AFFIDAVIT OF DESISTANCE AND/OR

QUIT CLAIMS
I,Eduardo C Enciso, of legal age, married to Segundina Enciso, Filipino and a
resident of Pinalpalan, Malaita, Davao del Sur, under oath duly depose and state THAT:
That I am the same person who caused the preparation of this affidavit having the
right and the capacity to do so;.
That I am the father of EDWIN ENCISO who died on December 5, 2013 at Purok
Pluto, Managa, Bansalan Davao del Sur, Philippines at around 8 oclock in the evening ;
That alleged perpetrator was Joel Albopera, a resident of Poblacion Uno,
Bansalan Davao del Sur.
That after a serious deliberation with my wife and children on the facts and
circumstances surrounding the incident, I have decided to cease and desist from further
prosecuting the case against Joel Albopera and realized to forgive the same:
That I shall not appear nor be available and testify against the said respondent in
any and all future hearing in the case. Moreover, I will no longer demand from the respondent
and his family any forms of settlement arising from the said incident;
I am executing this affidavit in order to apprise the duly constituted authorities
concerned of the forgoing facts and to apprise the authorities concerned and for whatever
purpose this may se4rve; .

nako og akoang asawa and nakapatay og dili na kami interesado nga mopasaka
ppa og kaso laban sa nailhan na nga nakapatay og sa iyang pamilya.
Ako magaingon na kung dili nako tumanon ang akong gipang ingon niining
dokumentoha, ako ma oblige sa akong sarili nga ibaalik ang kantidad nga akong
nadawat kay Felomina Albopera.

I, Perlito Yocte Lipalam, of legal age, Filipino, married, and a resident of Brgy
New Clarin, Bansalan, Davao del Sur, Philippines, after having been duly sworn to in
accordance with law, do hereby depose and say:
That I am the same and identical person who caused the preparation of this
affidavit and at the same time the complainant against RELYN R LIPALAM a resident of New
Clarin, Bansalan, Davao del Sur;
That the case filed was for violation of Republic Act 7610 and is now pending
before the office of the Provincial Prosecutor, Digos City for preliminary investigation and was
docketed as NPS X1-04-INV-16E-00261;
That after a serious deliberation on the facts and circumstances surrounding the
incident, I have decided to cease and desist from further prosecuting the case against RELYN R
LIPALAM;
That I shall not be available to appear and testify against the respondent in any
and all future hearing of the case;
That I execute this affidavit to attest to the truthfulness of the foregoing statements
and to apprise the authorities concerned to move for the immediate dismissal thereof.
