SUMMARY FOR THE CHIEF MINISTER

Subject:-

TRANSFER OF PROVINCIAL LAND / C&W LAND TO PAK ARMY


FOR SWAP OVER OF ADDITIONAL LAND REQUIRED FOR THE
WIDENING AND DUALIZATION OF MURREE CHOWK THANDIANI
CHOWK & NAWANSHEHR LINK ROAD DISTRICT ABBOTTABAD
ADP NO. 1199/140619 (2015-16).

It is submitted for information of the Competent Authority that the above


subject-cited scheme has been reflected in ADP (2015-16) at S.No. 1199/140619 with
an estimated cost of Rs. 988.520 Millions, and current year allocation of Rs. 120.00
Millions.

The existing road passes through the Cantonment Area where available

Right of Way of the road in its first 775 meters length is 45 feet on average according
to Army land Records as intimated by Military Estates Officer Hazara Circle
Abbottabad. Copies of the Military Estates Officer letters are appended at (Flag A)
and (Flag B). Whereas, the Design Formation width required for dualization of the
road is 66 feet. Accordingly, additional land measuring about approx 8 Kanals (7
Kanals 18 Marlas) is required by Pakhtunkhwa Highways Authority for execution of
the scheme in above-mentioned Army area.

The Pak Army has agreed for providing the additional land, mentioned in

para 2/S, to Pakhtunkhwa Highways Authority on the condition of swap over of


equal land with them. Station Head Quarters Abbottabad letter in this regard is
appended at (Flag C). As no such land is available with Pakhtunkhwa Highways
Authority for the purpose, therefore, District Administration Abbottabad was requested
for identification of any such Provincial land which may be offered to Pak-Army for the
swap over. A joint meeting of the stake-holders was convened by the Deputy
Commissioner Abbottabad on 16-05-2016 after identification of available options for
such Provincial Government lands. One of the identified options is a 5

Kanal 19 Marla vacant land belonging to C&W Division Abbottabad and situated
along the same road in Moza Dhamtore. This option was accepted by the Pak-Army
and it was jointly agreed upon to process the case for transfer of this piece of land to
Army Authorities. The minutes of the Meeting are appended at (Flag D). The
relevant revenue record of this 5 Kanal 19 Marlas land, as provided by the District
Administration Abbottabad is appended at (Flag E).

Foregoing in view, it is submitted that the piece of land of 5 Kanals 19

Marlas as mentioned in Para 4/S may be approved by the Competent Authority for
its transfer to Pak Army in the name of Central Government, Ministry of Defence,
Defence Department, so that the additional land of 7 Kanal 18 Marlas required for
the execution of above scheme may be obtained from Pak-Army in exchange.

Para 4/S, read with para 3/S, is submitted for perusal and approval of

the Competent Authority in the best public interest.
