of the Royal
Commission being sought must extend to Bendigo Adelaide Bank, non-bank lenders, mortgage
managers and non-bank wholesale funders. The Bendigo Adelaide bank who have just been gifted the
Rural Finance Corporation by the Victorian State Government, have already started revaluing assets to
foreclose on rural mortgages in order to satisfy their 'Basel' based Claw Back provisions. Their
unconscionable conduct including the saturation marketing of Reverse Mortgages, Homesafe Solutions
'Debt Free Equity Release' are all scams design to divest the aged members of our society of their only
assets in a sneaky and underhanded manner, all the while protected by the fine print in their mortgage
agreements which are weighted 100% against their unsuspecting customers/borrowers.

I propose that, due to the high number of victims whose lives have been gravely affected by smaller and
non-bank lenders, the explanatory text describing the petition now be expanded to allow for the
inclusion of the Bendigo Adelaide Bank , other varieties of banks and money lenders who have
conveniently flown under the radar for far too long.

What happened to the State based legislative provisions and consumer protections provided in the old
Money Lenders Acts which afforded protection to borrowers where ASIC, FOS and our Federal
government do nothing and our legal system is totally bank biased.

educated woman and criminologist specializing in white collar crime. This without doubt is the biggest
collective scam I have ever exposed. Australian Bankers are running a Cartel, thousands of consumer
documents show why that is so. It is why there have been so many Parliamentary Inquiries into our
Financial System and the current FSI in recent times. I have lobbied and contributed to 15 of those
through hard lobbying. Bankers are also the CONTROL FRAUDS as described by Prof, Wm Black and
again Philip Soos and Paul D Egan in their book Bubble Economics. Bankers are Control Frauds
controlling all losses coming from Borrowers in 30 year "Interest Only" Sub Prime Loans and also
Investors tricked into unsafe investments entangles in PROPERTY, BANKING, DEVELOPMENT and
CONSTRUCTION. Moodys are worried. Bloombergs have sent out stories of warning signs. Retiree
investors have been fleeced of life savings. This should have been cleared up years ago, but people's
lives were being shatters and political backs were turned. The elephant is in the room and the pretense
is no longer sustainable. Everyone affected by loss from the Control Frauds either by savings or home
lost should by know understand they are part of a much bigger picture in organised white collar criminal
activity. (see my own Submission to the FSI). Immediate action is necessary and the first step is for David
Murray and the current Financial System Inquiry to recommend a Royal Commission into the entire
sector so as to examine properly each component and we need a very Wide Terms of Reference if we
are ever to get to the bottom of this mess. Banks are not too big to fail. If we try to use the moral hazard
line...we have forfeited our dearly held beliefs and values and we want those back.

My partner was lent more money than she could afford to easily repay, based purely on her
available property assets. The Bank grossly overstated her Salary and her Rental Income, even though
they were given Pay Slips, Rental Statements and a Tax Return. The Bank also gave her extra funds as a
buffer in her offset accounts. Two new properties were purchased and two previously unencumbered
properties were then cross collateralised under the loans. We spent 20 months with FOS, and even
though we could prove that the bank had overstated income and understated debt levels as part of the
applications, our case was thrown out as not being maladministration by the Bank. We are looking to
sell the two most recently purchased properties, but that will leave us out of pocket by close to $500k
and with debts on previously unencumbered properties. Instead of retiring, we are looking at another
10 years of workand we are still waiting for the original of the Loan Application Forms, even FOS
couldnt get them.

This has happened to me with BOQ as a Storm Financial Client. My income was increased on the
loan application by the bank personal to allow me to be illegible to lend through them even though they

We have lodged our dispute with FSP through the Financial Ombudsman's office. We lodged that
dispute in June 2013. Next morning (12 hours later) a representative of the FSP EDR department rang

Why have state police discovered the FACT 2008 that the internal banks system has at least 8
differing copies of the same Loan Application faxed/submitted by the brokers? Brokers were told to use
the serviceability calculator and allow the banks internal computer to create a futuristic income telling
them their lawyers had said the calculation was all above board. Meantime internal emails said: "pump
up the volume". The Sellers believed in these evil products and purchased the mortgages themselves
and now face ruin. The LAFs were doctored once again after being submitted! The evidence is

My family of four children and myself and husband lost our family home of 30years and two

seemed to submit out Loan application form with False declaration of income, buffer loans of $180,000
and stating that we had purchased a $50,000 boat and falsely stating that we took out the loan for a
$100,000 holiday, NEITHER of these were known to us and we have never taken any holidays of any sort
nor of that expense ever. A trip that we made in approximately 2002 was paid for by saving our money
and making deposits. NO LOAN was ever taken out. But, what we have uncovered is that we as
homeowners fighting for our homes, have discovered a culture of Lenders Insurance fraud, with the
Lenders Mortgage Insurance which most banks take out on us. Genworth does not seem interested in
this rort. Houses, excessively overvalued. No better than the Federal Reserve Banks Scamming racket
with selling our Plastic note to countries inASia, which we have all been silenced to talk about! WE are
not stupid we all know what is going on. The scam goes right to the top of the GOVernment and
judiciary. I lost my home, my family and what has this government done for us? Nothing. I sent an email
to Hon. Don Randel, I spoke to him at a meeting to ask for help, he wasn't the slightest bit interested in
our plight of bank fraud nor in a friend whose bank, turned his loan into multiple loans and stole ALL THE
DEPOSITS that he made. I found 4 loans which he had no idea of. When is anyone going to act. We
demand DEMAND, DEMAND, a royal commission into the banking sector and DON'T TRUST WHAT THEY

This is vital to me because I am one of these Australians who have lost their home, their Super,
their work and their dreams through this shockingly immoral, unethical and illegal behaviour. I also
personally know of many others who are in the same position as us, also at or close to retirement age. It
is absolutely true that 6 years ago we did own our own home, almost completely paid for, on the
northern beaches of Sydney, and since then have had to live in a 16ft caravan, which thankfully we still

place....as to how much you earn, living expenses..etc....

my reason for signing....why when you don't fit their criteria, they say no to a loan you know if
affordable, that you can manage, because you are already paying as much rent as what the repayments
would be. Or you are already paying for a loan with much higher repayments.

NO to an affordable loan, but hey there is a loan you can have....Low Doc..now called an
ALTERNATIVE DOCUMENTATION LOAN...and it's only twice the amount of interest and repayments...we
can lend you the money for your home...just need your home as security...and for you to pay a
Mortgage Risk Fee (this is instead of Lender Mortgage Insurance as this doesn't pay them when fraud is
involved)

Of cause they know you will eventually default...but it's legal to sell your home....they don't loose.

The only risk is for the borrower to loose everything they have, every cent they had trying to keep
up with the payment.

And this is Okay??? This is not fraud..extortion ...corruption ???

The Government changed the legislation to make a lot of this okay, ASIC, FOS, COSL all have rules
and terms of reference as to Determination (no Resolution any more) COSL won't look at a case if there
is any fraud involved and sends you off to FOS whose terms of reference are twisted to favour the
Lender. They are all in breach of acting as advocates for their members.

The Government knowing, helping them....OF CAUSE THEY DON'T want a Royal Commission.

MAYBE we need a Royal Commission into the GOVERNMENT FIRST!!!

the principle at 75. I am u employed and the NAB took my tiny studio home that was unmortgaged as
security this year. The Family Court need the matter dealt with but NAB just referred the matter to the
Financial Ombudsman. I am stuck in their queue. This caused me to have a nervous breakdown a few
months ago and I was hospitalised for 6 weeks. There is no mention of my marital situation or of any
mortgages in the family estate on the documents my local branch showed me a month ago. I have never
seen this loan application. It even says I was living at my old family home that my ex-husband occupies. I
have never read or signed this.

My family had $2million in equity deceptively stolen by Homeloans Ltd and a very friendly and
convincing broker. The bank used a service calculator to estimate our income as $625,000, at the time
both my husband and I were unemployed (but we had equity). Homeloans and the broker fraudulently
sold us the story that this income figure included capital growth !! That was deception. Homeloans failed
to substantiate the income figure with facts, further lies. A Royal Commission is the only way to bring

I've just had my home taken by NAB and sold. It's insane how they went about it. Just sold not

signed agreement with them for a margin call at 80%, the bank then negotiated a rate of 90% with
Cassamaties, without consulting me. My margin call was at 121% and nobody but me is interested in
why this was allowed to happed. Cassimaties was the broker why should he do the margin call, I pay the
bank, of course they were responsable for the margin call.

dropped the case against me 4 days before trial An accountant was charged with preparing false

instruction from someone else and did not act alone!After joking BFCSA I went to COSL and reported
this fraud and asked them to look into my case.it took them 18 months and 5 case managers later to
decide they couldn't investigate my case further as they did not handle fraud!I also wrote to ASIC and
Mr.Medcraft -The response was to go to COSL or to the police.I wrote to APRA -response was : not their
jurisdiction .I wrote to I wrote to the then Prime Ministers Kevin Rudd Followed by Julia Gillard:-no
response.I wrote to Mr Joe Hockey :-no response. I then went back to the police with my lawyer and
reported the fraud on my loan.I had an interview with Detective Malcolm Brown who assured me he
would look into it and had heard of and had dealings with my brokers before.while in the interview
Detective Brown made the comment"we don,t like to go after corporate businesses".After 4 weeks of
not hearing anything I contacted Detective Brown who told they had decided not to go any further with
the investigation and was happy enough that the accountant was charged Case Closed!Since then I have
received an eviction notice and at present I am in the Supreme Court trying to make sense of all of this.I
was unemployed and studying when I was approved a Low Doc Loan.I then applied for a further amount
which was supposed to be added on to my original loan Instaed it was changed into a FULL DOC loan
using false tax returns and a False Income.How can the credit assessor approve any of this when clearly I
was Unemployed and 4mths later had an income of $92,000 ? I believe their has been not only FRAUD
and DECEPTION on this loan but also there has been a MALADMINISTRATION in LENDING.THis is my
story in short.

I am signing this petition because I thoroughly agree that a Royal Commission with wide range terms of
reference is needed, although given Ms Brailey's extensive experience and exposure to so many cases involving
the fraudulent lending practices of not just banks, but statistically more often by non-banks, I am surprised that
the scope of the Royal Commission being sought does not extend to also non-bank lenders, mortgage managers,
non-bank wholesale funders and their respective trustees (such as Permanent Custodians and GEL Custodians,
et al.).

I therefore propose that, due to the high number of BFCSA members and followers whose lives have been
gravely affected by non-bank lenders, the explanatory text describing the petition now be expanded to allow for
the inclusion of these other species of money lenders.

million per year plus bonus exits of around $50 million for creating criminal activity in banking and they are the big
winners. It's a PONZI like structure of unverified lending. All incomes are tampered with. All loans approved by a
computer. Free Markets gone mad. No Lender has been charged as yet for creating $100 billion in Australian
fraudulent mortgage loans.

No-one is looking after Consumer Protection in Australia. How can Lenders be permitted to lend 70 year old
disabled people on a pension a $400,000 high cost 30 year high risk loan to sink into property and then lose their
own home in 5 years? Why are Bankers immune from being jailed? Why are they permitted to receive $100 million
in salaries and bonuses. Are the biggest shareholders American? What is happening to our financial system?

ASIC say "not in public interest." COSL say: "fraud is there and we do not investigate fraud." FOS say: "YES
Maladmin in Lending so we determine $7000 discount off the loan is fair." The Bankers in Australia are operating
like CONTROL FRAUDS as they did in so many other nations. TOO BIG TO FAIL and the Government response
was to water down consumer protection laws to protect this Bank CARTEL?

The aging lose their homes, Kids lose inheritances. State & Federal Governments are forced to find money
...eg student loans and cuts to social security. And why? Because of practices described by Attorneys General in
cases like US v Citigroup as false, fraudulent and frauds. There's only one 'f' word that's not mentioned in these
huge fines overseas by real task forces, unlike our sad old ASIC and ir's mstress, the bank-funded so-called
Ombudsman (Ltd) which is a commercial arbitration 'court' that operates under ;'without prejudice' secrecy, and
expects old people to get forged papers kept in banks. Talk about a stacked deck.
