    DescriptionofAllegedViolation:
    BostonsMayor,theBostonSchoolCommittee(BSC),and15CommonwealthCharterSchools(eachof
    whichisalocaleducationauthority)playedasignificantroleincreating,structuringandempoweringthe
    BostonCompact.TheyvotedtocreatetheoriginalDistrictCharterCompactin2011.BostonSchool
    SuperintendentappointedhalfthememberstotheoriginalSteeringCommittee&designatedherDeputy
    SuperintendentCoChair.April2012,theCityandChartersectorsamendedtheCompacttoincludethe
    CatholicSchoolsector.MayorWalsh,uponelection,createdaChiefofEducationinhiscabinetandto
    serveasCoChairoftheCompactSteeringCommittee,formalizingtherelationshipwithCityHall.Heused
    his2015StateoftheCityspeechtoemphasizehisrightfulownershipoftheCompactandhisroleasthe
    driverofitsadoption.

    October14,2015BSC,uponlearningthattheCompactdidnotkeepminutesasisrequiredofitsown
    meetingsandthoseofitsEducationAdvisoryCommitteeandTaskForces,votedtorenewtheCompact,as
    didthecharterschoolsbycontemporaneousvotesoftheirboards,intendingfortheSteeringCommittee
    meetingsandsubcommitteemeetingstobeheldbehindcloseddoors.YettheBSCorder(approved50
    plus1abstention1absent)evidencesitscontrol:TheSuperintendentoftheBostonPublicSchools(BPS)
    Districtshallappointdesignees,includingacochair,torepresentBPSontheBostonCompactSteering
    Committee.TheCompactSteeringCommitteeshallcontinuetosubmitallpolicyrecommendationstothe
    BostonSchoolCommittee(andcharterschoolboardsandthegoverningbodiesoftheschoolsofthe
    ArchdioceseofBoston),asappropriate,forapproval.

    TheCompactservesapublicpurpose,namelytheeducationofmorethan90%oftheCitysk12students,
    includingthosewithdisabilities,specialneeds,andthosewithlimitedEnglishproficiency.(BostonPublic
    SchoolCommitteeAnswersOct.13,2015).TheCompactisengagedindeliberationsandwillbemaking

    recommendationstotheBostonSchoolCommitteeandCharterSchoolBoardsregardingacommonsystem
    ofassigningschoolagedchildrentoeitheraBPSschooloracharterschoolwithintheCity(EnrollBoston),
    servicesforstudentswithdisabilitiesandEnglishLanguageLearners,gradeconfiguration,atrisector
    masterfacilitiesplan,crosssectorleases,colocationofdistrictandcharterschools,bulkpurchasingand
    othergovernmentalfunctions.InJuly2015,theCompactidentifiedaneedforCityandchartersectorto
    contributerealdollarsinadditiontoinkindtimeandresourcesforitsinfrastructure.

    TheCompactadoptedbylaws(July15,2015),providingfortakingvotesbyaquorumof8Steering
    Committeemembers.ThebylawsallowforattendanceviaphoneorSkypeandvotingbyproxy,eventhough
    thisdoesnotconformwiththeAGOsregulationsgoverningremoteparticipation(See,Bylaws3.3and3.6).

    QUESTfiledapublicrecordsrequestSeptember24,2015seekingallminutesoftheCompactandits
    subcommittees.AttheOctober14,2014BSCmeeting,QUESTlearnedthattheCompactdidnotmaintain
    minutes,incontraventionoftheCompactbylawsandtheOML.

    TheCompactanditssubcommitteesdonotpostnoticeoftheirmeetings,incontraventionoftheOML.The
    Compactcreatedawebsite(www.bostoncompact.org)andposteddates,timesandplacesof7citywide
    communitymeetingsbutnotitsannualmeeting,SteeringCommitteemeetingsorsubcommitteemeetings.
    OnNovember2,IaskedCompactstafftwoquestionsviaemail:(1)WhenandwherearetheCompact's
    annualandquarterlymeetings?and(2)WillyoubepostingthetimeandplaceoftheCompact'smeetings
    ontheCompact'swebsite?Noresponse.

    ActionRequested:
    1. PostadvancenoticeofandagendasforallmeetingsoftheBostonCompactSteeringCommittee
    anditssubcommitteesonthetheCitywebsiteandBPSwebsites,theCompactwebsiteand
    websitesoftheparticipatingpubliccharterschools
    2. Prepareandpostminutesanddocumentsusedinthemeetingsontheaforementionedwebsites
    andmakethesepublicrecordsreadilyavailable,uponrequest,andinelectronicformatsoasnotto
    deterpublicaccess
    3. RetainminutesinanorganizedmannerpertheCitysrecordretentionschedule
    4. Makenotesanddocumentsusedatpriormeetingsheldbetween2011topresentreadilyavailable
