Solve the Eid divide,

Scholars told
Nominated MP Sheikh Muhammad Dor has urged Ulamaa (scholars) to come up
with measures to address
the divide of observing Eid ul
Adha on different days.
The Sheikh told the Ulamaa
not to downplay matter as it
is contributing to divisions
within the ranks of Muslims
and added that scholars need
to address it with a mater of
urgency.
He differed with views held by
some that it was in order for
Muslims to observe the event
on different days saying that
all Muslims should come together as one united family
in celebrating Eid ul Adha. It
is impossible that both views
are right. I do not subscribe
to this, the Sheikh said during the closure of a four day
training seminar for Imams at
Jamia mosque last week.
While some Muslims celebrated the event on Tuesday joining millions of pilgrims from around the
world observing the rst day of slaughtering of the ritual animal sacrice, the acting Chief Kadhi Sheikh Ahmed Muhdhar announced
Wednesday as the ofcial day for the Eid ul Adha celebrations
Sheikh Dor who is an Imam at the Mbaruki mosque in Mombasa
and also the secretary general of the Council of Imams and Preachers of Kenya (CIPK) said the matter was bringing into disrepute the
position of Muslims in the country and it was important that the issue was addressed in urgency to bring to an end the differences.
We should not wait for the next Eid ul Adha for the same controversy to appear, scholars must addressed this matter as soon as
possible, the Sheikh said.
The Imam of Parliament went on to suggest that scholars who
hold the different views meet and harmoniously discuss the matter as the divisions among them were causing similar effect on the
unity of the community.
On his part, Sheikh Ahmad Msallam a prominent scholar who sits
on the advisory board of the council of scholars of Jamia Mosque

Muslim leaders in Mombasa have said the American envoy is doing
Kenyans a disservice by not revealing the names of prominent Kenyans who were issued with a visa ban barring them from travelling
to the United States. The four individuals were singled out for their
involvement in drug trafcking.
The leaders told Ambassador Michael Ranneburger that if his revelations were sincere, he needs to make the names public as this will
facilitate the prosecution of those involved in the drug trade whose
effects have led to worsening drug addiction among youth in the
region.

Tackle the drug problem at the coast

The recent ban on four prominent Kenyans who include honorable Members of Parliament to travel to the United States due to
their involvement in the drug trade should serve as a wake up call
for the government to take extra and concrete measures to contain
the proliferation of the drug trade which has taken root at the coast
region.
It has been an open secret that prominent Kenyans are heavily
involved in drug trade where they reap millions but on the ip side
deliberately destroy the livelihood and promising future of thousands of youths.
The cost region notably, Mombasa, Lamu and Malindi counties
have earned the negative distinction as being among the hotspots
and melting point for drug distribution and addiction in the country.
As a result more than 30,000 youths in these areas have been
turned into zombies and their productive lives have been wrecked
after being addicted to hard drugs.
Despite the hue cry raised about this social degeneration, little has
come foth on the part of the government to contain this dangerous
trend. In a desperate attempt to get the attention of the authorities,
leaders from the region even went further and obtained the names
of some of the people involved in this trade which were circulated
in various media outlets but still this did not prick the nerves of
those concerned.
The most which has come from the security enforcement agencies
has been raids on peddlers dens after media exposure but as
has always turned out to be the case is that within a few days, the
trade continues as business as usual. More disturbing is that those
supposed to root out these criminals and social mists are active
accomplices in this trade in some case standing in as sentries for
the drug lords and peddlers.
Little has also been done to rehabilitate the victims and see to it
that their normal condition is restored. In spite of the fact that the
coast region has the highest drug addicts in the country, there is no
government run rehabilitation centre to serve as a recovery point
to change the deplorable conditions of the addicts. The few established centres are privately managed and cannot cope with the

huge numbers of the addicts.

During national events and barazas, ofcials stress on the commitment of the government to root out this vice but by and large these
have remained to be mere pronouncements.
Drugs especially cannabis (bhang) are continually ferried all the
way from the Ugandan border and the Tanzania border through
Migori destined for the Coast region but the numerous police
roadblocks all the way, appear to have done little to contain this
thriving practice. The few consignments netted by the police and
are proudly displayed to the public form only a tip of the ice berg.
Before the Islamic Party of Kenya (IPK) resurgence at the coast in
the early 1990s which saw thousands of Muslim youths come to
the forefront to agitate for their rights, the drug menace was virtually unheard of in the region. It was only after this period that drugs
started making their way to the streets of Mombasa, Malindi and
Lamu and in a few years had blossomed to various towns and in a
few years the problem had blossomed to worrying heights.
Some commentators have pointed a nger at the deliberate plot
through drug proliferation as a way of containing Muslim youths
to undermine any future resolve to undertake such a resurgence
which had brought much discomfort to the government of the day.
Whatever the caser, there is no justication whatsoever to allow
the proliferation of drugs which is contributing greatly to destroy
the lives and promising future of many young people.
While the vast majority of the victims are young people from the
coast, this should not be taken that this is only a matter to be conned at the region but its ripple effect in the years to come will denitely trickle to other areas of the country and perhaps with more
devastating consequences.
That is why it becomes necessary for the government adopt more
stricter measures to tame this evil trade and cut its tentacles right
from the drug barons regardless of their lofty positions. The current
situation demands that the problem is declared a national disaster and with these, the State should invest greater resources to
actively ght this hydra before its tentacles engulf other parts of
the country.

Name the drug suspects, leaders tell American envoy

Story From Page 1
dulghaful El-Busaidy said the same benchmark which the United
States was using in the so-called war on terror should also apply
in the efforts to ght drugs. The United States has been sharing
information on terrorism with the Kenyan government and several
people have been arrested as a result. It should provide the same
information to the government to arrest and prosecute the suspects, he said.
The chairman lamented that drugs had greatly hurt the youth particularly those from the Muslim community and said that urgent action
was needed to address this problem. His sentiments were echoed
by the chairman of the Sharrif Nassir Foundation Abdulswamad
Nassir who told the envoy to publicly name those responsible for
drug trafcking as this will be a big step forward in the war against
drugs. If the matter was concerning terrorism, the suspects would
have long been named and shamed, this should also apply in this
case, he said.
He accused the government of sleeping on its job and said it was
important that the authorities wake up to face the reality which has
led to the lives of thousands of youth being destroyed by the rising
cases of drug addiction.
At least every family in the region has in one way or the other been
affected by this drug menace, he said.
Hassan Omar, a commissioner with the state funded Kenyan National Commission on Human Rights (KNCHR) also called on the
envoy to make known the names of those affected by the visa ban.
The commissioner said the US in its counter terrorism campaign
has been able to share information with the government and wondered why it was resorting to silence while the lives of many young
people were at risk.

The leaders made the remarks after the Eid ul Adha prayers at the
Mombasa Municipal Stadium.
Reports have indicated that the persons who are on the list include
three politicians, a senior civil servant and a prominent businessman based at the coast.
An estimated 50,000 youths in the coast region are hooked on hard
drugs mainly cocaine, heroin and cannabis (bhang)

Solve the Eid divide

Story From Page 1
Committee concurred with Sheikh Dors sentiments saying that
such differences needed not to occur during the celebrations of the
feast of sacrice. He pointed out that while the differences emanating during the sighting of the crescent at the beginning and end
of Ramadhan can be tolerated, it was incomprehensible that such
divisions should be witnessed during Eid ul Adha. Sheikh Msallam
explained that the event was pegged on the ritual of standing on the
mount of Arafah during the pilgrimage period and the following day
is the day of Eid. We can use the priceless wisdom left for us by one
of our prominent scholars Seyyid bin Seyyid Ahmad Badawi who
subscribed to this view and adviced Muslims to use this benchmark
and not to divide among themselves during the time of Eid ul Adha,
he said.
In Nairobi, thousands of Muslims turned up the Sir Ali Muslim Club
which was the main venue for the Eid prayers. Similar prayers were
held at various grounds and mosques in the city and its surroundings.

The Farewell Sermon of Prophet Muhammad (Hijjatul Widdah)

Prophet Muhammad peace be upon him delivered his last sermon
(Khutbah) on the ninth day of Dhul Hijjah (12th and last month of
the Islamic year), 10 years after Hijrah the migration from Makkah to
Madinah in the Uranah Valley of mount Arafat. His words were quite
clear and concise and were directed to the entire humanity.
After praising, and thanking Allah he said: "O People, lend me an
attentive ear, for I know not whether after this year, I shall ever be
amongst you again. Therefore listen to what I am saying to you very
carefully and take these words to those who could not be present
here today.
O People, just as you regard this month, this day, this city as sacred, so regard the life and property of every Muslim as a sacred
trust. Return the goods entrusted to you to their rightful owners.
Hurt no one so that no one may hurt you. Remember that you will
indeed meet your Lord, and that He will indeed reckon your deeds.
Allah has forbidden you to take usury (interest), therefore all interest obligation shall henceforth be waived. Your capital, however, is
yours to keep. You will neither inict nor suffer any inequity. Allah
has judged that there shall be no interest and that all the interest
due to Abbas ibn Abdal Muttalib (the Prophets uncle) shall henceforth be waived.
Beware of Satan, for the safety of your religion. He has lost all hope
that he will ever be able to lead you astray in big things, so beware
of following him in small things.
O People, it is true that you have certain rights with regard to your
women, but they also have rights over you. Remember that you
have taken them as your wives only under Allahs trust and with His
permission. If they abide by your right then to them belongs the right
to be fed and clothed in kindness. Do treat your women well and be
kind to them for they are your partners and committed helpers. And
it is your right that they do not make friends with any one of whom
you do not approve, as well as never to be unchaste.
O People, listen to me in earnest, worship Allah, say your ve daily
prayers (Salah), fast during the month of Ramadhan, and give your
wealth in Zakat. Perform Hajj if you can afford to.
All mankind is from Adam and Eve, an Arab has no superiority over
a non-Arab nor a non-Arab has any superiority over an Arab; also a
white has no superiority over black nor a black has any superiority
over white except by piety and good action. Learn that every Muslim is a brother to every Muslim and that the Muslims constitute one
brotherhood. Nothing shall be legitimate to a Muslim which belongs
to a fellow Muslim unless it was given freely and willingly. Do not,
therefore, do injustice to yourselves.
Remember, one day you will appear before Allah and answer your
deeds. So beware, do not stray from the path of righteousness after
I am gone.
O People, no Prophet will come after me and no new faith will
be born. Reason well, therefore, O People, and understand words
which I convey to you. I leave behind me two things, the QURAN
and my example, the SUNNAH and if you follow these you will never go astray.
All those who listen to me shall pass on my words to others and
those to others again; and may the last ones understand my words
better than those who listen to me directly. Be my witness, O ALLAH, that I have conveyed your message to your people".
s part of this sermon, the Prophet recited them a Revelation from
God which he had just received: This day the disbelievers despair
of prevailing against your religion, so fear them not, but fear Me
(God)! This day have I perfected for you your religion and fullled
My favor unto you, and it hath been My good pleasure to choose
Islam for you as your religion (Al-Quran 5:3).
Toward the end of his sermon, Muhammad asked:
"O people, have I faithfully delivered unto you my message?"
A powerful murmur of assent "O God, yes!", arose from thousands
of pilgrims and the vibrant words rolled like thunder throughout the

One can heed words of wisdom and guidelines from the last sermon (khutbah) of the Prophet peace be upon him. His sermons emphasized on the following:
Sacredness of a Muslims life and property
The importance of propagating this message to all others (A Muslims responsibility thus does not end by following the religion)
A reminder that everyone is fully accountable for their deeds and
Allah will take every person into account. If everyone heeded to
this fact alone, the world would be a much better place today.
The prohibition of dealing with interest
The awareness of Satan and how he can work to deviate us from
the right path and doing evil things.
Rights of women over men and rights of men over women.
Treatment of women with kindness.
Modesty and chastity in women.
The importance of worshiping Allah (saying your ve daily prayers
(Salah), fasting during the month of Ramadhan, giving charity (Zakat) and performing pilgrimage (Hajj).
Equality amongst all regardless of racial or ethnic background.
The need to establish justice.
Islam is the nal divine religion (Last prophet and Last Book).
The position of mankind is respected and the blood shed is totally
prohibited.
Prophet Muhammad fullled his duty as a messenger.

YOUTH AND CHILDREN

A Message to Graduates
Whilst we have covered the importance of learning about our religion to benet us in the hereafter, it is also necessary to learn about
Islam so that we may be in a position to answer any questions that
non-Muslim work colleagues may pose to us genuinely or out of
curiosity.
Islam is in the spotlight; the media reports and the people see.
Hence situations are bound to arise where you will be asked
questions about Islam. It is therefore important that we should be
equipped with the correct answers and teachings of Islam rather
than substituting it with your own logic. Using your own logic in most
cases will mean that you wont be sharing the true teachings and
views of Islam and instead could be causing confusion and misinterpretation of our beautiful deen. Remember, what you say or utter is
what most people will think of Islam; so think before you speak.
Graduation also means that you have acquired a certain status
in society as well as now being able to place certain letters after
your name. One should, however, remember that in Islam there is
no superiority of one over another except through taqwa. Verily,
the most honourable of you with Allah is that (believer) who has AtTaqwa. [Surah Hujurat V13]
Also, never look down upon anyone or let pride set into your heart
as a result of your education or due to the status you will enjoy at
the workplace. Any status we can obtain in the world is of no value
whatsoever if Allah is displeased with us. Remember we should
look at the people below us in the dunya, so that we may make
shukr for what Allah has given us, and we should compete with the
people above us in the matters of deen so that we may become
closer to Allah.
After graduation some of you may return to your home town whilst
others remain living away from home to continue studies or work.
We should reect on how we travelled away from home to acquire
our worldly education and if need be we must prepared to travel
to acquire religious knowledge and benet also. We are aware of
how our pious predecessors would travel years and years to obtain
knowledge, but that was a sacrice that they were willing to make.
We have vast arrays of modern technology to aid us. Make the most
of the means and resources that Allah has blessed you with.

Someone will be graduating soon and some very good general

advice is needed for the graduates.
Graduation day is the culmination studying a particular subject in
depth. You have spent these years studying because you realise
that education is a means to attaining a good career and perceive it
to lead to a better way of life.
At this signicant stage in your life, you are experiencing the transition from being a student through to a professional who will soon
be working in the real world. With this transition comes the need to
prepare yourself in dealing with issues that may arise in the workplace mainly because of your religion.
Whilst many undergraduates become closer to their deen at university thanks to the efforts of Islamic associations, for those of us
who will be going out into the workplace where their will be a minority Muslim workforce or where contact with fellow Muslims will be
limited, it is especially vital for us to hold on to our deen; That is
YOUR ISLAM.
If during your college days, you were unable to get involved with
the Muslim community, make this the starting point of change in
your life.
The one who treads a path seeking therein knowledge, Allah eases his path to the Garden. [Sahih Muslim]
We must fully realise that our ultimate purpose in this world is to
serve Allah and that our ultimate goal is to reach Jannah in the
akhira (hereafter). Therefore your focus should now, be on adopting
the means to achieve this eternal goal, i.e. adopting the teachings
of Islam and following the Sunnah of our beloved messenger Muhammad peace be upon him.
This does not mean that you have to become a hermit and retreat
to some remote jungle to spend the rest of your days engaged in
acts of worship. In fact we must live in the dunya but work for the
akhira. What does this mean? This means that we must attempt
to the best of our ability to seek deen knowledge into at least the
basic fundamentals of our religion. For example start from the basic
qh of cleanliness and prayer and then move onto more advanced
areas of the shariah such as the etiquettes of trading and business,
especially for the eld of work that you will soon enter into. You may
also decide to study the qh of Nikah because sooner or later if not
already you will be approaching the stage where you will marry and
eventually settle down with a family. These are just suggestions that
hope to serve as an example of how you can tread that path to bring
you closer to your Lord Allah and how you can balance the work of
this world with the work of the akhira, Inshallah.

You And Me
Before mankind lived upon this earth
Adam was created without father or birth
Allah made him from different colored clay
so that is why our skins are colored in this way.
Some of us are dark and others a kind of white
but it is only our belief that separates us in His Sight.
He made us all to know one another
to become sisters and brothers each to the other.

permissible "striking" as that which leaves no mark on the body. It

is interesting that this latter fourteen-centuries-old qualier is the
criterion used in contemporary American law to separate a light and
harmless tap or strike from "abuse" in the legal sense. This makes it
clear that even this extreme, last resort, and "lesser of the two evils"
measure that may save a marriage does not meet the denitions of
"physical abuse," "family violence, " or "wife battering" in the 20th
century law in liberal democracies, where such extremes are so
commonplace that they are seen as national concerns.
c.The permissibility of such symbolic expression of the seriousness
of continued refraction does not imply its desirability. In several hadiths, the Prophet (peace and blessings be upon him) discouraged
this measure. Here are some of his sayings in this regard: "Do not
beat the female servants of Allah"; "Some (women) visited my family complaining about their husbands (beating them). These (husbands) are not the best of you."
In another hadith the Prophet (peace and blessings be upon him)
is reported to have said:How does anyone of you beat his wife as
he beats the stallion camel and then he may embrace (sleep with)
her?
d.True following of the Sunnah is to follow the example of the
Prophet (peace and blessings be upon him) who never resorted to

that measure, regardless of the circumstances.

e.Islamic teachings are universal in nature. They respond to the
needs and circumstances of diverse times, cultures and circumstances. Some measures may work in some cases and cultures or
with certain persons but may not be effective in others. By denition,
a "permissible" act is neither required, encouraged or forbidden. In
fact it may be to spell out the extent of permissibility, such as in the
issue at hand, rather than leaving it unrestricted or unqualied, or ignoring it all together. In the absence of strict qualiers, persons may
interpret the matter in their own way, which can lead to excesses
and real abuse.
f.Any excess, cruelty, family violence, or abuse committed by
any "Muslim" can never be traced, honestly, to any revelatory text
(Qur'an or Hadith). Such excesses and violations are to be blamed
on the person(s) himself, as it shows that they are paying lip service
to Islamic teachings and injunctions and failing to follow the true
Sunnah of the Prophet (peace and blessings be upon him)."

Imams urged to expand their roles in society

A call has been made to Imams not to only conne their roles in mosques but also increase their
activities by actively participating in societal activities.
Notwithstanding their important role in the
mosques, Imams also have an obligation to play
in the larger Muslim community and the wider
society at large, said Sheikh Muhammad Dor, a
Nominated MP.
Speaking at the closure of a four day Imam training programme at Jamia mosque, he regretted
that Imams have largely forsake their roles as
community leaders and only conned their activities within the four walls of the mosque.
Your role in not limited to prayers only. You have
a much larger role to play in the society and this
should be cleary evident in your activities, he said
at the event where he was the guest of honour.
By virtue of their position, Sheikh Dor said the
Imams were community leaders and the society
expects them to play an extra role in addressing day-to-day activities in their respective areas.
Imams should also actively participate in activities related to the welfare of orphans and widows,
youth empowerment, addressing poverty levels,
HIV/AIDS challenges and other social problems,
he said.
The Sheikh also told the Imams to reach out to the
youth and groom them into productive members
of the society. He noted that in many areas there
existed a vacuum between the older generations
and the youth and said Imams had an obligation
to bridge this divide as it will make inculcate vir-

tues of being responsible citizens.

In his remarks, the Imams were further adviced to reach out to other sectors in the
community as this will contribute to good relations and better understanding between
Muslims and other members of the society. You need also to engage with other leaders in the community and actively participate in programmes which will contribute to
the development of your areas, he noted.
The four day event was organized by Jamia Mosque in conjunction with African Muslim Agency.

US jury hands down Ghailani verdict

The rst former Guantanamo detainee to be
tried in a civilian court has been found not
guilty on all but one of the 286 charges in
the 1998 bombings of two US embassies in
Africa.
A federal jury handed down the verdict on
Wednesday to Ahmed Ghailani, a Tanzanian national who had been accused of conspiring in the car bomb attacks in Kenya and
Tanzania that killed 224 people.
The jury found him guilty of one charge of
conspiracy to damage or destroy US property by means of an explosive device.
Ghailani was cleared of 276 murder and
attempted murder counts, along with ve
other conspiracy charges.
However, he faces a mandatory minimum
sentence of 20 years after his conspiracy
conviction.
Daphne Eviatar, from Human Rights First,
said that the trial demonstrated the system
works and that there was no need to keep
the Guantanamo Bay facility open. "What
strikes me is how efcient, fair, and transparent the federal court prosecution was,"
she said.
Ghailani was accused by government prosecutors of conspiring to carry out the attacks
by purchasing a lorry and gas cylinders. But
his lawyers argued that he was a dupe of
the senior al-Qeada leaders and that he had
no prior knowledge of their plans.

Under US law, prosecutors must prove that

a defendant wilfully and knowingly took part
in a plot.
Ghailani was arrested in Pakistan in 2004
and was transferred to the US-run Guantanamo Bay detention facility in Cuba in
2006.
The trial at a New York courthouse had
been viewed as a possible test case for
the US government's aim of putting other
Guantanamo detainees on civilian trials on
US soil.
Ghailani's prosecution also demonstrated
some of the constitutional challenges the
government would face if that happens.
On the eve of the trial last month, the judge
barred the government from calling a key
witness because the witness had been
identied as being subject to harsh interrogation techniques.
Ramzi Kassem, a lawyer for Guantanamo
and Afghanistan's Bagram detainees, told
Al Jazeera that the Ghailani verdict will add
fuel to the debate in the US about whether
to go with the regular court system versus
military commissions. "On the one hand,
it can be characterised as a defeat for the
[Barack] Obama administration because
you've got a man that has been acquitted of
over 280 charges," he said.
"So it's not like the Obama administration
isn't getting a conviction out of this case.

A chance for growth

The recent case of eleven Muslim parents
taking a national school to court reminds us
that we have a long way to go in order to be
safe from the violations of our rights by others. This is just one case out of so many that
we suffer at the hands of others, but which
pass unreported.
Despite the fact that Muslims make up over
a third of the population of the country, less
than 10 percent of the population is in primary and secondary schools are Muslims. Out
of the less than 10 percent in these schools,
probably 7 percent are in Christian missionary schools, 2 percent in public and other private schools while a triing 1 percent could
be in schools which satisfy our standards.
Out of these schools which satisfy our standards two have already been implicated for
suspicious cases of exam anomalies. Where
is the future of our growth, then?
ALLAH says in The Glorious Quran, Suratu
Tawbah Aya 38, then, 41:
Oh Ye who believe! What is the matter with
you, that, when you are asked to go forth in
the Cause of ALLAH, you cling heavily to the
earth? Do you prefer the life of this world
to the Hereafter? But little is the comfort of
this life, as compared with the Hereafter
..(9:38).
Go ye forth lightly or heavily, and strive and
struggle, with your goods and your persons,
in the Cause of ALLAH. That is best for you,
if you (but) knew.(9:41)
That is why the One Shilling Foundation
was formed: To heed ALLAHs call that we
go forth in HIS cause; to help out the Ummah to prefer the Hereafter by doing noble
deeds and to unite the Ummah in pursuit of
a common goal of uplifting the standards of
the Ummah.
We urge you to join the One Shilling Foundation and sustain your membership so we
may build strong institutions like schools for
our children, colleges, universities and hospitals.
