SUPERINTENDENT'S EMPLOYMENT CONTRACT (2015 - 2018) AGREEMENT made this |b day of __Julv) 2015, between the BOARD OF EDUCATION OF MINOOKA CONIMI CONSOLIDATED SCHOOL DISTRICT NO. 201, GRUNDY, KENDALL and WILL COUNTIES, ILLINOIS, ‘reinafter referred to as the "Board," and KRISTOPHER MONN, hereinafter referred to as the "Superintendent," has been approved by a MOTION adopted at the meeting of the BOARD. hneld on July 13, 2015, and is included ia the MENUTES of said meeting, A. EMPLOYMENT AND COMPENSATION 1. Salary and Term of Employment, The Board hereby employs the ‘Superintendent fora multiyear period, commencing on August 1, 2015, and terminating on June 30, 2018, at an aumualized salary of One Hundred Sixty-One Thousand Dollars and No Cents (161,000.00), payable in equal installments in accordance with the rules ofthe Board governing payments of other administrative sal members in the District. Bach subsequent Contract Year, the Board, shall establish the annual salary for the Superintendent, provided the annual base salary isnot less than the annual base salary afforded inthe preceding Contract Year. As used in this Contract, the term “Contract Year” is defined as the period commencing on July 1 ofa given calendar year and continuing until June 30 ofthe following calendar year, however, the 2015- 2016 Contract Year shall begin on August 1. In addition tothe annual base salary stated in paragreph A.1 of this Contract, the Board shall pay on behalf of the Superintendent to the State of Illinois Teachers’ Retirement System ("TRS") and the Teacher Health Insurance Security Fund (“THIS”) the Superintendent's required member contributions to the pension system and health fund. The Superintendent shall not bave any right fr claim to these amounts, except as they may become available at the time of retirement or resignation ftom TRS and THIS. Both parties acknowledge thatthe Superintendent did not have the option of choosing to receive the contributed amounts directly, instead of having such contributions paid by the Board to TRS and THIS, and further acknowledge that such contributions are made as a condition of employment to secure the Superintendent's future services, knowledge and experience. 3. Greditable Earnings. The partes hereby agree that the Board makes no representations regarding the creditable earnings status with respect to any compensation received by the Superintendent pursuant to the terms of this Agreement. Any and all Aeterminations regarding creditable earnings, creditable service, and related TRS issues shall be ‘made by TRS and, where applicable, a court of competent jurisdiction, B, CONDITIONS OF EMPLOYMENT. 1. License, During the term of this Contract, the Superintendent shall hold a valid and properly registered license issued by the Illinois State Educator Preparation and Licensure ‘Board qualifying him to act as Superintendent ofthe School Distict. 2. Medical Examination, As a required condition of employment for new ‘employees, and prior o commencing duties under this Contract, the Superintendent shall submit 10 a physical examination by a physician licensed in Illinois to practice medicine and surgery in all its branches, and shall provide the Board with a written certification of physical fitness to perform duties assigned and freedom from communicable disease in accordance with Section 24- 5 of the linois School Code. ‘The Superintendent shall further submit, t Board expense, to & physical or mental examination by a physician licensed in Ulinois to practice medicine and surgery in all its branches whenever the Board deems such examination necessary and in accordance with applicable law. As a condition of employment, the Superintendent also agrees to comply with all health requirements established by law. 3. Waiver of Tenure, The Superintendent acknowledges that, pursuant to the ‘Schoo! Code, he waives any right to tenure in the School District by virue of entering into this ‘multi-year contract and eny multi-year extension thereo 4. Criminal Hackground Investigation, As a required condition of employment for new employees, the Superintendent shall authorize a eriminal background investigation by the Board, pursuant to the School Code and DCFS Child Abuse Registry background investigation, The Administrator acknowledges that this Contract is coatingent upon the Board desming acceptable the results of such criminal background investigation, the DCTS Child “Abuse Registry check, a Statewide Sex Offender Database check, and a Statewide Murderer and Violent Offender Against Youth Database check. 5. Emplovment Representations. The Superiniendent represents that he is not ‘under contract with any other school district for any portion ofthe term covered by this Contract. ‘The Superintendent further represents that all information provided tothe District in the process of application for employment was true and complete, © BENEFITS 1. Reimbursement of Business Expenses, The Board shall reimburse the Superintendent in accordance with Distrit procedures for reasonable monly expenses incu in the performance of his duties, Iemizaton shall be made by the Superintendent of ll expenses incured 2 Insurance. The Board will provide the Superintendent with the following insurance benefits during each Contract Year: 8. Individual/fllfamily hospitlization/medical, vision and dental insurance, 1s provided under any group programs effective in the Distict; Liability indemnification and protection, as provided under the Distit’s| liability insurance policies; and ¢. Individual term life insurance, in the amount of two (2) times the base salary set forth in Section A.i of this Contract, subject to all eligibility conditions of the District's group program carrier If, at any time during the term of this Contract, the Board's payment of insurance ‘premiums is deemed to constitute a diseriminatory or otherwise impermissible benefit under law fr regulation or other official guidance subjecting the Boare or Superintendent to potential penalies, fees, excise taxes, employee benefit plan failures or increased tax payments, then the ‘Board may, in its diseretion, determine to decrease is payment for such insurance and make & corresponding increase in the Superintendent's salary or other compensation to offset the cash ‘value of the reduction in such insurance premium benefit, The Board's action to convert a benefit under this paragraph shall be in implementation of this provision of this Contract and shall not constitute or require an amendment to this Contract, 3. Vacation, The Superintendent shall be entitled to paid vacation of twenty (20) working days in each Contract Year (pro-rated accordingly for the 2015-2016 Contract Year), provided, however, any vacation time in excess of five (5) consecutive days shell be mutually agreed upon by the Board President and the Superintendent. Vacetion must be taken within the Contact Year granted or shal be forfeited wo the Board and not accumulated. However, eech CContrat Year, the Superintendent may roll over @ maximum of ten (10) unused vacation days for use in the following Contact Year. At no time may the Superintendent have more thn thirty (G0) unused vacation days available for use. The Superintendent shall sso be entitled to al legal and school holidays as designated on the Distct calendar. Winter, spring, and summer recess periods shall constitute working days unless specifically scheduled and credited toward the ‘acaton days listed above. Upon termination ofthis Contract, if the Board is require bylaw to pay for any unused, accumulated vacation days, such payment shall be made afer the Superintendents receipt of his final paycheck for regular earings and lst day of work in the Distt 4. Siok Leave, For the 2015-2016 Contract Year, the Superintendent shall be ‘granted paid sick leave, as defined in Section 24-6 of the School Code, of twenty (20) working Gays. For Contract Years following the 2015-2016 Contract Year, the Superintendent shall be ‘granted paid sick leave, as defined in Section 24-6 of the School Code, of sixten (16) working days each Contract Year, but not to exceed the normal annual allotment afforded to teachers under their collective bargaining agreement. Unused sick leave may be accumulated without limit. 5. Membership Dues. The Board shall pay for the Superintendent's dues and membership fees to the Illinois Association of Schoo! Administrators, American Association of School Administrators, the Illinois Association of School Business Official, the Association of, School Business Officials Intemational, and such other professional organizations as approved by the Board. 6. Professional Meetings Attendance. Subject to prior approval by the Board, the Superintendent may attend appropriate professional meetings at the local, state end national levels. All reasonable expenses incurred shall be paid by the Board 7. Deferred Compensation. From the annual salary stated in paragraph A.1 ofthis Contract, the Superintendent may (1) annually defer compensation pursuant to and in accordance ‘with the terms of an eligible deferred compensation plan as described in Section 457(8) of the ‘Internal Revenue Code if adopted by the Board, and/or (2) auhorize a salary reduction in order that the Board may purchase a 403(b) eligible product for the Superintendent as described in Section 403(b) of the Internal Revenue Code, in accordance with the Board's 403(t) Plan if offered, and provided thatthe Superintendent confirms that any such deferrals and/or reductions are within Internal Revenue Code limitations 8. Cell Phoue, The Board has determined that, by virtue of his job duties, the ‘Superintendent needs to be immediately reachable by the Board and other District administrators and staf in the event of emergencies outside normal work hours and/or when the Superintendent is away from the District. Accordingly, the Board will provide the Superintendent witl ‘monthly allowance for use of his personal cell phone of Seventy Dollars and No/Cents ($70.00). ‘The Board shall make such provision for a business purpose, and not for purposes of compensation of the Superintendent. ‘The Superintendent may use the phone for both District and personal business in accordance with IRS guidelines. 9. Transportation, The Superintendent shall be required, as a condition of employment, fo use his own personal vehicle to visit sites of schools, attend Board and community functions, and attend conferences, meetings and workshops. The Board shall reimburse the Superintendent at the current Internal Revenue Service rate per mile for miles traveled on District business with his personal vehicle. As a condition of reimbursement, the Superintendent shall be required to provide the Board with writen substantiation of miles and expected reimbursement amounts as required by the Internal Revenue Code of 1986, as amended, and its regulations and official guidance as well as District procedure. D. POWERS AND DUTIES 1, Duties. The duties and responsibilities of the Superintendent shall be all those ties of the office of the Superintendent of Schools as set forth in the job description and contained in Board Policy, as adopted, and which may reasonably be amended from time to time. ‘The Superintendent shall have charge of the administration of the schools under the direction of the Board, He shall be the chief executive officer for the Board; shall recommend the selection, retention and dismissal of, and direct and assign, teachers and other employees of the School District under his supervision; shall organize and direct the administrative and supervisory stal; shall make recommendations to the Board concerning the budget, building plans, location of sites, and the selection of textbooks, technology, instructional material, and ‘courses of study; shall direct the keeping ofall records and accounts, and ad inthe making of ell reports, as requited by the Board; shall recommend rules, regulations, and procedures deemed necessary for the welfare of the School District; and, in general, shall perform all other duties incident to the offce of the Superintendent asthe Board may delegate to him or as required by law. 2. Extent of Serviee, The Superintendent shall devote his entire time, attention, and energy to the business of the School District and related professional activities. With the permission of the Board, the Superintendent may attend university courses, seminars, or other professional growth activities; serve as @ consultant to another district or educational agency for 8 short-term duration without loss of salary; lecture and engage in writing activities and speaking engagemen's. The Superintendent may not jeopardize the functioning of the School District by any lengthy and conspicuous absence for such professional activities, 3. Performance Goals and Indicators, In accordance with the requirements of the School Code for multi-year employment contracts, the parties agree that the following performance goals for the Superintendent, including the indicators listed beneath the goals that shall be used by the Board to measure the Superintendent's performance, have been esablished with respect to student performance and academic improvement. The Board may adjust these performance goais annually. Annually, the Superintendent, with the assistance of his administrative team shall (1) evaluate student performance: (2) review the curriculum and instructional services: (3) report to the School Board of hs findings as to (a) student performance and (b) recommendation, if any, for curiculum or instructional changes as a result of his evaluation of student performance. The presentation of the report shall constitute the indicator of meeting the goal of student performance and academic improvement as required by Section 10-23.8 of the Ulinois School Code. E, _ RENEWAL, EXTENSION, AND AMENDMENT OF CONTRACT 1. Nom-Renewal, Notice of intent not to renew this Contract shall be given to the Superintendent by the Board by April of the year in which the Contract expires, Said notice shall be in writing and state the specific reason for non-renewel. Failure to provide timely notice ‘of non-renewal shall extend this Contract for one (1) addtional year. The Superintendent shall notify the President and Secretary ofthe Board by February 1 of the year in which the Contract expires that failure of the Board to give the Superintendent said noiice of intent not to renew shall extend this Contract for one (1) additional year. The failure of the Superintendent to give the required reminder notice to the Board shall waive the obligation of the Board hereunder to give its notice of intent by April 1. Within ten (10) days aftr receipt ofa notice of intent not to renew this Contract, the Superintendent may request a closed session hearing on the dismissal sour s 2. Renewal and Extensions. This Contract may be reviewed by the Board and the Superintendent at any time before Februcry 1, 2018, and may then be extended fora single year fr multi-year period, upon such terms and conditions as may be mutually agreed to by the parties, provided the Superintendent has met the performance goals and indicators set forth in paragraph D.3 of this Contract, if required by law. After February 1, 2018, the Contract may be renewed for a single year dr multi-year period, upon such terms’ and conditions as may be rmotually agreed to by the partes. In the event the Board and Superintendent agree to extend or renew the Contract, the Board shall take specific action to discontinue this Contract and enter into a new contract of employment. 3. Amendment, Any salary or other adjustment or modification made during the life of this Contract shall be in the form of a written amendment and shall become a part ofthis Contract, but such adjustment or modification shall not be construed as a new contract with the Superintendent or as an extension of the termination date of this Contract. F, TERMINATION 1. Grounds for Termination, This Contract may be terminated during its term by: a Mutual agreement; b. Permanent disability (inability to perform essential job functions with or ‘without accommodation © Discharge for eause; or 4. Death of the Superintendent 2. Cause, Discharge for cause shall be for any conduct, act or failure to act by the Superintendent which is detrimental to the best interest of the School District. Reasons for discharge for cause shall be given in writing to the Superintendent, who shall be entitled to notice and « hearing before the Board to discuss such causes. IF the Superintendent chooses to be ‘sccompanied by legal counsel, he shall bear any costs therein involved. The Board hearing shall ’be conducted in closed session. Failure to comply with the terms and conditions of this Contract after reasonable notification by the Board and an opportunity to correct, as reasonably determined by the Board, where appropriate, shall also be sufficient cause for discharge as provided herein. Nothing herein shall prohibit the Board from suspending the Superintendent ‘with pay pending completion of the requirements of this paragraph. 3. Effects of Termination, Upon termination of this Contract, no further ‘compensation of benefits afforded under these contractual provisions shall be paid to the Superintendent or aay third party on his behalf unless otherwise provided by law and/or an agreement of the parties. This provision does not restrict the right of beneficiaries of the Superintendent to receive compensation or benefits for wich they may be eligible under any District insurance policy or plan provided under the terms of this Contract in accordance with such poliey or plan, and/or as required by law. G—_ EVALUATION The Board and Superintendent agree that annually they shall mutually discuss and evaluate their working relationship, rapport, end understanding. By June 30° of each Contract Year ofthe Contract, the Superintendents performance shall be aporased by the Board and a ‘written evaluation ofthat performance given to the Superintendent; provide i the last year ofthe Contract such evaluation shall occur before January 15% As required under the School Code the ‘Board shall evaluate the Superintendent in his administration of school boaré policies and his steveardship of the assets of the District. The Superintenden’s progress toward and afainment of te performance goals set forth in paragraph D.3 ofthis Contrct, and any other goals as may hhave been established pursuant to such paragraph, shall also be assessed. After an evaluation is conducted by the Board, the partes shall schedule a meeting to review the evaluation and
