ORDINANCE NO. 027, s. 2009
AN ORDINANCE PRESCRIBING THE PROCEDURES AND REGULATION ON
REGISTRATION OF FISHING VESSELS THREE (3) GROSSTONNAGE OR
LESS, CHARGING FEES AND, IMPOSING PENALTIES IN VIOLATION
THEREOF.
Be it ordained by the Sangguniang Bayan of Ragay, Province of
Camarines Sur, that
SECTION 1. TITLE. This ordinance shall be known as Registration
Ordinance for Fishing vessels three (3) gross tons and below.
SECTION 2. STATEMENT OF POLICY.
1. It is one of the major concerns of this local government the
development and progress of the fishing industry, to safeguard the
ownership of the fishing vessel and the transport of people thru
water vessels.
2. to protect and develop the fishery and aquatic resources in the
municipal waters, reserve their use and enjoyment primarily to
residents of the municipality;
3. to ensure the judicious and wise utilization, management on a
sustainable basis to avoid depletion of the marine resources;
4. to protect the rights of the municipal fisherfolks to the preferential
use of the communal marine and fishery resources as they are no
longer mere users of these resources but active participants in the

protection, conservation, rehabilitation and management of the


same.
SECTION 3. PURPOSES AND OBJECTIVES. This ordinance shall have
the following purposes and objectives.
3.1. Uniform Guidelines. To prescribe a uniform system and
procedure in the conduct of the registration of fishing boats three
(3) gross tonnage and below. And, to issue appropriate documents
to the owner of the fishing vessel.
3.2. Institutional Arrangement. To delineate the function of this
local government, all national government agencies concerned,
and all relevant sectors involved in the registration of fishing
boats three (3) gross tonnage and below.
3.3. Implementation and Monitoring. To establish mechanism to
implement this ordinance and enable all agencies involved to
monitor compliance of owners with respect to this ordinance and
other national laws relative to the fishing industry.
SECTION 4. ROLES

4.1. The Maritime Industry Authority (MARINA) and PCG shall extend
technical assistance and support to the local government of
Ragay, Camarines Sur with respect to registration of fishing
vessels as provided for in Executive Order 305 and maintain a
separate data bank of the list of registered fishing vessels. With
the exception of the registration function as devolved, the MARINA
and PCG shall continue to exercise each visitorial functions to
enforce compliance with the revised Philippine Merchant Marine
Rules and Regulation and all other existing laws, rules and
regulation on maritime safety. Said office shall also assist the LGURagay to qualify and issue appropriate documents to the
fisherfolks to operate motorized vessels.
SECTION 5. COVERAGE. This ordinance shall cover the registration of
all fishing boats three (3) gross tonnage and below whether used for
transportation, in the fishing industry, for non-commercial purposes and for
personal use.
SECTION 6. DEFINITION OF TERMS. As used in this ordinance, the
following term and phrases shall mean:

factor of 0.70 divided by 2.83;

LGU;

fishing operations in municipal waters weighing
three (3) gross tons and below;
7. Net tonnage the GT modified by a factor of 0.32;
8. Registered breadth - the transverse distance taken at a widest
part of the hull, excluding rub rails from the
outboard side of the skin on one side of the hull
to the outboard side of the skin on the other
side of the hull;
9. Registered Depth - the vertical distance taken at or near midships
from a line drawn horizontally through the
gunwale of the skin of the sides of the hull
(excluding the rail) to the outboard face of the
bottom skin of the hull, excluding the keel;

Registered Length the
horizontal
distance
between the outboard side of the foremost part
of the stern and the outboard side of the
aftermost part of the stern, excluding fittings
and attachments;
11.
Tonnage length the length measured at the
centerline of the fishing vessel from the point
forward where the line of the tonnage deck
intersects the line of the inboard faces at the
stern to the point where the line of the tonnage
deck intersect the inboard face of the stern.
12.
Tonnage Breadth measured at the midpart
from the gunwale inside of the skin of the hull
to inside of the on the other side of the hull.
13.
Municipal Waters include
streams,
lakes,
inland bodies of waters and tidal waters within
the municipality which are not included within
the protected areas as defined under Republic
Act No. 7586 (The NIPAS Law), public forest,
timberlands, forests reserves or fishery
reserve, but also marine waters included
between two (2) lines drawn perpendicular to
the general coastline from point where the line
of the municipality touch the sea at low tide
and a third line parallel with the general
coastline including offshore islands and 15
kilometer from such coastline. Where two (2)
municipalities are so situated on opposite
shores that there is less than 30 kilometer of
marine water, the third line shall be equally
distant.

by mechanical means.

Homeport refers to the barangay where the


owner of the fishing vessel reside and/or
registered.
Control Number (CN) - means
the
identifying
number of the fishing vessel and year
registered, the color and the number assigned
to each barangay, the name of this
municipality and the province and, the engine
number.

SECTION 7. SCOPE OF REGISTRATION FUNCTION


7.1. The registration is limited to the conferment of identity to the
fishing vessel and does not serve as an authorization or license to
fish in the Municipal Waters of Ragay, Camarines Sur which shall
be subject of a separate application with this LGU in accordance
with Municipal Ordinance No. 032, s. 1999.
SECTION 8. GENERAL REGISTRATION GUIDELINES
8.1. APPLICATION
The LGU-Ragay shall require the applicant to file an application using
the standard application form (ANNEX A) which shall contain the
following information: name of owner, nationality, residence, types
and makes of fishing vessel and propulsion and other pertinent
information that this LGU may require. The application form shall
be issued to the applicant provided, he/she has an endorsement
coming from the Barangay Fishery and Aquatic Resources
Management Council (BFARMC) or Municipal Fishery and Aquatic
Resources Management Council (MFARMC).
Only Filipino citizens, single proprietorship, partnership and/or
corporation and duly registered and accredited fisherfolks
association and cooperatives are eligible to apply for registration.
The following documents should be attached to the application form:
1. Official receipt of purchase of the engine. In case of loss of official
receipt, a certification of ownership issued by the Barangay
Chairman.
2. Barangay clearance issued by the Punong Barangay of the fishing
vessel homeport.
3. Endorsement certificate coming from BFARMC or MFARMC.
8.2. MUNICIPAL REGISTRATION NUMBER/CONTROL NUMBER OF
FISHING VESSELS
All registered fishing vessels shall be assigned a municipal registration
number by the Municipal Government which will serve as the Control Number
(CN)through the Municipal Agriculture Office who shall cause the painting on
each side of the fishing vessel according to the number assigned to the
barangay measuring 14 inches in height and 24 inches in length.
All painting shall be done at every homeport within the municipality. For
the purpose of ensuring uniformity and control, no person shall be allowed to
paint the registration number/control number; tamper and/or retouch on the

said fishing vessel, unless authorized by the Municipal Agriculture Office or his
duly authorized representative.
8.3. COLOR CODE OF FISHING VESSELS
After the application was duly approved by the Municipal Mayor, the
Municipal Agriculture Office thru its fishery technicians, shall cause the painting
on each side of the fishing vessel at the homeport with the following
identification viz:

8.4. ADMEASUREMENT.
The LGU-Ragay with the assistance from MARINA and PCG shall train and
authorize a poll of inspectors to conduct an inspection of the fishing vessel to
determine its gross tonnage using the metric formula as follows:

The inspector shall certify the correctness of the admeasurements in the
standard tonnage measurement form (ANNEX B).
8.5. CERTIFICATION FROM THE PHILIPPINE NATIONAL POLICE ON
FISHING
VESSELS
FROM
OTHER
MUNICIPALITIES
CHANGING
HOMEPORT
The applicant coming from other municipalities shall secure a clearance
from the Municipal Police Station of the LGU where the owner previously
resides or previous homeport.

No clearance for the change of homeport shall be issued by the current


homeport under the following instances:
1. The single proprietorship, corporation or fisherfolks cooperative
has no branch office in the intended homeport.
2. There is an outstanding safety requirement, which the boat has to
comply.
3. The fishing vessel is involved in a pending criminal or
Administrative case for violation of a fishery law or ordinance or
civil case regarding questions of ownership.
Filing of an application for issuance of a new homeport must be
supported by the following documents.
1. The original copy of the Control Number (CN); and
2. Clearance to change homeport issued by the Punong Barangay of
current homeport.
Upon approval of the change of homeport, all records pertaining to the
boat shall be transmitted by the previous homeport to the new homeport.
SECTION 6. RE-ISSUANCE OF CONTROL NUMBER:
The LGU shall re-issue the CN in the following instances:
a. Change in ownership of transfer of the fishing vessel without
change in homeport.
b. Change in the engine of motor fishing vessel
c. Change of name
A. In case the fishing vessel is the subject of sale or transfer of
ownership, the LGU shall re-issue the CN, containing the amended information
on ownership upon application of the new owner or transferee and subject to
compliance with following requirements:
1. Submission of a duly notarized Deed of Absolute Sale or contract
of sale executed by the Punong Barangay;
2. Posting in the Barangay or Town Hall for seven (7) consecutive
days giving notice that the fishing banca has been sold or
transferred to a new owner;
3. Certification of Publication executed by the Barangay Captain or
Municipal Mayor that said notice had been p0sted in the premises
and that there are no oppositors to the fishing boats sale and,
4. Photocopy/ies of the approved application with CN.
B. In case of change in the engine.
In case of replacement of boat engine, an application for the issuance of
new CN shall be filed with the current homeport accompanied by the following
documents:
1. Photocopy of the original copy of CN;
2. Official Receipt of Purchase of engine and/or certification of the
Punong Barangay.

The LGU shall re-issue a CN when an owner or operator desires to


change the name of his boat upon application filed with the current homeport
stating the reason for such.
An application with change of name will not be approved if the boat is
involved in civil case regarding question of ownership or in criminal or civil case
for violation of fishery law or ordinance.
Only applications with complete documentary requirements shall be
accepted. The following are the documents that should be attached to the
application.
1. Photocopy of the approved application
2. The Posting of a notice in the Barangay and Municipal Hall on the
change of the Name of the boat for a period of seven (7)
consecutive days.
3. Certification of Publication executed by the Barangay Captain and
Municipal Mayor that notice had been posted and that no
opposition or claims were filed against the boat during the sevenday period of publication.

SECTION 7. DELETION OR CANCELLATION OF REGISTRATION.


In case of loss or decay of the fishing vessel or its involvement in a
manner/maritime incident the ownership / operator shall immediately inform
the LGU. The latter shall delete or cancel the fishing vessel registration .
The LGU may also cancel or delete the registration of the fishing vessel
for other lawful causes, after duly notifying its owner / operator and compliance
with the requirements of due process.
In case of fishing vessel which had been proven in court that it was used
in the commission of a crime or violation of fishing laws and/or ordinances.
SECTION 8. RECORD-KEEPING AND SUBMISSION OF REPORTS.
The LGU shall maintain up to date records of fishing vessels three (3)
gross tonnage and below under their jurisdiction and submit when required to
the MARINA Central Office or MARINA Regional office concerned, the PCG
Station/Detachment and DA-BFAR the list of vessels registered and
deleted/cancelled within the first quarter of the succeeding year.
SECTION 9. REGISTRATION FEES

SECTION 10. PENALTY CLAUSE. Violation of any of the provision of


this Ordinance by any person either natural or juridical shall subject the said
offender to a penalty of fine to a minimum of not less than Php 1,000.00 to a
maximum of not more than Php 2,500.00 and/or imprisonment of not less than
one (1) month but not more than six (6) months subject to the discretion of the
Court. If the offender is a juridical person, the penalty of fine and/or
imprisonment shall be imposed to its President, Manager, Director,
representative or employee thereof responsible for the violations.
SECTION 11. RULES OF CONSTRUCTION
Consistent with the intent of this ordinance, question raised emanating
in this ordinance shall always be interpreted in favor of the LGU as well as, in a
suppletory manner, the promotion of responsible and sustainable fisheries and
maritime safety.
SECTION 12. REPEALING CLAUSE
Any ordinance or part thereof contrary to or inconsistent with this
ordinance are hereby repealed or modified accordingly.
SECTION 13. EFFECTIVITY
This ordinance shall take effect after review of the Sangguniang
Panlalawigan of the Province of Camarines Sur and after publication in the
newspaper of public circulation.
