Construction Contractor

Undertakes or offers to undertake or purports to have


the capacity to undertake, or submits a bid to, or does
himself or by or through others

Construct, alter, repair, add to, subtract from, improve,


move, wreck or demolish any building, highway, road,
railroad, excavation or other structure, projects,
development or improvement, or any part thereof,
including erection of scaffolding or other structures or
works in connection therewith.

Note: The term contractor is synonymous with the term builder.


A contractor may be an individual, firm, partnership, corporations,
association or other organization or any combination thereof. It
includes the principal contractor, subcontractor and specialty
contractor.

Types of Licenses
Regular License - reserved for and issued only to
constructor-firms of Filipino sole proprietorship,
or partnership/ corporation with at least 60%
Filipino equity participation and duly organized
and existing under and by virtue of the laws of
the Philippines.
Special License - issued to a joint venture, a
consortium, a foreign constructor or a project
owner* which shall authorize the licensee to
engage only in the construction of a single
specific project;only for BOT or Government ICB
projects.

CHECKLIST OF
REQUIREMENTS

I. NEW APPLICATION
LEGAL:
1. Affidavit of Attestation and General Information
1.1 For Sole Proprietorship: Certified copy of BTRCP Certificate of Registration with
pertinent BTRCP Form No. 16;
1.2 For Partnership or Corporation: Certified copy of SEC Certificate of Registration and
Articles of Partnership/Incorporation and ByLaws with construction contracting as
one of the purposes and subsequent amendments thereto, if any;
1.3 For Cooperative: Certified copy of CDA Certificate of Registration from Cooperative
Development Authority , Articles of Cooperation and ByLaws with construction
contracting as one of the purposes and subsequent amendments thereto, if any;
2. Authorized Managing Officer (AMO) Nomination:
2.1 AMO Affidavit with a passport size picture of AMO;
For corporations only: Original Corp. Secretary's certificate as to the nomination of
the AMO;
2.2 Original NBI clearance of Filipino AMO; (valid as of the date of filing)
2.3 If AMO is NonFilipino (in addition to 2.1):
2.3.1 Working Visa
2.3.2 Alien Certificate of Registration;
2.3.3 NBI clearance if AMO has resided in the Philippines for six (6) months or longer
if not, equivalent clearance from AMO's home country duly authenticated by the
Philippine Embassy.

I. NEW APPLICATION
For Corporations or Associations with foreign shareholders, the following documents shall be
submitted:
1. Corporate Secretarys Certification as follows:
a. List of stockholders showing their nationalities and shareholdings; and
b. List of Board of Directors showing their names and nationality.
2. Copy of latest General Information Sheet duly filed with SEC showing the names of
stockholders and directors, nationality and shareholdings.
The percentage control of the number of seats occupied by foreigners in the Board of
Directors shall not exceed 40%.
FINANCIAL:
3. Complete Financial Statements with accompanying Auditors notes dated within the last six
(6) months immediately preceding the filing of application (duly audited and signed on
every page by an Independent CPA with valid PRCBOA accreditation) and a CDR
(compact disc recordable) containing the firms Audited Balance Sheet & Income
Statement
in the prescribed template to be uploaded by the CIAPRID in CIAP database. The PCAB
Financial Statement Forms A & B can be downloaded from the DTI website
www.dti.gov.ph.
3.1. For old companies, audited financial statements for the immediately preceding
taxable year and copy of the Quarterly or Annual Income Tax Return certified by
the BIR

I. NEW APPLICATION
3.2.

Cash, Original copy of Bank Certification/Bank statement of account certified by


Bank Manager of cash deposits as of the Balance Sheet date;Note: (Amount in
excess of of 1% of the minimum networth required for category applied for or
P 50,000.00 whichever is higher, reflected as Cash or Cash on Hand shall be
deducted from the networth, If unsupported.)
3.2.1. Authorization to Depository Bank;

3.3. List of Land and Building/Industrial Plants owned by the applicant and registered in
its name
3.3.1. Certified Copy of Transfer of Certificate of Title (TCT) including back page
3.3.2. Deed of Sale or Certified Copy of Tax Declaration of Land / Bldg., owned by
the applicant.
3.4. List of Construction and/or Transportation/Delivery Vehicles/Equipment/
Machineries/Plants owned by the applicant and registered in its name
3.4.1 Certified Copy by Land Transportation Office (LTO) of Certificate of
Registration and Current Official Receipt of Registration of Construction
and/or Transportation/Delivery Vehicles/Equipment reported;
3.4.2. Certified Copy of Deed of Sale or sales invoices/official receipts of other
construction equipment/machineries;

I. NEW APPLICATION
3.5. Documents to be submitted if the values of the applicant's Inventories and
Receivables Accounts exceed more than 20% of the contractors networth,
otherwise, the amount in excess of said account shall be deducted for
categorization purposes.
3.5.1 Schedule of Inventories duly signed by AMO and Certified by the firms PRC
BOA accredited CPA
3.5.2 Schedule of Receivables duly signed by AMO and Certified by the firms PRC
BOA accredited CPA
For those applying for categories AAA and AA ; Submit copy/ies of progress billings certified
by government project owners and/or certification under oath of private project owners as to
the remaining balance of receivable.
4. Authorization to BIR & other agencies and/or quarterly income tax return to cover income
reported on interim financial statements.

I. NEW APPLICATION
TECHNICAL:
5. List of Sustaining Technical Employee/s STE supported by the following
documents for each STE:
5.1. STE Affidavit/s with recent passport size picture/s.
5.1.1 Certified Copy by the Professional Regulation Commission of its valid PRC ID
or Certification of Good Standing from PRC in the absence valid PRC ID;
Original NBI Clearance/s of nominated STE/s;
5.2. STE Affidavit/s of Construction Experience
5.3. Personal Appearance Form duly accomplished and signed by the STE/s appearing
before the designated officer of the PCAB or the nearest DTI regional/provincial
office
5.4. Affidavit of No Construction Activity
OTHERS:
1.Original Signature of AMO on each and every page of the application forms including
Supporting documents.
2.The Board may require the AMO interview and submission of pertinent
documents/information other than the above in order to fully determine the
qualifications of the applicants;

3. AMO/Applicants for TRADE category may no longer be required to take the AMO
examinations. Photocopies of documents, in lieu, of certified copies are accepted
provided original copies are presented for authentication.
4. Selfstamped envelopes (One self stamped mailing envelope is required for each
supporting document submitted), or a prepaid courier pouch.
5. Applicants interested to participate in government projects should accomplish
Application for Registration and Classification of Contractor for Government
Infrastructure Projects and file the same together with the PCAB Application Form.
6. Accomplished Affidavit for Firms Authorized Representatives

II. RENEWAL OF APPLICATION


LEGAL:
1. Affidavit of Attestation and General Information
1.1 Certified true copy of subsequent amendments (if any) to Articles of Incorporation
and/or ByLaws in case of Corporate or Partnership applicant;
In case of corporate applicant with foreign content, proofs/documents showing that
election of aliens in the Board of Directors is allowed in proportion to their share in
capital:
1.2.1 Original copy of Secretarys Certification as to the present composition of the
firms Shareholdings and Board of Directors showing the names, nationalities,
shareholdings of Stockholders and directors;
1.2.2 Certified copy of the pertinent pages of the firms latest General Information
Sheet (GIS) submitted to SEC showing the updated list of stockholders and
directors.
1.2.3 In case of renewal of application filed after June 30 deadline, an upfront
payment of P 5,000.00 Additional License Fee shall be
required.

II. RENEWAL OF APPLICATION


FINANCIAL
2. Certified copy of the Annual Income Tax Return filed with the BIR for the taxable year
immediately preceding the filing of renewal application;
3. Complete Financial Statements with accompanying Auditors notes dated within the last six
(6) months immediately preceding the filing of application (duly audited and signed on
every page by an Independent CPA with valid PRCBOA accreditation) and a CDR
(compact disc recordable) containing the firms Audited Balance Sheet & Income
Statement in the prescribed template to be uploaded by the CIAPRID in CIAP database.

3.1.

If increase is due to additional capital infusion:


3.1.1 Cash Original copy of Bank Certification/Bank statement of account certified
by Bank Manager of cash deposits as of the Balance Sheet date;
Authorization to Depository Bank;
(NOTE: Amounts in excess of of 1% of the minimum networth required for
the contractors existing category or P 50,000 Reflected as Cash on Hand will
be deducted from the Networth if unsupported).

II. RENEWAL OF APPLICATION


3.1.2 Land and Building List of Land and Building/s owned by the company and
registered in its name
Certified copy of TCT including back page for newly acquired land and/or
condominium which were not previously reported/submitted to PCAB.
Certified copy of Deed of Sale or Tax Declaration of newly acquired /
newly constructed building which were not previously reported /
submitted to PCAB.

3.1.3 Transportation & Construction Equipment List of Construction and/or


Transportation/Delivery Vehicles/Equipment/Machineries/Plants owned by
the company and registered in its name,
Certified copy by the LTO of the LTO Certificate of Registration and current
Official Receipt of Registration of newly acquired registrable Construction
and/or Transportation / Delivery Vehicles/Equipment

6.2 Certified true copy of valid PRC ID of STE as licensed professional or original
Certification of Good Standing for those awaiting issuance of new or renewed
PRC ID.
6.3 NBI clearance/s of new STE/s;
6.4 STE Affidavit/s of Construction Experience;
6.5 Personal Appearance Form duly accomplished and signed by the STE/s appearing
before the designated officer of the PCAB or the nearest DTI regional/provincial
office
For previously nominated STE/s:
6.6 STE Affidavit/s
6.7 Proof of Employment
6.7.1 For STE/s below 60 years old: Certified true copy of the pertinent page of
CCL (formerly SSS Form R3) submitted to SSS for the quarter immediately
preceding the filing of application;
6.7.2 For STEs 60 years old and above: Certified true copy of Certificate of Income
Tax Withheld on compensation (BIR Form 2316, formerly BIR W2) for the
taxable year immediately preceding the filing of application issued by the
firm to the employee and duly stamped received by BIR/ or accredited bank.

each Contract Agreement submitted duly authenticated by the tendering agency or
project owner or in case of subcontract by the prime/main contractor.
5. Copy of Certificate of Creditable Income Tax Withheld (Form 1743.1/1743.750/2307),
stampedreceived and certified by BIR for each private contracts and subcontracts..
