That accused went to Dansclihon and recruited the ‘Private complainants to work as house helpers on March 22, 2009, 3. That it was the father of (QD OQEED wito recommended her daughter to the accused to work as a house helper. On the other hand, the facts left CONTROVERTED are as follows? ‘That private complainants are minors. ‘That accused zecruited the private complainants to work as house helpers. ‘That accused promised private complainants to work as house helpers at Camella Homes with Php 1,500.00 monthly salary. 4. That accused brought the private complainants to Marawi City without their consent and their parents. 5. That accused sold the private complainants to CUD AGB and -_: AEE for Php 1,600.00. ‘That they were not paid of their salary. ‘That they were brought to Marawi City for forced labor. ‘That the private complainants were fetched by their parents in Marawi City with the policemen. 9. ‘That accused is known to the family of the private complainants even before March 22, 2009. ope ee EVIDENCE FOR THE PROSECUTION: 1@D SED (SED) one of the private complainants who is no longer a minor testified and relayed how they were niade to work in Marawi by accused. She recalled that at 3:00 o'clock in the afternoon ‘of March 22, 2009 she was with “AAA” in Dansolihon and saw her uncle }@: SSE nd auntie aD SED with Gloria ‘Nangeas (Nangcas). The latter asked them if they were willing to work and she accompanied her to their home where Nangcas had to occasion to talk to her parents. J@MW recalled Nangcas asking her father if he was amenable if she will work but heg father answered “no”. Nangcas was persistent and told her father, “brod, your daughter is interested for a job and you are not. The salary is P 1,500.00 a month and she will go home during Sundays ated she will work only in Camella”. Her father still did not agree but ted because of the salary and the location which is only in Camella.” ‘Thereafter, SMD had her dothes all ready and Nangcas proceeded to the house of TAAA" since her sister “BBB was also interested. Nangcas also asked the parents of “AAA” and “COC” if they were amenable that their daughter will work but their father refused since he can still afford to feed his daughters, and their mother was apprehensive that her daughter might be brought to Marawi. Gloria Nangeas x aT With their packed things in tow, SMM “AAA”, “BBB”, and “CCC’ went along with Nangcas who brought them to Camella Homes on board a PUJ. Accordingly, Nangcas talked to a woman on the road at Camella and then informed thean that the alleged prospective employer is not in their house and is in Cogon. They then proceeded to the back of Cogon market (interior portion) at around 5:00 o'clock in the aftemoon where Nangcas called up somebody using her mobile phone, and when Nangeas went to the public comfort room, S@jjjheard a trisikad driver saying ” Nang, you give us thet too fat Indies, maybe that is your new recruit” They were then made to board a tinted van with Nangeas informing them that they will go to Iigan City because their employer was there to which SIM replied: “Nang, we might be brought to Marawi” but Nangcas answered her saying: ” No, Marawi is nota safe place:”® recalled that they have already passed Digan City and she told Nangcas, “Nang, wwe are already very far” since she was afraid as it was already late at that time and. they were passing on uninhabited places. Nangcas, who feigned to be asleep ignored her until the van finally stopped at around 9:00 o’clock in the evening. They were told that the employer in Iligan already had a house helper, and it was in Marawi where they were needed. \QBEBclaimed that they wanted to go horne bat they have no fare in going back to Cagayan de Oro which is quite far from Marawi City.* They were brought to the house of one BDA GED (PB where they, including Nangcas, slept for anight. They worked as house helpers at the house of Qjand planned to work there for 15 days for them to have fare in going back to Cagayan de Oro. On April 14, 2009 which was her birthday, SIMI asked that she be allowed to g0 home but she was not permitted. With the help of the house help of the neighboring house who lent them her cellular phone, she sent a text message to her father.” ‘Subsequently, her father came over to Marawi accompanied by his friend who is a Muslim-native and his wife with three (3) other women and two (2) policemen to fetch her? Her father talked with Cgjgibut the latter refused to release them to her father. One of his father’s companions got mad and told Ciggggpthat Mr was already there and he aust be able to bring them back and thas Mr friend subsequently talked to CQgiin a Muslim dialect. While all these transpired, the policemen were just beside theat Since her father would not leave without them, he was able to take het and “BBB” with him. From Ojgg’s residence, they went to the latter's sister to take “AAA” and “CCC” with them, 100" “AAA’, a minor, averred that she was recruited as house helper by Nangcas supposedly to work only at Camella Homes but she and her companions were brought to Marawi City2> On March 22, 2009 at around 3:00 o‘clock in the afternoon, she was ‘on the road near the to the house of that was also the time that Nangcas came and asked them if they were willing to work. When they inquired where, they were informed by Nangcas that they will only have to work at Camella Homes. After packing her things, they proceeded to the house of “BRB" where Nangcas likewise asked her if she was willing to work at Camella Homes to which she agreed.” Thereafter, they rode a passenger jeepney in going to Camella. When they acrived there, Nangcas went to a house in Camella and had a talked with a woman, and shortly thereafter they were told by Nangcas that their employer was not in the house hence, they went to Cogon to meet their employer. However, when they arrived at Cogon they were made to board a van, with the understanding that they were going back to Camella Homes. However, they were surprised when they travelled for a long time. While they were travelling, Nangcas was sleeping and they tried to ‘wake her up bat she did not. It was only when they arrived in Marawi that Nangeas woke up. CRIM CASE NO.2009-643 Pp. vs. Gloria Nangcas i ‘The van then left and Nangcas brought to the house of one HD AMID (BMD) where they stayed for the night. ‘The following morning they were distributed: She and “BBB” stayed with BQ) [QUEM was brought to the sister of BEB and het ("AANS") sister, “CCC” was brought to MSU Marawi.® They were not paid salary by their employer and they were merely informed that they will no longer receive any salury because they were already sold to them. Whes they also asked Bj that they will only work half a month in order for them to have a fare in going to Cagayan de Oro, the latter did not agree because Nangcas already took their money when -he left. ‘When they cried, Hg told them to stop as they could no longer do anything about it She reasoned out that they did not try to escape because they will be Killed. “AAA” added that they were maitveated by their employer and when they were scolded: their employer would act as if she would hit them with a broom. They were also tola that they will be sexually abused by the soldiers and will be killed. They were only given left over tice or food." She also explained that they still work even they were not given any salary because they could not go home as they do not have fare in going back to Cagayan de Oro City 3° According to “AAA”, she saw [QD SQM when they were brought there to help in some works anc that was the time they got a charice to call the father: =: thru the cellular phone of the neighbor's house help. She was also able to talk to her Sister “CCC” inside the roomat the house of S's employer during the graduation of her child because they were brought there and they had a chance to talle in the room.® On May 2009, her parents went to Marawi and talked with BEBwho was first hesitant to urn her over to her parents but because of the employer of her sister CCCCS, BB finally agreed to release her.8 “AAA” daimed they were not paid their salary even when they were already fetched by her parents. Fourieen-year old “BBB” testified to corroborate with the testimonies of (I RMD eel "AAA". It ras on March 22, 2009 at P-3. Dansolinon, Cagayan de Om City. She was watching over her younger sibling when JMB “Aa” and “ccc” arrived with a woman later identified as the accused. She admitted having known the every Saturday and Sunday, hence, she went with them in riding a passenger jeepney in going to Camella Homes. When they arrived at Camella, they went to a house where only Nangeas went inside and talked to a woman and when she went outside, she informed them that they will go to Cogon market to meet their employer. When they arrived at Cogon, they were told again that the employer was not there but was in ‘stiched Wigan. When they tied to wake up Nangeas to inform her that they were already in Ihgan, she pretended.ap be asleep. The van continued to travel and they just passed by Iligan and when it stopped, Nangcas went out from the van and informed them that they already arrived. When they inquired what place it was, Nangcas told them that it was Marawi City.** According to “BBB” they felt afraid when they knew they were in Marawi City when their intention in going with Nangcas was only to work in Camella Homes. Left with no choice, they followed Nangcas in going to a house where they were given food and they stayed for a night there, Early on the following day, she and jo SAE were brought to the house of one CABAGHEMD house while “AAA” and “CCC” were left behind. “BBB” daimed that she saw Nangcas and Cg talked and even heard them talking but she could not understand what they were talking about since they talked in a mustin dialect. “BBB” also daimed that when they were in Marawi, she told Nangcas that they do not want to work there but the latter assured her that she will be back to fetch her. OQjigkhen told then that Nangcas tock Php 1,600.00, for each of them since the latter sold them to her, hence, they could no Jonger receive heir salary.” “BBB” adkds that the gate of the house of CM is always locked but there was a time that the child of C@™gg went out and when the child came back the helper arent in with her and that was the time Judith was able to borrow the mobile phone of the latter. VQ VQMB of the PNP police station of ‘Lumbia, Cagayan de Oro City testified that the parents of the private complainants asked assistance from im and he accompanied them in going to Marawi to rescue the private complainants, V@Brecalled that on May 1, 2009, they were conducting a mobile patrol at Brgy. Dansolihon when a E@@B OMIM father of [QM requested police assistance from them to rescue his daughter and dee (3) other minors who were brought to Marawi City without their consent. They went to the house of Nangcas but she was not there anc they were only able to talk to her (2) daughters. They waited for Nangeas to go to their station but she did not come, On May 5, 2008, a clearance from their mobile patrol director directed them to go to Marawi. VIvith two police officers, together with the parents of the private complainants proceeded to Marawi City and sought some help.» Theit plan was for the parents and the good citizens to talk with the employers fret, while V@™@Bind the other police officers only waited at new Caloocan, Marawi City.s? After the complainants were retrieved by their parents, the complainants informed them it was Nangeas who brought them to Marawi and there were also other minors being broaght by Nangcas who were waiting tobe retrieved. He also heard them zelay Ler ordeal of being pressured, intimidated and were told that they will be brought to Manila if they were not retrieved by theic parents." H@MMBhowever, told Nangeas that he had no intention to have his daughter work but Sf the latter is interested to work in Camella, itis okay with him, en agreed to the offer of Nangcas and they likewise agreed that the salary will be Php 1,500.00 One(1) month thereafter, EQUMP wondered why IMD dia not come home, hence, they started searching for her, He called Nangcas and asked her ” Sister, why is it that my daughter did not go home” and according to EASED he was told by Nangcas that“ I was there yesterday ani they can go home after {20 (2) months! . He then told Nangeas that he wanted his daughter to go home because his wife was worried but Nangcas reiterated (hat JQ cannot go home until after two (2) months. When he told Nangeas that he sent somebody to Camella Homes to look for his daughter, Nangcas told him that the place cannot be easily located since there are big houses there. After he was told by Nangcas that J@MIMHB cannot go home until after two (2) stonths, Fgilwaited but after a month and a week from March 22, 2009, }@MMBB called him saying, “Pa, we are in Marawl City Gloria Nangcas brought us here” Withal, EQBM went to the Lumbia Police Station to seek for assistance and to borrow a vehicle in going to Marawi. After the call made by [9 EQN contacted the owner of the celludar phone wit gave him direction as to where he can find his daugiter whose employer was one Apa On May 5, 2009, E@MlBwith the mother of “BBB” and the mother of “AAA” and “CCC” and with the help of V@jand a maranao friend, they proceeded to Marawi City. The wife of their maranao friend accompanied them to the place of the Am, lkaving the police officers at their house upon her advice so as to avoid any ‘commotion. Eq selayed that upon their arrival at the place of the AIM, they ‘refused to selease his daughter and told them that his daughter was in good hands and besides that, he saw her already. They had a talk which according to EQ lasted for ‘wwo (2) hours with the wife of the maranao friend taking negotiation with the Atty. AQQEMMD told them that Nangcas already got an advance of Php 1,500.00 each, Finally, they were able to get his daughter after the two-hour negotiation.#* They then proceeded to retrieve the ‘three(3) other minors with the help of the wife of their ‘maranad friend, Fortunately, it did not take them long to get them since Atty. AI already called the employers of the minors to give the minors back to them. She admitted having given ‘Nangeas Php 1,600.00 as reimbursement for mutch work since their house is not big and he can call her anytime. During the time that the two (2) complainants were working with het, she did not hogs them complain and they were in good terms. She denied having refused to release them to their parents when the latter came over to get them.” Accused Gloria Nangcas (Nangeas) testified to deny the charge against her and stated her version of the story. She daimed she was in Dansolihon. The latter told her to ask permission from het father. JQ SQM also told her that she has a friend who was also interested to work.® Nangeas then asked permission from Eq for }@™M to work at Camella, “CCC” arrived to fetch her sister “AAA” who applied for werk and for which she also went to the house of the siblings “AAA” and “CCC” to ask ‘permission from theis parents. The latter assented. On their way to the terminal located at ——ae, Nangeas, avers she met “BBB” who asked her where her cousins will work. ”’ BBB” just went with them because it was her day-off and she also wanted to see the faces of the employer of her cousins so she can visit them during her rest day Nangeas arrived at Camella with [QED "AAA", “BBB” and “CCC” to the Rouse of j@ but the latter told her that he only needed two helpers with salary pegged at Php 1,500.00 and that he wanted Ql and “CCC’, the younger sister of “BAA bat"CCC’ would not want to separate from her. Jj would agree to hire the three if they will agree with a salary in the amount of Php 1,300.each. Nangeas then claimed that she tok JJ to call his mother in Digan if she wanted to get three helpers to which Jags mother replied, “okay, you bring the 3 here in Tigan."** Nangcas added ‘that Jqgg’s mother told Jo give her the fare money but j@jjcannot give any since he did not receive his salary yet Hence the agreement was for her to just ride a vehicle and their fare paid to be paid upon arrival. They proceeded to Cogon where they took a van in going to Tambo, Gerona, Digan. Nangcas claims they did not push through to Tambo, Gerona because Mrs. MQM called to tell her she will no longer hire the helpers because her (old/current) helper will no longer go home. Nangcas then informed the driver of the van that they will no longer proceed to Tambo, Gerona, and proceeded to ligan City terminal where she asked the driver if he could bring them. ‘back to Cagayan de Oxo City. When the driver asked her if she has the money to pay for the fare upon reaching Cagayan de Oro City, QI SQ told her that they just proceed to Marawi where she has an uncle at Tamparan.* Accordingly, Qi has no money for the fare and could not contact her uncle to prepare the fate money 60 she (Nangcas) decided that they proceed to the house of A@fiMat Marawi. Nangcas further claimes that she told [Ql to tell her cousins of this plan because they were not able to ask permission from the parents of “AAA” and “CCC’# and that JQ did hence, they proceeded to the house of Nangcas’ close friend, BAI) AR (BAB). the sister of CQMD AQMIM at Barrio Green Basak, Marawis! The other 3 will first observe their employer.”” On May 5 J@MD called her but told JQ that she cannot fetch her because she was attending to ‘his husband who was hospitalized.” E@gggggealed her on May 7, informing her that he already fetched his daughter and the other kelpers on May 5 at 3:00 o'clock in the afternoon,” REBUTTAL EVIDENCE OF THE PROSECUTION: TQM testified to rebut the claim of Nangcas that it was his daughter's idea that they will go to Marawi where JQ was supposed to have an uncle, and Nangcas’ HD end three other private complainants.
