PNP MEMORANDUM CIRCULAR

GUIDELINES AND PROCEDURES FOR ACCREDITATION OF LOGISTICS
PROVIDERS, BROKERS, FORWARDERS AND TRUCKERS
1. REFERENCES:
a. Republic Act No. 9516: An Act Further Amending the Provisions of
Presidential Decree No. 1866, as amended, entitled Codifying the Laws
on Illegal/Unlawful Possession, Manufacture, Dealing in, Acquisition or
Disposition of Firearms, Ammunition or Explosives or Instruments used in
the Manufacture of Firearms, Ammunition or Explosives and Imposing
Stiffer Penalties for Certain Violations thereof, and for other Relevant
Purposes;
b. Implementing Rules and Regulations on Controlled Chemicals pursuant to
Sections 4-C to 4-F of PD No. 1866 as Amended by RA No. 9516; and
c. PNP Memorandum Circular No. 2014-058 entitled Supplemental
Guidelines in the Processing of Explosives/Explosive Ingredients and/or
Controlled Chemicals Permits and Licenses.
2. SITUATION:
Controlled chemicals are considered dangerous goods which when
transported require a higher degree of caution, prudence and diligence as well as
exacting standards of safety and security. The criticality and vulnerability of controlled
chemicals transport cannot be taken for granted, thus, both the government and the
private sector should take the concrete step to ensure the proper transport of these
goods with the end view of promoting business as well as ensuring public safety.
Relative to this, the Philippine National Police is the sole authority that regulates and
supervises the possession, manufacture, dealing in, acquisition or disposition of
controlled chemicals to include their movement and transportation. This is specifically
provided in Section 7.2 of the Implementing Rules and Regulations of RA No. 9516, to
wit:
The PNP, through the CSG, shall formulate policies and guidelines for the
operationalization of PNP accredited logistics service provider/broker/
forwarder/trucker to be utilized in the movement and transportation of
controlled chemicals.
3. SCOPE:
This Memorandum Circular (MC) applies to all logistics providers, brokers,
forwarders, and truckers as well as and manufacturers, dealers and purchasers which
that have company-owned vehicles engaged in the land transportation and movement
of controlled chemicals using truck lorries, tractor head loading container vans, closed
vans and similar other vehicles subject for accreditation.

4. PURPOSE:
This MC sets forth the guidelines and procedures to be implemented by the
Philippine National Police (PNP) in the accreditation of all logistics providers, brokers,
forwarders, and truckers, as well as and manufacturers, dealers and purchasers which
that have company-owned vehicles engaged in the land transportation and movement
of controlled chemicals using truck lorries, tractor head loading container vans, closed
vans and similar other vehicles subject for accreditation.
5. RATIONALE:
In a series of correspondences with the Chief, PNP and SILG, controlled
chemicals and allied industry stakeholders escalated their issues and concerns on how
best to streamline prevailing regulatory procedures and thus encourage trade
facilitation. These correspondences triggered a series of consultative meetings which
culminated on December 9, 2015 at the Star Officers Lounge, National Headquarters
Building, Camp Crame, Quezon City, which was presided by the Secretary of the
Interior and Local Government who announced the creation of a Technical Working
Group (TWG) on Controlled Chemicals to address the issues and concerns of the
industry stakeholders. In subsequent meetings, this TWG was subdivided into three
Sub-Technical Working Groups (STWGs) and one of these STWGs is the Sub-Technical
Working Group on the Accreditation of Logistics Providers composed of the
representatives of various national government agencies, officers of various stakeholder
organizations of controlled chemicals and other allied industries. The Sub-TWG
conducted several meetings and came up with their final output containing the
guidelines, parameters and terms of reference governing the accreditation of logistics
providers.
6. DEFINITION OF TERMS:
For the purpose of this MC, the following operational terms are defined:
a. Accreditation refers to the process of evaluation, validation and
registration of entity with the PNP, authorizing them to provide logistics
service for the transportation and movement of controlled chemicals using
truck lorries, tractor head loading container vans, closed vans and similar
other vehicles subject for accreditation.
b. Accreditation Certificate refers to the document issued to qualified
entities authorizing them to provide logistics service for the land
transportation and movement of controlled chemicals using truck lorries,
tractor head loading container vans, closed vans and similar other
vehicles subject for accreditation.
c. Accredited Entity refers to logistics providers, brokers, forwarders, and
truckers, as well as and manufacturers, dealers and purchasers which that
have company-owned vehicles engaged in the transportation and
movement of controlled chemicals. using truck lorries, tractor head loading
container vans, closed vans and similar other vehicles which have been
duly accredited by the PNP;
d. Automation refers to the process of integration of a form into a Portable
Document Format (PDF) that is automatically routed to the correct
recipients, or the ability to deploy an information technology or
telecommunications service by using pre-dened procedures that are
carried out electronically reducing human intervention to a minimum.

e. Broker refers to a person or entity, who for compensation or otherwise


provides land transportation service provider for the movement of
controlled chemicals belonging to a licensed entity using truck lorries,
tractor head loading container vans, closed vans and similar other
vehicles subject for accreditation from the point of origin to end-use
destination (Non-Custom Broker).
f. Company-owned Vehicle refers to the truck lorries, tractor head loading
container vans, closed vans and similar other vehicles subject for
accreditation, owned by licensed manufacturer, dealer and purchaser,
used in the transportation and movement of controlled chemicals from the
point of origin to end-use destination.
g. Controlled Chemicals refer exclusively to chlorates, nitrates, nitric acid
and such other chemicals categorized under Section 3.1 of the IRR on
Controlled Chemicals that can be used for the manufacture of explosives
and explosive ingredients, where the explosive is capable or is intended to
be made capable of producing destructive effect on contiguous objects or
causing injury or death to any person.
h. Forwarder refers to a person or entity responsible for the bookings of
shipment for the land transportation of controlled chemicals, who has
contract/service level agreement with carriers or often multiple carriers to
transport controlled chemicals belonging to a licensed entity using truck
lorries, tractor head loading container vans, closed vans and similar other
vehicles subject for accreditation from the point of origin to end-use
destination.
i. Global Positioning System (GPS) - is a radio navigation system that allows
land users to determine their exact location, speed, and time 24 hours a
day, in all weather conditions, anywhere in the Philippines.
j. Logistics Providers refers to the entity that provides logistics service for
the land transportation and movement of controlled chemicals using truck
lorries, tractor head loading container vans, closed vans and similar other
vehicles subject for accreditation from the point of origin to end-use
destination.
k. PNP Accreditation Board (PNPAB) refers to the PNP Board imbued with
a function to review, validate, and recommend the application for
accreditation of all logistics providers, brokers, forwarders, and truckers as
well as and manufacturers, dealers and purchasers which that have
company-owned vehicles engaged in the land transportation and
movement of controlled chemicals using truck lorries, tractor head loading
container vans, closed vans and similar other vehicles subject for
accreditation through a Resolution to be approved by the Chief, PNP or
his authorized representative.
l. Trucker refers to a person or entity engaged in the transportation and
movement of controlled chemicals from point of origin to the point of
destination.
7. CONCEPT OF IMPLEMENTATION:
a. 1st Phase: Accreditation of logistics providers, brokers, forwarders and
truckers as well as and manufacturers, dealers and purchasers which that
have company-owned vehicles for transportation of low-risk controlled
chemicals:

1) Within one month after the approval of this MC, a PNP Accreditation
Board shall be created pursuant to paragraph 8 of this MC.
2) Only logistics providers, brokers, forwarders, and truckers as well as
and manufacturers, dealers and purchasers which that have companyowned vehicles for the movement and transportation of low-risk
controlled chemicals shall be accredited by the board upon compliance
of the requirements set forth in paragraph 9 of this MC.
3) Pending the FEO Nationwide Automation Accreditation service and if
there will be no entity that will avail of the PNP Accreditation, one police
security escort shall be required for every movement and transportation
of high-risk controlled chemicals.
b. 2nd Phase: Procurement/Acquisition Planning of the FEO Nationwide
Automation
1) Within six months after the approval of this MC, the FEO shall prepare
the scope of works and the budgetary requirement for the nationwide
automation with the objective of monitoring the land transportation and
movement of controlled chemicals through PNP accredited logistics
providers, brokers, forwarders, and truckers as well as and
manufacturers, dealers and purchasers which that have companyowned vehicles.
2) The Directorate for Comptrollership (DC) shall provide funds for the
aforementioned project.
c. 3rd Phase: Procurement/Acquisition Proceedings and Implementation of
the FEO Nationwide Automation
d. 4th Phase: Mandatory accreditation of all logistics providers, brokers,
forwarders, and truckers as well as and manufacturers, dealers and
purchasers which that have company-owned vehicles for transportation of
low-risk and high-risk controlled chemicals pursuant to paragraph 9 of this
MC.
8. PNP ACCREDITATION BOARD
The following sets forth the guidelines and procedures to be considered in the
accreditation of logistics providers, brokers, forwarders, and truckers as well as and
manufacturers, dealers and purchasers which that have company-owned vehicles
engaged in the land transportation and movement of controlled chemicals using truck
lorries, tractor head loading container vans, closed vans and similar other vehicles
subject for accreditation:
a. To carry out the purpose of this MC, the PNP Accreditation Board
(PNPAB) shall be created to be composed of the following members:

b. The PNP Accreditation Board shall have the following functions and
responsibilities:
1) Evaluate all applications and recommend for the accreditation of
logistics providers, brokers, forwarders, and truckers as well as and
manufacturers, dealers and purchasers which that have companyowned vehicles to the approving authority.
2) Inform/notify the party through the Secretariat the decision of the
approving authority.
3) Recommend to the Chief, PNP or his authorized representative the
revocation of accreditation or imposition of penalty against accredited
entity who violates the provision of this MC.
c. Quorum
A majority of the total Board composition shall constitute a quorum
for the transaction of business, provided that the presence of the
Chairman or Vice-Chairman shall be required is a must.
d. Board meetings.
1) The Board shall meet/convene twice a month or as frequently as
necessary to perform its duties.
2) The Chairman or, Vice Chairman, shall preside at all meetings of the
Board. The decision of at least a majority of those present at a in the
meeting at which there is a quorum shall be valid and binding as an act
of the Board: Provided, however, That the Chairman or, in his absence,
the Vice-Chairman, shall vote only in case of a tie.
3) All minutes of the meetings and other records, documents,
data/information shall be prepared, updated, maintained and kept by
the Board Secretariat.
e. The Secretariat (EMD, FEO) shall have the following functions and
responsibilities:
1) Receive all applications for accreditation and evaluate the
completeness, authenticity and validity of the documentary
requirements as required under this MC;
2) Immediately endorse to the PAB the applications for accreditation for
deliberation;
3) Provide administrative support to the Board;

4) Organize and make all necessary arrangement for meetings;


5) Prepare minutes of meeting and resolution
recommendation of the majority of the Board; and

6) Inform the concerned applicant of the decision of the approving


authority via social media and other means of communication.

9. GUIDELINES IN THE ACCREDITATION:


a. The approving authority for the accreditation (New and Renewal) of the
logistics providers, brokers, forwarders, and truckers as well as and
manufacturers, dealers and purchasers which that have company-owned
vehicles shall be the Chief, PNP but may be delegated to the Director,
Civil Security Group (CSG).
b. Accredited company-owned vehicle shall be strictly use in the
transportation and movement of controlled chemicals for their companys
business purposes only and not for compensation or otherwise provides
land transportation service provider to other licensed entity.
c. Accreditation Certificate shall be valid for a period of one year from the
date of issuance. The application for renewal must be filed If an
application for renewal is filed at least 60 thirty (30) calendar days prior to
its expiration date, the expiring accreditation certificate shall remain valid
until a decision is rendered on the application for renewal. The Head
Secretariat is enjoined to act on all applications for renewal within the 60
calendar days.
d. Applications for renewal of accreditation certificate filed beyond the thirty
(30) calendar days reglementary period and the validity expires, the
accredited logistics providers, forwarders, brokers, truckers, and
manufacturers, dealers and purchasers that have company-owned
vehicles shall not be allowed to transport and move controlled chemicals
pending approval of their application.
e. Accredited entity with expired accreditation certificate shall be given until
six months to renew its accreditation subject to imposition of
administrative fines. Pending renewal of the expired accreditation
certificate, accredited entity is prohibited to transport and move controlled
chemicals. After six months of non-renewal, the PNP shall undertake
action to revoke/cancel the accreditation.
f. Administrative Fines shall be imposed on expired licenses Accreditation
Certificate, as follows:

cancellation of accreditation
g. Accreditation Certificate shall be issued only upon compliance with all the
requirements including the payment of the prescribed fees.
h. Applications for accreditation shall be in the name of and shall be
represented by the owner, in case of sole proprietorships or partnerships,
or, in case of corporations, by the president or any corporate officer or
member of the Board empowered through a Secretarys Certificate.
The applicant may duly authorize a representative to process the
application through a Special Power of Attorney (SPA) stating that he/she
had been authorized for the purpose of processing the application for
accreditation.
i. Requirements for Accreditation: The following documentary requirements
in original or authenticated copies shall be submitted to the Board
Secretariat:
a) For New Application:
i)
Notarized Accomplished Application Form;
ii) Personal Data Sheet (PDS) and NBI Clearance of the
applicant;
iii) Audited Financial Statements for the last three years (for new
companies Interim Balance Sheet);
iv) For local corporation/partnership: Certificate of Registration of
the firm with the Securities and Exchange Commission (SEC)
to include its machine validated Articles of Incorporation and
General Information Sheet (GIS);
For foreign multi-corporation: SEC Registration to do business
in the Philippines;
For Single Proprietorship: Certificate of Registration with the
Department of Trade and Industry (DTI);
v) Business Permit/PEZA Certificate of Registration-Business to
Operate;
vi) Notarized Accountability Statement (e.g. Spill response)
vii) Properly labeled pictures (8x10 in size) of garage printed in
photo paper;
viii) List of Vehicles / Trucks certified and signed by the company's
official to include the following documents:
(1) Copy of Franchise/Decision from LTFRB;
(2) Certified True Copy of OR/CR of Vehicles (must be
updated and under the name of the applicant or any
binding instrument);
(3) Photograph of vehicle (front, back and side view); and
(4) Global Positioning System (GPS) Tracking Device
linked to the FEO automation.
ix) Equipage inside the vehicle/truck:
(1) Two fire extinguisher per vehicle;
(2) One Extra Drum for holding spillage/Appropriate spill
response equipment;
(3) Personal Protective Equipments; and
(4) Suitable Communications System.
x) For authorized representative: Special Power of Attorney
(SPA) stating that he/she has been authorized by the applicant

for the purpose of processing the application for accreditation


with valid Government ID.
xi) List of Drivers and Helpers with the following documents:
(1) Personal Data Sheet with 2x2 ID picture;
(2) Drivers License;
(3) NBI Clearance;
(4) Controlled Chemicals Safety Training Certificate
issued by PNP CSG conducted by the DENR-EMB
(5) Police Clearance; and
(6) Barangay Clearance.
xii) Accreditation Fee P15,000 - Imposition of new fees shall be
subject for study, review and recommendation of the Revision
of Fees Committee and for approval of SILG pursuant to DOFDBM-NEDA Joint Circular No. 1-2013 dated January 30, 2016.
b) For Renewal:
i)
Notarized Accomplished Application Form;
ii) Business Permit/PEZA Certificate of Registration-Business to
Operate;
iii) List of Vehicles / Trucks certified and signed by the company's
official to include the following documents:
(1) Copy of Franchise of LTO - Decision from LTFRB;
(2) Certified True Copy of OR/CR of Vehicles (must be
updated and under the name of the applicant or any
binding instrument;
(3) Photograph of vehicle (front, back and side); and
(4) Global Positioning System (GPS) Tracking Device
linked to the FEO automation.
xii) Equipage inside the vehicle/truck:
(1) Two fire extinguisher per vehicle;
(2) One Extra Drum for holding spillage/Appropriate spill
response equipment;
(3) Personal Protective Equipments; and
(4) Suitable Communications System
ix) For new authorized representative: Special Power of Attorney
(SPA) stating that he/she has been authorized by the applicant
for the purpose of processing the application for accreditation
with valid Government ID.
x) List of Drivers and Helpers with the following documents
a) For additional/new drivers and helpers, the following
documents shall be submitted:
(1) Personal Data Sheet with 2x2 ID picture;
(2) Professional Drivers License (for Drivers only);
(3) Controlled Chemicals Safety Training Certificate
issued by PNP CSG conducted by the DENR-EMB;
(4) NBI Clearance;
(5) Police Clearance; and
(6) Barangay ClearanceandBarangay Clearance.
b) For old drivers and helpers, the following documents shall
be submitted:
(1) Professional Drivers License;
(2) NBI Clearance;
(3) Police Clearance;; and and
(4) Barangay Clearance.Barangay Clearance.
xiii) Accreditation Fee P 15,000.00 Imposition of new fees shall
be subject for study, review and recommendation of the
Revision of Fees Committee and for approval of SILG
pursuant to DOF-DBM-NEDA Joint Circular No. 1-2013 dated
January 30, 2016.

j. In case of additional and/or replacement of drivers and helpers, the


applicant shall immediately inform the PNP and submit their PDS and NBI
clearance.
k. All documentary requirements should be valid at the time of filing of the
application.
l. DTI-certified small enterprises, CHED/DepEd/TESDA-certified academe,
DOST-certified analytical/testing laboratories, and DOH-certified hospitals
with purchasers license shall only be required to use the accredited entity
in case of transportation and movement of high-risk controlled chemicals.
m. DTI-certified micro enterprises and barangay-certified farmers shall not be
required to use the accredited entity in the transportation and movement
of controlled chemicals.
10. PROCESSING OF ACCREDITATION
a. Applicants shall submit their applications with complete and valid
documentary requirements to the Head Secretariat using the prescribed
Application Form.
b. Upon receipt of the application, the Head Secretariat shall check whether
the documentary requirements are complete and valid.
c. The Secretariat shall then conduct actual inspection to the vehicle,
verifying the authenticity and/or existence of the following:
1) Certified True Copy of OR/CR of Vehicles (must be updated and under
the name of the applicant or any binding instrument);
2) Photograph of vehicle (front, back and side);
3) Condition of the vehicles for accreditation;
4) Global Positioning System (GPS) Tracking Device; and
5) Provision of containment, emergency equipment and markings.
d. For applications outside Metro Manila, the inspection of the vehicle/trucks
shall be conducted by the Regional Civil Security Unit (RCSU). Pending
activation by the RCSU, inspection shall be conducted by the Police
Provincial Office (PPO) which has territorial jurisdiction over the place of
business of the applicant.
e. The Head Secretariat shall set a meeting and present the application for
accreditation with the complete, authentic and valid documentary
requirements to the PNP Accreditation Board.
f. The Board shall resolve and recommend to the approving authority the
application for accreditation based on the result on the compliance of
documentary requirements and inspection.
g. Upon receipt of the approved accreditation Certification, the Head
Secretariat shall release the accreditation in two copies distributed as
follows:
1) Original Copy for the accredited entity; and
2) Original Duplicate Copy for the Chief, FEO.

11. SCOPE OF ACCREDITATION OF LOGISTICS PROVIDERS, BROKERS,


FORWARDERS AND TRUCKERS
a. The accredited logistics providers, brokers, forwarders, and truckers shall
have the authority to transport and move controlled chemicals belonging
to a licensed entity using truck lorries, tractor head loading container vans,
closed vans and similar other accredited vehicles from the point of origin
to end-use destination.
b. The accredited dealers and purchasers which that have company-owned
vehicles shall have the authority to transport and move controlled
chemicals only for their licensed clients and for their own consumption.
12. GUIDELINES IN THE MOVEMENT
CONTROLLED CHEMICALS

AND

TRANSPORTATION

OF

All accredited entities must observe the following guidelines in the movement
and transportation of controlled chemicals:

a. Safety Measures.
1) All packages, boxes and/or container of controlled chemicals should
follow the Globally Harmonized System (GHS) labeling requirements of
chemicals.
2) Vehicle which is used for transporting controlled chemicals should
have adequate capacity for the job and be in good condition generally.
3) Congested traffic should be avoided and no unnecessary stops should
be made. Stopping at any garages, repair shops and populated areas
when carrying controlled chemicals should be avoided.
4) Stops should be made only when necessary and refueling en route
should be avoided however whenever possible and if refueling is
inevitable it should be done with the motor engine stopped and brakes
set.
b. Security Measures
1) For High-Risk Controlled Chemicals:
a) Unloading/Delivery of chemicals shall be done in the presence of the
accompanying police security escort pending operationalization of
the PNP accredited logistics service provider/broker/ forwarder/
trucker.
b) An inventory shall be made and signed by the consignee and
witnessed by the accompanying police security escort. A copy of the
inventory shall be furnished to each of the witnesses.
2) For Low-Risk Controlled Chemicals:
a) Unloading/Delivery shall be done in the presence of the responsible
personnel of the storage facility and of the PNP accredited entity.

b) An inventory shall be made and signed by the responsible


personnel of the forwarder and witnessed by the responsible
personnel of the storage facility. A copy of the inventory shall be
furnished to each of the witnesses.
c) The responsible personnel of the PNP accredited entity shall see to
it that the controlled chemicals are stored and properly secured in
the storage facility. He shall submit an after-activity report to the
concerned Approving Authority copy furnished the Provincial
Director, PPO/City Director, CPO stating the time and date the
controlled chemicals arrived.
13. RECORD OF TRANSACTIONS, INVENTORY AND INSPECTION:
a. All accredited entity shall maintain a permanent record of all transactions
entered into in relation with the controlled chemicals, such as the
following: name of clients with copies of licenses/permits and service level
agreement, list of controlled chemicals, date and time of movement and
transportation and other records that the Chief, PNP may require.
Notarized Monthly Reports of the aforementioned transactions shall be
submitted on or before the fifteenth (15th) day of the following month to the
EMD, FEO.
b. The retention period for records and reports of all transactions shall be for
five years.
c. The PNP through the EMD, FEO may inspect the vehicles and/or examine
the records of the accredited entity for inventory, monitoring purposes
and/or investigation as the case may be.
d. The inspection of vehicles and/or examination of records shall be
conducted during office hours (8:00 AM to 5:00 PM). The Inspection Team
shall be covered with a Letter Order issued by the PNP.
14. REVOCATION OF ACCREDITATION
a. The Chief, PNP or his authorized representative through the
recommendation of the PNPAB shall impose the following penalties for
failure to maintain a permanent record of all transactions, failure to submit
reports on a monthly basis, submission of erroneous report, or failure to
observe the guidelines in the movement of controlled chemicals as
provided under Annex B of the IRR on Controlled Chemicals:

b. The Chief, PNP or his/her authorized representative through the


recommendation of the PAB shall revoke the accreditation on any of the
following grounds:
1) Movement and transportation of controlled chemicals of an unlicensed
person and/or entity and/or not covered with appropriate permit;
2) Movement and transportation of controlled chemical with unlicensed
and/or unlisted driver;

3) Submission of falsified document in the application of accreditation.

15. REPEALING CLAUSE:


All procedures, rules and regulations not in conformity with this
memorandum circular are hereby rescinded, amended or modified accordingly.
16. EFFECTIVITY:
This MC shall take effect 15 days from the date a copy thereof has been
