2. Supervisory Employees
- Supervisory employees are those who have the power to recommend. The
power to recommend must not be merely routinary or clerical in nature but
requires the use of independent judgment. (RECOMMENDER)
- Not eligible for membership of C.B unit of the rank and file employees
- But they can join, assist, organize a labor organization of their own
- Rank & file and supervisory employees operating within the same
establishment may join a federation
3. Confidential employees
- Those who: Assist or act in a confidential capacity to persons who formulate,
determine, and effectuate management policies in the field of labor
relations
- If confidential matters ra concerning business standpoint, they shall not be
prohibited to join
- Reason: conflict of interest

The Council shall implement and administer the provisions of this Executive Order.
For this purpose, the Council shall promulgate the necessary rules and regulations
to implement this Executive Order.
VIII. Settlement of Disputes
Sec. 16. The Civil Service and labor laws and procedures, whenever applicable, shall
be followed in the resolution of complaints, grievances and cases involving
government employees. In case any dispute remains unresolved after exhausting all
the available remedies under existing laws and procedures, the parties may jointly
refer the dispute to the Council, for appropriate action.
